Logic And Laws: Relief From Statutory Obfuscation, Rudy Engholm
Logic And Laws: Relief From Statutory Obfuscation, Rudy Engholm
University of Michigan Journal of Law Reform
Ever-expanding use of the legislative process in recent years has resulted in a vast proliferation of statutes and regulations. The Public Acts of the First United States Congress (1789-91) filled only 203 pages. The Public Acts of the Thirty-first Congress (1850-51) filled 227 pages, those of the Sixty-first Congress (1909-11) filled 1459 pages, and those of the Ninety-first Congress (1969-71) filled 2938 pages. In addition, publication of new and recently amended federal regulations contributed to a Federal Register exceeding 45,000 pages in length in 1974. The growth of state statutory materials parallels this trend. Unfortunately, the technology of statutory expression …

Some Observations On Promoting And Accommodating The Interests Of The Public, The Bar, And The Law Schools, Theodore J. St. Antoine
Some Observations On Promoting And Accommodating The Interests Of The Public, The Bar, And The Law Schools, Theodore J. St. Antoine
Law Quadrangle (formerly Law Quad Notes)
By Dean Theodore J. St. Antoine based on the Dean's Report to the President of the University for the 1973-74 academic year.
By now most Americans, and not least the lawyers, would probably like to forget all about Watergate. But its reverberations pervaded the Law School during the past year, and I think a few further observations are in order.
This seems especially appropriate because a growing number of signs indicate the ultimate meaning of this painful episode may be quite different from the initial perceptions. An affair that many persons thought demeaning to the whole legal profession could yet …

Fighting Conflicts Of Interest In Officialdom: Constitutional And Practical Guidelines For State Financial Disclosure Laws, Michigan Law Review
Michigan Law Review
This note will examine the individual interests in running for office and in personal financial privacy in order to determine what level of scrutiny should be applied to disclosure statutes. After concluding that only minimal scrutiny should apply--a standard certainly met by the state's strong interests--it will be argued that nonconstitutional considerations bearing on the practicality of disclosure statutes nevertheless require a careful balancing of the state interest in disclosure against the individual interests of each class of persons affected by the statutes. The discussion of the strength of the state's interest in disclosure with respect to each class will …

The Clinical Law Experiment: Michigan's First Five Years, Steven D. Pepe
The Clinical Law Experiment: Michigan's First Five Years, Steven D. Pepe
Law Quadrangle (formerly Law Quad Notes)
Many Michigan law alumni continue to inquire about the Clinical Law Program, now entering its fifth year of fulltime operation. Prof. Al Conard's "Letter from the Law Clinic" in the fall, 1973, Law Quadrangle Notes gave a perceptive and entertaining glimpse into some of the case situations at the clinic and the types of learning in which clinic students are engaged. This article will sketch the development and operation of our clinical experiment in legal education. A future article will explore the goals, methodology, and problems of clinical legal education. A third and final article will focus on a particular …
Lawyers And Professionalism: A Further Psychiatric Perspective On Legal Education, Andrew S. Watson
Lawyers And Professionalism: A Further Psychiatric Perspective On Legal Education, Andrew S. Watson
University of Michigan Journal of Law Reform
In recent years, clinical teaching methods have played an increasingly significant role in the education of this nation's lawyers. With the consequential accumulation of data pertaining to various institutional experiences, it is now worthwhile to explore, from a clinician's perspective, some of the psychodynamics of this educational process as it appears to affect a student's future professional behavior. In addition to such an examination, this article will delineate methods for dealing with the stresses of a lawyer's professional life, suggesting ways in which the attorney may satisfy his goals as well as those of his client. It is hoped that …
Employer Racial Discrimination: Reviewing The Role Of The Nlrb, Lawrence F. Doppelt
Employer Racial Discrimination: Reviewing The Role Of The Nlrb, Lawrence F. Doppelt
University of Michigan Journal of Law Reform
The NLRB and various commentators rely upon three basic legal arguments in rejecting this interpretation: first, the EEOC, and not the NLRB, is the sole and proper agency for litigating racial issues; second, employer racial discrimination does not interfere with the protected rights of employees under the Act, and third, it is not, and never was, Congress' intent in passing the Act to bring racial discrimination within its purview. Unquestionably, each of these legal arguments has, or at some time had, surface appeal, and, at one time, considerable force. The great mass of legal commentary supports at least one of …
The Sherman Act And Bar Admission Residence Requirements, Harvey Freedenberg
The Sherman Act And Bar Admission Residence Requirements, Harvey Freedenberg
University of Michigan Journal of Law Reform
This article will focus on the restrictive aspects of residence qualifications for admission to the state bar. Such restrictions are significant in three cases: initial admission to the bar, relocation by a foreign attorney, and multistate practice by an attorney admitted to the bar in another state. An attempt will be made to determine whether these requirements might be invalid under the Sherman Act and to analyze the case for their abolition. The commercial counterpart of professional entry restrictions has been termed "the very essence of monopoly,” and on this basis it is submitted that further freedom from antitrust scrutiny …

Internal Revenue Code section 351(a) provides that no gain or loss shall be recognized if property is transferred to a corporation solely in exchange for its stock or securities and the transferors control the corporation immediately after the exchange. If, in addition to receiving stock or securities in an exchange that would otherwise qualify for section 351 treatment, a transferor receives other property or money -- "boot" -- any realized gain is recognized up to the amount of the money and the fair market value of the other property received. The transferee corporation's assumption of the transferor's liabilities or its …

IN March 1971, the Michigan Bar Commissioners appointed a twenty-five-member committee with a directive "to promulgate a recommended revision of the Code of Criminal Procedure codifying existing statutory and case law provisions which, in the judgment of the Committee, should be retained and adding thereto such provisions as the Committee, in its judgment, deems warranted; and to incorporate such recommendations into proposed legislation for submission to the Legislature."' The committee membership included judges, prosecutors, legislators, criminal defense lawyers, law school professors, and representatives of Michigan police and corrections agencies.2 Judge Horace Gilmore served as Chairman, and I served as Reporter.
