The growing recognition of the rights of nature is a blend of both modern conservation efforts and principles reflected in traditional Indigenous stewardship that should be an essential component of the discourse around environmental justice. This article provides an overview of the laws that invoke the rights of nature that Indigenous perspectives and practices regarding environmental preservation have influenced. This dissertation is about teeth- rather, how they are portrayed in British colonial discourses of the late eighteenth and early nineteenth century and their development as a commodified material object associated with purity, lands, and visceral emotionality. What do teeth specifically, and orality more generally, mean to eighteenth and nineteenth-century readers in relation to the logics of white possession? How did objectified subjects react to and respond to the affective tension created by this objectification? Teeth are represented in relation to feminine purity throughout British writing from at least the 1600’s. However, between 1770-1900, teeth gain additional cultural meanings, most …

Water resources management is becoming increasingly complex in the Middle Rio Grande Valley, where the negative impacts of climate change and growing demand for a fully allocated river put further strain on diminishing water supply. The precarity of future water availability emphasizes the importance of fully accounting for existing water rights allocations and understanding how ever changing social and ecological processes might hinder those rights from being fully realized. There is a need to utilize knowledge exchange avenues between academia and non-academic communities in order to advance environmental science and engineering education. Many universities and research centers attempt to enhance knowledge sharing by organizing broader impact outreach events such as lab tours, demonstrations, hands-on activities, and public presentations. Anecdotally, at two NSF-funded centers, the Transformation Network and Center for Water and the Environment, we have seen that only the same small subset of students and postdocs frequently participate while over 70% of those invited never volunteer. Using dairy farm data, this dissertation investigates the environmental and health implications of concentrated animal feeding operations (CAFOs) in New Mexico. It seeks to answer three primary research questions: (1) the relationship between environmental justice indicators and proximity to dairy farms; (2) the overall health consequences of dairy air pollutants; and (3) the viability of implementing an anaerobic digester (AD) system as a potential solution to externality concerns while maintaining dairy farm economic sustainability.
The first study demonstrates that foreign-born populations and Hispanics disproportionately experience emissions from CAFOs, with living near dairy farms or in areas with elevated ammonia levels …

From Austin To Santa Fe: Exploring The Prosecution Of Environmental Crimes Within Epa Region 6, Dr. Joshua Ozymy, Dr. Melissa Jarrell Ozymy

Criminal violations of environmental law are prosecuted by EPA and DOJ. Despite decades of such prosecutions, there has been relatively little analysis done towards understanding existing patterns in criminal prosecution of environmental crimes, especially on a regional basis. This article analyzes the 287 prosecutions which occurred in EPA Region 6 between 1983–2022, out of the 2,807 total environmental crimes prosecuted by all of EPA during that period. In the selected cases, defendants were cumulatively assessed with over $908 million in monetary penalties, 225 years of incarceration, and 1,032 years of probation. Las Cruces is the second largest city in New Mexico which has experienced exponential growth in the last three decades. The city has been cultivated by a rich history of Native populations, Spanish colonialism, and American democratic government. The culmination of these influences on Las Cruces had much influence on the Mesquite Historic District, the original townsite of Las Cruces. This area is home to many generational families and is adjacent to the downtown Main Street corridor. Downtown was built from the destruction of the Mesquite Historic District caused by waves of urban renewal projects. Through organizing, legislative action and …

In 2019, New Mexico Governor Michelle Lujan Grisham issued an executive order establishing a goal of cutting New Mexico greenhouse gas (GHG) emissions 45 percent by 2030.1 In parallel, the state legislature enacted the 2019 Energy Transition Act (ETA), which requires New Mexico utilities to decarbonize their electricity supply by 2045.2 In keeping with these actions, state agencies issued regulations to reduce GHG emissions from oil and gas and transportation sources and to implement the ETA.

Estimating Potential Exposure From Abandoned Uranium Mine Sites Through Machine Learning Classification Of Animal Behavior: A Case Study In The Navajo Nation, Christopher Girlamo

Waste from Abandoned Uranium Mines (AUMs) has negatively impacted Indigenous communities for generations. To answer these concerns, this research collaborated with Navajo Nation community members in Cove, AZ and Red Valley, AZ in order to better predict the potential AUM waste exposure their flocks face. A GIS-Multi-Criteria Decision Analysis (GIS-MCDA) model quantified potential exposure to AUM waste. Animal behavior was classified based on GPS and accelerometer data utilizing a Hidden Markov Model (HMM). The results of both the GIS-MCDA and animal behavior classification modeling was combined into a cumulative exposure potential value for each animal. This study found that livestock …

The COVID-19 pandemic, the ongoing reckoning with structural racism, and an emerging focus on justice in the clean energy transition have combined to spotlight utility disconnections and the related issues of energy access, affordability, and security. Recent empirical scholarship has demonstrated that electricity disconnections of lower-income people are relatively common, disproportionately affect people of color, and cause significant harm. This Article describes how a number of U.S. states are fashioning an emerging policy model that makes significant progress toward truly affordable and accessible electricity service for all. Abstract
The Intergovernmental Panel on Climate Change—the UN’s expert science panel—has repeatedly found that limiting climate change to prevent catastrophic harms will require at least some use of carbon capture and sequestration (CCS), and may entail substantial deployments of this technology. There is significant uncertainty, however, about the level of lifecycle greenhouse gas (GHG) reductions achievable in practice from varying CCS applications; some applications could even lead to net increases in emissions. In addition, a number of these applications create or maintain other harms, especially those related to fossil fuel extraction and use. For these reasons, many environmental justice advocates …

Tree plantings are often proposed as a solution to a variety of urban problems. The purpose of this project is to investigate the historical formation of urban tree cover in Gallup, New Mexico, and the extent to which urban tree plantings can benefit areas with inequitable urban tree distribution. To do this, I employ a mixed methods approach that includes correlation analysis, historical analysis, and analysis of urban tree canopy change from 1972-2005. The findings from this study indicate that Gallup’s history of tree plantings is heavily influenced by its history of economic development. Additionally, the findings demonstrate that if …

Technologies Of Territoriality: Indigeneity, Surveillance, And The State, Elspeth Iralu

This dissertation examines the global spatial surveillance of Indigenous peoples, nations, and territories in the twenty-first century through a multi-site relational analysis of colonial surveillance and Indigenous cartography in the United States, India, and Palestine. Analyzing Indigenous graphic novels, video games, virtual reality, performance protests, and visual art, I demonstrate how air and the aerial perspective actively shape what happens on and below the ground. I argue that Indigenous experiences of and responses to colonial and counterinsurgent surveillance are not limited by the geographic and legal bounds of nation-states but are rather linked through global histories of militarization and colonialism. …

Few people outside of EPA seem to be aware of the existence of the Superfund removal program, a program through which millions of dollars are allocated through EPA’s ten regional offices each year for cleaning up contaminated sites that are not designated 'Superfund' sites. This essay will provide a basic introduction to the Superfund removal program and particularly encourage consideration of Superfund removals to address growing concerns for environmental justice. Part II examines the legal authorities and limitations of the Superfund removal program. Part III provides examples of removal actions in environmental justice communities across the country. Since appearing in modern form fifty years ago, the Clean Water Act has proven a powerful force for environmental justice, helping to clean up urban waterways across the country. Through establishment of water quality standards and enforcement of regulatory requirements, the Clean Water Act has compelled public authorities and private companies to upgrade infrastructure and curtail

In a series of nine treaties with Native Nations in the late 1860s, the United States promised to reimburse Indigenous people for wrongs committed by “bad men among the whites, or among other people subject to the authority of the United States.” In the century and half that followed the signing of these nine treaties, “bad men among the whites” claims have been litigated in the Federal Circuit with some success by Indigenous plaintiffs, and courts have shaped the meaning of the clause and the remedies a successful plaintiff may receive. The experiences of Previously Incarcerated Indigenous Students (PIIS) need to be understood so that educators and administrators can include the experiences, perspectives, and realities of Indigenous students who have been previously incarcerated in Adult Basic Education (ABE) and collegiate programs at Tribal Community Colleges and Universities (TCUs). To date, considering and providing targeted support for this population has not been part of the focus of TCUs even when all tribal colleges work to strengthen the cultural heritage of their respective tribes (Bad Wound, 1990) and some students at TCUs are PIIS.
