3d Printing And U.S. Copyright Law, Ryan G. Vacca, Peter S. Menell

Law Faculty Scholarship

This article explores how 3D printing fits within US copyright law. US copyright law provides a well-developed general framework for the protection of creative designs, whether fixed in CAD files or 3D objects. Enforcement of copyright protection in this industry faces some of the same challenges encountered by other content industries whose works were disrupted by the digital revolution. Nonetheless, 3D printing brings distinctive issues. Although grounded in statute, US copyright law has a rich common law tradition that affords courts significant leeway in adapting doctrines to new and unforeseen technological developments. This capacity is reinforced by the range of …

Permissive Certificates: Collectors Of Art As Collectors Of Permissions, Peter J. Karol Jan 2019

Permissive Certificates: Collectors Of Art As Collectors Of Permissions, Peter J. Karol

Law Faculty Scholarship

Artists have been dramatically reshaping the fine art certificate of authenticity since the 1960s. Where traditional certificates merely certified extant objects as authentic works of a named artist, newer instruments purported both to authorize the creation of unbuilt artworks and instruct buyers how to manifest and install them. Such “Permissive Certificates” have fascinated contemporary art historians ever since. Prior scholarship has shown how such documents, essentially blueprints for art creation, force us to confront fundamental ontological questions on the nature of art, the relationship between artist, collector and viewer, and the influence of money and acquisitiveness on art generation. But …

Market-Base Solutions To Manage The Guarani Aquifer: Pigouvian Fee And Cap-And-Trade, Julia Hayes Vieira Jan 2019

Market-Base Solutions To Manage The Guarani Aquifer: Pigouvian Fee And Cap-And-Trade, Julia Hayes Vieira

Master's Theses and Capstones

The objective of this case-study is to analyze the effects and the perception of different groups in possibly implementing market-based approaches of Pigouvian tax and Cap-and-Trade to manage the Guarani Aquifer, Brazil. The Pigouvian Tax is a corrective taxation that assigns a price for the negative impacts water consumption creates to aquifers, as a way to influence a more sustainable level of water consumption. Cap-and-Trade sets a maximum quantity of water allowed to be used from aquifers, and allow economic agents to trade quantities of water they have the right to use, as a way to adapt to the cap. …

Microchannel Plates In Mass Spectrometer Instruments For Spacecraft, Nicholas Kenneth Lubinsky Jan 2019

Microchannel Plates In Mass Spectrometer Instruments For Spacecraft, Nicholas Kenneth Lubinsky

Doctoral Dissertations

Earth's magnetosphere contains plasma originating both from the solar wind and from

the ionosphere. While H+ is the dominant ion from both sources, the solar wind contains

high charge state ions such as He++, and O6+, while the ionosphere contributes singly ionized

heavy ions including He+, N+ and O+. Measuring the composition gives information on

the source and mass dependent entry, heating and acceleration mechanisms. However, most

ion composition instruments are not able to clearly distinguish between some of the heavy

ions involved in these processes, particularly N+ and O+. This thesis aims to test a new

design of a …

Evaluation Of New England Salt Marsh Support Of The American Eel, Anguilla Rostrata, And The Impacts Of Hydrologic Restriction, Alyson L. Eberhardt Jan 2019

Evaluation Of New England Salt Marsh Support Of The American Eel, Anguilla Rostrata, And The Impacts Of Hydrologic Restriction, Alyson L. Eberhardt

Doctoral Dissertations

American eels are frequently captured in saltmarsh habitats yet little is known about eel use of these systems. Coastal systems such as salt marshes are vulnerable to habitat impacts due to high rates of coastal development, including impacts from undersized culverts that result in tidally restricted systems upstream. Given the decline in the American eel population, a need exists for a clearer understanding of the functional difference of hydrologically restricted and unrestricted salt marshes in the support of eels. To address data gaps and inform saltmarsh management to support eels, laboratory and field experiments were employed that assessed the value …

Coastal Conflicts And Cross-Sectoral Engagement: Learning From Disputes Over Science In Coastal And Ocean Systems, Lindsey C. Williams Jan 2019

Coastal Conflicts And Cross-Sectoral Engagement: Learning From Disputes Over Science In Coastal And Ocean Systems, Lindsey C. Williams

Doctoral Dissertations

It is widely accepted that public policy decisions that account for scientific and technical advice are likely to improve outcomes for all. With more data and information available though, it is becoming increasingly difficult to even agree on the baseline facts. This research explores the question: How do cross-sectoral engagement opportunities influence science intensive disputes over the management of coastal and ocean resources? To address this question, I studied two cases in New England: 1) marine fisheries management (Northeast Multispecies Complex aka groundfish) and 2) estuarine water quality management (Great Bay, New Hampshire). Informed by participant observation and semi-structured interviews …

The Purpose And Value Of Agricultural Experiment Stations Today: A Perception Study Of The Directors Of State Agricultural Experiment Stations, Lori Wright Jan 2019

The Purpose And Value Of Agricultural Experiment Stations Today: A Perception Study Of The Directors Of State Agricultural Experiment Stations, Lori Wright

Doctoral Dissertations

This study investigates the dynamic relationship of the purpose and value of state agricultural experiment stations today as perceived by a sample of the directors of state agricultural experiment station in the United States funded by the Hatch Act of 1887. State agricultural experiment stations are a fundamental component of the land-grant university system; they are the original model and the first centers for applied research at most flagship state land-grant research universities in the United States (Kerr, 1987; Knoblauch, 1962). The purpose of state agricultural experiment stations has evolved since their inception as new agricultural issues have arisen, new …

Seasonal Methane And Carbon Dioxide Emissions Along A Temperate Fluvial Wetland Dominated River Continuum, Paige Elizabeth Clarizia Jan 2019

Seasonal Methane And Carbon Dioxide Emissions Along A Temperate Fluvial Wetland Dominated River Continuum, Paige Elizabeth Clarizia

Master's Theses and Capstones

Freshwater ecosystems, such as streams and fluvial wetlands, are a subset of global aquatic ecosystems and produce and emit significant amounts of the greenhouse gases (GHG) methane (CH4) and carbon dioxide (CO2) to the atmosphere. In temperate regions, freshwater ecosystems often contain fluvial wetlands, which form the boundary between stream and wetland ecosystems. In fluvial wetlands, oxygen- and nutrient- poor soils are continuously fed by upstream river networks, which have the potential to create ecosystems with enhanced GHG production and emissions. The magnitude and seasonal variability of natural GHG emissions from freshwater fluvial wetlands, though highly understudied, have been suggested …

Characterization Of Hsp90 Subpopulation Conformations Targeted By Inhibitors And The Effect Of Phosphorylation On Hsp90’S Association With Co-Chaperone And Client Proteins, Daniel T. Thornton Jan 2019

Characterization Of Hsp90 Subpopulation Conformations Targeted By Inhibitors And The Effect Of Phosphorylation On Hsp90’S Association With Co-Chaperone And Client Proteins, Daniel T. Thornton

Master's Theses and Capstones

Heat shock protein 90 (Hsp90) is a highly conserved and dynamic molecular chaperone protein important for regulating protein activity and interactions in cellular signaling and adaptive stress responses. As a key regulatory protein, Hsp90 is often manipulated by cancer cells to enhance tumorigenic cell growth and even exists in some tumors as a multimeric complex called the “epichaperome.” With its linked role in cancer proliferation, Hsp90 serves as a promising cancer therapeutic target, with many Hsp90 inhibitors developed including geldanamycin and PU-H71. With limited information existing regarding epichaperome formation and structure, this study seeks to investigate potential regulatory mechanisms for …

Evaluating The Role Of A Cav2.2 Splice Variant In Behavioral Responses To Stress, Novelty, And Other Monoamine-Linked Functions, Ashton Brennecke Jan 2019

Evaluating The Role Of A Cav2.2 Splice Variant In Behavioral Responses To Stress, Novelty, And Other Monoamine-Linked Functions, Ashton Brennecke

Master's Theses and Capstones

CaV2.2 (N-type) channel is a presynaptic channel that enables calcium influx into axon terminals, thereby playing a vital role in coupling action potentials to neurotransmitter release in the central and peripheral nervous systems. In vitro studies of CaV2.2 show that the channel directly modulates levels of the monoamines including dopamine, serotonin, and norepinephrine. Further, CaV2.2-null mice exhibit heightened aggression and hyperlocomotion linked to aberrant dopamine and serotonin function. All these studies suggest that CaV2.2 plays a pivotal role in monoaminergic function. CaV2.2 contains an alternatively spliced exon, e18a, which is either included (+18a-CaV2.2) or removed (Δ18a-Ca¬V2.2) from the channel and …

The Effect Of Meloxicam On The Ability Of Neonatal Dairy Calves To Absorb Igg Provided By Colostrum Replacer, Meaghan O.C. Clark Jan 2019

The Effect Of Meloxicam On The Ability Of Neonatal Dairy Calves To Absorb Igg Provided By Colostrum Replacer, Meaghan O.C. Clark

Master's Theses and Capstones

The objective of this study was to determine the effect of meloxicam, administered either in pill form immediately prior to colostrum replacer (CR), or powder form, mixed in solution with CR, on the immunoglobulin G (IgG) uptake, growth, and health of pre-weaned calves. A pilot study considering the potential benefits of meloxicam in pre-weaned heifers indicated administration of the drug following difficult parturition improved body weight (BW) and overall health, but was not associated with passive transfer of immunity (Murray et al., 2015). However, calves from this study were sampled from 10 commercial farms, and therefore, treatment administration was inconsistent, …

Quality Improvement On The Long-Term Care Ventilator Unit: Interventions To Increase Patient Safety And Prevent Patient Harm, Billie Anderson, Joanne Samuels

DNP Scholarly Projects

BACKGROUND: Tracheostomy patients are susceptible to life-threatening emergencies when their airways are compromised. Epidemiologic data suggests that 3.2% to 30% of tracheostomy patents have a complication. The long-term care ventilator unit (LTCVU) is a 25-bed unit in a nursing home. It has noted that 40% of patients have a complication. A group of hospitals demonstrated a 90% reduction in complications through five interventions.

METHODS: The Johns Hopkins Nursing Evidence-Based Practice model was utilized to take the Global Tracheostomy Collaborative interventions and apply them to the LTCVU with the aim of reducing the number of airway complications on the unit by …

Engaging Persons With Mental Illness And/Or Substance Use Disorder In Care Coordination Services: An Improvement Project At A Federally Qualified Community Health Center, Elizabeth A. Hale Jan 2019

Engaging Persons With Mental Illness And/Or Substance Use Disorder In Care Coordination Services: An Improvement Project At A Federally Qualified Community Health Center, Elizabeth A. Hale

DNP Scholarly Projects

Background: Mental health and substance use disorders seldom occur in isolation. They frequently accompany each other, as well as a substantial number of chronic general medical illnesses. Consequently, mental health conditions, substance-use disorders, and general health conditions are frequently co-occurring, and coordination of all of these types of health care is essential to improved health outcomes (Institute of Medicine, 2006). The U.S. system of healthcare is failing to identify, engage, and effectively treat people who are suffering from behavioral health conditions (Blanco, Coye, Knickman, Krishnan, Krystal, Pincus, Rauch, Simon, Vitiello, 2016). Because of poor coordination and lack of engagement, …

Health Risks Of Firearm Ownership: A Patient Screening And Education Intervention, Aaron Kahn Jan 2019

Health Risks Of Firearm Ownership: A Patient Screening And Education Intervention, Aaron Kahn

DNP Scholarly Projects

BACKGROUND

There is significant health risk associated with firearm ownership. To address this risk a primary care-based intervention was designed and implemented to screen for firearm ownership, educate patients on the risks of gun ownership, and provide patients with resources for reducing associated health risks.

METHODS

A mixed methods study design was employed. Four primary care providers (PCP) practicing in family health volunteered to participate in this intervention. Focus groups with participating PCPs were conducted prior to the intervention to solicit recommendations for intervention protocol and assess participating PCPs current understanding of the health risks of firearm ownership, and after …
