Attitudes Toward Execution: The Tragic And Grotesque Framing Of Capital Punishment In The News, Katherine Shuy

This essay undertakes a detailed frame analysis of print and electronic media coverage of three nationally publicized death penalty cases between the years of 2014 and 2015. Drawing specifically from the work of Kenneth Burke (1984), this research argues that tragically framed death penalty cases reify victim/perpetrator discourses and cause the actual act of execution to be a fitting resolution within a narrative. Burke’s (1984) grotesque-mystical frame and Bakhtin’s (1984) theory of the grotesque body are used to argue that the media’s portrayal of botched executions help highlight the incongruities with the system of capital punishment, and cause audiences to …

Job stress has been linked to several negative outcomes for workers in human service professions. Despite a wealth of knowledge on job stress in social service occupations, relatively little is known about the job stress of probation officers. In eastern Montana and western North Dakota’s Bakken region, a recent oil extraction boom and bust cycle has caused rapid socio-demographic change. Researchers have found that oil extraction in the Bakken region has led to several challenges for social service and police agencies in the area. The United States Circuit Court of the First Circuit’s decision in Town of Barnstable v. O’Connor reignites a hotly debated offshore wind plant proposal. The First Circuit held that the Ex parte Young exception to the Eleventh Amendment applied because the complaint alleged an ongoing violation of federal law and the relief sought was prospective. The court did not discuss the merits of the claim, so the fight against the proposed wind plant powers on.

There are about 194 permitted dams within the Clark Fork Watershed in Montana alone; 51 of these are classified as high hazard. Congruent with state and federal guidelines, all of these high hazard dams are required to have an Emergency Action Plan (EAP) that includes dam breach inundation mapping. The purpose of having an EAP is to protect public safety. Unfortunately, many of these EAP’s are outdated and contain inaccurate data.

Historically, one-dimensional hydraulic modeling software, such as HEC-RAS, has been the primary method to model dam breach inundation. One-dimensional models have yielded good results, but can be challenging to …

A Solution In Search Of A Problem: The Difficulty With State Constitutional "Right To Hunt" Amendments, Stacey Gordon

This article explores the facets of hunting amendments. Part I traces the legal history of protections for hunting, from early laws to preserve hunting for the people to modern hunter harassment statutes. Part II analyzes the forms of hunting amendments—some guarantee a right, others only recognize a heritage; some are fundamental rights, others are less strong; some are limited by private property rights, others are absolute. Nonetheless, they have a common source. Part III considers the impacts— possibly unintended consequences—of hunting amendments. Finally, Part IV suggests that while there are unrecognized common values between hunters and animal welfare groups that …

Land Acquisition In The State Of Alaska: Akiachak Native Community V. Salazar, Wesley J. Furlong

Akiachak Native Community v. Salazar and the BIA’s repeal of the Alaska Exception are set to mark sweeping changes for Alaska Natives. Following the United States District Court for the District of Columbia’s holding that the prohibition of trust acquisitions in Alaska violates the IRA, and before the United States Court of Appeals for the D.C. Circuit could issue an opinion on the merits, the BIA repealed its rule prohibiting such acquisitions. The potential for drastic changes to the landscape of native communities and villages in Alaska is highly likely.

Obtaining reliable knowledge is the first step towards properly managing wildlife species. Columbian black-tailed deer (Odocoileus hemionus columbianus) on Whidbey Island, Washington have not been the subject of study, and little is known about the population, or the opinion of resident’s of Whidbey Island towards the deer population. However, wildlife managers suggest deer on the island may be overabundant or over social carrying capacity. "Why Wait Until They Commit A Crime?": Moral Imbecility And The Problem Of Knowledge In Progressive America, 1880-1920, Chelsea D. Chamberlain

Focusing on the forty-year period from 1880 to 1920, this thesis explores moral imbecility--the lack of a moral sense at birth--as a contested medical diagnosis that embodied many of modernizing America's greatest fears. It argues that moral imbecility played a pivotal role in facilitating the emergence of several hallmarks of modern America. The diagnosis legitimated medical experts’ far-reaching cultural authority, encouraged the rise of a surveillance society, and secured the growth of a medicalized bureaucratic state responsible for institutionalizing hundreds of thousands of people. The purpose of this study is to examine issues associated with the reporting of sexual assault victimization to the police and police responses to these reports. The information gathered will be used to inform best practices regarding future responses by the Missoula Police Department (MPD) and other stakeholders. The information will also be used to inform a larger investigation that will take place after the current pilot phase of the project ends. The Impact Of Detention On Juvenile Recidivism In Montana: Is The Impact Of Detention Influenced By Other Factors?, Daniel N. Acton

The purpose of this study is to identify the effect detention has on recidivism risk as well as to identify the degree to which the effect of detention on recidivism is influenced by other variables. The data for this analysis were collected by probation officers across Montana, using the Back on Track risk assessment instrument (N=840). Although detention was the topic of interest, this analysis also tested aspects of three popular criminological theories: social bond theory, self-control theory, and life-course persistent theory. Using logistic regression, the effects of detention and a variety of other risk factors are identified. Hypothesis one …

Wildland-urban interface growth and factors increasing the probability of wildfire suggest that annual spending on wildfire risk mitigation and suppression will continue to increase. With limited information about the benefits and costs of risk mitigation, land managers and homeowners may under- or over-invest in risk mitigation, where costs are disproportionate to the expected benefits of the strategy. This study accounted for expected increases in wildfire risk (due to growth of the WUI, climate change and vegetation growth) over time in Flathead County, Montana, and estimated the expected avoided loss in structure values associated with three treatment levels that would require …

The State of Montana automatically restores felons’ gun rights once they complete their underlying sentences, so long as the crimes for which they were sentenced did not involve a dangerous weapon. However, in Van der hule v. Holder, the Ninth Circuit Court of Appeals stripped those gun rights under federal statute.
