Life Insurance Funding Of Stock Purchase Agreements, Arthur J. Wojta Jan 1969

Life Insurance Funding Of Stock Purchase Agreements, Arthur J. Wojta

Nebraska Law Review

The insurance funded stock purchase agreement is often a vital part of any plan for continued business success. It also can be an essential part of a family's estate plan. The shareholders usually agree that death is a major uncertainty, and that they intend to remain active in the business as long as possible. Funding the purchase agreement is almost a necessity and life insurance admirably takes care of the major uncertainty, the premature death. Properly arranged, the insurance funded stock purchase agreement adds planning certainty where none previously existed.

Nebraska Supreme Court Review, James A. Beltzer, Roger M. Beverage, Thomas R. Pansing, John A. Rasmussen Jr.

Nebraska Law Review

The Nebraska Law Review is pleased to introduce in this issue a section devoted exclusively to recent decisions of the Nebraska Supreme Court. This section, to be published on an annual basis, will contain a critical discussion of recent decisions which the Nebraska Law Review believes are either cases of first impression in our court or rulings which substantially alter previous case law in Nebraska. The purpose of the Nebraska section is (1) to provide attorneys in Nebraska and elsewhere with a comprehensive study of the holdings of selected cases and an analysis of how these decisions relate to previous …

Review De Novo In Alimony And Property Settlement: Is It Desirable?, William L. Mccown Jan 1969

Review De Novo In Alimony And Property Settlement: Is It Desirable?, William L. Mccown

Nebraska Law Review

This Comment attempts to analyze the practical effects of review de novo in one category of divorce cases: those involving alimony and property settlement. To accomplish this task, it is necessary to examine Nebraska's substantive rules for determining alimony and rendering property settlements, which is followed by an exploration of the historical basis for review de novo, with particular attention to its development in Nebraska. There is then an analysis of review de novo in alimony and property settlement cases, and some of the issues are discussed. Finally, some procedural recommendations are posited with the goal of improving appellate review …

Nebraska Jails: Cure Or Cause?, David R. Parker Jan 1969

Nebraska Jails: Cure Or Cause?, David R. Parker

Nebraska Law Review

An inquiry into Nebraska's jails is warranted and long overdue. To analyze the jail systems in the state, it is necessary to study the legal basis of the jail system as contained in the laws, how that system operates today, what about the system gives rise to concern, and what can be done to improve the system. Throughout the analysis, a comparison to national statistics is meaningful to determine if the comments and recommendations of national and federal authorities are relevant in Nebraska.

I. Statutory Provisions

II. Survey of Status

III. Areas of Concern

IV. Recommendations … 1. Proper use …

Gaseous Exchange In Crop Stands, Edgar Lemon Jan 1969

Gaseous Exchange In Crop Stands, Edgar Lemon

Department of Agronomy and Horticulture: Faculty Publications

Man through the ages has evolved a strategy, albeit empirical, of manipulating the environment and the plant to his advantage. Practices such as fertilizing the soil, irrigation, weed control, and plant breeding and selection are common. Nonetheless, concentrated and coordinated efforts to understand the mechanisms controlling the whole soil-plant- atmosphere continuum is a new approach to finding new ways to favorably manipulate the whole system as well as predict response.
Conceptually and experimentally it has proven advantageous to view the total system in terms of energy, momentum, and mass exchange. This makes sense because in the first instance the foundations …

Plant Morphology And Stand Geometry In Relation To Nitrogen, Robert F. Chandler Jr. Jan 1969

Plant Morphology And Stand Geometry In Relation To Nitrogen, Robert F. Chandler Jr.

Department of Agronomy and Horticulture: Faculty Publications

During the past decade, the importance of plant morphology and spacing in relation to nitrogen responsiveness in terms of crop yield has been increasingly recognized, particularly in the case of the cereal grains.
It is the purpose of this paper to present examples of experimental results obtained by rice research workers which support certain significant principles. Although this treatise will be confined to the rice plant (Oryza sativa L.),as Wittwer (1968) points out, the principles elucidated are applicable to many other crops, and particularly to the small grains, such as wheat (Triticum aestivum L.), oats (Avena sativa …

Physiological Responses To Nitrogen In Plants, Yoshio Murata Jan 1969

Physiological Responses To Nitrogen In Plants, Yoshio Murata

Department of Agronomy and Horticulture: Faculty Publications

Recent advances in crop physiology have given us some clues for analysis of the complex relationships of environmental factors, cultural conditions and genetic factors to crop yield. However, in order to accomplish this analysis, it is quite necessary to have concrete knowledge about the causal relationships and the time sequence of the processes of yield-formation.
In grain crops, the process of yield-formation may be divided into the following three phases:
1) Formation of organs for nutrient absorption and photosynthesis,
2) Formation of flower organs and "yield-container," and
3) Production, accumulation and translocation of "yield-contents."
The effect of nitrogen, which has …

Interrelationships Among Photosynthesis, Respiration, And Movement Of Carbon In Developing Crops, Volkmar Stoy Jan 1969

Interrelationships Among Photosynthesis, Respiration, And Movement Of Carbon In Developing Crops, Volkmar Stoy

Department of Agronomy and Horticulture: Faculty Publications

From the preceding lectures we have learned a great deal about how external conditions may influence various internal physiological processes within plants, and it therefore appears appropriate to consider briefly how these processes influence one another and also the manner in which they relate to yield. The main processes of interest in this connection are photosynthesis, respiration, and carbon assimilate translocation; but aspects of growth, development, mineral nutrition, etc., will also be considered when relevant.

Ionic Transport In Potassium Chloride, Robert Fuller, Charles L. Marquardt, Michael H. Reilly, John C. Wells Jr. Dec 1968

Ionic Transport In Potassium Chloride, Robert Fuller, Charles L. Marquardt, Michael H. Reilly, John C. Wells Jr.

Robert G. Fuller Publications

The electrical conductivity and chlorine ion diffusion in KC1 and KCl:SrC12 single crystals have been analyzed by least-squares methods, using as a model a perfect crystal perturbed by five defects: isolated anion vacancies, isolated cation vacancies, divalent cation impurities, divalent cation-impurity-cation-vacancy complexes, and vacancy pairs. The transport equations were derived from this five-defect model using a simple theory for noninteracting particles, except for the nearest-neighbor binding to form complexes and vacancy pairs, and using the same theory including long-range Coulomb interactions between the isolated defects. This latter theory yielded the better description of the experimental results. However, the analyses …

Species And Abundance Of Diurnal Raptors In The Panhandle Of Nebraska, John E. Mathisen, Ann Mathisen Dec 1968

Species And Abundance Of Diurnal Raptors In The Panhandle Of Nebraska, John E. Mathisen, Ann Mathisen

Nebraska Game and Parks Commission: Staff Research Publications

RECENT evidence of population declines for several species of raptors has been a subject of some concern both nationally and internationally. Although raptors are the most conspicuous birds in our environment, by virtue of their large size, flight habits, and food habits, little information is available to evaluate population densities and trends over large areas. Data are needed to provide yardsticks for judging population changes over time periods and among geographic areas.

This study was undertaken to provide information on the species and seasonal abundance of raptors in the panhandle of Nebraska for three years (1957 through 1959). Ten years …

Mourning Dove Status Report, 1967, James L. Ruos, Duncan Mcdonald Dec 1968

Mourning Dove Status Report, 1967, James L. Ruos, Duncan Mcdonald

United States Fish and Wildlife Service: Publications

Nationwide dove population indexes in the 1967 Mourning Dove Status Report were obtained by essentially the same data gathering and analyzing procedures as in 1966. A refinement was made in the base year index, using the mean of the 1966 and 1967 readings as the base for all States. There was a slight adjustment in physiographic region boundaries.

Energy Deposition By Electron Beams And Δ Rays, E. J. Kobetich, Robert Katz Dec 1968

Energy Deposition By Electron Beams And Δ Rays, E. J. Kobetich, Robert Katz

Robert Katz Publications

The product of two empirical relations, for the practical range and the transmission probability of normally incident electrons through plane sheets of matter, may be differentiated to yield a simple formulation of the energy deposition by electron beams, in agreement with more complex formulations and with experimental data. When combined with the δ-ray distribution formula, these results provide a theory of the spatial distribution of ionization energy about the path of a rapidly moving ion, which is basic to theories of radiation damage and detection.

Application Of The Method Of Lattice Statics To Interstitial Cu Atoms In Cu, John Flocken, John Hardy Nov 1968

Application Of The Method Of Lattice Statics To Interstitial Cu Atoms In Cu, John Flocken, John Hardy

John R. Hardy Papers

We have calculated the lattice distortion produced by a body-centered interstitial Cu atom in a Cu host lattice. The calculations have been carried out consistently on the basis of discrete lattice theory, using the technique of lattice statics which is based on the Fourier transformation of the direct-space equilibrium equations. The force constants for the perfect lattice have been taken from measured phonon-dispersion curves, and we have used Huntington's Born-Mayer potential to describe the interaction between the interstitial atom and the atoms of the host lattice. The comparison of our results with those obtained by earlier workers, using semidiscrete matching …

Protein Synthesis During Fungal Spore Germination Ii. Aminoacyl-Soluble Ribonucleic Acid Synthetase Activities During Germination Of Botryodiplodia Theobromae Spores, James L. Van Etten, Robert Brambl Oct 1968

Protein Synthesis During Fungal Spore Germination Ii. Aminoacyl-Soluble Ribonucleic Acid Synthetase Activities During Germination Of Botryodiplodia Theobromae Spores, James L. Van Etten, Robert Brambl

Department of Plant Pathology: Faculty Publications

The specific activities of 13 aminoacyl-soluble ribonucleic acid (sRNA) synthetases were measured at various time intervals during the germination of Botryodiplodia theobromae conidiospores. The enzyme activities were low or absent in ungerminated spores, and they increased rapidly as germination proceeded. When extracts of the ungerminated spores were prepared with mortar and pestle, very little or no enzyme activity was detected. When the extracts were prepared with a mechanical homogenizer, however, they exhibited some enzyme activity, although less than did the extracts from germinated spores. Enzyme activities from germinated spores were approximately the same, regardless of the method of preparation. The …

Basic Statement On Migratory Bird Treaty, E. M. Bosak Sep 1968

Basic Statement On Migratory Bird Treaty, E. M. Bosak

Bird Control Seminars Proceedings

My portion of the program is the basic statement on the Migratory Bird Treaty Act regulations. Basically, laws are designed to control the actions of human beings. J. Edgar Hoover recently stated, "Man cannot live in our complex society today without a system of laws. The social system is doomed unless the laws are enforced, and the enforcement officer is ineffective unless his efforts to maintain the peace and protect life and property are supported by the government and the people." Therefore, it behooves each one of us to be aware of those laws that affect us in our everyday …

Bird Control Under A State Fish And Game Permit System, James Shepard Sep 1968

Bird Control Under A State Fish And Game Permit System, James Shepard

Bird Control Seminars Proceedings

I guess the impetus for laws in our state, really was the action of the city of Boston in 1963, when the Parks and Recreation Department felt that it was time to do something about massive populations of pigeons on the Boston Commons and in the city. The Parks Department came to our agency to find out what could be done. We immediately found as a result of a reorganization and recodification of the laws some 20 years before, that it was illegal to use or apply poisons for the purpose of killing any birds or mammals in the Commonwealth …

Use Of Strychnine Treated Grain For Industrial Pigeon Control, Joseph Watkins Sep 1968

Use Of Strychnine Treated Grain For Industrial Pigeon Control, Joseph Watkins

Bird Control Seminars Proceedings

The pest bird involved in nearly 100% of our jobs has been the pigeon. We don't do killing in residential areas, nor have we done killing in downtown areas. All of our work has been confined to industrial plants and commercial buildings where strychnine, and we have used other methods that can kill the birds. In these plants we have had some problems with industrial or labor re-lations. These have been coped with by working with the union, with the labor relation people, and as high up as purchasing level. First of all we think that with strychnine if we …

Costs Of New Materials: The Manufacturer's Dilemma, Dan Macdougall Sep 1968

Costs Of New Materials: The Manufacturer's Dilemma, Dan Macdougall

Bird Control Seminars Proceedings

I thought it was possible that some of you might not be acquainted with some of the frustrations which are involved in jousting with the bureaucracy in Washington. So I thought I would review that situation very briefly for you, particularly in regard to the compound Queletox. We will confess that we had some real qualms about accepting this material for control as a bird toxicant initially. And the reasons we were concerned about this were because the compound was being used in other areas as an agricultural chemical. It was registered for mosquito control, and it was being used …

Bait And Bait Materials, Fred R. Courtsal Sep 1968

Bait And Bait Materials, Fred R. Courtsal

Bird Control Seminars Proceedings

I'm going to speak about bird baits that are produced by the rodent-control fund. In my estimation, there are about six criteria for mixing good, high quality bait materials. The first one would be a toxicant. This is the first thing people talk or think about. I would assume that you would select a toxicant that has the quality to do the intended job. The second point is the sticker. So our criteria for a sticker are as follows: good adhering qualities, good spreading qualities (by this I mean if you introduce the toxicant into a sticker as is often …

To Kill Or Not To Kill : That Is The Question, John R. Beck, William J. Spitz Sep 1968

To Kill Or Not To Kill : That Is The Question, John R. Beck, William J. Spitz

Bird Control Seminars Proceedings

In talking with the panel that has agreed to be with you this morning, we find that almost to a man they feel very strongly there is no "it" in bird control, that a good applicator needs to be well balanced and well rounded, that he needs to know, far more than one approach, that he needs to be able to understand people, biological problems, ecology, eco-nomics, and several other factors. The idea that sometimes comes across in meetings such as this is, and rightly so in some instances, "I have the final answer." Gentlemen, there is no "it" in …

Bird Problems At Military Airports, B. W. Brink Sep 1968

Bird Problems At Military Airports, B. W. Brink

Bird Control Seminars Proceedings

I notice by the program that this was to be a progress report, new aspects of control. I'd like to narrow the scope a little bit, at least for my remarks; they will be essentially confined to activities of MAC, Military Airlift Command. There are 10 major commands in the Air Force. I'd like to reduce the word progress to lower case letters, at least; and I'd like to deemphasize the word new, for most of these things are not brand new for us. The scope of this problem is world wide, air force wide; and I'm going to confine …

Birds, Encephalitis, And Ectoparasites, Margaret A. Parsons Sep 1968

Birds, Encephalitis, And Ectoparasites, Margaret A. Parsons

Bird Control Seminars Proceedings

Encephalitis or "inflammation of the brain" is a general term applied to a disorder which may have many causes. Usually this disorder is caused by a virus but it may also be produced by other types of micro-organisms. Encephalitis may also occur after an initial infection with mumps, measles and other childhood diseases, or following a vaccination, or as a result of a non-infectious process such as poisoning. Since encephalitis affects the brain, which in turn controls all body functions, encephalitis from any cause can show symptoms of general illness throughout the body such as headache, nausea and vomiting, fever, …

Status Of Bio-Sonics In Pest Bird Control, Gordon W. Boudreau Sep 1968

Status Of Bio-Sonics In Pest Bird Control, Gordon W. Boudreau

Bird Control Seminars Proceedings

Bioacoustics is defined as the study of biologically significant sounds ori-ginated by animals, and the mechanisms which produce and receive these sounds. Many of these sounds are audible to the human ear but some are above the human hearing range and fall into the ultrasonics class. There are sounds used by animals which are near or below the normal human hearing range in pitch, as in certain fish. Bioacoustics comprises a broad field of investigation and is an area which has only recently been explored. Improvements in electronic audio equipment have provided the impetus which launched recent bioacoustical investigations and …

Daily And Seasonal Susceptibility Cycles Of The Starling, Robert G. Schwab Sep 1968

Daily And Seasonal Susceptibility Cycles Of The Starling, Robert G. Schwab

Bird Control Seminars Proceedings

I would like to review a few of the characteristics of 3-chloro-p-toluidine hydrochloride (DRC-1339) prior to discussion on the daily and seasonal suscep-tibility of starlings to this avicide. DRC-1339 was screened and developed by the Denver Research Center (U.S.D.I.) and since has been tested in various portions of the country by the Denver Center and other organizations, including the State of California. In California we are much impressed with this compound for a variety of reasons, particularly the specificity of it to birds, ease in handling, ease in formulation, and many other characteristics which make this a highly desirable avicide. …
