Das Margens Do Império: Raça, Género E Sexualidade Em Recordações D’Uma Colonial (Memórias Da Preta Fernanda), Fernando Beleza

Languages, Literatures & Cultures

Dietary Supplement Labeling: Cognitive Biases, Market Manipulation & Consumer Choice, Michael Mccann Jan 2014

Dietary Supplement Labeling: Cognitive Biases, Market Manipulation & Consumer Choice, Michael Mccann

Law Faculty Scholarship

There exists increasing concern that the Dietary Supplements Health and Education Act (DSHEA) has proven ineffective. Much of the concern regards the disparity in legislative treatment between dietary supplements, foods, and pharmaceutical drugs. Namely, while pharmaceutical drugs must undergo years of costly pre-market testing, most supplements, like foods, can immediately enter the market, and only after repeated instances of adverse reactions can the Food and Drug Administration (FDA) remove them. Such a framework appears to belie both consumer expectations and marketing strategies, as supplements tend to be most perceived for their apparent medicinal qualities. This philosophy of waiting for a …

Contraceptive Sabotage, Leah A. Plunkett Jan 2014

Contraceptive Sabotage, Leah A. Plunkett

Law Faculty Scholarship

This Article responds to the alarm recently sounded by the American College of Obstetricians and Gynecologists over “birth control sabotage”—the “active interference [by one partner] with [the other] partner’s contraceptive methods in an attempt to promote pregnancy.” Currently, sabotage is not a crime, and existing categories of criminal offenses fail to capture the essence of the injury it does to victims. This Article argues that sabotage should be a separate crime—but only when perpetrated against those partners who can and do get pregnant as a result of having sabotaged sex. Using the principle of self-possession—understood as a person’s basic right …

Convict Voices: Women, Class, And Writing About Prison In Nineteenth-Century England, Anne Schwan Jan 2014

Convict Voices: Women, Class, And Writing About Prison In Nineteenth-Century England, Anne Schwan

University of New Hampshire Press: Open Access Books

In this lively study of the development and transformation of voices of female offenders in nineteenth-century England, Anne Schwan analyzes a range of colorful sources, including crime broadsides, reform literature, prisoners' own writings about imprisonment and courtroom politics, and conventional literary texts, such as Adam Bede and The Moonstone. Not only does Schwan demonstrate strategies for interpreting ambivalent and often contradictory texts, she also provides a carefully historicized approach to the work of feminist recovery. Crossing class lines, genre boundaries, and gender roles in the effort to trace prisoners, authors, and female communities (imagined or real), Schwan brings new insight …

Do You Believe He Can Fly? Royce White And Reasonable Accommodations Under The Americans With Disabilities Act For Nba Players With Anxiety Disorder And Fear Of Flying, Michael Mccann Jan 2014

Do You Believe He Can Fly? Royce White And Reasonable Accommodations Under The Americans With Disabilities Act For Nba Players With Anxiety Disorder And Fear Of Flying, Michael Mccann

Law Faculty Scholarship

This Article examines the legal ramifications of Royce White, a basketball player with general anxiety disorder and obsessive compulsive disorder, playing in the NBA. White's conditions cause him to have a fear of flying, thus making it difficult to play in the NBA. This subject is without precedent in sports law and, because of the unique aspects of an NBA playing career, lacks clear analogy to other employment circumstances. This dispute also illuminates broader legal and policy issues in the relationship between employment and mental illness.

This Article argues that White would likely fail in a lawsuit against an NBA …

Juror Internet Misconduct: A Survey Of New Hampshire Superior Court Judges, Brooke Lovett Shilo Jan 2014

Juror Internet Misconduct: A Survey Of New Hampshire Superior Court Judges, Brooke Lovett Shilo

The University of New Hampshire Law Review

[Excerpt] “The Constitution guarantees criminal defendants the right to a fair trial before an impartial jury and the right to confront the evidence against them. When a juror improperly accesses the Internet during a criminal trial, the defendant is denied these constitutional rights. The problem of outside information entering the courtroom is as old as our judicial system. As early as 1907, Justice Holmes observed that, “The theory of our [criminal justice] system is that the conclusions to be reached in a case will be induced only by evidence and argument in open court, and not by any outside influence, …

Competencies For The 21st Century: Teaching An Understanding Of Others, Critical Thinking, Leadership And A Sense Of Obligation. Perceptions Of Educational Leaders., Michael F. Schwartz Jan 2014

Competencies For The 21st Century: Teaching An Understanding Of Others, Critical Thinking, Leadership And A Sense Of Obligation. Perceptions Of Educational Leaders., Michael F. Schwartz

Doctoral Dissertations

In the 18th century, utilitarian writers highlighted the importance of a sense of obligation, an understanding of others, and the ability to think critically (Daniels, Bizar, & Zemelman, 2001; Kant, 1785/2008). Additionally, scholars stressed the importance of leadership (Burns, 1978). Teacher instruction in the 19th century incorporated many of these values (Kliebard, 2004). However as the common school developed in the early 19th century there was a shift from these values toward a common curriculum meeting industrial needs (Tyack, 1974). As the 20th century ended, significant federal and state legislation further funneled school curriculum to focus on very specific instruction …

The Complexities Of Family Health: Effects On Women's Employment, Jess Carson Jan 2014

The Complexities Of Family Health: Effects On Women's Employment, Jess Carson

Doctoral Dissertations

An extensive sociological literature links women's health, their children's health, and their disproportionate designation as unpaid caregivers to variation in women's labor supply and earnings. However, there is a dearth of research that simultaneously considers the health of multiple family members to explore how the distribution of chronic conditions within and across families may relate to women's work. Using data from the 2007 Panel Study of Income Dynamics (and its supplemental surveys, the Child Development Supplement and the Transition into Adulthood Study), this dissertation conceptualizes health as a family-level construct and explores how the distribution of chronic conditions in families …

Asymmetry In The Magnocellular And Parvocellular Pathways, Jenny Louise Lang Jan 2014

Asymmetry In The Magnocellular And Parvocellular Pathways, Jenny Louise Lang

Doctoral Dissertations

Why humans are less sensitive to increment than decrement contrast remains unknown. One hypothesis is that the psychophysical asymmetry in increment and decrement thresholds results from an asymmetry in respective ON and OFF cell contrast gains. Contrast gain also differs, however, by the visual pathway within which the ON and OFF cells travel. Cells show greater contrast gain in the magnocellular (M) than parvocellular (P) pathway. Therefore, the asymmetry in increment and decrement thresholds may also differ by visual pathway. My first three experiments established that observers were more sensitive to decrement than increment contrast in both pathways, in monocular …

A Whole Grain Education Program For Older Adults: Its Effectiveness On Older Adults' Knowledge And Intake Of Whole Grains And Its Implications For Use With Younger Adults, Kristin Emily Davis Jan 2014

A Whole Grain Education Program For Older Adults: Its Effectiveness On Older Adults' Knowledge And Intake Of Whole Grains And Its Implications For Use With Younger Adults, Kristin Emily Davis

Master's Theses and Capstones

The average adult in America eats less than one serving of the recommended three serving minimum of whole grains each day. Consumption of whole grains in older adults is particularly low; consumption in college students is even lower. This pilot study investigated the effectiveness of a three-session nutrition education program, entitled "Is It Whole Grain?" to improve older adults knowledge, identification and consumption of whole grains. Based on the analysis of pre- and post- intervention whole grain questionnaire responses from 157 older adults, aged 60 or older, residing in New Hampshire and Iowa, significant improvements in older adults' knowledge and …

Alienation In Capitalism: Rediscovering Fulfillment, Gregory Lee Carter Jan 2014

Alienation In Capitalism: Rediscovering Fulfillment, Gregory Lee Carter

Honors Theses and Capstones

Many Americans are pessimistic about their country's medium or long-term economic outlook. A century ago, Big Business was born as an economic force, but it has powerfully infiltrated the realm of politics now. The corporate scramble for natural resources has caused global disharmony and domestic economic conflict in the U.S. The capitalist system, which many have come to realize is unsustainable and oppressive, has thus come to fulfill some of the predictions made by earlier critics from Kierkegaard, Rousseau, to Marx. Each believed that a society which is forced to accommodate an oppressive system will inherently display alienation. That …

Student Attitudes Towards Drinking Behaviors, Laura Gaines Jan 2014

Student Attitudes Towards Drinking Behaviors, Laura Gaines

Honors Theses and Capstones

The literature is relatively inconclusive regarding predictors of alcohol use; while some studies have demonstrated an association between high levels of social interaction and increased alcohol use, others have shown that a lack of social support is linked to drinking heavily. The current study was conducted with students at the University of New Hampshire; participants’ attitudes towards alcohol were assessed along with many psychosocial factors. Low levels of conscientiousness, parent and high school influence, frequently attending parties, and friend influence were most highly predictive of positive attitudes towards alcohol; multiple regression of these factors accounted for 30.1% of the variance. …

The Examination Of Organizational Respect In Relation To Organizational Culture, Amanda N. Walker Jan 2014

The Examination Of Organizational Respect In Relation To Organizational Culture, Amanda N. Walker

Honors Theses and Capstones

This paper is an in-depth examination of the connection between organizational respect and the strong roots of organizational culture. Throughout this thesis, we will examine the importance of management recognizing and implementing respect, how respect affects behaviors and characteristics of employees, and ways in which employees tend to feel the most respected. Additionally, we will closely examine the importance of establishing feelings of support, caring, and collaboration within an organization in efforts to create an environment filled with respect. Another concept that will be examined is the idea of person-culture fit, and how the alignment of values between employees and …

Sexual Violence And Relationship Abuse Among College Students: The Bystander Intervention Process, Elizabeth J. Wible Jan 2014

Sexual Violence And Relationship Abuse Among College Students: The Bystander Intervention Process, Elizabeth J. Wible

Honors Theses and Capstones

This project investigated how college students describe bystander intervention in the context of sexual violence and relationship abuse compared to intervention in a general helping situation. The participants were 53 undergraduate students at a New England University. Prior to graduation, all of the participants were asked questions via audio controlled, face-to-face qualitative interviews that related to their helping behaviors during their time in college. The participant responses revealed that general helping is often a simple, one-time event if time permits it. However, helping in the context of sexual violence or relationship abuse revealed many serious barriers for the bystander due …

Honors Theses and Capstones

This paper reports a research study focused on perspective of nurse body size and how it affects confidence in a nurses’ ability to provide education on diet and exercise. The study followed a descriptive method design guided by a cross-sectional survey with quantitative variables. Results show that there is increased confidence in a nurse’s ability to provide education and influence habits regarding diet and exercise when the nurse role models such behaviors. Other findings presented include respondents’ perception of their body mass index versus their actual body mass index, percentage of respondents with health care conditions related to obesity, and …
