The Historic Superfund Listing Of The Lukachukai Mountains Mining District, Nadine Padilla
The Historic Superfund Listing Of The Lukachukai Mountains Mining District, Nadine Padilla
Faculty Scholarship
President Biden’s 2021 Bipartisan Infrastructure Law included, among its many provisions, a historic investment of $3.5 billion to be allocated toward cleanups under the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA), also known as Superfund. This investment will help in addressing the problem of legacy pollution that impacts communities across the country. Approximately $1 billion will go towards clearing the backlog of 49 previously unfunded Superfund sites and will accelerate cleanup at over 85 current Superfund sites. Remaining funds will go towards launching cleanup efforts at 25 new Superfund sites. In a development that aligns with these broader cleanup …
Modern Agricultural Servitude: The Modern Farm Worker Experience In The Salinas Valley, Jesus E. Tavarez
Modern Agricultural Servitude: The Modern Farm Worker Experience In The Salinas Valley, Jesus E. Tavarez
Chicana and Chicano Studies ETDs
The prevailing narrative in Chicanx studies focuses on the historical labor activism of the United Farm Workers (UFW) in the 1960s and ‘70s. I am particularly interested in examining the contemporary campesino experience in the Salinas Valley by discussing the history behind Mexican cheap labor, low wages, exploitive work conditions with inadequate healthcare, agrochemical exposure, and historical consciousness of farm workers. I will argue that farm workers are in dire need of a migratory reform as an approach to improve the working conditions of farm workers throughout California. This research aims to shed light on how the multi-billion-dollar agribusiness industry …

Insertion And Use Of Multicriteria Methods For Neutrosophic Judicial Evaluation, Roberto Carlos Jiménez Martinez, María José Calderón Velásquez, Manuel Augusto Suarez Albiñol, Yusleidy Marlie Gordo Gómez
Neutrosophic Sets and Systems
This study addresses the growing need to integrate multicriteria methods into judicial evaluation, specifically through a neutrosophic approach, to improve the accuracy and reliability of legal decision-making. Today, the judicial system faces critical challenges related to the interpretation of evidence, the consideration of multiple factors, and the uncertainty inherent in complex cases. Although various approaches have been used in judicial evaluation, few effectively address the ambiguity and indeterminacy present in the opinions of judges and experts, leading to fragmented or biased analysis. This study seeks to close that gap by applying neutrosophic multicriteria methods, which allow for a more balanced …

Drinking Water And Wastewater In Socioeconomically Disadvantaged Communities In New Mexico: The Utilization Of Geographic Information Systems To Identify Communities Most In Need Of Technical Assistance, Alejandra Gaytan Tellez
Water Resources Professional Project Reports
The goal of this study is to identify the most burdened New Mexico community water systems (CWSs) and publicly owned treatment works (POTWs) with National Pollutant Discharge Elimination System (NPDES) permits to be able to provide them with technical assistance to address their issues, such as health-based and monitoring and reporting violations. Additionally, technical assistance can help them access federal or state funding to improve the infrastructure within their systems. The study evaluated multiple factors to determine the systems with the highest level of burden and reported the results as value numbers. The CWSs were evaluated on 10 factors that …

Decolonizing Digital Accessibility Within Land/Water Realities Using Minimal Computing, Mary Rice
Decolonizing Digital Accessibility Within Land/Water Realities Using Minimal Computing, Mary Rice
Researchers
The purpose of this essay is to conceptualize accessibility in digital education for school children through a minimal computing perspective. This perspective prioritizes the contextual, social, and relational as part of the ethic of minimal computing mantra to consider What. We. Need. To achieve our goals, we begin with a story from a classroom in rural New Mexico, then we problematize definitions of accessibility for computing in educational settings considering how an identification as having disabilities is situated within colonial monolingual/monocultural structures that position minds and bodies as deficient. We connect these structures to capitalistic educational technology movements like using …
Critical Geospatial Data Science: Principles For Curating, Analyzing, And Sharing Geospatial Data, Daniel Beene
Critical Geospatial Data Science: Principles For Curating, Analyzing, And Sharing Geospatial Data, Daniel Beene
Geography ETDs
Critical geospatial data science (CGDS) offers principles for engaging with geospatial data, methods, and translation by pulling from critical epistemologies in geography. CGDS interrogates objective “truths” in science by actively engaging in critique of geospatial data and methodologies. Specifically, CGDS contends with the political context and motivations behind geospatial data science (GDS) while using GDS methods to understand how social-spatial arrangements manifest and are reinforced through data. CGDS explicitly aims to inform practices for criticality from within GDS and provides opportunities for multidisciplinary research that incorporates social theories, contextualizes geospatial data, and critically evaluates the effects and ethics of (under)representation …

Reproducing And Challenging Islamophobia In News Framing Of Ilhan Omar And Rashida Tlaib, Two Prominent Muslim Women In U.S. Politics, Saiqa Shahzadi
Communication ETDs
ABSTRACT
Muslim women are frequently misrepresented in U.S. mainstream media and often portrayed adversely as a homogeneous group of women defined and silenced by religious and gender oppression. Scholarly research has documented how this historical pattern of representation ignores their intersectional, complex identities and reinforces the discourse of Islamophobia. This thesis will explore this problem in the case of the first Muslim American women elected to the U.S. House of Representatives: Ilhan Omar (D-Minnesota) and Rashida Tlaib (D-Michigan). Drawing on theories of media framing, intersectionality, and Islamophobia, the research examined 12 in-depth stories from 2019 and 2023 in three mainstream …
Affordable Housing In Healthy Communities: Integrating Environmental Justice Into The Application Criteria For Affordable Housing Tax Credits In New Mexico, Vanessa Springer
Affordable Housing In Healthy Communities: Integrating Environmental Justice Into The Application Criteria For Affordable Housing Tax Credits In New Mexico, Vanessa Springer
New Mexico Law Review
In Bernalillo County, New Mexico, communities of color and people living below the poverty line are more likely to live in areas with high exposure to pollution and associated health risks. Similar trends are echoed throughout the country. These data trends and experiences form the basis for the environmental justice movement, or the movement for a clean and safe environment for all people regardless of race or class. As the science on disparate environmental impacts develops, so does the law, and regulations to control further disparate impacts in low-income communities and communities of color are being introduced and implemented in …

Agroecology And Soil Stewardship: Values And Techniques Of Smallholder Farmers In Bernalillo County, Stephanie Olivas
Agroecology And Soil Stewardship: Values And Techniques Of Smallholder Farmers In Bernalillo County, Stephanie Olivas
Geography ETDs
Agrarian movements around the world use agroecology to build sovereignty and steward dynamic ecosystems. Research has shown that agroecological farmers steward more resilient crops, more resilient soil biomes, and greater biodiversity than conventional agriculture. GIS and remote sensing offer many tools to detect the impacts of these farmers on the environment, but it is less clear how such technologies fit into agroecological goals. This study asks: what values, experiences and knowledge do smallholder producers in Bernalillo County embody in their soil stewardship practices? Also, what experience or knowledge do smallholder producers in Bernalillo County have about remote sensing, and would …

Pathology Research and Scholarship
This paper explores the exposome concept and its role in elucidating the interplay between environmental exposures and human health. We introduce two key concepts critical for exposomics research. Firstly, we discuss the joint impact of genetics and environment on phenotypes, emphasizing the variance attributable to shared and nonshared environmental factors, underscoring the complexity of quantifying the exposome's influence on health outcomes. Secondly, we introduce the importance of advanced data-driven methods in large cohort studies for exposomic measurements. Here, we introduce the exposome-wide association study (ExWAS), an approach designed for systematic discovery of relationships between phenotypes and various exposures, identifying significant …

Bend Down Select: Analysis Of Secondhand Clothing Waste In Africa Under The Current Anti-Dumping Regime, Bisi Ogunmefun
Natural Resources Journal
The second-hand clothing market is a multi-billion-dollar industry that has helped many developing countries stimulate their economy. Over the years, however, the quality of secondhand clothing has declined as the fast-fashion market rises. Countries such as India and the Philippines have banned secondhand clothing imports to protect their textile industries from demise. African countries like Kenya, Rwanda, and Uganda also attempted to ban secondhand clothing imports but were sanctioned with a threat of removal from the African Growth Opportunity Act. This article explores how Anti-Dumping Laws fail to fulfill their ordinary meaning in the secondhand fashion market in African countries …

Symposium On New Mexico's Just Transition, Melanie Coffing, Logan Stokes
Natural Resources Journal
A Just Transition aims to develop capacity for a low-carbon, climate-resilient economy while maximizing benefits and minimizing hardships for working communities. The ideation and implementation of such a sweeping, intersectional policy framework requires thoughtful conversation, collaborative action, and years of dedication from community members and policy makers alike. On November 3, 2023, the Natural Resources Journal, through the University of New Mexico School of Law, and the New Mexico Speaker of the House, Javier Martínez, hosted the Symposium on New Mexico’s Just Transition. Students from the law school and the Natural Resources Journal had the opportunity to collaborate with community …

Environmental Justice Beyond 2°C, Clifford Villa
Environmental Justice Beyond 2°C, Clifford Villa
Faculty Scholarship
In the last four decades, average temperatures have risen significantly across the United States, with Alaska and New Mexico among the fastest warming states. Since 1970, average temperatures in New Mexico have risen 3.5 degrees Fahrenheit (°F)—or nearly 2 degrees Celsius (°C). The international scientific community has urged world leaders to contain global warming above pre-industrial levels to 1.5°C ideally, and to 2°C at worst. Current trajectories, however, suggest we may shoot past 2°C of global warming this century and enter a world of 3-4°C or beyond... The “trade offs” and “letting go” as we confront the looming 4°C world …

A New Day For Environmental Justice At The U.S. Epa, Clifford Villa
Faculty Scholarship
September 24, 2022, was a big day in the history of the EPA. On this day, EPA Administrator Michael Regan signed an order creating a new Office of Environmental Justice and External Civil Rights (“OEJECR”) within the EPA. We’re very excited about our new office of environmental justice at the EPA. However, the EPA takes environmental justice seriously across all the offices, including my own Office of Land and Emergency Management (“OLEM”).
In this lecture, we will begin with some early history of environmental justice, how we realized the existence of environmental injustice in the first place. Then we’ll talk …
