Wake Up And Die Right: The Rationale, Standard, And Jurisprudential Significance Of The Competency To Face Execution Requirement, Robert F. Schopp Jan 1991

Wake Up And Die Right: The Rationale, Standard, And Jurisprudential Significance Of The Competency To Face Execution Requirement, Robert F. Schopp

Nebraska College of Law: Faculty Publications

Contemporary American criminal law prohibits the execution of those who are not competent to face execution. The state cannot execute convicted offenders, including those who have been sentenced to death for capital crimes under valid law and through acceptable procedures, unless those offenders are competent at the time of execution. Although this requirement applies in all states that practice the death penalty and traces its heritage deep into the common law, its exact formulation remains controversial as does the appropriate rationale and the corresponding procedure.'

Five identifiable questions have troubled courts and commentators. First, what rationale justifies this requirement? Second, …

The Psychotherapist's Duty To Protect The Public: The Appropriate Standard And The Foundation In Legal Theory And Empirical Premises, Robert F. Schopp Jan 1991

The Psychotherapist's Duty To Protect The Public: The Appropriate Standard And The Foundation In Legal Theory And Empirical Premises, Robert F. Schopp

Nebraska College of Law: Faculty Publications

Several states have established a duty on the part of psychotherapists to protect the public from harm caused by their dangerous patients. The Supreme Court of California initially articulated this duty in the widely discussed Tarasoff case where the court stated:

When a therapist determines, or pursuant to the standards of his profession should determine, that his patient presents a serious danger of violence to another, he incurs an obligation to use reasonable care to protect the intended victim against such danger. This discharge of this duty may require the therapist ... to warn the intended victim or others... to …

2. Psychodiagnostic Computing: From Interpretive Programs To Expert Systems, Marley W. Watkins, Paul A. Mcdermott

The Computer and the Decision-Making Process

As amply demonstrated by the chapters in this volume, computer applications have pervaded all aspects of psychological practice. Although thought by some to be relatively new (Nolen & Spencer, 1986), semiautomatic scoring of the Strong Vocational Interest Blank was accomplished more than 50 years ago (Campbell, 1968) and systems of computer-based test interpretation have been operational for 25 years (Fowler, 1985).

DEVELOPMENT OF ADMINISTRATION AND INTERPRETATION PROGRAMS

Early automated programs typically focused upon the scoring or interpretation of a single psychological test. Most frequently, that test was the Minnesota Multiphasic Personality Inventory (Fowler, 1985) but the Rorschach was interpreted as …

Coyote Space Use In Relation To Prey Abundance, L. Scott Mills, Frederick F. Knowlton Jan 1991

Coyote Space Use In Relation To Prey Abundance, L. Scott Mills, Frederick F. Knowlton

United States Fish and Wildlife Service: Publications

Food abundance is an important factor determining space use in many species, but its effect on carnivore home range and territory size has rarely been investigated. We explored the relationship between food abundance for the coyote (Canis latrans) and space use in two study areas in the northern Great Basin, where the primary prey, the black-tailed jackrabbit (Lepus californicus), fluctuates dramatically in abundance. At one site, home ranges and temtories were significantly larger during a time of prey scarcity than when prey was abundant. Coyotes on the second site had similar-size home ranges and territories at low and high prey …

Windbreaks In Sustainable Agricultural Systems, Vernon C. Quam, John Gardner, James R. Brandle, Teresa K. Boes Jan 1991

Windbreaks In Sustainable Agricultural Systems, Vernon C. Quam, John Gardner, James R. Brandle, Teresa K. Boes

School of Natural Resources: Faculty Publications

Sustainable agriculture is a system of whole-farm resource use balanced with whole-farm productivity. The overall level of productivity achieved is dependent upon the ability to coordinate and manage simultaneously the soil, water, plant, and animal resources within climatic and economic limits. Both the kind and amount of plants and animals supported by the system are important and play significant roles, both individually and collectively in maintaining a healthy farm environment. In the future, integrated systems will help reduce human impact on resources while providing sufficient supplies of high quality food and fiber.

Windbreaks provide protection for people, animals, buildings, crops, …

Patterns Of Appraisal And Coping Across Different Stressor Conditions Among Former Prisoners Of War With And Without Posttraumatic Stress Disorder, John A. Fairbank, David J. Hansen, James M. Fitterling Jan 1991

Patterns Of Appraisal And Coping Across Different Stressor Conditions Among Former Prisoners Of War With And Without Posttraumatic Stress Disorder, John A. Fairbank, David J. Hansen, James M. Fitterling

Department of Psychology: Faculty Publications

Little is known about how survivors of extreme events cope with traumatic memories and subsequent negative life experiences. The present study compared (a) repatriated prisoners of war (RPWs) from World War II (WWII) with chronic posttraumatic stress disorder (PTSD), (b) RPWs without PTSD, and (c) noncombat veterans on measures of general psychological functioning, appraisal, and coping. Appraisal and coping were assessed under 2 stressor conditions: memories of war/captivity and recent negative life events. RPWs with PTSD reported poorer general psychological functioning; significantly less control over memories of WW II; and more frequent use of self-isolation, wishful thinking, self-blame, and social …

In Vitro Assembly Of Apophytochrome And Apophytochrome Deletion Mutants Expressed In Yeast With Phycocyanobilin, Lily Deforce, Ken-Ichi Tomizawa, Naoko Ito, Dave Farrens, Pill-Soon Song, Masaki Furuya Jan 1991

In Vitro Assembly Of Apophytochrome And Apophytochrome Deletion Mutants Expressed In Yeast With Phycocyanobilin, Lily Deforce, Ken-Ichi Tomizawa, Naoko Ito, Dave Farrens, Pill-Soon Song, Masaki Furuya

Department of Chemistry: Faculty Publications

Recombinant pea type I phytochrome apoprotein expressed in yeast is shown to assemble in vitro with phycocyanobilin to produce a photoreversible phytochromelike adduct. As an initial investigation of the amino acid sequence requirements for chromophore incorporation, three phyA gene product deletion mutants were produced in yeast. Truncation of the N-terminal tail to residue 46 demonstrates that this region is not critical to bilin attachment, but a deletion mutant lacking 222 amino acids from the N terminus failed to yield holophytochrome in vitro, under the same conditions. A mutant comprising a deletion of the C terminus to residue 548 …

Drought Planning: A Process For State Government, Donald A. Wilhite Jan 1991

Drought Planning: A Process For State Government, Donald A. Wilhite

National Drought Mitigation Center: Faculty Publications

Drought has been a prevalent feature of the American landscape during the latter part of the 1980s, producing serious socioeconomic and environmental consequences. These recent experiences with drought have renewed concern about the inadequacy of federal and state contingency planning efforts and the lack of coordination for assessment and response efforts between these levels of government. This paper presents the results of research aimed at facilitating the preparation of drought contingency plans by state government in conjunction with a state’s overall water management planning activity. The ten-step drought plan development process reported is intended to improve mitigation efforts through more …

Drought Planning And State Government: Current Status, Donald A. Wilhite Jan 1991

Drought Planning And State Government: Current Status, Donald A. Wilhite

National Drought Mitigation Center: Faculty Publications

Recent droughts, calls for action by regional, national, and international organizations, and the availability of model plans have stimulated considerable activity in the development of drought contingency plans by state government in the United States. In 1982 only three states had prepared formal drought plans; currently 23 states have completed plans. These planning efforts have often been conducted in conjunction with a state's overall water management planning initiative. Clearly, states can now be labeled as policy innovators in the field of drought planning. The atmospheric science community should play a prominent role in the planning process at all levels of …

Nf91-28 Psittacosis (Chlamydia Psittaci Infections) In Pet Birds, Eva Wallner-Pendleton Jan 1991

Nf91-28 Psittacosis (Chlamydia Psittaci Infections) In Pet Birds, Eva Wallner-Pendleton

University of Nebraska-Lincoln Extension: Historical Materials

Companion birds continue to increase in popularity as pets in the United States. Birds most frequently kept belong to the family psittacidae, or the parrot family. Although domestic breeding of parrots is becoming more widespread, a large number of birds are still imported from outside the United States. By law, these birds must enter the country through quarantine stations. There they spend at least 30 days and are tested for disease and fed food containing tetracycline, an antibiotic. The antibiotic treatment is to hopefully eliminate infections with Chlamydia psittaci, the bacterium that causes psittacosis.

Habitat Associations And Relative Densities Of Rodent Populations In Cultivated Areas Of Central Argentina, James N. Mills, Barbara A. Ellis, Kelly T. Mckee, Julio I. Maiztegui, James E. Childs

Zoonotics and Wildlife Disease: Publications

Small mammals were livetrapped during 12 months in crop fields and weedy borders at 18 sites in central Argentina. A total of 1,652 mammals of 14 species was captured during3 3,060 trap-nights. Six species of rodents comprised > 95% of captures. Periodically disturbed fields of crops were dominated by Calomys musculinus and C. laucha, and to a lesser extent Mus musculus. A second group composed of Akodon azarae, Bolomys obscures, and Oligoryzomys flavescens primarily inhabited the more stable, weedy borders of cultivated fields. Peaks in relative densities of C. musculinus, C. laucha, and M . musculus …

Transformation Of 1-Aminonapththalene At The Surface Of Smectite Clays, Calvin C. Ainsworth, Bruce D. Mcveety, Steven C. Smith, John M. Zachara Jan 1991

Transformation Of 1-Aminonapththalene At The Surface Of Smectite Clays, Calvin C. Ainsworth, Bruce D. Mcveety, Steven C. Smith, John M. Zachara

United States Department of Energy: Publications

One-aminonaphthalene is sorbed onto the Na-saturated smectite clays, montmorillonite and hectorite, by cation exchange. In the presence of Fe3+ either in the clay structure or on the clay surface, sorption is followed by the formation of a blue-colored complex, with the continuous disappearance of aminonaphthalene from solution and the clay surface. The rate of aminonaphthalene disappearance decreases as pH increases. With time, four major products that appear to be structural isomers of N(4- aminonaphthyl)-1-naphthylamine are produced. A simplified model of this transformation is suggested to be the oxidation by Fe3+ of sorbed aminonaphthalene forming a radical cation-clay complex. …

Long-Term Decline In Freshwater Mussels (Bivalvia: Unionidae) Of The Western Basin Of Lake Erie, Thomas F. Nalepa, Bruce A. Manny, James C. Roth, Samuel C. Mozley, Donald W. Schloesser Jan 1991

Long-Term Decline In Freshwater Mussels (Bivalvia: Unionidae) Of The Western Basin Of Lake Erie, Thomas F. Nalepa, Bruce A. Manny, James C. Roth, Samuel C. Mozley, Donald W. Schloesser

United States Department of Commerce: Staff Publications

Long-term trends in the abundance of unionids in the western basin of Lake Erie were examined from data collected at 17 stations in 1961, 1972, and 1982. The mean number of unionids at these stations declined over this time period, decreasing from 10 m-2 in 1961, to 6 m-2 in 1972, down to 4 m-2 in 1982. This decline in abundance was reflected in the decrease in the number of stations where mussels were found; unionids were found at 16 of the 17 stations in 1961, but at only 6 stations in 1982. Reasons for the decrease …
