Pervasive Infancy: Reassessing The Contract Capacity Of Adults In Modern America, Michael S. Lewis Nov 2020

Pervasive Infancy: Reassessing The Contract Capacity Of Adults In Modern America, Michael S. Lewis

The University of New Hampshire Law Review

This article argues that the law of consumer contracts should permit adults to access the same protections available to children where data about adult performance indicates that the two categories of people are similarly situated within the domain of consumer contracts. In making this claim, this article relies upon a description of capacity articulated by Professor Martha Nussbaum in her important work on the subject. Professor Nussbaum explains that capacity is a function, not only of a person’s innate capabilities, but of a person’s opportunity or ability to deploy those capabilities within environmental limitations. Capacity to contract in a free …

Two Kinds Of Polar Knowledge, Lawrence C. Hamilton Nov 2020

Two Kinds Of Polar Knowledge, Lawrence C. Hamilton

Faculty Publications

Outreach and communication with the public have substantial value in polar research, in which studies often find changes of global importance that are happening far out of sight from the majority of people living at lower latitudes. Seeking evidence on the effectiveness of outreach programs, the U.S. National Science Foundation sponsored large-scale survey assessments before and after the International Polar Year in 2007/2008. Polar-knowledge questions have subsequently been tested and refined through other nationwide and regional surveys. More than a decade of such work has established that basic but fairly specific knowledge questions, with all answer choices sounding plausible but …

Views Of The Highway: Infrastructure Reality, Perceptions, And Politics, Linda M. Fogg, Lawrence C. Hamilton, Erin S. Bell

Faculty Publications

Transportation infrastructure such as highways and bridges requires upgrades and maintenance. In many U.S. regions, these requirements have surpassed current funding, so new solutions are needed. One obvious though imperfect source is gasoline taxes, but raising these is politically risky, regardless of need. To illuminate this conflict, we analyze data from four random-sample telephone surveys (2016–2018, n = 2,035) that asked residents in the U.S. state of New Hampshire about their perceptions of highway and bridge conditions, and support for gas tax increases. About one third of the respondents counterfactually reported that highway and bridge conditions had improved compared with …

Career Development Programs And Their Benefits To The Organization, Andrew Fryburg Oct 2020

Career Development Programs And Their Benefits To The Organization, Andrew Fryburg

M.S. in Leadership

The research gathered during this project provides evidence to answer the question; How can an effective Career Development Program (CDP) influence an organization’s outcomes and impact its employees? This is important to answer because if employees are not satisfied with their organization then it becomes difficult to retain employees. This effects the employee’s morale and in turn their productivity. The literature gathered focuses on how CDPs allow employees to have a more robust career, how they improve employee morale resulting in higher productivity, and lastly, how research shows that employees are more invested in their organization when that organization shows …

Exploring Parents’ Ongoing Role In Romantic Development: Insights From Young Adults, Tyler B. Jamison, Hung Yuan Lo Sep 2020

Exploring Parents’ Ongoing Role In Romantic Development: Insights From Young Adults, Tyler B. Jamison, Hung Yuan Lo

Faculty Publications

Important decisions about romantic relationships are often made during adulthood, but the foundations for healthy relationships begin during childhood. Romantic development is related to experiences in the family of origin such as parenting, parents’ romantic history, and patterns of interaction within families. In order to better understand how this process unfolds into adulthood, we used relationship history interviews from 35 young adults (ages 24–40) to explore the mechanisms through which parents influence their children’s romantic development. We used Applied Thematic Analysis to guide our secondary analysis of relationship histories data. The findings suggest adult children internalize and apply the examples …

Securities Regulation And Social Media, Seth C. Oranburg Sep 2020

Securities Regulation And Social Media, Seth C. Oranburg

Law Faculty Scholarship

Federal securities regulation originally divided corporate finance into two neat categories, public and private. In 1933, private financing was limited to “sophisticated” investors but otherwise lightly regulated. Public financing became heavily regulated. In 1982, the SEC introduced Reg D, which introduced the concept of “general solicitation” to clarify the distinction between public and private offerings. Reg D is well understood to prohibit newspaper advertisements and permit direct solicitations to venture capital investors. This enabled great wealth consolidation in regions like Silicon Valley while effectively banning general solicitations in private offerings.

Now, social media communication challenges the definition of “general solicitation.” …

Exploring Student Motivation In Quantitative Biology, Alexander Richard Kulacki Sep 2020

Exploring Student Motivation In Quantitative Biology, Alexander Richard Kulacki

Master's Theses and Capstones

The field of biology is becoming increasingly reliant on quantitative tools, methods, and techniques, driving a need for incoming biologists to have robust quantitative skills. However, efforts to incorporate more quantitative skills at the undergraduate level are hampered by low student engagement with math in biology. Students’ motivation towards quantitative biology can provide insight into how best to increase their engagement and thus performance with these topics. This thesis examines students’ motivation towards math in biology through two key constructs: 1) students’ self-efficacy, through the theoretical lens of Social Cognitive Theory; and 2) students’ task-values, through the theoretical lens of …

Reducing Dropout Rates Of New Hampshire High School Students By Increasing The Compelled Years Of Attendance: An Analysis Of Local Administrator Perceptions Of And Responses To State Law 193:1, Andrew K. Korman Sep 2020

Reducing Dropout Rates Of New Hampshire High School Students By Increasing The Compelled Years Of Attendance: An Analysis Of Local Administrator Perceptions Of And Responses To State Law 193:1, Andrew K. Korman

Doctoral Dissertations

In 2007 New Hampshire passed a law, RSA 193:1, that changed the compulsory age of education for all public school students from age 16 to age 18. The purpose of this research is to explore the effect of RSA 193:1 on dropout rates in New Hampshire’s public high schools and to examine the perception of the high school principal in understanding the effect of the law and any differential effects of the law on students. Through an examination of five years of dropout data combined with a survey to current high school principals, findings indicate that there is strong support …
