With the Internal Revenue Code of 1954 not yet three months old, reams have already been written about it, more reams are being written and more will be written. It would be interesting to speculate with the statisticians, the “believe-it-or-not” and the “strange-as-it-seems” boys as to how many times around the globe all the lines written and to be written on that Code would stretch, if laid end to end.

At common law every criminal homicide was considered either murder or manslaughter. There were no degrees of murder. Murder was the unlawful killing of another with "malice aforethought" and this malice could either be express or implied. Manslaughter, on the other hand, was the unlawful killing of another without malice.

In Nebraska there are two statutory degrees of murder. The first degree murder statute provides that every person who "purposely and of deliberate and premeditated malice or in the perpetration of or attempt to perpetrate any rape, arson robbery or burglary ... kill[s] another... shall be deemed guilty of murder …

To convict a person of a felony, the criminal law requires that the corpus delicti be established beyond a reasonable doubt. The corpus delicti is made up of three elements: (1) there must be an injury or loss; (2) the injury or loss must result from the doing of a criminal act; and (3) the accused must be identified as the doer of the criminal act. Unless the accused confesses or admits the crime, all three of these elements must be proved by competent evidence which will exclude all reasonable doubt of his guilt. A recent amendment to the Nebraska statutes provides that whosoever should debauch the person or deprave the morals of a minor; fondle a child under 16 in a lewd manner; or expose his person to a child under 16 should be guilty of a felony upon the first conviction, and should be liable to fine, or imprisonment, or both. It is further provided that if the person commits a second offense of the same nature, psychiatric examination of the offender before sentencing is required. Defendant, charged with robbery, claimed that he did not remember committing the offense and pleaded not guilty by reason of insanity. A psychiatrist who examined the defendant prior to trial was asked by the defense to state from his examination whether he considered the defendant insane and also to state the basis for his conclusion. The trial court refused to admit the psychiatrist's testimony, sustaining the objection that it was based on self-serving statements made by the accused to the psychiatrist and consequently hearsay. American law has long afforded the state and its subdivisions of government an immunity from liability for tort. The Federal Government, the state, municipal corporations, and quasi-municipal corporations of various types, are exempted from tort accountability for their wrongful acts.

In the past, the subdivisions which are the recipients of this immunity have not been reluctant to accept it. Taylor, in her book Public Accountability of Foundations and Charitable Trusts sketches the regulatory machinery in some twelve states and England and Canada, with a glance at the federal machinery in the form of the Internal Revenue Code and the Service which administers it. In the preparation of her study, a questionnaire was sent to the attorneys general of 48 states and two territories inquiring into the legal machinery in their states for the performance of the attorney general's ancient duty of representing the public interest in connection with charitable trusts. In an action against the manufacturer for damages caused by a defect in an automobile, the jury returned a verdict for the plaintiff in the amount of $50,000, whereupon the trial judge stated, “Members of the jury, I am astounded. It is my opinion that that is clearly against the weight of the evidence in this case.” A motion for a new trial was made by the defendant, but the trial judge died before it could be heard by him. Petitioner was indicted in Ohio for the crime of non-support of a minor child. The Governor of Ohio issued an extradition warrant to the Governor of California, and petitioner sought his release through a habeas corpus action stating that prior to his arrest he had petitioned for and secured from the Superior Court of San Diego County an order requiring him contribute to the support of his wife and minor child in Ohio.
