In December 1998, a 31-year-old male (the victim) sawmill employee was killed when struck by a log that rolled off the top of the truck. He was preparing the truck to be unloaded when the log rolled off. While most of the logs received by the sawmill were delivered by independent loggers, the company did own one boom truck that their employees used to pick up timber. This was the truck the victim was driving the day of the incident. At the time of the incident, he was working alone.

In October 1998, a 58-year-old male truck driver/yard worker died of traumatic head injuries when he fell 48" from a storage rack. The employee had climbed onto the storage rack to retrieve 3/4" round molding, 8 feet in length for a customer to load into his truck. The employee placed his feet on pine boards that were being stored on the middle row and was trying to retrieve molding being stored above (approximately 9 feet off the floor). A method for specifying a fatty acid at the sn2 position of acylglycerol lipids including (a) transfecting a vector including the SLC1 gene or a variant thereof into embryonic biological material, and (b) allowing the SLC1 gene to specify the type of fatty acid at the sn2 position of acylglycerol lipids. Also provided for is an isolated SLC1 gene and a probe for its detection.

In November 1998, a 32-year-old male truck driver was killed when he was struck by a log that rolled off the top of his tractor trailer truck while preparing the truck for unloading at a sawmill complex. The victim accompanied by his father, had picked up a load of logs and transported them approximately 220 miles to the sawmill complex. He arrived at the mill with the logs secured by straps and stacked well above the standards of the trucks trailer. He drove to an unloading area. A 62-year-old male was killed when the tractor he was operating punctured an aboveground gas line. He had recently moved to the area and was in the process of acquiring some land for farming. The land was overgrown with weeds and brush about 5 feet high. On a warm, clear afternoon he went out to clear the land with a tractor and rotary mower. Transgenic Mice Which Overexpress Neurotrophin-3 (Nt-3) And Method Of Use, Kathryn M. Albers, Brian M. Davis

Transgenic mice express increased levels of neurotrophin-3 (NT-3) in epithelium when their ancestors are microinjected with the NT-3 gene. The NT-3 growth factor expressing transgenic mice are useful in the study of neurodegenerative disorders of the brain such as Parkinson's syndrome and Alzheimer's disease, of the spinal cord motor neurons such as amyotrophic lateral sclerosis, and for testing drug candidates for the treatment of these diseases.

Agronomy Notes

For several decades, farmers have experienced a common stand-establishment disease syndrome when spring-seeded alfalfa was followed by extended periods of wet weather. Seedlings affected by this syndrome exhibit severe stunting as well as yellowing and reddening of seed leaves (cotyledons), but they do not wilt or collapse, as they might from a damping-off disease. Commonly, the problem affects most or all of the field.

Based on research that began in the 1980's, we suspected that a fungus called Aphanomyces euteiches (hereafter simply called Aphanomyces) was responsible. This root-rot fungus can be found in the majority of alfalfa fields we …

Evaluation Of Soilless Media Used In Tobacco Float Systems, Robert C. Pearce, Jack M. Zeleznik

Agronomy Notes

A wide range of soilless media is currently available to tobacco growers utilizing the float system for transplant production. Most of the media are predominantly made up of peat moss with varying amounts of perlite, vermiculite,and coconut fibers (coir). One of the most difficult problems for growers has been inconsistency in the media from year to year. Because peat is a natural product, some year to year variability is unavoidable. However, many manufacturers of soilless media have procedures in place to ensure that the final product is as consistent as possible.

A Proposal To Require Lawyers To Disclose Information About Procedural Matters, William H. Fortune

In the absence of a rule clearly requiring disclosure, a lawyer is obligated not to disclose information which is adverse to the interests of a client. However, judges should be able to expect lawyers to disclose information about procedural matters. This Article argues that Model Rule of Professional Conduct 3.3 should be amended to require disclosure of information about procedural matters. Part I describes the events in Potter v. Eli Lilly & Co., a case involving a secret settlement related to Prozac. Part II makes the argument for a rule requiring disclosure of procedural information. Part III describes how …

Objective: Tractor rollovers are a major cause of farm injuries and fatalities. The authors used data from a statewide surveillance study to estimate the prevalence of safety features such as rollover protective structures, seat belts, and power take-off shields on farm tractors in Kentucky.

Methods: Using data from the Farm Family Health and Hazard Surveillance Project, the authors report on the prevalence of farm tractor safety features by size of farm, by region of the state, by number of tractors per farm, and by tractor age and estimate the prevalence of tractors equipped with rollover protection by region and for …

Toward Justice In Tobacco Policymaking: A Critique Of Hanson And Logue And An Alternative Approach To The Costs Of Cigarettes, Richard C. Ausness, Paul A. Lebel

Much of tobacco policymaking has been driven by economic and political forces. Professors LeBel and Ausness offer an alternative approach to tobacco policymaking that places justice concerns at the center of the analysis. Their article presents a detailed critique of a significant recent work by Professors Hanson and Logue advocating extensive tobacco industry liability on economic efficiency grounds. Asserting that a “fresh start” is necessary, LeBel and Ausness identify the interests at play in the tobacco policy arena. Many individuals in society think that all lawyers are liars. Some think lawyers are allowed to lie. Regrettably, some American lawyers apparently think so too. In the United States there has been, and continues to be, a troubling lack of professional consensus when it comes to litigating a case. Indeed, lawyers who are neither corrupt nor insensitive have been accused of arguing that the elicitation of false testimony, and the use of it, is a professional responsibility. Fairness also calls for some acknowledgment that even the most cunning, zealous, and successful of trial lawyers have agonized over such moral choices. …
