Border Town Bullies: The Bad Auto Deal And Subprime Lending Problem Among Navajo Nation Car Buyers, Megan Horning
Border Town Bullies: The Bad Auto Deal And Subprime Lending Problem Among Navajo Nation Car Buyers, Megan Horning
Student Published Scholarship
This article argues that due to the circumstances of Navajo Nation residents, Navajo car buyers have a greater need for cars and are therefore disproportionately harmed by unfair border town auto deals and subprime auto loans. Additionally, this article suggests several ways to address these issues while acknowledging the conundrum created if Navajo Nation residents are prevented from buying cars.
Part I of this article describes the current U.S. auto sales and lending process, including the stages of car buying, credit score calculation, and how national auto sales, lending, and investment markets profit from unfair car sales and subprime lending. …

Water Resources Professional Project Reports
Due to a mix of inter-related human and natural factors, such as climate change, drought, beetle damage, 20th century fire suppression policy and associated hazardous fuels build-up, and the expansive growth of the Wildland-Urban Interface, many montane forests in New Mexico and elsewhere in the western United States have become increasingly susceptible to high-severity wildfires. Critical sources for public drinking water systems often originate in montane forests, where wildland fires can alter hydrologic systems and degrade watersheds, while creating significant runoff, debris, and water quality impacts downstream. As the impact of high severity wildfires expands significantly beyond the proximal burn …
Measuring The Effect Of Urban Development On Runoff Volumes In Albuquerque, Nm, Rachel Hertzman
Measuring The Effect Of Urban Development On Runoff Volumes In Albuquerque, Nm, Rachel Hertzman
Water Resources Professional Project Reports
Stormwater runoff volumes increase with urbanization, at a significant cost to the environment (Walsh, et al., 2005; Dhakal & Chevalier, 2016; Warnemuende, Shuster, Smith, & Bonta, 2003; Dougherty, et al., 2007; Jacobson, 2011; Natural Resources Conservation Service, 1986; Masoud, 2015). Urban development alters soil, pollutant loads in runoff, geomorphology, channelization, and topography—determinative factors in conducting stormwater away from habitable areas and filtering toxins from the domestic water supply (Sutton, Anderson, Elvidge, Tuttle, & Ghosh, 2009; Hale, Turnbull, Earl, Childers, & Grimm, 2015; Goldshleger, Maor, Garzuzi, & Asaf, 2015; Schueler, Fraley-McNeal, & Cappiella, 2009; Gremillion, Gonyeau, & Wanielista, 2000; Furusho, Andrieu, …

Cooperative Federalism In Biscayne National Park, Ryan B. Stoa
Cooperative Federalism In Biscayne National Park, Ryan B. Stoa
Natural Resources Journal
Biscayne National Park is the largest marine national park in the United States. It contains four distinct ecosystems, encompasses 173,000 acres (only five percent of which are land), and is located within densely populated Miami-Dade County. The bay has a rich history of natural resource utilization, but aggressive residential and industrial development schemes prompted Congress to create Biscayne National Monument in 1968, followed by the designation of Biscayne National Park in 1980. When the dust settled, Florida retained key management powers over the Park, including joint authority over fishery management. States and the federal government occasionally share responsibility for regulating …

Arizona Water Law: A Parched Public Interest, Janet M. Howe
Arizona Water Law: A Parched Public Interest, Janet M. Howe
Law of the Rio Chama
Water is an essential and increasingly scarce resource in the west. Such scarcity has revealed the importance of considering the public interest in allocating water rights. Many states, including Arizona, apply the doctrine of prior appropriation to allocate water rights. Arizona, through the Arizona Department of Water Resources, is statutorily required to review all water allocations with the public interest and welfare in mind during its initial appropriation of water rights. However, in reality, the majority of Arizona surface water has already been initially appropriated--increasing the popularity of severance and transfer agreements to change the use of water. Arizona's water …
Postcolonial Management Of The Transboundary Guaraní Aquifer System: Indigenous Input As A Guide For Environmental Sustainability, Melissa Leonard
Postcolonial Management Of The Transboundary Guaraní Aquifer System: Indigenous Input As A Guide For Environmental Sustainability, Melissa Leonard
Tribal Law Journal
This article discusses the Guaraní Aquifer System, which is a vast groundwater source that spans across Argentina, Uruguay, Paraguay, and Brazil. The Guaraní Aquifer System is located beneath the ancestral homelands of the Guaraní indigenous peoples, yet it is exclusively managed by nation states. The Guaraní indigenous peoples have been deprived of their ancestral land and have no say in the utilization or management of the Aquifer. This article discusses social and legal theory relating to water management and governance, as well as Guaraní social organization, belief systems, and customary environmental law in the context of “postcolonial” water management. This …

The Lower Colorado River and Rio Grande Basins are home to many riparian vertebrate species with different degrees of rarity. In our study, we focused on two species of birds and two species of gartersnakes that are associated with riparian areas: the Yellow-breasted Chat (Icteria virens), the Yellow Warbler (Setophaga petechia), the Northern Mexican Gartersnake (Thamnophis eques megalops) and the Narrow-headed Gartersnake (T. rufipunctatus). While the extent of distributions of these species is relatively large, they are often patchily distributed in populations that are small; in addition, both gartersnake species are listed as threatened under the Endangered Species Act. Aside …

Carbonic Springs As Distal Manifestations Of The Jemez Geothermal System, San Ysidro, New Mexico, Highlighting The Importance Of Fault Pathways And Hydrochemical Mixing., Christopher Mcgibbon
Earth and Planetary Sciences ETDs
Input of deeply sourced (endogenic) waters can contribute significant quantities of salinity to groundwater, degrading water quality, with faults acting as conduits for subsurface fluid flow. Understanding the source, movement, and chemistry of groundwater is becoming ever more significant with changing climate and weather patterns. Systematic sampling was carried out on three groups of carbonic warm and hot springs in New Mexico, USA: 1) Tierra Amarilla springs (~ 20ºC), near San Ysidro south of Nacimiento Mountains, 2) Penasco springs (~ 20 ºC) along the Nacimiento fault west of the Nacimiento basement mountain block, and 3) Soda Dam, Jemez, and Indian …
The Impact Of Temperature, Ph And Environmental Heterogeneity On Prokaryotic Diversity In Yellowstone National Park Thermal Springs, Xiaoben Jiang
The Impact Of Temperature, Ph And Environmental Heterogeneity On Prokaryotic Diversity In Yellowstone National Park Thermal Springs, Xiaoben Jiang
Biology ETDs
Yellowstone National Park (YNP) is one of the largest and most diverse hydrothermal areas on Earth. Extensive culture-independent studies in YNP thermal springs have shown dramatic taxonomic and metabolic diversity in microbial communities. We conducted a survey of bacterial communities along temperature gradients in three alkaline springs with similar geochemistries at the local scale. With these data, we investigated the influence of environmental variables on bacterial community diversity and assemblages along a broad temperature range using high throughput 454 pyrosequencing. Previous studies have suggested that pH is the driver of microbial diversity in thermal springs among geographical regions or at …

Narratives Of Violence And Tales Of Power: The Work Of Jorge González Camarena, The History Of The Castillo De Chapultepec, And The Establishment Of The National Museums In The Project Of Mexican Nationalism, Rebekah Carmen Bellum
Art & Art History ETDs
In the project of nationalism in Mexico, the governing bodies acted out a deliberate process of reclamation of the histories and mythologies of Mexico for the purpose of state programming, and for the development of an official narrative of nationality. In my thesis, I trace the effects of nationalism by first looking into a history of power in Mexico as articulated through the adaptive reuse, over centuries, of the Castillo de Chapultepec building. This building has housed the National Museum of History (Museo Nacional de Historia) since the early 1940s, and has played a prominent role in the construction and …
Email And Enron: Using Cmm To Make Better Social Worlds In Organizations, Nicholas Noblet
Email And Enron: Using Cmm To Make Better Social Worlds In Organizations, Nicholas Noblet
Communication ETDs
Email as a communication phenomenon has been in existence since the 1970s, and yet researchers are still discovering new information regarding the usage and implications of usage for this medium (Atherton, Sawmynaden, Sheikh, Majeed, & Car, 2012; Zhu and White, 2009). This dissertation seeks to better understand organizational communication through the examination of email. Enron, a very large organization that peaked in the 1990s, utilized email for a variety of different purposes. Enron's email was placed online by the federal government, and includes communication from top executives. These messages represent the largest publicly accessible database of corporate email, and will …

Festivals Of Art, Carnivals Of Representation: On Contemporary Art And Neoliberalism, Tijen Tunali
Art & Art History ETDs
In this dissertation, I look at the changing praxes of contemporary art and culture vis-á-vis neoliberalism. With examples from the Americas, the Middle East, and Eastern Europe, I acknowledge, but trespass the visible effects and outcomes of globalization with regard to art and culture. In current literature they often are interpreted as straightforward and homogeneous developments, but in this dissertation, I show the complexity, heterogeneity and inequality of new social, political, and cultural relationships wrought by and against the neoliberal ideology and processes that affect all corners of the world. My main focus is on the dialectics of contemporary art …

Funding The Costs Of Disease Outbreaks Caused By Non Vaccination, Robert L. Schwartz
Funding The Costs Of Disease Outbreaks Caused By Non Vaccination, Robert L. Schwartz
Faculty Scholarship
While vaccination rates in the United States are high – generally over 90 percent – rates of exemptions have been going up, and preventable diseases coming back. 2014 is shaping to be one of the worst years for measles since 1994, with outbreaks generally starting from unvaccinated individuals and affecting primarily the unvaccinated. While pertussis is a more complex story, communities with high rates of exemptions are more vulnerable to outbreaks. Aside from their human cost and the financial cost of treatment imposed on those who become ill, outbreaks impose financial costs on an already burdened public health system, diverting …

Functional Requirements Specification For Archival Asset Management: Identification And Integration Of Essential Properties Of Services Oriented Architecture Products, Jon Wheeler, Karl Benedict
University Libraries & Learning Sciences Faculty and Staff Publications
The complexity and size of geospatial data can constrain the capabilities of service providers and create risks to the long term preservation and archiving of valuable information assets. While services oriented architectures such as the Earth Data Analysis Center's Geographic Storage, Transformation and Retrieval Engine (GSToRE1) facilitate increased use and impact of geospatial data by mitigating these complexities through the development of dynamic applications and interfaces, such services can often be primarily focused on the maintenance and delivery of only the most current versions of geospatial data that may nonetheless possess significant historical, cultural, or scientific value. Actions and documentation …
El Metro: The History Of A Monument In Motion, William Veeder
El Metro: The History Of A Monument In Motion, William Veeder
History ETDs
This dissertation examines how the Mexico City Metro was promoted as something that was technically advanced. In this narrative Mexico City became more like the great cities of Europe by building a Metro. The Metro was also promoted as Mexican. In this narrative each stage of Mexican civilization had its great projects. The Aztec built the Templo mayor. The Spanish built the Cathedral; The Metro was the project of the modern era. This dissertation utilized a methodology that was previously used to examine monuments in Mexico. My approach was novel because I applied this system of analysis to the Metro. …
Differential Returns To Education Across Cognitive Ability Levels: Evidence From Cebu Longitudinal Health And Nutrition Survey Data, Tej Gautam
Economics ETDs
This thesis estimates the returns to education in association with childhood cognitive ability for Filipino youth using the Cebu Longituditional Health and Nutrition Survey Data. After reviewing wide range of literature on returns to education and cognitive ability, we find that limited studies have been done concerning the returns to education in conjunction with childhood cognitive ability in the context of developing country. Estimated results using OLS method show that the male returns to education at average cognitive level is 2.5% and for female it is around 8%. In terms of cognitive ability, the marginal effect of schooling decreases as …
