Transitional justice refers to a variety of mechanisms established to help postconflict societies account for the war and build the peace, including war crimes tribunals, truth and reconciliation commissions, and reparations programs. The framework of transitional justice, while responsive to local actors and local realities, was largely constructed by external actors, including foreign states, international organizations, non-governmental agencies, advocates, and academics working in the fields of human rights and rule of law promotion. State Constitutional Law As A Basis For Federal Constitutional Interpretation: The Lessons Of The Second Amendment, D. Bruce Black, Kara L. Kapp

This Article advocates that courts should rely more heavily on an underappreciated method of constitutional interpretation: reference to parallel state constitutional text and jurisprudence. This article is novel insofar as it develops a normative argument for why courts should consult state constitutions in interpreting the meaning of the federal constitution. To illustrate the value of this method for jurists who ascribe to various judicial philosophies, the authors apply this method to the U.S. Supreme Court’s newly developed Second Amendment jurisprudence. Patterns of community structure and richness provide context for studies from microbial ecology, global macroecology, languages, to Bayesian statistics. Diversity patterns for animals on land and their predictor variables are well studied. However, diversity patterns for bacterial communities and marine macroorganisms are not well studied or understood. Here I examine diversity patterns in caves, on the external surface of Chiroptera (bats), and in marine ecosystems. At the local to regional scale we investigate factors that drive bacterial community patterns in richness and composition in lava cave microbial mats and microbes on bats. Coevolving Histories Inside And Out: Phylogenetics, Comparative Parasitology, And Host Affinities Of Chipmunk Sucking Lice And Pinworms, Kayce C. Bell

Diversification of parasite species, in light of their host association, is an area ripe for testing hypotheses of evolution when one species requires another for survival. The 23 species of western North American chipmunks (genus Tamias) host two species of ectoparasitic sucking lice (Anoplura) and two species of endoparasitic pinworms (Nematoda). I used a phylogenetic approach to investigate the evolutionary histories of the parasites in light of the hosts and the landscape. In comparing the parasites, I found that the two pinworm species have similar diversification patterns, linked to hosts, but those processes occurred on different time scales. As another …

Energy is a common currency of ecological interactions. In this dissertation, I consider ecological energetics at different temporal, spatial and organizational scales. In my first chapter, I examine the energetics and thermoregulation of an enigmatic taxon: dinosaurs. From fossil evidence and assessment of living vertebrates I conclude that many non-avian dinosaurs were likely thermally intermediate, or 'mesothermic'. In my second chapter I detail the empirical evidence gathered to buttress my claim of dinosaur mesothermy. In my third chapter, I show how ecosystem rates of carbon flux, gross primary production and total biomass can be linked to individual body size. In …

Drought can flip ecosystems between states and in the process alter key systems such as plant biomass and carbon balance. Many drought-related studies have focused on plant responses or charismatic megafauna. Less work has addressed drought in the context of aboveground-belowground feedbacks. Impacts of drought are increasing, particularly in arid environments such as the southwestern United States. Major tree species of these regions, such as piñon pine, are adapted to a wetter and more predictable climate than the projected future climate. A pressing conservation challenge is understanding how organisms will be impacted by climate change. From the paleontological record, we know organisms have options when facing change: they can do nothing, move, or adapt. These responses shape an organism's niche (a foundational concept in biology) that is abiotically constrained, but modified by biotic interactions. The greatest disturbances in recent North American geologic history is the human mediated extinction of megafauna ~11,700 years B.P. and climate change following the last glacial period. This dissertation explores cultural narratives regarding the relationship between environmental toxins and breast cancer causation. It is not an analysis of current scientific research; grounded in Foucault’s theory of genealogy and archaeology, it evaluates cultural narratives on breast cancer causation that may be subsumed by the mainstream focus upon a cure for breast cancer, overlooking how people with breast cancer perceive illness causation, particularly as it relates to toxic exposure. Effect Of Branched-Chain Amino Acid Supplementation On Recovery Of Performance And Muscle Damage, & Autophagy And Heat Shock Protein Response, Trisha Vandusseldorp

Purpose: To investigate: 1) if branched-chain amino acid supplementation (BCAA) enhances recovery from acute, eccentric resistance exercise as measured by indirect markers of muscle damage, and 2) the impact of acute, eccentric resistance exercise on markers of autophagy and heat shock protein during recovery. Methods: Twenty resistance-trained males were randomly assigned to eight days of BCAA or PLCB and adhered to a diet consisting of 1.2 g/kg/d protein. On day five, all subjects completed 10x8 eccentric squats at 70% one repetition maximum (1RM), followed by 5x20 split jumps. Mexico’s recent energy reform portends a new era of private engagement in the oil and gas sectors. According to government officials and industry leaders, the opening of energy reserves for private development will spur economic growth and establish the country as a leader in the energy arena. Human papillomaviruses (HPVs) are the most common sexually transmitted infectious agents. They are responsible for >99% of all cervical cancers as well as subsets of other anogenital cancers. HPVs are also the causative agents of a growing number of head and neck cancers. As such, they present a significant health problem both in the U.S. and developing countries. Diabetes is an incurable metabolic disease characterized by high blood sugar levels. The feet of people with diabetes are at the risk of a variety of pathological consequences including peripheral vascular disease, deformity, ulceration, and ultimately amputation. The key to managing the diabetic foot is prevention and early detection. Unfortunately, current hospital centered reactive diabetes care and the availability of inadequate qualitative diagnostic screening procedures causes physicians to miss the diagnosis in 61% of the patients. The recent approval of a Clean Energy Certificates market in Mexico is part of the broad Energy Reform in the country since the end of 2013. Clean Energy Certificates create an incentive for new investment and a source of extra income for green energy producers in the electricity market. Mexico’s scheme is based on similar Green Trade Certificates schemes, which promote investment in renewable energy by setting quotas on electricity producers and requiring certain electricity users to buy certificates. This project aims to provide greater understanding of the agricultural practices of prehistoric cultures throughout the arid and semi-arid environments of western New Mexico by developing a remote sensing suitability model that will identify prime environments for a specific form of agricultural field, ak chin, that are often difficult to locate with standard field-based archaeological methods. This dissertation is a report on an interdisciplinary investigation consisting of an application of random walk techniques to problems in ecology, particularly to the spread of Hantavirus epidemic among rodents that live on an open terrain. The population of mice that we consider is made up of infectious disease-carrying mice and susceptible mice that are disease-free, and each mouse has its own home range around which it executes a random walk. "Sed Neque Silentio Pretereundum": An Analysis Of The Miracles Of Saint William Of Norwich, Sarah Rose Edwards Obenauf

William of Norwich was born around 1132, and, according to his biographer Thomas of Monmouth, he was killed by Jews during Easter week of 1144. Consequently, whenever William is mentioned in modern scholarship, it is almost always in relation to Jewish ritual murder and the blood libel legend. To date, no scholarship has systematically categorized or analyzed the miracles and visions contained in The Life and Passion of William of Norwich nor discussed what these stories suggest about the pilgrims who visited his tomb.
