Addressing Legal Uncertainties In Article Versions And Institutional Copyright Policies To Support Immediate Public Access To Federal Grant-Funded Publications, Yuanxiao Xu

New federal public access policies—mandated by the 2022 OSTP Memo and already adopted by several key federal grant-making agencies—require authors funded by federal grants to deposit peer-reviewed publications for immediate public access. This paper explains how grant- receiving institutions and their affiliated authors can dispel legal uncertainties and comply with the new public access policies. Section I delineates how valid prior licenses enable public deposit of manuscripts notwithstanding later publishing agreements transferring copyright to the journals. Chronic aphasia following a left middle cerebral artery (L-MCA) stroke is often associated with limited recovery beyond the acute phase, necessitating interventions that target neuroplastic mechanisms. This study examined the effects of somatosensory pneumotactile stimulation paired with cognitive-linguistic tasks on functional language performance in an individual with chronic aphasia. Using a single-subject pre-post design, the participant completed a 10-week intervention protocol involving repeated pneumotactile stimulation via the GALILEO system combined with language and motor tasks. Outcomes were assessed using standardized measures, discourse-based language samples, oral reading, repetition, and phonemic verbal fluency. This research evaluates the safety performance of flashing yellow arrows (FYA) and driver behavioral responses in Nebraska, using data from 324 FYA intersections (Lincoln 160; Omaha 164) to develop evidence-based implementation guidance. The study addresses critical knowledge gaps in local driver acceptance patterns, the effectiveness of phasing configurations, and a comprehensive safety assessment that integrates crash and conflict analyses. The methodology employed four complementary analyses: (1) negative binomial crash frequency modeling of 3945 unique left turn crashes (2015-2024) across Lincoln and Omaha; (2) binary logistic regression of 948 gap acceptance decisions across 43 intersections; (3) linear regression of post-encroachment time …

Nebraska Department of Transportation (NDOT) staff frequently decide on changes to existing two-way stop- controlled (TWSC) intersections on rural expressway to alternative facilities, such as a restricted crossing U-turn (RCUT), a roundabout, a signalized intersection, or an interchange. As Nebraska makes progress toward completion of its expressway system, updated and defensible decision-making is essential for conversion of TWSC highway intersections. NDOT’s existing guidelines, developed in the 1990s, no longer reflect current operations, safety performance, or modern intersection designs.

This project updated and expanded NDOT’s guidance using contemporary traffic operational and safety data, combined with robust microsimulation and safety performance modeling. …

Ultra-high-performance concrete (UHPC) is an advanced cementitious material known for its exceptional strength and durability, making it an ideal material for bridge deck overlays and repairs that address the common issue of premature deck deterioration. Conventional UHPC is typically flowable and self-leveling, which makes it unsuitable for deck surfaces with cross-slopes and/or sloped vertical profiles. Therefore, a highly thixotropic UHPC that responds well to vibration while remaining stable on sloped surfaces is needed for overlay applications. Recent years have witnessed increasing concern about democratic backsliding across different regime types, raising important questions about how citizens perceive the legitimacy of political systems during periods of institutional decline. Since 2019, the Republic of Georgia has been experiencing a sustained period of political unrest, which has deepened political polarization and contributed to a decline in Georgia’s Democracy Index. This study examines how citizens perceived the legitimacy of their political system amid democratic backsliding between 2019-2024.

Protest is omnipresent, and yet not much is known about the efficacy and impacts of its different rhetorical strategies—particularly so for marginalized populations, whose available means of protest are already limited by both material realities and assumptions that govern who and what can make waves. Litigation routinely employs scientific evidence to aid judicial fact-finding and decision-making. This is especially important in areas like family law, where legal standards—such as the best interests of the child—often depend in part on scientific findings. Yet the legal system’s gatekeeping doctrines (Frye, Daubert, and Federal Rule of Evidence 702) apply primarily to expert testimony, leaving other pathways through which scientific evidence reaches courts largely unchecked. These other pathways include citations in briefs and opinions to non-peer-reviewed or non-scientific sources such as law reviews, treatises, and self-published materials, which often become outdated and are not well positioned …

The Nebraska Legislature passed the Let Them Grow Act on May 22, 2023, which prohibits minors from receiving gender-affirming care in Nebraska. This Note argues that the Act violates the Equal Protection Clause of the Fourteenth Amendment because it exempts intersex children—those born with ambiguous sex characteristics—from protections against unnecessary, irreversible, and nonconsensual medical procedures, while the Act protects those born with clearly male and female sex characteristics. This Note clarifies the distinction between the issues faced by intersex individuals and transgender individuals, and highlights the psychological and physical harms of early sex assignment surgeries. Four major generative AI engines—DeepSeek, Claude, ChatGPT, and Grok—are useful legal analysis tools for employment law practitioners. This Article presents the results of an experiment in which a transcript of a hypothetical client interview involving potential disability discrimination, retaliation, and wrongful termination claims was submitted to each AI system. The accompanying prompts requested identification and assessment of viable legal theories. The experiment demonstrates that contemporary generative AI performs sophisticated legal analysis comparable to experienced associates, correctly identifying major employment law claims including ADA violations, Title VII discrimination, OSHA retaliation, FMLA interference, and workers’ compensation retaliation. Over the course of its history, the United States has wrestled with a wide variety of issues that have tested the tension between the Establishment and Free Exercise clauses of the First Amendment. One such issue involves the extent to which religious schools can access public funds, which was addressed by the proposal of the Blaine Amendment on a national scale in 1875. The Blaine Amendment was intended to prevent religious groups from accessing public funds, and although it did not pass on a national level, it was adopted by many states.

This Article offers a comprehensive framework for States’ taxing powers in outer space. Beginning with an analysis of the legal status of airspace and outer space, the study addresses the taxation of commercial space activities, where traditional fiscal approaches of residence-based and source-based taxation break down. The discussion ultimately centers on Article VIII of the Outer Space Treaty, on which basis the present Article proposes the “Tax Jurisdiction by Registration Principle,” arguing that the act of registering a space object provides a legal basis for taxing income derived from its use. The Nebraska Department of Transportation (NDOT) must manage sediment, and pollutant loads from roadway runoff to meet stormwater regulations. The SAFL Baffle, a hydrodynamic separator used by NDOT, depends on reliable estimates of total suspended solids (TSS) and particle size distribution (PSD). However, limited data exists for Nebraska roadways. In this study stormwater runoff was monitored at four NDOT-maintained sites, two in Lincoln and two in Beatrice, over 1.5 years to characterize TSS and PSD and to evaluate SAFL Baffle performance using the SHSAM model. It is important for transportation agencies to assess their winter maintenance operations performance to identify areas for improvement and/or resource investment to maintain optimal levels of service, mobility, and safety. This study explores nine winter snowstorms in Nebraska during the 2023-2024 winter season across 20 road segments, 12 of which were along the Interstate-80 corridor. Datasets explored include meteorological information, traffic mobility insights, winter maintenance operations activities, and road conditions before, during, and after the periods of accumulating snowfall.
