The Nebraska Art Association, Fred N. Wells Jan 1972

The Nebraska Art Association, Fred N. Wells

Sheldon Museum of Art: Catalogs and Publications

In this history of the Nebraska Art Association emphasis has been placed on the development of policies which governed the formation of the collections, the close relationship between the Association and the University, and especially the family interests which have made possible many generous gifts.

It all began with Sarah Wool Moore, as dedicated a disciple of the visual arts as ever wielded a crayon or a camel's hair brush. Miss Moore had come to Nebraska University in 1884 as a teacher of drawing and painting. She had been a pupil of August Eisenmenger, rector of the Vienna Academy of …

Robert Weaver Jan 1972

Robert Weaver

Sheldon Museum of Art: Catalogs and Publications

INTRODUCTION

Looking at and becoming excited about painted images is a somewhat old-fashioned, doubtful thing to do. After all, this is the era of the cool, impersonal, environmental and conceptual varieties of detachment, which make suspect all images having emotional impact. If such images carry the traces of a contemporary personality and of a gut-feit, hand made commitment, how are we to account for them? Yet, why must we account for them? If they are of high quality, then questions of how and why become impertinent.

Bob Weaver's paintings and prints are of this rare species, and as such present …

Thomas Coleman, Printmaker, James Eisentrager, Jon Nelson Jan 1972

Thomas Coleman, Printmaker, James Eisentrager, Jon Nelson

Sheldon Museum of Art: Catalogs and Publications

Introduction

I do not recall ever having finished a coffee break with Tom Coleman. He was not given to second cups and rarely finished his first.

When he joined the University of Nebraska art department staff in 1963, the studio facilities in the then new Nelle Cochrane Woods Building were hardly finished. With the dispatch that became so characteristic of him, Tom readied his intaglio area, and by 1966 had added lithography to his program.

Tom's work habits were rooted in Midwestern traditions. His labor was rhythmic and persistent.

His imagery was to some extent Midwestern. It stemmed for the …

Miocene Amphicyonids (Mammalia, Carnivora) From The Agate Spring Quarries, Sioux County, Nebraska, Robert M. Hunt Jr. Jan 1972

Miocene Amphicyonids (Mammalia, Carnivora) From The Agate Spring Quarries, Sioux County, Nebraska, Robert M. Hunt Jr.

Department of Earth and Atmospheric Sciences: Faculty Publications

The Miocene late Arikareean land mammal "age" is largely defined by the faunal assemblage from the Agate Spring Quarries and other nearby localities in the Harrison Formation of Sioux County, Nebraska. Amphicyonid carnivores of the genera Cynelos Jourdan and Ysengrinia Ginsburg were previously known only from European Oligocene and Miocene deposits. These genera are now known from the Harrison Formation of Sioux and Box Butte counties, western Nebraska, and therefore the late Arikareean fauna now includes three amphicyonids: Cynelos sp., (?) Ysengrinia sp., Daphoenodon superbus Peterson. The stage of evolution of these carnivores suggests a correlation of the Agate Spring …

Nebraska Supreme Court Review, Lawayne Feit, Lloyd Friesen, Gale Pokorny, Thomas Polityka

Nebraska Law Review

Nebraska Law Review takes pride in presenting the fourth annual Supreme Court Review. This section is devoted to analyses of recent Nebraska decisions of first impression or landmark rulings which substantially alter a particular area of case law in Nebraska. This section is devoted to the practitioner and intended to provide attorneys with a comprehensive study of selected case holdings and an analysis of how these decisions relate to previous Nebraska decisions and the case law of other jurisdictions. These cases discussed here were decided in the September term 1970 and the January term 1971. This section does not include …

In Forma Pauperis: Boddie V. Connecticut And The Nebraska Statute, Dennis J. Burnett Jan 1972

In Forma Pauperis: Boddie V. Connecticut And The Nebraska Statute, Dennis J. Burnett

Nebraska Law Review

An indigent, even though he may have suffered the most grievous injuries and have the most obvious right to redress for his injuries, may not be able to enter the court system. Even when an indigent can find an attorney to handle the case, the filing fee and the service of process fee often stand as insurmountable barriers which effectively bar the indigent from the court room. This, however, is no longer the plight of the indigent in Nebraska due to the recent passage of a comprehensive in forma pauperis statute. The passage of this in forma pauperis statute was …

Fundamentals Of Summary Jurisdiction In Straight Bankruptcy Over Controversies Between Trustees And Third Persons, Jerrold L. Strasheim Jan 1972

Fundamentals Of Summary Jurisdiction In Straight Bankruptcy Over Controversies Between Trustees And Third Persons, Jerrold L. Strasheim

Nebraska Law Review

It is open to the United States Congress under its constitutional authority to create separate bankruptcy courts. Instead of doing so, Congress has directed United States district courts to serve as bankruptcy courts on a part-time basis. It also is within the congressional prerogative to confer upon the chosen bankruptcy courts exclusive jurisdiction over all controversies arising under the Bankruptcy Act. But that jurisdiction has been fractionated, with some reserved to bankruptcy courts and the balance distributed to two kinds of nonbankruptcy courts, namely United States district courts sitting as ordinary federal courts and state courts. Jurisdiction may be classified …

Promises And Realities: The Continuing Myth Of Equal Justice For All, H. Bruce Hamilton Jan 1972

Promises And Realities: The Continuing Myth Of Equal Justice For All, H. Bruce Hamilton

Nebraska Law Review

No one can really doubt that the U.S. Steel Corporation, Jacqueline Kennedy Onassis, or H. L. Hunt could obtain a reasonable approximation of justice through our legal process. But can we say the same for a skid row derelict, an Appalachian tenant farmer, a Sheridan County Indian, an Omaha ghetto black, or a Lincoln welfare mother? Much has been done to rectify injustices, yet can anyone deny that the American revolutionary promise of two hundred years is still a substantially unmet pledge? The economic system, the legal system, in short, the system has failed approximately one-fourth of all Americans. The …

A Misuse Of Statistics And Future Damages, Gregory Searson Jan 1972

A Misuse Of Statistics And Future Damages, Gregory Searson

Nebraska Law Review

An injured party may generally recover damages for various types of personal injuries in tort litigation. In particular, a plaintiff is allowed to recover for damages reasonably expected in the future. This Comment is concerned primarily with the use of statistics in calculating future earning capacity, but it will also examine other problems encountered in attempting to measure prospective damages. Initially, the Comment outlines and criticizes the mechanics involved in the application of the "present approach." Then it analyzes the use of statistics and notes that the present formula used in calculating future damages leads to a consistent overstatement of …

The Law As A Trade, Wallace Rudolph Jan 1972

The Law As A Trade, Wallace Rudolph

Nebraska Law Review

A new organization is needed to supply legal services to the public. Only after the abandonment of such artificial devices as price fixing can the use of legal assistants under control of lawyers come into existence. The demand for legal services by an increasingly affluent society can only be tapped if we learn to supply such services cheaply and efficiently. This can happen only if we abandon fixed fee systems and supply all the existing demand. The Bar should reconsider its approach and abandon minimum bar fees to foster, instead, the training of legal assistants and the delivery of inexpensive …

Table Of Contents, Vol. 51, No. 3

Nebraska Law Review

The vast and sophisticated needs of the public cannot be met through a dependence on sheer voluntarism and moral responsibility, which is the state of professional response at this time. If the legal process is to provide an adequate forum for legitimate claims, the profession must redefine its entire system for delivery of legal assistance. Such legal planning would necessarily have to include an appraisal of the legal system itself, with an examination of who has access to the system, the means for implementing access, and provisions for remuneration for those who assist in providing access. Unless such a comprehensive …

Are Legal Aid Societies, Lawyer Referral Services, And Group Legal Services Adequate Under The Code Of Professional Responsibility, Jeffrey Stoehr Jan 1972

Are Legal Aid Societies, Lawyer Referral Services, And Group Legal Services Adequate Under The Code Of Professional Responsibility, Jeffrey Stoehr

Nebraska Law Review

While other professions have attempted to make their services more readily available in recent years, the legal profession's availability has remained relatively static. Today there is a considerable lack of legal services for a great majority of the people. This lack of available services is most critical in the lower and middle income classes. Only recently have any remedies to this problem been suggested and actively undertaken. Legal aid societies, lawyer referral services, and group legal service plans are the three primary methods used to combat the problem. Legal aid societies are primarily for lower income individuals while group legal …

Professional Responsibility And The Availability Of Legal Services, Stephen H. Lewis Jan 1972

Professional Responsibility And The Availability Of Legal Services, Stephen H. Lewis

Nebraska Law Review

Lawyers for People of Moderate Means, by Barlow F. Christenson, presents some of the problems of making legal services available to a greater number of people. The wealthy have no difficulty in obtaining counsel, and legal services are available to the poor through various legal aid programs, but people who are unable to qualify for legal aid but who cannot afford the services of an attorney must go without one. Christenson suggests methods to increase the efficiency of the private attorney's practice and thus reduce the cost of legal service. He also suggests alternatives to the traditional private practice, …

Informed Consent: Some Problems Revisited, Arthur J. Shartsis Jan 1972

Informed Consent: Some Problems Revisited, Arthur J. Shartsis

Nebraska Law Review

It is no longer disputed that the physician has a duty to inform his patient of the nature of the treatment proposed by the physician and the risks involved in that treatment. Because of this required disclosure the patient is better able to "determine what shall be done with his own body" by making an informed decision whether or not to undergo treatment. Yet, both the law and medicine are far from the "last say" concerning certain particularly difficult problems which arise within the scope of the physician's communication to the patient and the patient's assent to treatment. In this …
