Public Land & Resources Law Review

In June 2015, the Lake Fire burned through California’s San Bernardino National Forest. Three hundred miles east of the fire, six air quality monitors exceeded NAAQS in Phoenix, Arizona. Arizona’s Department of Environmental Quality petitioned the EPA to exclude those exceedances to avoid stricter regulatory burdens and the need for contingency measures. Applying the Exceptional Events Rule, the EPA permitted the petition to exclude the data therefore allowing Phoenix to successfully demonstrate attainment of the ozone NAAQS by the July 2018 deadline. Petitioners sought review of the EPA’s final decision and were denied their petition for review by the Ninth …

Public Land & Resources Law Review

The Seventh Circuit Court of Appeals will hear oral arguments on Monday, November 8, 2021, at 9:30 a.m. at Everett McKinley Dirksen Courthouse in Chicago, Illinois. This case asks whether states may assess property taxes on Indian-owned reservation fee lands that were allotted under treaty, not the General Allotment Act. The lower court held that reservation allotments which had at any time been owned by non-tribal-members could be subject to state property tax. Allotments always held by members remained exempt. While this issue is somewhat narrow, it raises broad questions about applying the well-established Indian canons of construction.

Social Isolation And Loneliness Among Rural And Urban People With Disabilities, University Of Montana Rural Institute Nov 2021

Social Isolation And Loneliness Among Rural And Urban People With Disabilities, University Of Montana Rural Institute

Social connection is the experience of interacting with and feeling connected to other people. A lack of social connections can lead to social isolation and loneliness. Social isolation is an objective measure based on a limited number of social connections. Loneliness is the perception of being isolated or feeling alone. Both social isolation and loneliness are associated with adverse physical and mental health outcomes. Researchers used data from two national surveys to understand the experiences of social isolation and loneliness among people with disabilities. Findings indicate people with disabilities report higher rates of social isolation and loneliness than people without …

“La Justicia Ambiental Es Para Ti Y Para Mí”: Translating Collective Struggles For Environmental And Energy Justice In Puerto Rico’S Jobos Bay Communities, Catalina M. De Onis

University of Montana Staff Publications

Rural, coastal communities in the Jobos Bay region of southeastern Puerto Rico confront disproportionate harms as an energy sacrifice zone. This space is constituted by imported fossil fuel dependency, economic and climate injustices, environmental racism, ecocide, US colonialism and imperialism, neoliberalism, and racial capitalism. In response, many grassroots actors mobilize against the toxic assault on their communities to push for alternatives beyond the suffocating status quo via apoyo mutuo [mutual support]. This survival work and movement building occur literally in “the outdoors” and in other intertwined multispecies environments, challenging narrow, oppressive colonial, and consumerist constructs that reduce “the outdoors” to …

Projected Impact Of Visitor Limitations In Glacier National Park, Glenna Hartman, Elena A. Bigart, Jeremy L. Sage Nov 2021

Projected Impact Of Visitor Limitations In Glacier National Park, Glenna Hartman, Elena A. Bigart, Jeremy L. Sage

Institute for Tourism and Recreation Research Publications

With consistently increasing visitor numbers in Glacier National Park (GNP), park managers are working to come up with management solutions for transportation, visitation, visitor use, trails, and access within the Going-to-the-Sun Road (GTSR) corridor during peak season. The GTSR Corridor Management Plan Environmental Assessment was developed in September, 2019. The preferred alternative included in the assessment is an adaptive management approach to address visitation levels, which includes strategies such as expanding the shuttle system, adding hiking and biking trails, and some changes to parking availability in various areas.

The objective of this study is to provide a review of various …

Recreate Responsibly: Montanans' Confidence & Perceptions When Recreating Outdoors, Carter Bermingham, Megan Schultz, Matthew Pettigrew

Institute for Tourism and Recreation Research Publications

This report is a summary of Montana residents and their self-reported level of confidence in the outdoors as well as their perception of others' abilities while recreating. In 2021, there was a collaborative effort amongst tourism partners and public land agencies to reach out to the public with an initiative designed to provide resources to residents and non-residents on how to properly behave while recreating on Montana's public lands. The Recreate Responsibly campaign aimed to provide guidelines for responsible action, incorporating such topics as aquatic invasive species, leave no trace principles, and physical distancing during the COVID-19 pandemic.
