Wage Earner Plans In Nebraska, Donald H. Bowman
Wage Earner Plans In Nebraska, Donald H. Bowman
Nebraska Law Review
Chapter XIII of the Bankruptcy Act presents a workable plan whereby all who participate in it will benefit thereby. It is essentially a rehabilitation device and the unfortunate debtors, who seek to pay their debts rather than having them discharged in straight bankruptcy, require the conscientious attention of their attorneys, the referee, and the trustee to that end.

The Impact Of The Vicinage Requirement: An Empirical Look, Dale W. Broeder
The Impact Of The Vicinage Requirement: An Empirical Look, Dale W. Broeder
Nebraska Law Review
This is rather an introductory sampling article drawn from data generated by what is now familiarly known as the University of Chicago Jury Project. It was a study of twenty-three consecutively tried jury trials in a federal district court in the Midwest. The author personally observed all of such trials from beginning to end. All but a few lawyers serving in them were intensively interviewed, and with the court's permission, 225 jurors participating in such cases were interviewed. There were sixteen civil cases and seven criminal cases.

The Criminal Law System, Karl Menninger M.D.
The Criminal Law System, Karl Menninger M.D.
Nebraska Law Review
Our highly civilized nation has the most crime of any country in the world. Our beloved President was only recently assassinated by a nonentity who was himself assassinated before a trial could be held. Our jails are full, our court dockets are jammed. Every state is enlarging its prison "facilities" at the very moment that all progressive states are reducing the capacities and populations of their state hospitals. While four-fifths of the patients in our state hospitals are now discharged within a few months of their admission, seventy per cent of the people in jail receiving the standard penological "treatment" …

Toward A More Enlightened Sentencing Procedure, Theodore Levin
Toward A More Enlightened Sentencing Procedure, Theodore Levin
Nebraska Law Review
The inequities of sentences for criminal offenders present one of the great problems in the administration of criminal justice. The impact of an individual judge's background, personality, and prejudices on the sentences which he pronounces has increasingly become a matter of legitimate public concern. Courts, in the sentencing of convicted persons, must be something other than mechanical instruments of punishment. The symbolic blindfold on the statue of Justice was never intended to obscure from the sight of the judge an understanding of the human being who stands before him awaiting judgment. The quality of sentencing must concern us no less …
Revocable Inter Vivos Trusts Versus The Statutory Share, William C. Owen
Revocable Inter Vivos Trusts Versus The Statutory Share, William C. Owen
Nebraska Law Review
In Nebraska, as in many other states, a person, during his lifetime, may dispose of personal property either by gift or otherwise so as to completely vitiate the statutory share of a surviving spouse. One method employed by donors in attempting to effect inter vivos transfers of property is the so-called living revocable trust. This method is particularly attractive to the settlor since he not only enjoys a power of revocation but may also reserve a life interest in the income arising from the investment of the trust res. While most courts agree that such a trust is a …
Staff And Client Participation: A New Approach To Correctional Research, J. Douglas Grant, Joan Grant
Staff And Client Participation: A New Approach To Correctional Research, J. Douglas Grant, Joan Grant
Nebraska Law Review
Research in corrections is no longer something done sporadically. Professional research staffs are now permanent parts of most major correctional organizations and correctional research has become routinized. A good deal of this change can be attributed to the demands of state legislators and other budget-controlling bodies for evidence of payoff in the programs they are asked to support. There are three crucial questions concerning this expansion: (1) Where is the manpower coming from? Who will do the innovating, data collecting, evaluating, and monitoring necessary for effective research? (2) Who will determine what program innovations should be studied? and (3) How …

Joint Tortfeasors—Validity Of Loan Agreements And Use Of Pro Tanto Bar—Tober V. Hampton, 178 Neb. 858, 136 N.W.2d 194 (1965), Stephen G. Olson
Nebraska Law Review
Loan agreements rely upon the existence of allowable indemnity for their justification and validity in the joint tortfeasor situation. If indemnity is allowed in a given situation, objections to the use of a loan agreement must be rejected. If, however, a suit for indemnity is not allowed between two joint tortfeasors, loan agreements should not allow such a result indirectly. Therefore, it may be concluded that the use of loan agreements in Nebraska in the joint tortfeasor situation will only be upheld when a suit for indemnification would also be upheld. Whether loan agreements are held to be valid or …
The Federal Work Release Program, Lawrence A. Carpenter
The Federal Work Release Program, Lawrence A. Carpenter
Nebraska Law Review
The Prisoner Rehabilitation Act of 1965 authorized furloughs, a system of work release, and the use of community residential treatment centers for adult federal prisoners. The act and its implications are producing great changes in correctional work. All through the federal prison system, educational and vocational training programs are being restudied and geared to meet actual community employment opportunities and the actual capacities of prisoners. The basic missions of institutions are being reevaluated and in some instances changed. The new programs are also bringing about significant alterations in personnel recruitment and development programs, organizational patterns, and budgetary planning. The walls …

Constitutional Law—Bill Of Attainder—Section 504 Of The Landrum-Griffin Act Held: Unconstitutional—United States V. Brown, 381 U.S. 437 (1965), Mark F. Anderson
Nebraska Law Review
A bill of attainder is a legislative act which inflicts punishment without a judicial trial upon named individuals or those of an easily ascertainable class. The present case applies this definition to a legislative act which specifically designates Communists as individuals unfit to hold union office and punishes them by forcing them to choose between loss of their union position and criminal sanctions. A bill of attainder necessarily denies the victim due process of law. But the bill of attainder clause is in the Constitution for the specific purpose of insuring that no one is tried and convicted by the …
A New Look At Sunday Closing Legislation, Richard A. Spellman
A New Look At Sunday Closing Legislation, Richard A. Spellman
Nebraska Law Review
The Supreme Court of the United States has held that Sunday closing laws do not violate the first amendment, whether or not they contain exemptions for Sabbatarians (those who keep Saturday holy). However, in two cases—Terry Carpenter, Inc. v. Wood and Skag-Way Dep't Stores, Inc. v. City of Omaha—the Supreme Court of Nebraska came to the conclusion that Sunday closing legislation is a tool for religious as well as commercial discrimination, and therefore, on the balance, is not so important to the welfare of the state as the statutes upheld by the United States Supreme Court. The purpose …

Milton Avery 1893 - 1965, Norman A. Geske, Frank Getlein
Milton Avery 1893 - 1965, Norman A. Geske, Frank Getlein
Sheldon Museum of Art: Catalogs and Publications
There are few painters quite like Milton Avery in the whole history of 20th century American painting. To find his precedent in independence of spirit, purity of vision or completeness of realization one must at least look back to the "loners" of the past century, to Homer, Ryder and Eakins. Of his own generation one can cite Stuart Davis, Edwin Dickinson, Charles Burchfield, or, Arthur Dove, Edward Hopper or Charles Sheeler, and yet, like all these in quality, how different he is at the same time. He does not react in the same way to the influences, foreign and domestic, …

Nineteenth Century American Landscapes, Jon Nelson
Sheldon Museum of Art: Catalogs and Publications
Introduction: "In the woods, we return to reason and faith. There I feel that nothing can befall me in life,-no disgrace, no calamity (leaving my eyes) , which nature cannot repair. Standing on the bare ground,-my head bathed by the blithe air, and up-lifted into infinite space,-all mean egotism vanishes. . .. I am nothing, I see all; the currents of the universal Being circulate through me. I am part or parcel of God."
These words of Ralph \Valdo Emerson from his essay On Nature express the sentiments of the early nineteenth century American landscapists, known as the Hudson …

The Art Of Printmaking: Part 1. The Tools And Techniques Of The Printmaker, Norman Geske
Sheldon Museum of Art: Catalogs and Publications
There are four major techniques for making original prints. A brief descriptlon of each of these -- relief processes, incised processes, planographic processes, and stencil processes -- is found in the following paragraphs.
Most art museums today seek the means of reaching a wider public than is actually counted through the turnstile and, as a result, art objects have come to be a commonplace in public places of all kinds, civic and commercial. Art has even taken to the road in circulating exhibitions, art-mobiles and the like. The present series of exhibitions has been organized as an effort in this …

Proceedings Of The First Annual Meeting Of The National Collegiate Honors Council. University Of Kansas, Lawrence, October 22-24, 1966, Walter D. Weir
National Collegiate Honors Council Monographs
The National Collegiate Honors Council held its first annual meeting on the campus of the University of Kansas, October 22-24, 1966. The proceedings of that meeting are contained in this volume. This new association is a response to the expressed desire of many hundreds of educators throughout the country that, when the Inter-University Committee on the Superior Student (ICSS) was terminated in 1965, a national organization of individuals as well as institutions be formed. The new organization would carry on some of the functions of ICSS but would be free also to develop in ways appropriate to the present status …

University of Nebraska-Lincoln Libraries: Faculty Publications
According to Frank Lundy, director of libraries at NU, completion of the three-story steel and glass structure, faced with pebbled concrete, fulfills a long-recognized need for expanded library facilities to serve the College of Agriculture and Home Economics.
During the 1964-65 academic year there were 1,235 undergraduate students enrolled in agriculture and home economics, and about 200 graduate students in the two areas. The resident faculty and research staff totaled 168. In addition, the library facility is used by the agricultural and home economics Extension staff and a number of individuals with Federal appointments who are officed on the East …

Changes In Fungi With Age I. Chemical Composition Of Rhizoctonia Solani And Sclerotium Bataticola , David Gottlieb, James L. Van Etten
Department of Plant Pathology: Faculty Publications
The chemical composition of the mycelium of Rhizoctonia solani and Sclerotium bataticola was determined in cells of various ages. The percentage, per unit of dry weight, of soluble amino nitrogen, deoxyribonucleic acid (DNA), ribonucleic acid (RNA), ergosterol, and protein decreased with age in both fungi. Total lipids and fatty acids increased with age in S. bataticola but remained constant in R. solani. Total carbohydrate increased with age in R. solani and decreased in S. bataticola. Fewer changes with age were observed when the results were calculated in ratio to DNA. There was no change in the ratios of protein, …

Changes In Fungi With Age Ii. Respiration And Respiratory Enzymes Of Rhizoctonia Solani And Sclerotium Bataticola, James L. Van Etten, H. Peter Molitoris, David Gottlieb
Department of Plant Pathology: Faculty Publications
The rate of respiration of Rhizoctonia solani and Sclerotium bataticola decreased with age. This decrease in respiratory rate might be produced by a decrease in the specific activity of one or more enzymes involved in carbohydrate metabolism. Specific activities in cell-free extracts were measured for most of the enzymes in the hexose monophosphate shunt, Embden-Meyerhof-Parnas pathway, tricarboxylic acid cycle, and terminal electron-transport system. In addition, glucose oxidase, isocitritase, and malic enzyme were measured. In R. solani, increases in activity with age occurred for hexokinase, α-glycerolphosphate dehydrogenase, malic dehydrogenase, and cytochrome oxidase. Decreases occurred for phosphohexokinase, aconitase, nicotinamide adenine dinucleotide-specific …
