Increasing Consumer Opportunities For Self-Employment In Vocational Rehabilitation, University Of Montana Rural Institute
Employment
Self-employment is an important option for people with disabilities, especially for those living in rural communities where economic choice and opportunity may be more limited. Although people with disabilities are self-employed at higher rates than people without disabilities, few vocational rehabilitation (VR) consumers become self-employed partly due to lack of knowledge and barriers within VR systems. This research report explains some reasons for low rates of self-employment within the VR system, and presents the Vocational Rehabilitation Self-Employment Guide-an online resource providing guidance and tools to assist people with disabilities and VR counselors with the self-employment process. This guide was …

Readiness For Auc-Dosing Of Vancomycin In Montana Hospitals, Staci Hemmer
Readiness For Auc-Dosing Of Vancomycin In Montana Hospitals, Staci Hemmer
University Grant Program Reports
Vancomycin is an essential antibiotic for treating methicillin-resistant Staphylococcus Aureus (MRSA) infections. Vancomycin requires close monitoring because of its potential to damage the kidney.1 Evidence now supports the use of a new parameter, area-under-the-curve (AUC), to monitor vancomycin dosing and recently has become the standard-of-care.2,3,4 The preferred method for estimating AUC is with sophisticated, computer software using a Bayesian analysis. The expense of commercially available programs may be difficult to justify for hospitals with limited budgets, especially smaller hospitals that infrequently administer vancomycin to patients.

Weaponizing Copyright, Cathay Y. N. Smith
Weaponizing Copyright, Cathay Y. N. Smith
Faculty Law Review Articles
Copyright grants authors exclusive rights in their works in order to encourage creation and dissemination of socially valuable works. It permits copyright owners to assert their copyright against violations of those rights when necessary to protect their market exclusivity and economic interests. Increasingly, however, copyright is being used by individuals to achieve other objectives. This Article examines the increasingly widespread phenomenon of individuals using copyright to vindicate noncopyright interests, which this Article refers to as “weaponizing copyright.” In some cases, copyright is weaponized to silence criticism and legitimate speech. In other instances, the objective is to erase facts and make …
Explicit Instruction In Legal Education: Boon Or Spoon?, Beth A. Brennan
Explicit Instruction In Legal Education: Boon Or Spoon?, Beth A. Brennan
Faculty Law Review Articles
While legal education unquestionably hones students’ critical thinking skills, it also privileges students who are faster readers and have prior background knowledge or larger working memories. According to the prevailing mythology of law school pedagogy, students learn by struggling to find their way out of chaos. Only then is their learning deep enough to permit them to engage in critical thinking and legal reasoning. Learning theory and research suggest this type of “inquiry” learning is not an effective way to introduce novice learners to a subject. Lacking basic substantive and procedural knowledge, students’ struggles are often unproductive and dispiriting. Initial …

Public Land & Resources Law Review
The Montana Supreme Court held in 2020 that loopholes in the Montana Environmental Procedure Act ("MEPA") review process violate Montana's constitutional right to a clean and healthful environment. The holding sets a strong precedent requiring statutory protections to prevent harm to the environment before it occurs.
