Nebraska Law Review

While numerous courts have recognized the right of parents to maintain a cause of action for wrongful birth grounded in medical malpractice, the same courts have steadily refused to recognize a child's right to maintain a parallel cause of action for wrongful life. Recently, in Turpin v. Sortini, the California Supreme Court became the first high court of any state to recognize a child's right to maintain a wrongful life action based on medical malpractice. In resolving conflict between lower courts, the California Supreme Court constructed a theory of wrongful life that was based upon medical malpractice, drawing upon …

Is The Group Home "Like A Pig In The Parlor"?, Patricia A. Burdyny

Nebraska Law Review

Recorded history of mental retardation predates defined knowledge of many other areas of disability. Yet society continues to have difficulties dealing with this handicap. Disparate views regarding appropriate housing of the mentally retarded have resulted in increased litigation during recent years. Specifically, courts have been asked to determine whether mentally retarded persons, who cannot live alone, have a right to reside in community group homes. Nebraska, although a leader in the field of agency placement services for the mentally retarded, has not been immune to this wave of litigation. A recent state district court case, Knudtson v. Trainor (Trendwood), …

More Than Just A Place To Live: A History Of Raymond, Love, Heppner, And Piper Halls, Jay Curtiss

Archives & Special Collections

Fifty years ago, in-the fall of 1932, Raymond Hall opened-to students for the first time. To commemorate the fiftieth anniversary of this event, I took it upon myself to compile a history of the buildings and to write biographies of the people after which those buildings are named.

When I began working on this little piece of nostalgia, I didn't realize how much work would be involved, and how long it would ultimately take. Now, nearly three years later, my work is compete, at least as far as I am willing to go.

Many people have asked me why I …

Physiology Of Male Reproduction, R. P. Amann, B. D. Schanbacher Jan 1983

Physiology Of Male Reproduction, R. P. Amann, B. D. Schanbacher

United States Department of Agriculture-Agricultural Research Service / University of Nebraska-Lincoln: Faculty Publications

The major advances over the past 25 yr in male reproductive physiology of cattle, sheep, swine and horses are reviewed. Those findings which have allowed efficient culling of subfertile males and exploitation of the reproductive capacity of genetically superior sires are emphasized.

Hormones secreted by the male gonad early in gestation induce regression of potentially female structures and development of the male reproductive tract. Compartmentalization of the testis and formation of the bloodtestis barrier during prepubertal development permit the steroidogenic and gametogenic activities of the adult testes to proceed normally. The role of the central nervous system, hypothalamus and anterior …

Pulsatile Luteinizing Hormone Secretion In The Castrate Male Bovine: Effects Of Testosterone Or Estradiol Replacement Therapy, B. D. Schanbacher, M. J. D'Occhio, T. W. Gettys Jan 1983

Pulsatile Luteinizing Hormone Secretion In The Castrate Male Bovine: Effects Of Testosterone Or Estradiol Replacement Therapy, B. D. Schanbacher, M. J. D'Occhio, T. W. Gettys

United States Department of Agriculture-Agricultural Research Service / University of Nebraska-Lincoln: Faculty Publications

Luteinizing hormone (LH) secretory profiles have been determined for the male bovine following castration and steroid replacement therapy. Serum LH concentrations increased approximately threefold during the first week following castration and thereafter remained elevated (6.6 ± .7 ng/ml). Castrates not receiving steroid replacement showed a rhythmic pattern of LH release that was of high frequency (mean pulse interval; 85 ± 5 min) and high amplitude (mean peak concentration, 11.2 ± 1.4 ng/ml). Chronic administration of estradiol-17β via subdermal Silastic implants reduced mean serum LH concentrations (2.1 ± .3 ng/ml) and blocked the pulsatile pattern of LH release in all steers. …

Expression Of A Streptococcus Mutans Glucosyltransferase Gene In Escherichia Coli, James P. Robeson, Raul G. Barletta, Roy Curtiss Iii

School of Veterinary and Biomedical Sciences: Faculty Publications

Chromosomal DNA from Streptococcus mutans strain UAB90 (serotype c) was cloned into Escherichia coli K-12. The clone bank was screened for any sucrosehydrolyzing activity by selection for growth on raffinose in the presence of isopropyl- β-D-thiogalactoside. A clone expressing an S. mutans glucosyltransferase was identified. The S. mutans DNA encoding this enzyme is a 1.73-kilobase fragment cloned into the HindIII site of plasmid pBR322. We designated the gene gtfA. The plasmid-encoded gtfA enzyme, a 55,000-molecular-weight protein, is synthesized at 40% the level of pBR322-encoded β-lactamase in E. coli minicells. Using sucrose as substrate, the gtfA enzyme catalyzes …

Visual Search And Selection Of Natural Stimuli In The Pigeon: The Attention Threshold Hypothesis, Alan B. Bond Jan 1983

Visual Search And Selection Of Natural Stimuli In The Pigeon: The Attention Threshold Hypothesis, Alan B. Bond

Papers in Behavior in Biological Sciences

During visual search for samples of varying proportions of familiar, natural food grains displayed against a complex gravel background, pigeons exhibited “matching selection,” a tendency to overselect the more common grain. The matching selection effect was decreased at low levels of stimulus/background contrast and reversed when the grains were highly conspicuous. The results were consistent with the hypothesis that stimulus detectability should be enhanced by recent experience with a particular grain type, but they showed no convincing indications of a corresponding effect on the response criterion. An explanatory model, termed the attention threshold hypothesis, argues that the mean latency of …

Occurrence And Pathogenicity Of Heligmosomoides Spp. (Nematoda: Heligmosomidae) Associated With Cecal Villi In Arvicolid Rodents, Robert L. Rausch, M. L. Johnson

Harold W. Manter Laboratory of Parasitology: Faculty Publications

The host response to the nematodes Heligmosomoides hudsoni (Cameron, 1937) and H. johnsoni Rausch and Rausch, 1973 (Heligmosomidae) was investigated in their natural hosts, varying lemmings, Dicrostonyx spp., and heather voles, Phenucomys intermedius Merriam (Rodentia: Arvicolidae), respectively. The nematodes occupy the cecum of the host, where they coil tightly around the long cecal villi. In individual animaIs, the comparatively few villi occupied became much enlarged, exhibiting severe hyperplasia of the mucosa and other microscopic changes, as described. The mechanism of pathogenesis involved three factors: strangulation of the villi, pressure atrophy, and chronic irritation by the crests of the synlophe. In …

Significance Of Residual Organisms In Foods After Substerilizing Doses Of Gamma Radiation: A Review, R. B. Maxcy Jan 1983

Significance Of Residual Organisms In Foods After Substerilizing Doses Of Gamma Radiation: A Review, R. B. Maxcy

Department of Food Science and Technology: Faculty Publications

The nature of the flora surviving substerilizing irradiation of foods is dependent on the dose applied and the conditions of applications as well as the microenvi¬ronment of the food. At a dose level low enough to preserve acceptable sensory properties of fresh food, few if any of the common contaminants of public health significance survive irradiation. Survivors are weakened and present no unique problem of acquired resistance through recycling. Those bacteria surviving a low dose treatment of a relatively contaminated product like ground beef can grow under normal storage conditions and cause obvious sensory spoilage. Thus, low dose irradiation extends …

Antitrust And The Future Of Cost Containment Efforts In The Health Profession, Eric L. Richards Jan 1983

Antitrust And The Future Of Cost Containment Efforts In The Health Profession, Eric L. Richards

Nebraska Law Review

In a recent opinion, Arizona v. Maricopa County Medical Society, the United States Supreme Court decided that section 1 of the Sherman Act was "violated by an agreement among competing physicians setting, by majority vote, the maximum fees that they may claim in full payment for health services provided to policy holders of specified insurance plans." As an aid to understanding the Maricopa County decision, this article explores the economic environment of the health care industry. It examines the rampant cost escalation that plagues the industry and explains how much of this inflationary surge is precipitated by a third-party …

A House Divided: Substantive Due Process In The Twentieth Century, Glen R. Anstine Jan 1983

A House Divided: Substantive Due Process In The Twentieth Century, Glen R. Anstine

Nebraska Law Review

The lines drawn to separate and distinguish the social sciences of economics, politics, and law are both real and imaginary. This Comment presents the hypothesis that a certain political theory has as natural co-tenants in the house of coherence a certain economic and legal philosophy. To explain and expand this hypothesis, two separate inquiries are focused upon. First, can a belief that government has a limited, or perhaps a nonexistent, role in policing what individuals speak, with whom they associate, or what system of religious beliefs they embrace coherently exist in the same framework of knowledge which also has as …

Drugs During Pregnancy: Dangerous Business—The Continued Movement To Provide Adequate Warnings For The Consumer, David Detar Newbert Jan 1983

Drugs During Pregnancy: Dangerous Business—The Continued Movement To Provide Adequate Warnings For The Consumer, David Detar Newbert

Nebraska Law Review

Recently, the United States Food and Drug Administration amended its general drug labeling provisions to include warnings on numerous over-the-counter drugs. These changes are directed at protecting consumers who are either pregnant or nursing their infants. As a result, manufacturers of thousands of over-the-counter drug products have until December 5, 1983, to comply with the new labeling requirements. This Comment briefly reviews the scientific information that led to the new labeling requirements and gives a historical perspective of the government's role in protecting the American consumer from dangerous drugs. It also explores the drug manufacturer's role in the entire process …

Minors And Privacy: Are Legal And Psychological Concepts Compatible?, Gary B. Melton

Nebraska Law Review

With the development of environmental psychology, psychologists have paid increasing attention to the importance of privacy and the means of attaining it. At the same time, however, there has been minimal consideration given to the potential integration of new literature on the topic with legal doctrines related to privacy rights. This article is intended to facilitate such an integration with respect to the privacy interests of minors. Such an emphasis is particularly timely in view of contemporary efforts to explore the psychological assumptions underlying legal and philosophical analyses of the nature of children's rights. The cases reviewed in this article …

The Desegregated School And Status Relationships Among Anglo And Hispanic Students, Peter Iadicola, Helen A. Moore Jan 1983

The Desegregated School And Status Relationships Among Anglo And Hispanic Students, Peter Iadicola, Helen A. Moore

Department of Sociology: Faculty Publications

Desgregated elementary school students display verbal and non-verbal indicators of status relationships in a structured, videotaped interaction game.  Both Hispanic and Anglo third grade student responses are analyzed across ten schools for a case study of factors that influence racial/ethnic integration outcomes.  Variance in student outcomes are primarily explained by socioeconomic dimensions of the schools.   These findings suggest that school desegregation poses a contradiction for Hispanic students.

Microbiological Water Quality Of Impoundments: A Literature Review, G. Allen Burton Jr. Dec 1982

Microbiological Water Quality Of Impoundments: A Literature Review, G. Allen Burton Jr.

United States Public Health Resources

Assessing the microbiological water quality of impoundments and the potential for waterborne disease outbreaks is a difficult task when using traditional sampling programs. Problems associated with using fecal coliform bacteria as indicators of human pathogen presence complicates assessments of future water quality in preimpoundment areas. Reliable determination of future and present microbiological water quality requires knowledge of how the chemical, physical, and biological characteristics of the watershed and impoundment interrelate to influence microbial indicator and pathogen densities. Accurate estimates of microbial indicator and pathogen densities, obtainable by using the enumeration methods and their modifications suggested in this report, will allow …

Foot Rot, Don Hudson Nov 1982

Foot Rot, Don Hudson

University of Nebraska-Lincoln Extension: Historical Materials

Foot rot (necrotic pododermatitis, foul foot) can be a very annoying problem in cattle. Once started in a herd and "seeded" in the soil, it may persist for quite a long time. Although the incidence of foot rot may not be high at any one time, it requires constant observation to prevent serious economic loss. The bacterium Fusobacterium necrophorum has been reported to cause foot rot. However, researchers have not been able to reproduce typical foot rot lesions with this organism. Recent research at the University of Missouri indicates that a combination of Fusobacterium necrophorum and Bacteroides melaninogenicus are the …

Chapter 9: Development And Learning: Complementary Or Conflicting Aims In Humanities Education?, Robert D. Narveson

ADAPT Program: Essays

It will be clear from these sketchy examples that working out some of the implications of Piagetian theory for an educational program such as ours offers us a continuing challenge. The theory perhaps does more to console us for some of our failures as teachers than to tell us how our failures may be overcome, for if the fault is in the developmental level that our students have attained, then the fault is not in us. Our teaching, Piaget tells us, can play a role in fostering development, but only a fairly limited role. On the other hand if we …
