Custom work is defined as “the hiring of men with machines for performance of a specified machine task.” The custom rate includes charges for the machine, tractor or power unit, fuel, lubrication, incidental supplies and operator's labor, except where otherwise indicated. The costs of material applied are not included-fertilizer, insecticide, herbicide and seed being cases in point. Custom rates in this circular were summarized from questionnaires received from farmers and custom operators throughout Nebraska. Each was asked to report the rates he charged or paid for customwork in 1968. The returns were tabulated for each of the state crop reporting …

The ever-increasing use of the automobile by the American public has caused a corresponding increase in the amount of litigation resulting from this use. When this litigation involves a traffic accident occurring outside the jurisdiction of the state courts where the plaintiff brings suit, particular problems arise. One possible method of obtaining jurisdiction over a nonresident defendant for an out-of-state accident is to use the defendant's automobile liability policy alleging it to be an asset. If the insurance company is doing business in the plaintiff's state this "asset" may then be asserted as establishing the basis of a quasi in …

The calcium and phosphorus requirements of growing-finishing swine have not been satisfactorily resolved. Recently it was suggested that levels of calcium and phosphorus needed in diets of growing-finishing (G-F) swine for optimum growth and feed conversion may be different from those needed for optimum bone development (Miller et al., 1960; Lloyd et al., 1961; Rutledge et al., 1961; Combs et al., 1966). The problem of determining calcium and phosphorus requirements is further magnified by the observation of Chapman et al. (1955) that G-F swine do not utilize plant phosphorus as efficiently as inorganic phosphorus. In …

How did the text of Apuleius' Apology originate? The question has seldom drawn the attention of scholars. Those who have dealt with it simply assume that Apuleius worked out and elaborated upon whatever he had actually said in court and then had the finished version published. Paul Vallette thus assumes Apuleius must have reworked the speech. The effects of CS1 duration, partial reinforcement, and trace conditioning on second-order conditioned suppression were investigated, employing 64 rats as Ss. In Experiment 1, the clearest second-order conditioning was obtained when CS1 duration was the same during both the first- and the second-order conditioning phases of the experiment. In Experiment 2, somewhat better second-order conditioning was obtained when first-order conditioning had been under conditions of partial reinforcement, delay CS-US pairing. In neither experiment were CS1 suppression and CS2 suppression during second-order testing well correlated. This aspect of the results raised the question of the influence of nonclassical conditioning factors on …

Studies On The Helminth Fauna Of Alaska, Xlvi. Davainea Lagopodis Sp. Nov. (Cestoda: Davaineidae) From Grouse (Tetraonidae), Robert L. Rausch

Cestodes of the genus Davainea Blanchard 1891, from grouse in various Eurasian and North American regions have been identified as D. tetraoensis Fuhrmann 1919, or less frequently as D. proglottina (Davaine 1860). Those from ptarmigan (Lagopus spp.) in Alaska, resembling D. tetraoensis in some details but having only a single row of rostellar hooks and fewer testes, were earlier reported as D. proglottina by Babero (1953). The study of additional material from grouse from Alaska indicates that this cestode is specifically distinct from the two species mentioned. It is described here as new.

Life insurance textbooks refer only briefly to the subject of price competition, and even some of these references contain statements that are inconsistent in certain respects. On the one hand, in discussions of regulation, the statement is sometimes made that life insurance rates generally are not regulated and that competition is felt to be a sufficient protection against excessive rates. On the other hand, in discussions of differences among insurance carriers, the statement is sometimes made that price comparisons in life insurance are sufficiently complex to be well beyond comprehension for the layman. Protection For Citizen Complaints To Public Authorities—Prohibition Of Retaliatory Evictions: The Case Of Edwards V. Habib, Neil B. Danberg

Edwards v. Habib is a recent decision from the United States Court of Appeals, District of Columbia Circuit, which allows tenants in month-to-month tenancies a defense against summary dispossess actions. Where the tenant had complained to local authorities that his dwelling did not meet the minimal housing standards in that jurisdiction, a landlord had been able to punish the complaining tenant through eviction. The tenant in the District of Columbia after Edwards is now permitted to assert as a defense to eviction the illegal retaliatory purpose of the landlord. The decision is an important judicial attempt to bring landlord-tenant law …

This Comment attempts to analyze the practical effects of review de novo in one category of divorce cases: those involving alimony and property settlement. To accomplish this task, it is necessary to examine Nebraska's substantive rules for determining alimony and rendering property settlements, which is followed by an exploration of the historical basis for review de novo, with particular attention to its development in Nebraska. There is then an analysis of review de novo in alimony and property settlement cases, and some of the issues are discussed. Finally, some procedural recommendations are posited with the goal of improving appellate review …

Through the medium of life insurance, millions of individuals have accumulated savings while providing protection for their families. Insurance companies have pooled these savings and injected them back into the financial bloodstream of the economy. This pool of investment funds has helped to achieve increasingly greater productivity and has raised the standard of living in our society. This article seeks to explain how life insurance functions as a vehicle for personal savings. The protection element of life insurance is related to the level premium concept of funding insurance. An inquiry into Nebraska's jails is warranted and long overdue. To analyze the jail systems in the state, it is necessary to study the legal basis of the jail system as contained in the laws, how that system operates today, what about the system gives rise to concern, and what can be done to improve the system. Throughout the analysis, a comparison to national statistics is meaningful to determine if the comments and recommendations of national and federal authorities are relevant in Nebraska.

Effects Of Main Stem Impoundments And Channelization Upon The Limnology Of The Missouri River, Nebraska, Larry A. Morris, Ralph N. Langemeier, Thomas R. Russell, Arthur Witt Jr.

Rigid control has been imposed upon the Missouri River by impounding over one-half of the upper 1,500 miles and by channeling most of the remaining river within permanent, narrow banks. These controls have caused environmental changes in the lower Missouri River, as shown by this study, of adjacent unchannelized and channelized sections of river below the main stem impoundments. Impoundments have regulated flow by evening maximum and minimum discharges and improved downstream water quality by decreasing turbidity and indirectly raising the dissolved oxygen. In addition the impoundments have contributed a limnetic cladoceran, Leptodora kindti, to the drift and have …
