Constitutional Law—Due Process And Abortion: United States V. Vuitch, 402 U.S. 62 (1971), John Wagner
Nebraska Law Review
Milan Vuitch, a licensed physician, was charged in the United States District Court for the District of Columbia with producing and attempting to produce abortions in violation of the District of Columbia abortion statute. Before trial Vuitch made a motion to dismiss the indictment on the ground that the abortion law was unconstitutionally vague. District Judge Gesell granted Vuitch's motion and dismissed the indictment because the abortion law failed to "give that certainty which due process of law considers essential in a criminal statute. " The United States immediately appealed to the United States Supreme Court, asserting jurisdiction under the …
Constitutional Law—Sodomy Statutes: The Question Of Constitutionality: Buchanan V. Batchelor, 308 F. Supp. 729 (N.D. Tex. 1970), John F. Simmons
Constitutional Law—Sodomy Statutes: The Question Of Constitutionality: Buchanan V. Batchelor, 308 F. Supp. 729 (N.D. Tex. 1970), John F. Simmons
Nebraska Law Review
Although the winds of change have created some ripples, the ancient crime of sodomy remains on the books in Nebraska and forty-six other states despite repeated attacks by commentators and renunciation by the Model Penal Code. Reinforced by Scripture and public sensibilities, sodomy statutes resisted constitutional attack until 1969, when the United States District Court for the Northern District of Texas in the case of Buchanan v. Batchelor found the Texas sodomy statute, essentially similar to those of almost all other jurisdictions, unconstitutional, and enjoined its enforcement.

The New Case For Private Annuities, M. H. Weinberg
The New Case For Private Annuities, M. H. Weinberg
Nebraska Law Review
With the promulgation of Rev. Rul. 69-74, many of the advantages of a private annuity were curtailed because of the holdings that (1) capital gain was recognized on the transaction before the recoupment of basis, and (2) the investment in the contract was limited to the adjusted basis of the appreciated property contributed, thus reducing the lifetime exclusion ratio. Because of these disadvantages and the fact that the three and one-half percent annuity tables were so outdated, many estate planners have felt that the private annuity lost some of its lustre. However, in the Federal Register for July 3, 1970, …

The 1967 Nebraska Legislature directed the Nebraska Soil and Water Conservation Commission to "plan, develop, and encourage the implementing of a comprehensive program of resource development, conservation, and utilization for the soil and water resources of this state." The 1967 legislature also unanimously endorsed Legislative Resolution No. 5 which requires the development of a State Water Plan by the Soil and Water Conservation Commission. The Resolution specifically states that "this State Water Plan, in addition to an evaluation of the land and water resources, will also include an examination of legal, social and economic factors which are associated with resources …

In the midst of the recent widespread and justifiable criticism of the legal system, the lawyer's reputation has undoubtedly suffered. Much of this criticism should not be placed on the legal profession. Society has refused to accept the burden of maintaining an efficient system of justice and the consequent inadequate law enforcement agencies, overcrowded court dockets, and outdated penal institutions are too notorious to require citation. The attorney needs the cooperation of the public.

One Man–One Vote And Judicial Selection, Denis R. Malm
Nebraska Law Review
By legislative enactment, the 1969 Nebraska Legislature created the Nebraska Constitutional Revision Commission, effective May 26, 1969. As an outgrowth of this legislation, the commission comprehensively reviewed the Constitution of Nebraska and presented its suggestions and recommendations for revision of the constitution in a report dated September 24, 1970. Substantial changes were made in Article V, the judicial article. The fourth recommended revision deals with the redistricting of judicial districts through the provisions of Article V, section 5. This Comment examines the redistricting provisions of Article V, section 5 in light of the constitutional requirements for equality in voting, and …

Due Process Restriction On The Employment Power And The Teaching Profession, Gary L. Dolan
Due Process Restriction On The Employment Power And The Teaching Profession, Gary L. Dolan
Nebraska Law Review
Judicial thinking has developed to the position that if a teacher is able to allege that a specific constitutional right such as freedom of speech, freedom of religion, or the right to equal protection has been violated, then redress is available. If the court agrees that action of the state infringes upon such a right, its attention then turns to the issue of procedural due process; that is, in the face of the competing interests involved, did the actions of the state comport with what the courts have defined as due process? This procedural due process may include such things …

Fraudulent Direct Sales Schemes In The Home Improvement Industry Under Nebraska Law, Richard Wegener
Fraudulent Direct Sales Schemes In The Home Improvement Industry Under Nebraska Law, Richard Wegener
Nebraska Law Review
Nebraska has recently been confronted with two cases involving deceptive sales practices in a classic direct selling context. In Central Construction Co. v. Osbahr and Dembowski v. Central Construction Co., the Nebraska Supreme Court came to seemingly conflicting conclusions in two cases that presented strikingly similar factual situations involving deceptive direct sales practices. The purpose of the following analysis is to outline prior Nebraska law in this area, to investigate the present status of Nebraska law in this area, and to compare the decisions against the backdrop of the Federal Trade Commission Act, the Nebraska Uniform Deceptive Trade Practices …

Franchise Full Disclosure, Terry D. Sattler
Franchise Full Disclosure, Terry D. Sattler
Nebraska Law Review
Although there is no "typical" franchise contract, the franchise purchaser, or franchisee, is usually required to pay a fee for the privilege of opening a franchise outlet, and must then rely upon the franchise seller, the franchisor, to provide guidance and support in the operation of the enterprise. If the venture fails, the franchisee may lose his entire investment. In the past, there have been attempts to regulate substantive provisions of franchise agreements in order to reduce the instances of investment loss by franchisees. The focus of recent concern over franchising practices has not involved the objection to particular contract …

Cheating As A Function Of The Labeling Of Natural Arousal, Richard A. Dienstbier, Pamela Osbourne Hunter
Cheating As A Function Of The Labeling Of Natural Arousal, Richard A. Dienstbier, Pamela Osbourne Hunter
Department of Psychology: Faculty Publications
One hundred and five college freshmen were given one of two different side-effects lists associated with a placebo pill. In a “second” experiment, subjects experienced failure on a vocabulary test, supposedly predictive of college success, and received an opportunity to cheat on the test by changing answers. Although it was anticipated that all subjects who considered cheating would experience some arousal, it was predicted that those subjects told to expect drug-induced side effects related to sympathetic arousal would not label their experienced arousal as fear or guilt, and would cheat more than the subjects who anticipated benign side effects. Of …
The Effect Of Stimulus Element Redundancy On Speed Of Discrimination As A Function Of State And Process Limitation, John H. Flowers, W. R. Garner
The Effect Of Stimulus Element Redundancy On Speed Of Discrimination As A Function Of State And Process Limitation, John H. Flowers, W. R. Garner
Department of Psychology: Faculty Publications
The effect of spatially repeated stimulus elements on the speed of discrimination, measured in a sorting task, was determined under conditions of low stimulus visibility (state limitation) and high stimulus similarity (process limitation). A significant increase in speed of sorting stimuli was found when the stimuli were state limited but not when process limited, even though base speeds were the same in both cases. It is concluded that element redundancy will improve discrimination performance only when the need for the improvement is a state limitation.
