Masson V. New Yorker Magazine, Inc., 111 S. Ct. 2419 (1991): Journalists Score Hollow Victory In Close Encounter Of The Word Kind—And You Can [Mis]Quote Me On That, Steven M. Thomas
Nebraska Law Review
The direct quotation is a narrative device treasured much by writers and readers alike. But the quoted passages that appear in print are not always carbon copies of the words actually spoken. Writers and reporters—for a number of reasons, some better than others—have been known to misquote those who feed them their steady diet of news. When writers attribute to newsmakers damning words they did not utter, the cry of libel can sound. During the 1991 term, the Supreme Court addressed the issue of errant quotations in Masson v. New Yorker Magazine, Inc. The plaintiff in Masson did not contend …
The Americanization Of Ritual Culture: The ‘Core Codes’ In American Culture And The Seductive Character Of American ‘Fun.’, Mary Jo Deegan, Michael R. Hill
The Americanization Of Ritual Culture: The ‘Core Codes’ In American Culture And The Seductive Character Of American ‘Fun.’, Mary Jo Deegan, Michael R. Hill
Department of Sociology: Faculty Publications
Modern life in the USA is driven by four “core codes” of oppression and repression which structure a wide range of cultural patterns, from fleeting, face-to-face interactions to enduring, large scale social institutions. The four codes (sex, class, bureaucratization, and the commodification of time) also give recognizable contours to modern American cultural rituals (participatory as well as media-constructed) and contribute to the seductive character of “fun” which these rituals typically generate. American “fun” provides short-lived, incomplete escapes from mundane routine, and simultaneously strengthens and reproduces the core oppression and repressions of everyday life.
American “fun” provides its consumers with ritual …
Review Of Aspen, A Documentary Film By Frederick Wiseman, Michael R. Hill
Review Of Aspen, A Documentary Film By Frederick Wiseman, Michael R. Hill
Department of Sociology: Faculty Publications
Frederick Wiseman's most recent documentary was heralded in the New York Times (December 29, 1991, pp. 27,36) with considerable fanfare, but for this reviewer Aspen is a sociological disappointment. Wiseman's unusually keen documentary grip on the subtleties and institutional complexities of Western society has momentarily slipped in his presentation of the collage of institutionally disjointed images offered in Aspen. Visually excavating the social nexus of community life as a whole is a worthy objective for filmmakers of Wiseman's stature and experience, but sociology instructors who hope that Aspen might serve as an institutionally sophisticated community study will have to …
States Of Mind Model And Cognitive Change In Treated Social Phobics, Monroe A. Bruch, Richard G. Heimberg, Debra A. Hope
States Of Mind Model And Cognitive Change In Treated Social Phobics, Monroe A. Bruch, Richard G. Heimberg, Debra A. Hope
Department of Psychology: Faculty Publications
The applicability of Schwartz and Garamoni’s (1986, 1989) States of Mind (SOM) model for assessing the influence of cognitive-behavioral therapy on cognitive functioning was evaluated with social phobics. The SOM model states that a positive dialogue (i.e., a 2:1 ratio of positive to negative thoughts) is optimal for effective coping. Social phobics receiving either a cognitive-behavioral or educational-supportive group treatment were compared for SOM change, as were subjects meeting criteria for improvement or nonimprovement. Also the study compared the predictability of the SOM ratio with a ratio based on percent of negative thoughts. Subjects in both treatments evidenced negative monologue …
Concurrent Validity Of The Social Phobia And Anxiety Inventory, James D. Herbert, Alan S. Bellack, Debra A. Hope
Concurrent Validity Of The Social Phobia And Anxiety Inventory, James D. Herbert, Alan S. Bellack, Debra A. Hope
Department of Psychology: Faculty Publications
The Social Phobia and Anxiety Inventory (SPAI) is a new instrument designed to assess symptoms of social phobia. Although the scale has been shown to have a good test-retest reliability, internal consistency, and construct validity, no studies have examined its concurrent validity with respect to other measures of social anxiety and avoidance. In the present study, the relationship between the SPAI and several self-report measures of social anxiety was examined in a sample of 23 patients meeting DSM-III-R criteria for social phobia. The relationship between the SPAI and other measures of psychopathology, as well as performance during a role play …

Cognitive Processes And Prosocial Behaviors Among Children: The Role Of Affective Attributions And Reconciliations, Gustavo Carlo, George Knight, Nancy Eisenberg, Ken J. Rotenberg
Cognitive Processes And Prosocial Behaviors Among Children: The Role Of Affective Attributions And Reconciliations, Gustavo Carlo, George Knight, Nancy Eisenberg, Ken J. Rotenberg
Department of Psychology: Faculty Publications
Although attributions about others’ sad emotions have been shown to be positively related to helping behavior, there have been considerable inconsistencies in the findings. This study was designed to investigate the relations of affective attributions, affective reconciliations, and cognitive perspective-taking measures to prosocial behavior. Eighty-nine preschool through second grade children were administered various social cognition indices (two affective and one cognitive); the children were then given an opportunity to help a same-sex confederate child obtain toys. Helping that required a specific form of affective attribution and reconciliation was signifi cantly related to the affective attribution and reconciliation measures when the …
Zami: A Portrait Of An Artist As A Black Lesbian, Barbara Dibernard
Zami: A Portrait Of An Artist As A Black Lesbian, Barbara Dibernard
Department of English: Faculty Publications
As feminist critics, we cannot continue to ignore differences in race, sexuality, and class when we write about women; we should heed Adrienne Rich's critique of her own earlier work, that she will never again write of the "faceless, raceless, classless category of 'all women.'" Aware that my work will be partial and limited, I would like to explore Audre Lorde's Zami as a portrait of an artist as a black lesbian. In doing so, I hope to suggest areas where we must open up our conception of the female Kunstlerroman so that we are taking account of Lorde's black …
Threatened And Endanger Species Of Wetiands And Waterways In Iowa, Kansas, Missouri, And Nebraska, Ann Burruss
Threatened And Endanger Species Of Wetiands And Waterways In Iowa, Kansas, Missouri, And Nebraska, Ann Burruss
United States Environmental Protection Agency: Publications
Wetlands and waterways, including perennial and intermittent streams, creeks, and rivers, are habitats for many rare animal and plant species. Wetlands in many areas continue to decline in acreage and suffer adverse impacts from conversion and development. Waterways are also under pressure from channelization and leveeing.
This study has two major components. First, a series of databases was developed that includes animals and plant species that are wetland or waterway dependent and found in Iowa, Kansas, Missouri, or Nebraska. The databases allow ready access to detailed information on each species and probable locations within each state. The plant and animal …
Critique Of Contingent Valuation And Travel Cost Methods For Valuing Natural Resources And Ecosystems, W. David Eberle, F. Gregory Hayden
Critique Of Contingent Valuation And Travel Cost Methods For Valuing Natural Resources And Ecosystems, W. David Eberle, F. Gregory Hayden
Department of Economics: Faculty Publications
In July 1989 the U.S. District Court of Appeals in Washington, D.C. disallowed the method that had been established by the U.S. Department of Interior (DOI) for determining what a corporation would pay in the case of injury to an ecosystem from hazardous waste spills [Ohio v. Interior 1989]. The DOI method was based on neoclassical methodology and appraisal techniques. The Court ruled that "restoration is the proper remedy for injury to property where measurement of damages by some other method will fail to compensate fully for the injury," and that "natural resources have value that is not readily …
Review Of Harry Kirke Wolfe: Pioneer In Psychology, By Ludy T. Benjamin, Jr., Daniel Bernstein
Review Of Harry Kirke Wolfe: Pioneer In Psychology, By Ludy T. Benjamin, Jr., Daniel Bernstein
Great Plains Research: A Journal of Natural and Social Sciences (through 2013)
While teaching at Nebraska Wesleyan University, Ludy Benjamin discovered that the first psychology professor at the University of Nebraska gained a place in the history of experimental psychology in the United States. Harry K. Wolfe received a doctorate from the University of Leipzig, where he studied with Wilhelm Wundt (one of the founders of experimental psychology). In 1889 Wolfe established the first undergraduate psychology laboratory in the United States. Benjamin has written this interesting and readable book about a great teacher. The story includes the saga of academic life at a fledgling public university, one man's experience of the debate …
Groundwater Levels in Nebraska, 1989, continues the excellent record of Nebraska Water Survey Papers produced by the Conservation and Survey Division and the US Geological Survey. The authors provide full color cartographic displays that are accurate as well as highly readable. Some of the maps treat the state of Nebraska for summary purposes. However, the greater value is found in the nine subregional large scale maps that cover the entire state in detail. Each map clearly displays the areas of significant water-level change that has occurred from the period of first reliable record through 1989. For Nebraskans, it should be …

The Relationship Between Critical Thinking Skills And 4-H Judging Activity Success Among Nebraska 4-H Program Participants, Susan J. Kowalski
The Relationship Between Critical Thinking Skills And 4-H Judging Activity Success Among Nebraska 4-H Program Participants, Susan J. Kowalski
Department of Agricultural Leadership, Education, and Communication: Dissertations, Theses, and Student Research
The purpose of this study was to determine the relationship of the critical thinking score as measured by Watson-Glaser Critical Thinking Appraisal score and subscores (Inferences, Recognizing Assumptions, Reasoning by Deduction, Drawing Conclusions and Evaluating Arguments), and mastery of judging activities between 2 groups (upper and lower quartiles) of participants in the 1990 Nebraska 4-H Senior Livestock Judging Activity. The study was descriptive-correlational in nature and was designed to gather data concerning the strength of relationships between variables.
Data were collected to:
1 ) describe the sample according to gender, age, and mastery of the judging activity; and describe the …
Prereferral Intervention: A Review Of The Research, J. Ron Nelson, Deborah J. Smith, Lonnie Taylor, John M. Dodd, Ken Reavis
Prereferral Intervention: A Review Of The Research, J. Ron Nelson, Deborah J. Smith, Lonnie Taylor, John M. Dodd, Ken Reavis
Department of Special Education and Communication Disorders: Faculty Publications
There is a national trend toward requiring prereferral intervention procedures prior to placing students in special education programs. A review of the research associated with prereferral intervention is presented. Findings suggest that prereferral intervention approaches can have positive impact on special education service delivery practices. The findings also indicate that such interventions can increase the abilities of teachers to educate students who are experiencing difficulty and improve the attitudes of teachers toward such students. Furthermore, the interventions implemented under the prereferral intervention approaches appear to produce the desired student performance, which decreases the overidentification of students as having handicaps. In …
Moral Versus Social-Conventional Reasoning: A Narrative And Cultural Critique, Carol S. Witherell, Carolyn P. Edwards
Moral Versus Social-Conventional Reasoning: A Narrative And Cultural Critique, Carol S. Witherell, Carolyn P. Edwards
Department of Child, Youth, and Family Studies: Faculty Publications
Abstract: We suggest in this paper that attempts to segregate social-conventional reasoning from the moral domain may represent an artifactual division, one that ignores major philosophic and psychological traditions and cultural constructs regarding the moral self. We address such issues as the individual, social, and relational dimensions of morality; the cultural context of moral development and behavior; and whether morality is solely a matter of justice, harm and welfare considerations, or concerned as well with culturally variable definitions of the good and the good society, with role obligations, and with caring and affective aspects of human experience. We conclude with …
Effects Of Leader-Member Exchange On Subordinates’ Upward Influence Attempts, Kathleen J. Krone
Effects Of Leader-Member Exchange On Subordinates’ Upward Influence Attempts, Kathleen J. Krone
Department of Communication Studies: Faculty Publications
This research examined the extent to which subordinates’ perceptions of supervisory relationship quality affected how frequently they use different types of tactics in their self-reported upward influence attempts. Based on their responses to the Leader-Member Exchange Scale (1982), three hundred and thirty-seven respondents from five different organizations were classified into an in-group or out-group supervisory relationship. As a part of a larger study, a typology of upward influence messages was created based on the extent to which: (l) the means employed to attempt influence are open or closed, and (2) the desired outcomes are openly expressed or left undisclosed. The …

“A Splendid Time Is Guaranteed For All,” Sgt. Pepper’S Lonely Hearts Club Band: A Brief Consideration, Randall Snyder
“A Splendid Time Is Guaranteed For All,” Sgt. Pepper’S Lonely Hearts Club Band: A Brief Consideration, Randall Snyder
Randall Snyder Compositions
Sgt. Pepper’s Lonely Hearts Club Band, the 13th of 18 Beatles albums, released in the United States on June 1, 1967, has come to be regarded as one of the seminal artifacts of popular culture of the 20th century. This short paper explores aspects of this music that reached such a broad audience, in particular, some observations of the albums’ astonishing textual and musical diversity as well as less-obvious commonalities that bind the 13 songs with a logic and unity rarely found in popular music.
Implications Of The Animal Rights Movement For Wildlife Damage Management, Alice P. Wywialowski
Implications Of The Animal Rights Movement For Wildlife Damage Management, Alice P. Wywialowski
Great Plains Wildlife Damage Control Workshop Proceedings
Animal rights advocates are a vocal and active segment of the public who are likely to protest the killing of animals to reduce wildlife-caused damage. Wildlife damage management frequently involves killing damage-causing animals. Most media portrayals of wildlife damage management programs emphasize the killing of wildlife, and so inherently evoke a negative response from the public. The goals of this paper are to help wildlife damage managers better understand animal rights advocates and to suggest possible means to reduce conflicts. To meet these goals, the animal rights movement is placed in a historical perspective with regard to the animal welfare …
Behavioral Consultation As A Process For Linking The Assessment And Treatment Of Social Skills, Susan M. Sheridan, Stephen N. Elliott
Behavioral Consultation As A Process For Linking The Assessment And Treatment Of Social Skills, Susan M. Sheridan, Stephen N. Elliott
Department of Educational Psychology: Faculty Publications
There has been recent interest in social skills assessment and treatment among researchers and practitioners. The research bases in these areas are expanding rapidly, and the identification of valid assessment methods and effective intervention strategies is promising. However, few researchers have identified ways in which social skills assessment and intervention can be linked in a practical manner. Likewise, the process by which services are delivered is rarely addressed. The purpose of this article is to present a model by which the interaction between social skills assessment and intervention can be enhanced, with a focus on the problem-solving process. One effective …
Evaluation Of Milkweed Floss As An Insulative Fill Material, Patricia Cox Crews, Shiela A. Sievert, Lisa T. Woeppel, Elizabeth A. Mccullough
Evaluation Of Milkweed Floss As An Insulative Fill Material&#;, Patricia Cox Crews, Shiela A. Sievert, Lisa T. Woeppel, Elizabeth A. Mccullough
Department of Textiles, Merchandising and Fashion Design: Faculty Publications
Milkweed, a perennial plant that can adapt to adverse soil conditions, is being developed as an alternative crop. Fiber characterization and potential market identification are critical to its development. The most promising commercial use for milkweed floss is as a loose fill for jackets and comforters. The purpose of this research was to evaluate milkweed floss as an insulative fill material and to compare its performance to other insulators. Seven identical jackets were constructed using different fill materials matched on a per unit weight basis. The insulation (clo) values for the jackets were measured using a standing, heated manikin in …

The Organ As A Profession: Facing The Future, Quentin Faulkner
Glenn Korff School of Music: Faculty Publications
A recent issue of the Wall Street Journal features an article about the phenomenal growth of the Assemblies of God: "Heavenly Gifts: Preaching a Gospel of Acquisitiveness, A Showy Sect Prospers."
Eluding the hellfire and smoke surrounding his pulpit, the Reverend Tommy Barnett waves goodbye. With a hearty "Hallelujah," he soars straight toward heaven and out of sight.
The abrupt flight of this Pentecostal Peter Paa in a gray suit brings gasps from many of the 6,500 faithful at Phoenix First Assembly. Joining in the extravaganza are a $500,000 special effects system, 200-member choir and 25-piece orchestra. It's a finale …

Bird Hazing And Frightening Methods And Techniques (With Emphasis On Containment Ponds), Rex E. Marsh, William A. Erickson, Terrell P. Salmon
Other Publications in Wildlife Management
Our primary purpose in preparing this overview of bird hazing or frightening methods and techniques is to provide the owners and operators of agricultural evaporation ponds with all possible information on hazing to minimize bird use of the ponds and reduce their exposure to possible contamination from accumulated substances, such as selenium.
While our main objective was to assist pond managers, our coverage of bird hazing is intentionally broad enough to be highly relevant to protect many agricultural crops and some aquaculture facilities from bird depredations, and to reduce bird numbers at airports where the potential for bird-aircraft strikes is …

Personality And Socialization Correlates Of Vicarious Emotional Responding, Nancy Eisenberg, Richard Fabes, Mark Schaller, Paul Miller, Gustavo Carlo, Rick Poulin, Cindy Shea, Rita Shell
Department of Psychology: Faculty Publications
The relations of personality and family characteristics to adults’ negative vicarious emotional responses to sympathy and distress films were examined. Ss reported more sympathy and less personal distress and exhibited less skin conductance as well as heart rate deceleration when viewing a sympathy-evoking film. Dispositional emotional intensity and fantasy empathy were associated with greater self-reported emotional responding and higher skin conductance. Dispositional perspective taking and personal distress were positively and negatively correlated, respectively, with reported vicarious responding to the sympathy film when Ss were administered instructions to imagine the emotions of those in the films. Family cohesiveness was associated with …

The Altruistic Personality: In What Contexts Is It Apparent?, Gustavo Carlo, Nancy Eisenberg, Debra Troyer, Galen Switzer, Anna L. Speer
Department of Psychology: Faculty Publications
Hypotheses concerning the specific contexts in which an altruistic personality might be most apparent were investigated, College students completed questionnaires tapping components of an altruistic personality, emotionality, and social desirability. At a 2nd session, the emotional evocativeness and ease of escape from the helping situation were experimentally manipulated. Ss were exposed to a distressed woman, completed state sympathy and personal distress indexes, and were given an opportunity to assist the woman. High scorers on dispositional altruism were expected to assist most when escape was easy, particularly when the distress cues were obvious. Altruistic and emotionally reactive persons were also expected …

The Unification Of Germany And International Law, Frans Von Der Dunk, Peter H. Kooijmans
Space, Cyber, and Telecommunications Law Program: Faculty Publications
The process of German unification, at least as far as its international legal aspects are concerned, is almost complete now. After the first Staatsvertrag, creating as of July 1, 1990, a monetary union between the Federal Republic of Germany ("FRG") and the German Democratic Republic ("GDR"), the second Staatsvertrag uniting the two States as of October 3 legally sealed the inter-German aspects of the unification.
At the same time, the September 12 Treaty between the four former occupation powers—the United States, the Soviet Union, Great Britain and France—and the two former occupied German States took care of the remaining …

Maize Production Impacts On Groundwater Quality, J.S. Schepers, M.G. Moravek, E.E. Alberts, K.D. Frank
United States Department of Agriculture-Agricultural Research Service / University of Nebraska-Lincoln: Faculty Publications
The cumulative effects of management practices on nitrate-nitrogen (NO3-N) leaching and ground water quality are frequently difficult to document because of the time required for expression and the diversity of interacting process involved. This work reports results of a N and water management program initiated by the Central Platte Natural Resource District (CPNRD) in Nebraska. Cultural pratices recommended by the (CPNRD) in Nebraska. Cultural practices recommended by the CPNRD and reported by producers for the 1988 growing season, representing approximately 3900 fields covering 84 210 ha of irrigated corn (Zea mays L.) indicated NO3-N contamination of groundwater was influenced by …

Review Of The Cherokees: A Population History, By Russell Thornton, Henry F. Dobyns
Great Plains Research: A Journal of Natural and Social Sciences (through 2013)
This volume discusses major dynamics of Cherokee population trends during historic times. That is, it describes the formation and fortunes of one ethnic minority in the United States. Such historic demography is necessarily limited by available information. Consequently, this discussion presents more (and more reliable) details about recent demographic trends than about earlier ones.
Drought Experience And Perception Of Climatic Change Among Great Plains Farmers, David M. Diggs
Drought Experience And Perception Of Climatic Change Among Great Plains Farmers, David M. Diggs
Great Plains Research: A Journal of Natural and Social Sciences (through 2013)
How humans perceive, respond, and adapt to long-term climatic change are questions of fundamental interest to nature and society researchers. This paper analyzes the effect of drought experience on Great Plains farmers' perceptions of long-term climate change. Approximately three-quarters of all farmers surveyed believed that the climate is, or is possibiy, changing. Drought experience, while perhaps not initiating concern for climate change, can solidify peoples' perceptions of the certainty and nature of the change. The potential cognitive heuristics used in the formation of climate change perceptions are discussed.
