One of the most important assignments I received when I assumed this position in 1990 was to address the question, "What is the cause of seeding failure when alfalfa is spring-seeded into soils that remain wet after seeding?" Six years of laboratory and field work have finally borne fruit. Based on our research, we can confidently present Kentucky alfalfa producers with three conclusions and a recommendation.

Transgenic mice that express increased levels of nerve growth factor (NGF) in the epidermis and other stratified, keratinized epithelium. The nerve growth factor expressing transgenic mice are useful in the study of neurodegenerative disorders of the brain such as Parkinson's syndrome and Alzheimer's disease and for testing for drug candidates for the treatment of these diseases.

Analysis of several post-Chevron cases indicates that every major Supreme Court case since 1984 involving the validity of a Treasury regulation is consistent with Chevron. Indeed, since 1984 every challenged Treasury regulation interpreting a statute in which Congress failed to address a specific tax issue has been upheld by the Court. In fact, no Supreme Court case since 1984 could be discovered in which the Court invalidated a Treasury regulation on the grounds that it was an unreasonable interpretation of a statute. A 59-year-old male was killed when he was struck by a tree while logging on a mountainside. The victim was working with two other men doing contract work for a local lumber company. All three men were full-time loggers and had many years of experience. On the morning of the incident, the men were working on a steep mountainside. Concentrations of indicator bacteria such as fecal coliform (FC) and fecal streptococcus (FS) are often used to assess the suitability of waters for their intended use(s) and to allocate resources for water quality improvement measures. There is evidence, however, that concentrations of FC and FS can be influenced by variables such as season and flow rate during sampling, which could lead to biased results. The objective of this study was to assess the impacts of season and flow rate on concentrations of FC and FS. Translational Regulation Of Lipoprotein Lipase By Epinephrine Involves A Trans-Acting Binding Protein Interacting With The 3′ Untranslated Region, Gouri Ranganathan, Diane Vu, Philip A. Kern

To better characterize the translational regulation of lipoprotein lipase (LPL) by epinephrine, cytoplasmic extracts were prepared from 3T3-L1 adipocytes, 3T3-F442A adipocytes, and other nonadipocyte cell lines (C2 cells, 3T3 fibroblasts, and Chinese hamster ovary cells). After treatment with epinephrine, cell extracts from the adipocytes inhibited LPL translation in an in vitro translation assay, whereas extracts from the C2 cells and 3T3 fibroblasts did not affect LPL translation. To identify the region on the LPL mRNA that controlled translation, in vitro translation was carried out using constructs containing different LPL sequences. Bacterial pathogens can degrade ground water quality by infiltrating and eroding from land treated with poultry wastes. The potential for ground water contamination (as well as associated health risks and cost of water treatment) greatly depends on the depth of soil to the water table or bedrock and soil structure. Pathogens must move through the soil profile to contaminate ground water (although sinkholes can provide a direct channel from the soil surface to the water table in karst areas). Deep soils have less potential for contamination than shallow soils. Structureless soils retain fecal bacteria better than well structured soils. Research …

A "genetic revolution" is upon us. Techniques for genetic testing have increased in sophistication, and an international effort to map and sequence human DNA—The Human Genome Project ("HGP")—is now well under way. We are beginning to exploit our new found genetic knowledge. Recognition of the relationship between developments in genetic science, law, and public policy, is creeping into the "literature" and into the law school curriculum. Even the popular 60 Minutes television "news magazine" recently did a program on the perils of genetic testing. Still, for lawyers and policymakers at least, the material is not all that accessible.

Calibration Of A Water-Quality Model For Herrington Lake Using Empirically Derived Measurements Of Phytoplankton Growth And Nutrient Assimilation, Paul A. Bukaveckas, Angela S. Crain

Importance of light limitation, nutrient availability, and hydrology in controlling the abundance and composition of the phytoplankton community of Herrington Lake (KY) was investigated over a two-year period. Selected environmental parameters were measured every two weeks (April-October) at five sampling stations located along the longitudinal gradient of the reservoir. In addition, short-term (48hr) nutrient enrichment experiments were conducted to assess the spatial and temporal variations in nutrient limitation. Phytoplankton growth responses to the combined addition of nitrogen (NO3) and phosphorus (PO4) were greater than those resulting from the addition of either nutrient alone. These results indicate …

This Note focuses on two important pieces of social-policy legislation that could be affected by United States v. Lopez: the Violence against Women Act (VAWA) and the Freedom of Access to Clinic Entrances Act (FACE). Conflicts exist in the lower federal courts regarding the constitutionality of both statutes, which were enacted under the Commerce Clause. This Note seeks to resolve the dispute in favor of upholding both acts. Part I surveys the major cases in the history of the Commerce Clause as they relate to social-policy legislation, up to and including Lopez. Part II discusses the conflicting cases in the …

Ligation of B cell receptor (BCR) on BKS-2, an immature B cell lymphoma by anti-IgM antibodies (Ab) caused apoptosis. Here we report that signaling through B cell receptor in wild type BKS-2 cells down-regulated the expression of Egr-1, a zinc finger-containing transcription factor. A reduction in the level of Egr-1 mRNA could be demonstrated as early as 30 min after the ligation of BCR on BKS-2 cells. Immunocytochemical and Western blot analysis revealed that the expression of EGR-1 protein was also inhibited by anti-IgM treatment. Antisense oligonucleotides to Egr-1 caused growth inhibition and apoptosis in BKS-2 cells, suggesting that expression …

Grazed pastures represent a source of potential nonpoint pollution. In comparison to other nonpoint sources (e.g., row-cropped lands), relatively little information exists regarding possible magnitudes of pollution from grazed pasture; how that pollution is affected by weather, soil, management and other variables; and how the pollution can be minimized. Runoff from land areas amended with poultry (Gallus gallus domesticus) manure can contain elevated concentrations of metals such as Cu, Fe, and Zn. Vegetative filter strips (VFS) can reduce runoff concentrations of animal manure components, but reported studies have typically focused on nutrients and solids rather than metals. This experiment assessed the impact of VFS length (0 to 12 m) on concentrations and mass losses of Cu, Fe, K, Na, Ni, and Zn in runoff from fescuegrass (Festuca arundinacea Schreb.) plots (1.5 m wide × 6 and 12 m long) treated with poultry litter. When Congress enacted the Federal Water Pollution Control Act, commonly known as the Clean Water Act, it established a pollution control regime that imposed a baseline level of technology-based pollution control, and was designed to ensure that water quality would not fall below certain standards. Twenty-five years after the enactment of the Clean Water Act, success may be claimed with regard to technology-based controls. Achieving water quality standard (WQS) compliance has proved much more difficult. Indeed, evaluated from a variety of perspectives, the enforcement of the water quality-based system of pollution control must be viewed as a failure.

According to these critics, tort law does not deter accidents, nor does it spread accident costs efficiently. Worst of all, the tort system is extremely expensive to operate. A 51-year-old mill owner (the victim) was killed while pulling a 16-foot log from the woods. He had reached the top of a 10-12-degree slope, turned slightly to the left and stopped, when the tractor he was driving turned over. It landed on the victim and then rolled again. The victim's partner, who was with him, ran to a nearby house where he had seen two men working outdoors earlier. He asked them to call 911 and then returned with a backhoe with which to lift the tractor. While he was doing this, emergency medical services (EMS) personnel arrived. The …

The invention provides the LCB1 and LCB2 genes of the yeast Saccharomyces cerevisiae that encode subunits of the enzyme serine palmitoyltransferase (SPT), the first enzyme leading to synthesis of the long-base component of the sphingolipids. The present specification describes the isolation of the LCB1 and LCB2 genes. The invention further relates to methods of using these genes to either inhibit SPT activity or to inhibit synthesis of the enzyme.
