"Reasonable [Cybersecurity] Measures" For Digital Trade Secrets: Lessons From Marketing, Raj Sachdev Jan 2025

"Reasonable [Cybersecurity] Measures" For Digital Trade Secrets: Lessons From Marketing, Raj Sachdev

Law Faculty Scholarship

The loss of digital trade secrets in marketing and beyond, often the source of competitive advantage, can have disastrous impacts on brands and companies. Bad actors want to get their digital hands on digital trade secrets, and other actors and factors may also cause a risk to their secrecy. The Defend Trade Secrets Act (DTSA) makes clear that “reasonable measures” must be taken to maintain the secrecy of a trade secret. Likewise, the Uniform Trade Secrets Act (UTSA) requires “reasonable steps.” However, in a digital age, the definition of what is “reasonable” is even more unclear than in offline settings. …

Fragmentation Of International Cybercrime Law, Mailyn Fidler Jan 2025

Fragmentation Of International Cybercrime Law, Mailyn Fidler

Law Faculty Scholarship

Cybercrime is global. But legal approaches to combating cybercrime have been fragmented. The first such multilateral legal mechanism, the Budapest Convention on Cybercrime, was launched in 2001 and positioned by its primarily Western drafters as a global instrument. But it has struggled to achieve full international uptake. Instead, many states have used regional organizations to create their own legal mechanisms addressing cybercrime and cybersecurity threats. More recently, the UN Convention on Cybercrime has emerged as an alternative to this fragmented landscape. But the emergence and significance of this “convergent” option cannot be understood without the context of the deep fragmentation …

Digital Platform Safety And The Problem Of Variable Costs, Margaret E. O'Grady, Fiona Scott Morton Jan 2025

Digital Platform Safety And The Problem Of Variable Costs, Margaret E. O'Grady, Fiona Scott Morton

Law Faculty Scholarship

Because the United States has no digital regulator to set minimum quality or safety standards for digital products, dominant platforms have both the ability and permission to harm consumers, a trend which will accelerate. Digital platforms with market power have no incentive to shoulder the expense of providing safe, high-quality services, because the marginal costs of providing increased quality and safety—often human beings engaged in content moderation or fact-checking—are so high. If providing better quality would increase profits, digital platforms would have done so already. Instead, digital platforms act like automobile manufacturers before regulators required seatbelts: they will insist that …

The Financialization Of The American Dream: Private Equity’S Rise In The Single-Family Rental Market, Colby Sherwin Jan 2025

The Financialization Of The American Dream: Private Equity’S Rise In The Single-Family Rental Market, Colby Sherwin

Honors Theses and Capstones

This thesis examines how private equity firms and other institutional investors are reshaping the single-family rental market in the United States, and what that shift means for homeownership, affordability, and community stability. What began as a short-term strategy to acquire foreclosed homes after the 2008 financial crisis has evolved into a long-term business model, with firms now owning hundreds of thousands of properties across the country. Leveraging their financial scale, these investors often outbid individual buyers, particularly in fast-growing cities. While proponents argue that institutional ownership brings professionalism and much-needed supply to tight housing markets, data shows that it has …

From Civil War To Cold War: China, The Us, And The Korean Conflict, Ethan Paul Foss Jan 2025

From Civil War To Cold War: China, The Us, And The Korean Conflict, Ethan Paul Foss

Honors Theses and Capstones

This history honors thesis investigates US foreign policy in East Asia during the early Cold War, specifically from 1945 to 1953, focusing on the Chinese Civil War and the Korean War. This thesis argues that American policymakers misjudged Chinese communism, Korean nationalism, and regional dynamics due to ideological assumptions and Cold War anxieties. The research examines missed diplomatic opportunities with Mao’s China, the flawed occupation of South Korea, and the escalation of the Korean Conflict, revealing how rigid anti-communist policies contributed to the Korean War's outbreak and strengthened communist alliances. Ultimately, it argues that the Korean War was less an …

Targeting Stat3 In Tnbc Drug Resistance, Madison A. Henry Jan 2025

Targeting Stat3 In Tnbc Drug Resistance, Madison A. Henry

Honors Theses and Capstones

Triple negative breast cancer (TNBC) is one of the most aggressive types of breast cancer and lacks the three commonly targeted receptors in breast cancer treatments. As a result of a lack of targetable receptors, the standard of care remains to be harsh chemotherapy treatments that often are successful in early TNBC cases but often result in relapsed TNBC. In addition to high rates of recurrence, TNBC is known for its aggressive metastasis and chemoresistance. Within TNBC, the transcription factor Signal Transducer and Activator of Transcription 3 (STAT3) is constitutively active and increases proliferation, and metastasis, and plays a role …

Hit Me, Baby, One More Time: A Critical Discourse Analysis Of The Celebrity Gossip Magazine Shaming Of Britney Spears, Anna Rae Drabik Jan 2025

Hit Me, Baby, One More Time: A Critical Discourse Analysis Of The Celebrity Gossip Magazine Shaming Of Britney Spears, Anna Rae Drabik

Honors Theses and Capstones

Britney Spears is an American pop star who rose to fame in the late 1990s at the age of 17 with her music, performances, and fashion. Spears was a prominent figure in celebrity gossip magazines, a genre which grew to prominence alongside and, in many ways, because of Spears. The distinct aesthetic and style of celebrity gossip magazines involved stories, blurbs, and images which wielded praise and shame—directly and indirectly—as tools to enforce norms and expectations for both female celebrities and female readers. Through a critical discourse analysis of 378 People and Us articles throughout the first ten years of …

Deportations And Debt: How The Trump Administration’S Immigration Policies Affect The United States’ National Debt Situation, James D. Webster Jan 2025

Deportations And Debt: How The Trump Administration’S Immigration Policies Affect The United States’ National Debt Situation, James D. Webster

Honors Theses and Capstones

The value of the United States’ national debt measured as a share of its economic output, otherwise known as its debt-to-GDP ratio, is projected to reach an all-time high and continue to climb over the span of the next 30 years. This can be attributed to a combination of tax and spending policies which generate annual budget deficits as well as a projected slowdown of economic growth. A major factor contributing to this situation is the slowing growth of the labor force in the United States. As time goes on, the growth of the U.S. population slows, and immigration becomes …

Right Not To Work: Unions And Title Vii, Seth C. Oranburg Jan 2025

Right Not To Work: Unions And Title Vii, Seth C. Oranburg

Law Faculty Scholarship

This article explores how Title VII's mandate for religious accommodation conflicts with union seniority rights, as revealed in Groff v. DeJoy. It argues that labor unions often oppose Sabbath accommodations not out of hostility to religion, but to protect bargained-for entitlements. The piece highlights a growing legal tension: whether co-worker burdens count as “undue hardship” under Title VII—a question with major implications for religious liberty in unionized workplaces.

A New State Constitutional Right To Informational Privacy: The Origins Speak, Albert E. Scherr, Neal Kurk Jan 2025

A New State Constitutional Right To Informational Privacy: The Origins Speak, Albert E. Scherr, Neal Kurk

Law Faculty Scholarship

[Excerpt] This article occupies the space between the ongoing, newly energized development of state constitutional law and the fraught public policy field of privacy protections. It analyzes a new state constitutional provision that is explicitly and exclusively about information privacy. The provision, Part I, Article 2b9 of the New Hampshire Constitution,10 reads as follows: An individual’s right to live free from governmental intrusion in private or personal information is natural, essential, and inherent.11 The provision extends an individual’s privacy right significantly beyond that of both the federal and New Hampshire state constitutions. It operates at the intersection of privacy and …

Developing An Evidence-Based Culture Through Journal Club: A Pilot Study, Allison Davidson Jan 2025

Developing An Evidence-Based Culture Through Journal Club: A Pilot Study, Allison Davidson

DNP Scholarly Projects

Evidence-based practice is essential for improving patient outcomes and reducing healthcare costs, yet its implementation in nursing remains limited due to persistent barriers such as lack of knowledge, leadership support, time, and resources. Despite these challenges, nurses generally hold positive attitudes toward EBP, indicating a strong foundation for future initiatives aimed at enhancing education, training, and organizational commitment. To fully integrate evidence-based practice into nursing care, healthcare systems must address these barriers and invest in sustained support, ensuring that clinical decisions are consistently guided by the best available evidence. A pilot nursing journal club, led by an evidence-based practice mentor …
