Accident And Malpractice Liability Of Professional Corporation Shareholders, Richard Tunis Prins
University of Michigan Journal of Law Reform
Part I of this note describes the various tort liability provisions found in the professional corporation acts, focusing particularly on the recently published Model Professional Corporation Supplement. Part II compares how effectively these alternatives accomplish the goals of accident law in the professional corporation setting. The inability of the preferred model provision to alleviate the malpractice problem in any way as well as proposals for reinvigoration of the professional corporation act concept are discussed in Part III.

The First-Year Courses: What's There And What's Not, David L. Chambers
Book Chapters
For many of you, law school will be a full-time occupation for three school years; for others, a second job squeezed in at night over four or five years. Whatever your route to a degree, whatever sort of law school you attend, the beginnings of law school are likely to be much the same. You will face initially a set of required courses that will probably bear the same titles as the titles of our next six chapters: Civil Procedure, Contracts, Criminal Law, Property, Torts and Constitutional Law. The six are likely to be taught in ways that resemble each …

The Future Of Evidence Law: Or, Some Prophecies About Proof, John W. Reed

I am honored to participate in this seminar that is part of the celebration surrounding the dedication of Colorado's new State Judicial Building. But that feeling of honor is tempered by an awareness of the responsibility and perils of the role I have been asked to play. With the assignment, "The Future of Evidence Law," I have been asked to play the prophet, to be a seer of sorts, and to suggest what rules and principles will govern proof at trials at some date in the future. Exactly what date was not specified in the invitation-a decade, perhaps? A generation? …

Mobilizing Private Law, Richard O. Lempert
Mobilizing Private Law, Richard O. Lempert
Book Chapters
The mobilization of law may be thought of as the process by which legal norms are invoked to regulate behavior. In the area of private law, mobilization has two distinct aspects. The first is the process by which existing disputes become engaged in the legal system. In theory this means that disputes are transferred from an arena where their resolution and the enforcement of resolutions depends on the relative power of the parties as enhanced or constrained by non-governmental normative systems to an arena where disputes are resolved by reference to governmental (legal) norms and resolutions enforced by the power …
The Clinical Law Experiment: Goals, Methods, And Problems, Steven D. Pepe
The Clinical Law Experiment: Goals, Methods, And Problems, Steven D. Pepe
Law Quadrangle (formerly Law Quad Notes)
In the fall 1975 Law Quadrangle Notes, the first of this series of articles gave an overview of the history and operation of the fieldwork and seminar components of Michigan's Clinical Law I course. This second article on the clinical law experiment will sketch some of the goals of Michigan's clinic, its educational method, and various problems and shortcomings. A future article will describe a special project in the 1974-75 academic year to use the clinical setting more effectively to confront issues of legal ethics and professional responsibility.
The Principle Of The Least Restrictive Alternative For Mentally-Retarded Persons: The Constitutional Issues, David L. Chambers
The Principle Of The Least Restrictive Alternative For Mentally-Retarded Persons: The Constitutional Issues, David L. Chambers
Book Chapters
Mentally retarded people are people. When strong reasons exist to treat them differently from other people, they should be provided the necessary services, restraint, or protection through means that intrude as little as possible on their freedom to live the life that others are permitted to live. "Normalization" is the term professionals use to define the goal and the process of helping mentally retarded citizens lead a "normal" life. The attainment of this goal involves undoing the multitude of formal constrictions governments have typically placed on the retarded citizen's freedom: his place of residence, his schooling, his control over his …
The Emerging Right Of Legal Assistance For The Indigent In Civil Proceedings, Jeffrey M. Mandell
The Emerging Right Of Legal Assistance For The Indigent In Civil Proceedings, Jeffrey M. Mandell
University of Michigan Journal of Law Reform
After the Supreme Court declared in Gideon v. Wainwright that indigents have a constitutional right to appointed counsel in criminal cases, attention turned to the possibility that a similar right could be found for civil litigants. Although there is no explicit constitutional guarantee of counsel for the civil litigant, the due process clause, which protects property rights as well as personal freedoms, arguably mandates that there be a right to professional representation of all citizens in all courts. The inability of most laymen to effectively present even a rudimentary case on their own behalf indicates that without counsel a meaningful …
