Answering The Dam Question: Visitor Perspectives On Removing And Maintaining Dams In Wilderness, William L. Rice, Christopher A. Armatas Apr 2024

Answering The Dam Question: Visitor Perspectives On Removing And Maintaining Dams In Wilderness, William L. Rice, Christopher A. Armatas

Society and Conservation Faculty Publications

Managers of designated wilderness in the United States are challenged by the complex issue of how to address existing dams and water storage. Dams can exist in wilderness, as they are considered a special provision that can provide a variety of benefits to society; however, dams are also considered a potential threat to wilderness character. We review the issue of dams in wilderness, and then present the results from a study in the Rattlesnake Wilderness in Montana where visitor opinions around dam removal or maintenance were assessed. Our aim through this present research is to examine public agreement or disagreement …

Arizona V. Navajo Nation, Sarah K. Yarlott Feb 2024

Arizona V. Navajo Nation, Sarah K. Yarlott

Public Land & Resources Law Review

Arizona v. Navajo Nation clarified the United States’ trust duties to protect tribal water rights under the Winters doctrine and the 1868 Treaty with the Navajo. Under the Winters doctrine, Indian reservations are permanent homes that include an implicit reservation of water rights. However, Winters did not elaborate on the United States’ role in securing those rights. In Navajo Nation, the Court settled whether the United States has an implied duty under its trust obligations to take affirmative steps in securing water rights for tribes; the Court held no such implied duty exists.

Sackett V. Environmental Protection Agency, Meridian Wappett Feb 2024

Sackett V. Environmental Protection Agency, Meridian Wappett

Public Land & Resources Law Review

In 2007, the Sacketts began developing a property a few hundred feet from Priest Lake in Northern Idaho by filling their lot with gravel. The EPA determined the lot constituted a federally protected wetland under the WOTUS definition because the lot was near a ditch that fed into a creek flowing into Priest Lake, a navigable intrastate lake. The EPA halted the construction. The Sacketts sued the EPA, arguing the CWA did not apply to their property. The Supreme Court held that the CWA did not apply to the Sacketts property because the CWA only covers wetlands and streams that …

Tiktok V. Montana - State Tiktok Ban Blocked By Court Based On Foreign Affairs Preemption, Anna C. Conley Feb 2024

Tiktok V. Montana - State Tiktok Ban Blocked By Court Based On Foreign Affairs Preemption, Anna C. Conley

Faculty Journal Articles & Other Writings

This article examines the U.S. District Court for the District of Montana's decision to preliminarily enjoin enforcement of Montana’s state law banning TikTok, citing foreign affairs preemption. The court found that the law conflicted with federal authority under the Defense Production Act (DPA), intruded upon the federal domain of foreign affairs, and violated the dormant foreign commerce clause. The case, now on appeal to the Ninth Circuit, highlights the tension between state-level regulation and federal control over foreign relations, particularly in the context of national security concerns surrounding Chinese-owned technology platforms. The article explores the legal arguments presented by TikTok …

An Active Learning Activity For The Construction Of A Finite-Field Slide Rule For Undergraduate Students, Marco Abrate Feb 2024

An Active Learning Activity For The Construction Of A Finite-Field Slide Rule For Undergraduate Students, Marco Abrate

The Mathematics Enthusiast

Math manipulatives and physical math activities offer numerous benefits in the learning process in all educational levels: they provide concrete representations of abstract concepts, thus helping more students to understand them, and they are an opportunity for students to explore and test their understanding of mathematical concepts. Moreover, in active learning activities conducted with tangible objects, students are physically engaged in the lessons, and are given a fun way to practice their math skills, which contributes with retention and positive feeling.

In this article, an active teaching activity aimed at first-year college students is presented, designed to deepen the understanding …

An Analysis Of Graduate Teaching Assistants’ Noticing Skills During Calculus And Physics Tutoring Scenarios, Lindsay Borger, M. J. Camarato, Molly H. Fisher Feb 2024

An Analysis Of Graduate Teaching Assistants’ Noticing Skills During Calculus And Physics Tutoring Scenarios, Lindsay Borger, M. J. Camarato, Molly H. Fisher

The Mathematics Enthusiast

Professional noticing of mathematical thinking, as defined by Jacobs, Lamb, and Philipp (2010) can be broken down into three components: attending to relevant cues, interpreting the mathematical understanding, and deciding the next best instructional steps. Most research on this topic has been conducted with elementary children. However, there is a gap in the research on professional noticing at more advanced levels, particularly college students. The purpose of this study was to take the concept of professional noticing and apply it to mathematics education at the post-secondary level. Specifically, the question we sought to answer in this study was: To what …

Displaying Gifted Students’ Mathematical Reasoning During Problem Solving: Challenges And Possibilities, Attila Szabo, Ann-Sophie Tillnert, John Mattsson Feb 2024

Displaying Gifted Students’ Mathematical Reasoning During Problem Solving: Challenges And Possibilities, Attila Szabo, Ann-Sophie Tillnert, John Mattsson

The Mathematics Enthusiast

When solving problems, mathematically gifted individuals tend to internalize intuitive ideas and approaches, and to shorten their reasoning. Consequently, for teachers it is difficult to observe gifted students’ mathematical reasoning in the context of problem solving. In this paper we investigate nine gifted Swedish 9th grade students’ mathematical reasoning during problem solving in small groups at vertical whiteboards. The data consists of 5 filmed group-activities, that were analysed according to a framework of collaborative problem-solving (Roschelle & Teasley, 1995). The analysis shows that every group solved proposed problems successfully within different socially negotiated Joint Problem Spaces (JPS) and, importantly, that …

The Field Q And The Equality 0.999. . . = 1 From Combinatorics Of Circular Words And History Of Practical Arithmetics, Benoit Rittaud, Laurent Vivier Feb 2024

The Field Q And The Equality 0.999. . . = 1 From Combinatorics Of Circular Words And History Of Practical Arithmetics, Benoit Rittaud, Laurent Vivier

The Mathematics Enthusiast

We reconsider the classical equality 0.999 . . . = 1 with the tool of circular words, that is, finite words whose last letter is assumed to be followed by the first one. Such circular words are naturally embedded with algebraic structures that enlight this problematic equality, allowing it to be considered in Q rather than in R. We comment early history of such structures, that involves English teachers and accountants of the first part of the 18th century, who appear to be the firsts to assert the equality 0.999 . . . = 1. Their level of understanding show …
