Coaching Caregivers In Rural Communities On Naturalistic Strategies Via Telehealth, Stevie L. Ogburn
Coaching Caregivers In Rural Communities On Naturalistic Strategies Via Telehealth, Stevie L. Ogburn
Theses and Dissertations--Early Childhood, Special Education, and Counselor Education
Naturalistic strategies have been shown in research to promote expressive language in children by embedding opportunities for learning trials during routines and activities. Efforts to promote expressive language development are often focused on training caregivers in implementing naturalistic strategies in their child’s typical daily routine. Coaching is a consistently effective training practice to prepare family members to implement the naturalistic strategies. While coaching has been shown to be effective, the recommended time requirement could be a barrier for most caregivers. Caregivers living in geographically remote areas also face additional barriers, such as higher rates of poverty and less access to …
Comparative Effects Of Words Plus Pictures And Words Alone On The Reading Comprehension Of Youth With Disabilities, Lindsay Caudill
Comparative Effects Of Words Plus Pictures And Words Alone On The Reading Comprehension Of Youth With Disabilities, Lindsay Caudill
Theses and Dissertations--Early Childhood, Special Education, and Counselor Education
This study compared the effectiveness and efficiency of two instructional conditions on the reading comprehension of fifth and sixth grade students with moderate and severe disabilities. A words plus pictures and words alone condition were examined through the use of an adapted alternating treatment design replicated across 3 participants. Results indicated that the effect was minimal, with words plus pictures being slightly more effective.
The Effects Of Using Constant Time Delay To Teach Digraphs To Elementary Students With Mild Disabilities, Sara Schuer
The Effects Of Using Constant Time Delay To Teach Digraphs To Elementary Students With Mild Disabilities, Sara Schuer
Theses and Dissertations--Early Childhood, Special Education, and Counselor Education
Constant time delay (CTD) is a near-errorless response prompting procedure that involves a presentation of a stimulus, a delay interval, and a controlling prompt. The purpose of this study was to determine the effectiveness of teaching vowel/consonant digraph sounds to children with mild disabilities using constant time delay. A multiple probe (conditions) across behaviors design, replicated with three students, was used. The results indicated that CTD is effective in teaching vowel/consonant digraphs to elementary students with mild disabilities which then generalize to reading words containing those same digraphs.
The Relationship Between Stress And Quality Of Life In People With Multiple Sclerosis: The Mediating Role Of Resilience, Byung Jin Kim
The Relationship Between Stress And Quality Of Life In People With Multiple Sclerosis: The Mediating Role Of Resilience, Byung Jin Kim
Theses and Dissertations--Early Childhood, Special Education, and Counselor Education
Multiple sclerosis (MS) is a chronic disease of the central nervous system encompassing the brain, spinal cord, and optic nerve, in which the patient’s immune system attacks healthy cells and tissues. Due to the unpredictable characteristics of the disease, MS can lead to an unusually high level of stress and may negatively impact the individual’s QoL. Resilience is a psychological structure that shows positive coping and adaptive ability from difficult or stressful situations. Resilience also indicates a buffering effect on the stressors of individuals with disabilities and serves to protect psychological health and function from disability. The purpose of this …

The Uniform Probate Code ("UPC") can trace its origins back to a Model Probate Code promulgated by the American Bar Association ("ABA")'s section on Real Property, Probate, and Trust Law in 1946. In 1962, the Section on Real Property, Probate, and Trust Law, along with National Conference of Commissioners on Uniform State Laws began work on what was to become the original UPC. The National Conferences and the ABA's House of Delegates approved the UPC in 1969.
The 1969 UPC was an attempt to modernize some of the traditional rules and provide a degree of uniformity for the American law …
Corporate Misconduct In The Pharmaceutical Industry, Richard C. Ausness
Corporate Misconduct In The Pharmaceutical Industry, Richard C. Ausness
Law Faculty Scholarly Articles
Sadly, many pharmaceutical companies have engaged in unethical or illegal behavior. The current opioid crisis is the most recent example of misconduct by pharmaceutical companies. Moreover, this pattern of conduct is neither rare, nor recent. Instead, it is long-standing and pervasive in nature. Furthermore, unlike wrongdoing by other businesses that cause primarily economic or environmental harm, wrongdoing by pharmaceutical companies, like that of asbestos or tobacco companies, may cause personal injuries and death on a large scale.

Plagiarism Pedagogy: Why Teaching Plagiarism Should Be A Fundamental Part Of Legal Education, Brian L. Frye, Megan E. Boyd
Plagiarism Pedagogy: Why Teaching Plagiarism Should Be A Fundamental Part Of Legal Education, Brian L. Frye, Megan E. Boyd
Law Faculty Scholarly Articles
As a practicing lawyer, if you aren’t plagiarizing, you’re committing malpractice. Litigators copy forms and arguments from winning briefs rather than bill their clients for reinventing the wheel. Transactional lawyers copy enforceable agreements to ensure their agreements are enforceable too. Partners routinely present documents prepared by associates (and sometimes even paralegals) as their own work. And judges are the most prolific plagiarists of all, copying briefs, opinions, treatises, and legal and nonlegal scholarship, adopting arguments from lawyers and holdings from other judges as their own and claiming authorship of opinions written primarily by their clerks or the parties to the …
A Textualist Interpretation Of The Visual Artists Rights Act Of 1990, Brian L. Frye
A Textualist Interpretation Of The Visual Artists Rights Act Of 1990, Brian L. Frye
Law Faculty Scholarly Articles
For numberless generations, jurisprudes waged total war in the
conflict among textualism, intentionalism, and purposivism.
Textualists insisted that courts must interpret statutes based on the
meaning of their text, intentionalists insisted on the intention of the
legislature, and purposivists insisted on the purpose of the statute.
Eventually, textualism prevailed. Courts universally recognize
that they are obligated to interpret statutes in light of their text, or
at least pretend that the text of the statute determined their
interpretation. And the few remaining heretics are swiftly identified
and corrected by their superiors. As Justice Kagan famously
observed, “We’re all textualists now.” Whether …
Special Education's Lessons For School Funding Litigation, Spencer C. Weiler, Scott R. Bauries
Special Education's Lessons For School Funding Litigation, Spencer C. Weiler, Scott R. Bauries
Law Faculty Scholarly Articles
In this Article, we make the case that the currently dominant approaches to challenging the constitutionality of a state’s funding efforts have proven ineffective. Instead, future lawsuits designed to bring about lasting funding reform should be informed by the successes within the field of special education by asking courts to examine individual-rights claims based on one student, or several similarly-situated individual students, petitioning the court for relief tailored to that student or class. Such an approach to school finance litigation could result in a decision that limits relief to just one application of the entire funding formula, and the remedy …
Limits Of The Rule Of Law: Negotiating Afghan “Traditional” Law In The International Civil Trials In The Czech Republic, Tomas Ledvinka, James M. Donovan
Limits Of The Rule Of Law: Negotiating Afghan “Traditional” Law In The International Civil Trials In The Czech Republic, Tomas Ledvinka, James M. Donovan
Law Faculty Scholarly Articles
Drawing on ethnographic research of judicial cases in the Czech Republic which involve the law in migrants' countries of origin, this Article outlines how multiple strategies handle encounters with the legal-cultural differences of Afghanistan in order to neutralize what may be called the “alterity” of law. The Article suggests that far from being analytical tools, concepts such as “context,” “culture,” and “customary” are strategically used by courts to neutralize unsettling aspects of foreign Afghan legalities. Further, it applies Leopold Pospíšil´s ethnological concept of legal authority as a vehicle for reinterpreting the contextual differentiation of Afghan “traditional” law as an alternative …
Grounding Suicide Terrorism In Death Anxiety And Consumer Capitalism, James M. Donovan
Grounding Suicide Terrorism In Death Anxiety And Consumer Capitalism, James M. Donovan
Law Faculty Scholarly Articles
This article examines an influential theory on suicide attacker motivations, the Significance Quest Theory, and suggests that this death anxiety approach can be improved by shifting its focus toward the related, but more comprehensive, Terror Management Theory. The theoretical productivity of this realignment is tested by examining the relationship between suicide attacks and one of the variables thought to trigger the underlying anxieties: the local pressures from global consumer capitalism. After describing the relationship between death anxiety and suicide terrorism generally, this article concludes by applying these insights to the ethnographic context of Egypt.
Causation And Apportionment Issues In Opioid Litigation, Richard C. Ausness
Causation And Apportionment Issues In Opioid Litigation, Richard C. Ausness
Law Faculty Scholarly Articles
In November 2019, an Oklahoma trial court judge, sitting without a jury, ruled that Johnson & Johnson and its subsidiary Janssen Pharmaceuticals were guilty of creating a public nuisance because their production and marketing of prescription opioid painkillers significantly contributed to the current opioid epidemic in the State of Oklahoma. The judge also held that Johnson & Johnson must contribute $65 million to pay for the State's program to abate this nuisance. Although the case has been appealed, it is significant because it was the first government sponsored opioid case to actually go to trial. Although there are many issues …
Novel Tools For Analysis Of Disordered Sleep And Motor Behavior In Preclinical Models Of Disease, Dillon M. Huffman
Novel Tools For Analysis Of Disordered Sleep And Motor Behavior In Preclinical Models Of Disease, Dillon M. Huffman
Theses and Dissertations--Biomedical Engineering
Subtle changes in sleep architecture can accompany and be symptomatic of various diseases or disorders. Understanding the complex interactions between sleep and health requires the ability to characterize sleep, probe its underlying mechanisms through perturbation, and quantify dependent physiological outcomes. Rodent models have come to be accepted as a valuable tool for preclinical investigations. However, experimental tools to accomplish such research typically rely on laborious methods that limit throughput and flexibility. Thus, research tools that minimize workload could be of great value to the research community and expedite investigation of the underlying mechanisms of sleep and further the development of …
Facilitating Analysis Of Toxoplasma Gondii Bradyzoite Metabolic Activity Via Image Processing And Multivariate Logistic Regression For High Throughput Classification Of Mitochondrial Morphologies, Brooke Place
Theses and Dissertations--Biomedical Engineering
Approximately a third of the population worldwide is chronically infected by the parasite Toxoplasma gondii. During chronic infection the parasite resides within tissue cysts as the poorly understood bradyzoite form. Observation of these bradyzoites via microscopic imaging within tissue cyst purified from infected mouse brains has shown metabolic activity with heterogeneous replication potential. With fluorescence microscopy imaging targeting the parasite’s actively respiring mitochondria, the parasite’s metabolic state can be further investigated as the morphology of mitochondria can be associated with specific physiologic states. However, manually classifying mitochondrial morphologies from these images can be tedious and prone to error as …
Risk-Based Construction Inspection, Shannon Rush
Risk-Based Construction Inspection, Shannon Rush
Theses and Dissertations--Civil Engineering
State Transportation Agencies have been experiencing staffing difficulties in the last couple of decades due to the deterioration of infrastructure and a large number of employees retiring or transitioning to the private sector. Therefore, the STA demographic has become much younger and a loss of critical knowledge has resulted from this changeover. Construction Inspection in particular has been severely impacted. Inspired by the NCHRP Synthesis 450, the Kentucky Transportation Cabinet has initiated the Risk-Based Construction Inspection project which focuses on prioritizing construction activities based on the risk associated with failure of that work item. The purpose of which is to …

Assessing Freeway Crash Risk Using Crowdsourced Waze Incident Alerts, Eugene Boasiako Antwi
Theses and Dissertations--Civil Engineering
Traffic data obtained through crowdsourcing are becoming more accessible to traffic agencies due to advancements in smartphone technology. Traffic managers aim to use this data to complement their conventional sources of data and provide additional context in their analysis. In this study, Waze incident alerts are integrated with GPS-Probe speed data and Kentucky State Police (KSP) crashes to assess their impact on traffic flow and safety on freeways in Kentucky. The analysis showed that the presence of a vehicle on the shoulder is associated with about 36.7% of freeway crashes in Kentucky. The presence of a vehicle on the shoulder …
Investigation Of Nitrate Transfer In Karst Basins During Storm Events Using Submersible Underwater Nutrient Analyzers, John Pike
Theses and Dissertations--Civil Engineering
Knowledge of nitrate sources and pathways in karst basins remains incomplete and hinders management of nutrients that cause algae blooms and degrade municipal water supply. However, the increased availability of optical, ultraviolet nitrate sensors allows advancement of nitrate source and transfer for water managers. A concept model is hypothesized for nitrate transfer during hydrologic events and baseflow that considers the multiple porosity of karst. To test the concept model, 15-minute nitrate sensor data is collected with submersible underwater nutrient analyzers over a multi-year period from two locations in a karst basin in the inner bluegrass region of central Kentucky, USA. …
Localization Of Stationary Source Of Floor Vibration Using The Steered Response Power Method, Mohammad Royvaran
Localization Of Stationary Source Of Floor Vibration Using The Steered Response Power Method, Mohammad Royvaran
Theses and Dissertations--Civil Engineering
If the generated vibration in a building exceeds the acceptable limit design for a floor system, it is necessary to identify the source of vibration, a process known as localization. The objective of this study is the localization of stationary vibration sources, and the approach used is the steered response power (SRP) method. This method has already been shown to work well for wireless and acoustical applications to locate transmitter and sound sources, respectively. To the writer’s knowledge, this study is the first application of the SRP method to locate vibration sources using floor vibration measurements. However, because waves behave …
Landslide Site Assessment And Characterization Using Remote Sensing Techniques, Batmyagmar Dashbold
Landslide Site Assessment And Characterization Using Remote Sensing Techniques, Batmyagmar Dashbold
Theses and Dissertations--Civil Engineering
Landslides are common and dangerous natural hazards that occur worldwide, often causing severe direct impacts on human lives, public and private properties. It is imperative to identify the landslide susceptible areas to avoid or mitigate the possible damage. Landslide prediction can be presented in a slope failure in spatial and/ or temporal terms. If it is presented in spatial term, it is considered a landslide susceptibility map (LSM) defined as the probability of spatial occurrence of slope failures. If it is presented in a combination of spatial and temporal distribution of the landslide susceptibility, it is commonly referred to as …
Markov Decision Processes With Embedded Agents, Luke Harold Miles
Markov Decision Processes With Embedded Agents, Luke Harold Miles
Theses and Dissertations--Computer Science
We present Markov Decision Processes with Embedded Agents (MDPEAs), an extension of multi-agent POMDPs that allow for the modeling of environments that can change the actuators, sensors, and learning function of the agent, e.g., a household robot which could gain and lose hardware from its frame, or a sovereign software agent which could encounter viruses on computers that modify its code. We show several toy problems for which standard reinforcement-learning methods fail to converge, and give an algorithm, `just-copy-it`, which learns some of them. Unlike MDPs, MDPEAs are closed systems and hence their evolution over time can be treated as …
Impact Of Short Meditation On Attentional Performance, Lauren E. Guerriero
Impact Of Short Meditation On Attentional Performance, Lauren E. Guerriero
Theses and Dissertations--Biology
Meditation describes a large variety of traditions that all include the conscious focus of attention. By maintaining attention, meditators experience both acute and long-term changes in physiology, anatomy, and cognitive performance. The type of performance benefit is believed to depend, at least in part, on the specific type of mental training. What is much less clear in the literature is the impact of a single session of meditation on the brain and how the acute changes could impact performance. Studies in advanced meditators show an increase in neuronal coordination and slowing of neuronal firing across many regions in the brain, …
Admittance Modeling For Elastic Thickness Across The Mars Crustal Dichotomy Boundary, Aspen Davis
Admittance Modeling For Elastic Thickness Across The Mars Crustal Dichotomy Boundary, Aspen Davis
Theses and Dissertations--Earth and Environmental Sciences
We use a Bouguer mass-sheet approximation for spectral admittance and correlation modeling to estimate elastic thickness, crustal thickness, crustal density, and load density across the Mars crustal dichotomy boundary near the landing site of NASA’s InSight Lander. We derive and constrain the parameter ranges using RMS misfit between the observed and theoretical admittance and their error bars. Spherical cap windows of 15° (900 km) radius are used to study 15 locations in the Northern Lowlands, the Southern Highlands and near and on the boundary which suggest distinct, but not sharp, difference in lithospheric properties. Elastic thickness estimates range generally between …
Integrated Geophysical Investigation Of Near-Surface Faults - Sassafras Ridge, New Madrid Seismic Zone, Usa, Cooper Cearley
Integrated Geophysical Investigation Of Near-Surface Faults - Sassafras Ridge, New Madrid Seismic Zone, Usa, Cooper Cearley
Theses and Dissertations--Earth and Environmental Sciences
The New Madrid Seismic Zone (NMSZ) is a large source of seismic hazard within the central and eastern United States. Seismogenic source parameters such as active fault location, slip rate, total displacement, and strain accommodation is poorly constrained due to the masking effect of the Mississippi Embayment sediment and agricultural practices on structures and surface expressions. Consequently, noninvasive geologic and geophysical investigation of the subsurface is needed to characterize seismogenic sources. Recent investigation of the Reelfoot Fault found that there is a strain accommodation enigma between the dextral offset at seismogenic depth versus the surface expression, Reelfoot Scarp. This strain …
Uncovering Frontier Mythologies: Memorial Landscapes In Minneapolis, Mn, Corrin Turkowitch
Uncovering Frontier Mythologies: Memorial Landscapes In Minneapolis, Mn, Corrin Turkowitch
Theses and Dissertations--Geography
This thesis analyzes the relationship between settler colonialism and public memory in B.F. Nelson Park, a downtown park in Minneapolis. My focus is the Pioneer statue, a large granite memorial depicting a frontier family in the middle of the park, which I examine through the lenses of race, gender, power, and violence. Using archival and landscape analysis I examine the historical and present built environment of the park and how it relates to white supremacy. Through interviews of two municipal constituencies, I evaluate how these organizations maintain present narratives of European settlement and in turn uphold the monument. This research …
Almost Heaven: Religious Arguments In Appalachian Extractive Fiction, Darby Lane Campbell
Almost Heaven: Religious Arguments In Appalachian Extractive Fiction, Darby Lane Campbell
Theses and Dissertations--English
Appalachia is a national sacrifice zone that hosts extractive industries directly responsible for many social problems in the region, however, many attribute these issues to the moral failings of Appalachians themselves. Activism in the area is heavily focused on opposing both extraction and the negative perceptions which contribute to its domination. One way this activism is conducted is through extractive fiction—novels which expose the destruction caused by extractive industries. Appalachian extractive fiction utilizes religion and spirituality to argue against extraction. This research examines how fiction can be an effective mode of activism and how the use of Christian arguments in …
The Influence Of Socioindexical Information On The Speech Perception-Production Link: Evidence From A Shadowing Task, Kyler B. Laycock
The Influence Of Socioindexical Information On The Speech Perception-Production Link: Evidence From A Shadowing Task, Kyler B. Laycock
Theses and Dissertations--Linguistics
The body of work on speech perception demonstrates the ability of listeners to utilize both visual and acoustic information in their processing of a given speech signal. More recent studies have established that listeners are sensitive to cues in both these modalities which inform their perception of a speaker's identity in parallel with the linguistic message, but the relationship between social information in perception and production together is unclear. This study reports the results of an experiment designed to test the hypothesis that expectations about a speakers identity is able to influence a listener's perception and production of speech in …
Reality And Ideology: The Use Of Gender Indexing Features In Reality Tv, Steven J. Gerencser
Reality And Ideology: The Use Of Gender Indexing Features In Reality Tv, Steven J. Gerencser
Theses and Dissertations--Linguistics
This article analyzes 4 episodes of the Japanese reality television program Terrace house: Aloha State for instances of gender indexing language to investigate the gap between actual speaker usage of these features and the linguistic ideology surrounding their usage as is perpetrated and perpetuated by media. Specifically, the gender indexing features which will be investigated to accomplish this are sentence final particles and first-person pronouns. Instances of these linguistic features are typically presented as features of gendered language, but as will be demonstrated, this does match their actual usage by speakers. I set out to answer three research questions, (1) …
Appalachia On The Airwaves: A History Of Public And Educational Television In The Southern Mountains, Carson Benn
Appalachia On The Airwaves: A History Of Public And Educational Television In The Southern Mountains, Carson Benn
Theses and Dissertations--History
Through a series of historical case studies of individual states within the multi-state region of the Appalachian mountain range, as well as the region as a whole, this dissertation examines educational television (ETV) operations, both at the network level and that of individual stations. Though mostly thought of as “public television”—an educational and noncommercial alternative to mainstream broadcast media—these ETV networks offered, I argue, something more analogous to present-day understandings of distance education and the use of instructional media and technology. Station directors, philanthropic benefactors, and school administrators took different approaches to providing the service of ETV, but all were …

“They Did This Work”: Black Activism, Education, And The Rosenwald Rural School-Building Program In Kentucky, Le Datta Denise Grimes
Theses and Dissertations--History
This study examines what Black Kentuckians did on their own behalf to educate themselves in the early twentieth century. I argue that Black Kentuckians’ agency and activism formed the bedrock of the Rosenwald movement in Kentucky. From 1917 to 1932, they built 158 Rosenwald Schools across the Bluegrass by welding together multiple strategies of resistance. Such agitation included voluntarily taxing themselves, waging legal battles, deploying military-style fundraising campaigns, and building institutions to support their schools. Seeking first-class citizenship, they also volunteered labor, donated land, and bought supplies to uplift themselves and their community through education. This work took place against …
