Declaratory Judgments In Nebraska, Matthew A. Schumacher Jan 1966

Declaratory Judgments In Nebraska, Matthew A. Schumacher

Nebraska Law Review

In 1929, Nebraska adopted the Uniform Declaratory Judgments Act, which was subsequently declared constitutional in Lynn v. Kearney County. Today, the uniform act has been adopted by forty states and the remaining ten states have some form of statutory declaratory relief. The federal courts have their own declaratory judgment procedure, made available in 1934, which is similar to the uniform act. Vast areas exist in the field of law where declarations could be used reasonably and with effective results; however, it is almost necessary to treat the declaratory judgment as merely another form of action.

Homegrown Industries in Nebraska (Dorothy Switzer and E. S. Wallace)

In July, 1965, we reprinted from the Texas Business Review an article dealing with "Homegrown Industries" in that state. At that time we expressed the hope that we might find the ingenuity of Nebraskans was at least equal to that of Texans and asked for information on similar industries in Nebraska.

Business Summary (J. Timothy Wilson)

In November, the dollar volume of business for Nebraska increased 9.0% from November, 1964, and decreased 0.4% from the previous month. The same index for the U.S. shows an 11.7% increase from November, 1964, …

Furrow Irrigation Of Nebraska Soils, Paul Fischbach, John R. Davis Jan 1966

Furrow Irrigation Of Nebraska Soils, Paul Fischbach, John R. Davis

University of Nebraska-Lincoln Extension: Historical Materials

Proper irrigation practices usually reduce irrigation costs and result in higher crop yields. These practices involve:

1. Applying the right amount of water.

2. Obtaining uniform water application over the field.

3. Applying water at the proper time.

This publication will serve as a general guide for the first two practices.

How Much Water To Apply

Applying proper amounts of water provides the best opportunity for high crop quality and yields.

The amount of water to apply at each irrigation depends on the amount of soil water used by the plants between irrigations, the water-holding capacity of the soil, and …

Nebraska Law Review

James V. Bennett, former director of the Federal Bureau of Prisons said in 1960: "[O]ne of the anomalies of our present legal folklore is the fact that the overwhelming majority of lawyers, including those who are elevated to the bench, have never seen with their own eyes how the kind of medicine they prescribe is actually administered." In light of this anomaly, three issues of the Nebraska Law Review will be devoted primarily to a discussion of post-conviction institutions and procedures. This issue contains articles from “A Symposium on Prisons and Correctional Law (Part I).”

Toward A More Enlightened Sentencing Procedure, Theodore Levin Jan 1966

Toward A More Enlightened Sentencing Procedure, Theodore Levin

Nebraska Law Review

The inequities of sentences for criminal offenders present one of the great problems in the administration of criminal justice. The impact of an individual judge's background, personality, and prejudices on the sentences which he pronounces has increasingly become a matter of legitimate public concern. Courts, in the sentencing of convicted persons, must be something other than mechanical instruments of punishment. The symbolic blindfold on the statue of Justice was never intended to obscure from the sight of the judge an understanding of the human being who stands before him awaiting judgment. The quality of sentencing must concern us no less …

Revocable Inter Vivos Trusts Versus The Statutory Share, William C. Owen Jan 1966

Revocable Inter Vivos Trusts Versus The Statutory Share, William C. Owen

Nebraska Law Review

In Nebraska, as in many other states, a person, during his lifetime, may dispose of personal property either by gift or otherwise so as to completely vitiate the statutory share of a surviving spouse. One method employed by donors in attempting to effect inter vivos transfers of property is the so-called living revocable trust. This method is particularly attractive to the settlor since he not only enjoys a power of revocation but may also reserve a life interest in the income arising from the investment of the trust res. While most courts agree that such a trust is a …

Staff And Client Participation: A New Approach To Correctional Research, J. Douglas Grant, Joan Grant Jan 1966

Staff And Client Participation: A New Approach To Correctional Research, J. Douglas Grant, Joan Grant

Nebraska Law Review

Research in corrections is no longer something done sporadically. Professional research staffs are now permanent parts of most major correctional organizations and correctional research has become routinized. A good deal of this change can be attributed to the demands of state legislators and other budget-controlling bodies for evidence of payoff in the programs they are asked to support. There are three crucial questions concerning this expansion: (1) Where is the manpower coming from? Who will do the innovating, data collecting, evaluating, and monitoring necessary for effective research? (2) Who will determine what program innovations should be studied? and (3) How …

The Federal Work Release Program, Lawrence A. Carpenter Jan 1966

The Federal Work Release Program, Lawrence A. Carpenter

Nebraska Law Review

The Prisoner Rehabilitation Act of 1965 authorized furloughs, a system of work release, and the use of community residential treatment centers for adult federal prisoners. The act and its implications are producing great changes in correctional work. All through the federal prison system, educational and vocational training programs are being restudied and geared to meet actual community employment opportunities and the actual capacities of prisoners. The basic missions of institutions are being reevaluated and in some instances changed. The new programs are also bringing about significant alterations in personnel recruitment and development programs, organizational patterns, and budgetary planning. The walls …

Constitutional Law—Bill Of Attainder—Section 504 Of The Landrum-Griffin Act Held: Unconstitutional—United States V. Brown, 381 U.S. 437 (1965), Mark F. Anderson

Nebraska Law Review

A bill of attainder is a legislative act which inflicts punishment without a judicial trial upon named individuals or those of an easily ascertainable class. The present case applies this definition to a legislative act which specifically designates Communists as individuals unfit to hold union office and punishes them by forcing them to choose between loss of their union position and criminal sanctions. A bill of attainder necessarily denies the victim due process of law. But the bill of attainder clause is in the Constitution for the specific purpose of insuring that no one is tried and convicted by the …

The National Collegiate Honors Council held its first annual meeting on the campus of the University of Kansas, October 22-24, 1966. The proceedings of that meeting are contained in this volume. This new association is a response to the expressed desire of many hundreds of educators throughout the country that, when the Inter-University Committee on the Superior Student (ICSS) was terminated in 1965, a national organization of individuals as well as institutions be formed. The new organization would carry on some of the functions of ICSS but would be free also to develop in ways appropriate to the present status …

Changes In Fungi With Age I. Chemical Composition Of Rhizoctonia Solani And Sclerotium Bataticola , David Gottlieb, James L. Van Etten

Department of Plant Pathology: Faculty Publications

The chemical composition of the mycelium of Rhizoctonia solani and Sclerotium bataticola was determined in cells of various ages. The percentage, per unit of dry weight, of soluble amino nitrogen, deoxyribonucleic acid (DNA), ribonucleic acid (RNA), ergosterol, and protein decreased with age in both fungi. Total lipids and fatty acids increased with age in S. bataticola but remained constant in R. solani. Total carbohydrate increased with age in R. solani and decreased in S. bataticola. Fewer changes with age were observed when the results were calculated in ratio to DNA. There was no change in the ratios of protein, …

Chromogen-Ratio Method For Determining Digestibility Of Plants By Grasshoppers, E. A. Heinrichs, K. P. Pruess Jan 1966

Chromogen-Ratio Method For Determining Digestibility Of Plants By Grasshoppers, E. A. Heinrichs, K. P. Pruess

Department of Entomology: Faculty Publications

The concentration of plant pigments in excreta vs. food provided a measure of digestibility of most plants by grasshoppers. Digestibility values obtained with the chromogen-ratio method and consumption-excretion ratios were highly correlated (r = 0.789**). Greatly disparate results were obtained in 4 cases. The chromogen method, when applicable, gave better duplicability and eliminated many of the errors and much labor associated with consumption-excretion ratios.

Observation Of Doppler-Shifted Peaks In The Energy Spectrum Of Autoionizatioin Electrons From Ar+ -Ar Collisions, M. Eugene Rudd, T. Jorgensen, Jr., D. J. Volz Jan 1966

Observation Of Doppler-Shifted Peaks In The Energy Spectrum Of Autoionizatioin Electrons From Ar+ -Ar Collisions, M. Eugene Rudd, T. Jorgensen, Jr., D. J. Volz

M. Eugene Rudd Publications

It is well known that when heavy ions traverse gas, electron pickup into excited states occurs. If the fast excited atom subsequently decays by radiating a photon, the energy of the photon will be Doppler shifted due to the motion of the source. This effect may be used to distinguish the radiation from stationary and moving atoms. For example, this method was used by Meinel to deduce the motion of solar protons streaming downward through the earth's atmosphere.
If instead the moving atom decays by autoionization, the ejected electron should also show a shift in energy analogous to the Doppler …
