Ethical Problems In Probate Matters, Hale Mccown Jan 1960

Ethical Problems In Probate Matters, Hale Mccown

Nebraska Law Review

Ethical standards are in general rigorously observed by the legal profession when they are known and recognized. In far too many instances, however, attorneys fail to recognize an ethical problem in the midst of the technical legal problems with which they are dealing. Probably in no field of practice are there more everyday problems of ethics than in the field of probate. Since a large percentage of probate matters are thought of as nonadversary proceedings, conflicts of interest many times pass unrecognized. This article is limited to a brief consideration of a few of the ethical problems more frequently encountered …

Silence And Perjury Before Police Officers: An Examination Of The Criminal Law Risks, Dale W. Broeder Jan 1960

Silence And Perjury Before Police Officers: An Examination Of The Criminal Law Risks, Dale W. Broeder

Nebraska Law Review

The purpose of this article is to review and to synthesize those areas of the law bearing on the nature and extent of the citizen's modern-day responsibilities to inform on the criminal activities of others and to discuss the criminal law risks involved in lying to police officers during the course of their investigations of crime. Policy considerations, of course, are also advanced. These subjects, it is realized, constitute only a portion, and that a comparatively small one, of the broad area of the extent of the citizen's duty to cooperate with police officers, but, it is hoped, a sufficiently …

New Rules Of Practice And Procedure Before The Nebraska Railway Commission, Samuel Van Pelt Jan 1960

New Rules Of Practice And Procedure Before The Nebraska Railway Commission, Samuel Van Pelt

Nebraska Law Review

During the past twelve years, several articles in this Review have discussed practice and procedure before the Nebraska State Railway Commission by surveying the procedural framework and organization of the Commission, by analyzing the Rules of Practice and Procedure adopted in 1950, and by presenting and solving some of the specific problems facing an attorney in preparing and presenting his case before the Commission. Since this topic was last presented, however, significant statutory additions, revisions of the Commission's rules of practice, and Supreme Court opinions have altered procedure before the Commission. The 1959 Session of the Legislature passed L.B. 362, …

Studies On The Helminth Fauna Of Alaska. Xxxiv. The Parasites Of Wolves, Canis Lupus L., Robert L. Rausch, Francis Williamson

Harold W. Manter Laboratory of Parasitology: Faculty Publications

It is generally recognized that canine animals comprise an important reservoir of parasites and diseases transmissible to man. These animals, including the domestic dog, have unusual economic importance in arctic and subarctic North America, particularly for the Eskimos and Indians living in more remote regions. These aboriginal peoples continually have close association with canine animals and would appear to be quite vulnerable to infection from this source. That this is true is already evident, although data on morbidity from animal-borne diseases are far from complete. At the present time, at least in Alaska, these people have little ability to lessen …

Geology Of The Upper Middle Creek Area Huerfano County, Colorado, J. H. Copeland May 1959

Geology Of The Upper Middle Creek Area Huerfano County, Colorado, J. H. Copeland

Open Access Master's Theses (through 2010)

The Sangre de Cristo Mountains of Colorado and New Mexico are, geologically speaking, relatively unknown. The equivocal nature of our knowledge of the range was a primary reason for studying a portion of it in some detail. Most of the previous studies have been concerned with the northern part of the range in Colorado, in the general area between Salida and La Veta Pass. This work has indicated that the complicated structure which characterizes the northern part of the range becomes simpler to the south. Therefore, a second objective of the current study has been to test this hypothesis. Thirdly, …

Fm 5-30, Engineer Intelligence, May 1959, Robert Bolin , Depositor

United States Department of Defense Military Intelligence

When this manual was issued, military intelligence in the US armed forces was highly decentralized. A number of organizations within the Army Corps of Engineers were responsible for producing engineer intelligence for US forces in the field and strategic engineer intelligence for use by the Department of Defense and US armed forces.

This detailed manual defines the engineer intelligence at length. It explains the role of the Corps of Engineers in the United States and of engineer elements within US forces in the field.

It explains the intelligence process, the planning and direction of collection efforts, the collection of information, …

Torts—Automobile Accident As A Transaction Within The Meaning Of The Dead Man Statute, John F. Haessler

Nebraska Law Review

The subject case, Fincham v. Mueller (166 Neb. 376, 89 N.W.2d 137 [1958]), involves an action for personal injuries resulting from a two-car collision at a country road intersection in which Mueller, driver of one of the cars, was killed. The driver of the other car, Fincham Sr., brought the action against the decedent’s estate as father and next friend of his eight-year-old son, Fincham Jr., who was riding with him as his guest. There were no eyewitnesses to the accident. At the trial, Fincham Sr. was allowed to testify as to his own vehicle and his operation thereof but …

Constitutional Law—Intra-State Produced And Consumed Wheat Under The Commerce Clause, Roger A. Langenheim Jan 1959

Constitutional Law—Intra-State Produced And Consumed Wheat Under The Commerce Clause, Roger A. Langenheim

Nebraska Law Review

The defendant, who operates a farm in Oklahoma, was notified by the County Committee authorized to administer marketing quotas for wheat under the provisions of the Agricultural Adjustment Act of 1938 that his farm wheat acreage allotment for 1956 was 0 acres, that his excess acreage of wheat was 43 acres, and that his farm marketing excess—upon which a civil penalty applies—was 473 bushels. Following defendant’s refusal to pay the penalty of $506.11 thus incurred, the United States brought action to recover this penalty. Defendant alleged, by way of affirmative defenses, that the Agricultural Adjustment Act of 1938 is unconstitutional …

Insurance—Company Liability For Wrongful Death When Insured Murdered By Purchaser With No Insurable Interest, Richard E. Petrie Jan 1959

Insurance—Company Liability For Wrongful Death When Insured Murdered By Purchaser With No Insurable Interest, Richard E. Petrie

Nebraska Law Review

Three insurance companies negligently issued policies on the life of a two-year-old child to an aunt-in-law having no insurable interest in the child’s life. A few months later, the aunt murdered the child. Plaintiff, the child’s father, recovered a $75,000 judgment against the insurance companies for his child’s wrongful death. Held: Judgment affirmed. The central reason for refusing to recognize insurance contracts where the beneficiary has no insurable interest is that such contracts provide a motive for murder. Hence an insurance company must use reasonable care not to issue a life insurance policy to one with no insurable interest and …

Influence Of Spectral Composition Of Light On Cis-Trans Interconversion Of O- Hydroxycinnamic Acid, Francis A. Haskins, H. J. Gorz Jan 1959

Influence Of Spectral Composition Of Light On Cis-Trans Interconversion Of O- Hydroxycinnamic Acid, Francis A. Haskins, H. J. Gorz

Department of Agronomy and Horticulture: Faculty Publications

In a recent report (1) from this laboratory, an improved fluorometric assay for coumarin in sweetclover is described. Briefly, the method consists of opening the lactone ring of coumarin by treatment with alkali, after which the resulting non-fluorescent cis-o-hydroxycinnamic acid is partially converted, by means of ultraviolet irradiation, to the fluorescent trans isomer. Measurements of fluorescence are then made. In the interval between ultraviolet treatment and measurement of fluorescence, the solutions to be assayed must be protected from the usual light of the laboratory, since exposure to such light results in loss of fluorescence, indicating a reconversion of some of …

Csr 381-1, Military Intelligence, Technical Intelligence Relationships, 12 November 1958., Us Army Chief Of Staff, Robert Bolin , Depositor

United States Department of Defense Military Intelligence

This document was issued by the Chief of Staff to prescribe relationships between different officers in the Army staff. Specifically, it was inteded to “prescribe relationships between the Assistant Chief of Staff for Intelligence (ACSI), the Deputy Chief of Staff for Logistics (DCSLOG), and the technical Services in the field of intelligence activities.”

It was published as part of an attempt to solve an ongoing organizational problem: how to coordinate the intelligence activities of the US government.

In the 1950s, military intelligence was decentralized. There was no national-level military intelligence agency. In theory, the Chief of Staff and the army …

Prelude To Democracy: A Study Of Proportional Representation And The Heritage Of Weimar Germany, 1871-1920, Donald J. Ziegler Oct 1958

Prelude To Democracy: A Study Of Proportional Representation And The Heritage Of Weimar Germany, 1871-1920, Donald J. Ziegler

University Studies (University of Nebraska) (1888–1984)

Surprisingly little has been written in critical analysis of German election systems. Herman Finer, Sigmund Neumann, and Carl Friedrich, among others, have dealt for the most part with political parties. James Pollock has written descriptions of election machinery and procedures. Ferdinand Hermens has produced the standard work on proportional representation, one confined in the section on Germany to its alleged role in the disintegration and collapse of the Weimar Republic. With the recent exception of Eugene Anderson's excellent analysis of Prussian politics, however, treatments of election systems have been for the most part unrelated to the context of German society …

Engineer Intelligence Guide 15, Collection Of Information On Coasts And Beaches, 1958, Robert Bolin , Depositor

United States Department of Defense Military Intelligence

In 1958, geographic intelligence in the US Armed Forces was decentralized. US Army Corps of Engineers was primarily responsible for creation of military intelligence concerning the surface of the earth excluding the oceans and seas for the armed forces of the United States. The Beach Erosion Board, originally an agency performing civil functions, had been preparing coast and beach intelligence since early in World War II. Engineer intelligence guides were issued to provide guidance concerning collection, processing, production, and dissemination of geographic intelligence to elements of the Corps of Engineers.

This Engineer Intelligence Guide contains a definition of Coast and …

Fm 3-130, U.S. Army Chemical, Biological And Radiological (Cbr) Intelligence, 1958, Robert Bolin , Depositor

United States Department of Defense Military Intelligence

An appropriate alternative title for this manual would be “Chemical Corps Intelligence.” When this manual was issued the Chemical Corps was a bureau in the Headquarters, Department of the Army, headed by a general officer called the Chief Chemical Officer (CCO), as well as a branch of the army to which officers and enlisted men were appointed. Among the duties of the CCO were the development and supply of chemical, biological, and radiological (CBR) weapons and equipment, the training of chemical units for service in the field, management of the careers of officers in the Chemical Corps branch, and the …

The Occurrence And Distribution Of Birds On Middleton Island, Alaska, Robert L. Rausch Jul 1958

The Occurrence And Distribution Of Birds On Middleton Island, Alaska, Robert L. Rausch

Harold W. Manter Laboratory of Parasitology: Faculty Publications

A survey of the birds of Middleton Island was made in June 1956. Forty-five species of birds were recorded. Of these, at least 16 species were breeding, four other species were possibly breeding, and 2.5 species were regarded as transients. The distribution of the breeding birds was correlated with six major ecological formations. Five of the latter were based on vegetational characteristics, while the rocky cliffs comprised the sixth.

The avian fauna of Middleton Island consists mainly of species found in the Prince William Sound region, to the north. An important exception was the Lapland Longspur, which previously has not …

The New Critics And The Language Of Poetry, C.E. Pulos Mar 1958

The New Critics And The Language Of Poetry, C.E. Pulos

University Studies (University of Nebraska) (1888–1984)

One of the most remarkable phenomena in the literary world of the present century has been the revolution in taste accomplished by what has come to be known as "the new criticism." While 1. A. Richards is sometimes looked upon as the founder of this movement, I purpose to show that the imagists were its real founders. The imagists and the school of Richards may, of course, be treated as separate schools. But they may also be regarded, as I propose to regard them, as different phases of the same basic movement.

To include the imagists under the new criticism …

Satire And Symbolism In Bleak House, Louis Crompton Jan 1958

Satire And Symbolism In Bleak House, Louis Crompton

Department of English: Faculty Publications

In Dicken’s Bleak House the nineteenth-century social order is portrayed with a power and vividness elsewhere unmatched in English fiction. Decaying slums with their filthy tenants, a sedately proud but hopelessly outmoded aristocracy, lawyers and clients lost in a fog of legal obfuscation, a confused and silly parliament engaged in a perpetual game of musical chairs; the magnitude of these symptoms of social distress is impressive, and equaled only by the completeness of the failure of those in power to deal with them. Whatever the dramatic weaknesses and confusions of the book, this satirical image of society is communicated to …

Physics, Chapter 35: Electronics, Henry Semat, Robert Katz

Robert Katz Publications

The electrons of an atom occupy certain energy levels when the atom is far from other atoms. When a large number of atoms are assembled to form a conducting metallic solid, the energy levels of the valence electrons are displaced in position to form a conduction band, as discussed in Section 28-4. The valence electrons occupy energy levels within the conduction band and are relatively free to drift from atom to atom within the metal. In accordance with a fundamental physical principle, known as the Pauli exclusion principle, only 1 electron may occupy a particular energy level. The conduction electrons …
