86 Year Old Farmer Is Killed After Being Hit By Tree Branch, Kentucky Injury Prevention And Research Center

Fatality Case Reports--Tractors/Logging

An 86-year-old male farmer was killed after being struck by a tree limb. The victim was driving a tractor through a pasture checking on his cattle. As he approached a large tree, the extended front end loader, in full upright position, which was attached to the tractor struck a tree branch. The branch broke off and struck the victim causing massive head injury. He was thrown from the tractor and discovered a few hours later by his grandson. The tractor was equipped with a Roll Over Protective Structure (ROPS) and a non-function seat belt. The tractor did not have a …

Preliminary Evaluation, Artimis Reference Point Signs, Jerry G. Pigman

Kentucky Transportation Center Research Report

The objectives of the preliminary evaluation were to determine if the installation of reference signs at intervals more frequent than one-mile increments would improve the ability of emergency personnel to respond to incidents or accidents on the freeway system in the Cincinnati-northem Kentucky area. A short-term evaluation was conducted of white on blue and white on green reference signs on a three-mile section of 1-275 in Cincinnati. Based on field observations and supplemented with subjective opinions of emergency response personnel, the reference signs were determined to be a beneficial addition to the location information available to the driving public. The …

Cost Estimating And Forecasting For Highway Work In Kentucky [1995], James D. Stevens Jun 1995

Cost Estimating And Forecasting For Highway Work In Kentucky [1995], James D. Stevens

Kentucky Transportation Center Research Report

There is a need for better cost estimating and forecasting for highway work in the Commonwealth of Kentucky. KRS45.245 grants the Interim Joint Committee on Transportation oversight of the biennial highway plan, including a review of all authorized highway project phases that exceed their estimates by 15%. In recent years, the Kentucky Transportation Cabinet has suffered the loss of many resources necessary to produce good cost estimates.

Estimates developed using current methods are not sufficiently accurate to preclude cost overruns in excess of 15%. Since enactment of KRS45.245 (1 July 1992 263 overruns, totaling nearly $117 million, have been submitted …

Kentucky Transportation Center Research Report

The Safety Management System (SMS) is one of six management systems mandated by Section 1 034 of the 1991 lntermodal Surface Transportation Efficiency Act (ISTEA). The overall goal of a SMS is to reduce the number and severity of traffic crashes. lt is to be comprehensive in that it incorporates all public roads and all contributing factors associated with the driver, the vehicle, and the roadway. The objective of this study was to develop a procedure to implement a SMS for Kentucky. A recommended process is described. Agencies and organizations were identified which have a role or interest in traffic …

Fecal Bacteria In Agricultural Waters Of The Bluegrass Region Of Kentucky, J. M. Howell, Mark S. Coyne, P. L. Cornelius May 1995

Fecal Bacteria In Agricultural Waters Of The Bluegrass Region Of Kentucky, J. M. Howell, Mark S. Coyne, P. L. Cornelius

Plant and Soil Sciences Faculty Publications

Agricultural runoff influenced by nonpoint pollution frequently exceeds the USEPA standards for bacterial contamination of primary contact water (200 fecal coliforms/100 mL). Few studies have evaluated the effect of cattle (Bos taurus) grazing on fecal contamination of ground water in the karst topography of central Kentucky. Our objectives were to: (i) observe the extent and pattern of fecal bacteria in agricultural waters from two central Kentucky watersheds; (ii) determine if monthly sampling accurately assessed the extent and variability of fecal contamination; and (iii) assess the fecal coliform/fecal streptococci ratio (FC/FS) as an indicator of fecal bacteria source. Springs, …

Farmer Killed When Run Over By Tractor In Barn, Kentucky Injury Prevention And Research Center

Fatality Case Reports--Tractors/Logging

A 62-year-old male farmer was killed inside his barn on a Saturday afternoon after starting his tractor from a standing position. The victim was demonstrating recent repairs to the tractor for his brother-in-law; a new battery and starter had been installed. Standing beside the tractor, the victim reached for the ignition switch to turn the tractor on. The tractor was in gear; when he turned the key the tractor lurched forward, running over the victim, who died moments later. The KY FACE investigators concluded that, to prevent similar occurrences, farmers and other tractor operators should:

The Use Of Audited Self-Regulation As A Regulatory Technique, Douglas C. Michael Apr 1995

The Use Of Audited Self-Regulation As A Regulatory Technique, Douglas C. Michael

Law Faculty Scholarly Articles

At first blush, "self-regulation" seems to be self-contradicting. If government regulation of an industry or problem is considered necessary, how can that responsibility then be returned to those from whom it was taken? Notwithstanding this apparent contradiction, audited self-regulation is used successfully by federal regulatory agencies. It is apparently adopted, however, on an ad hoc basis: in one industry or application but not in another that possesses similar characteristics. This article reviews these previously uncollected efforts at audited self-regulation to evaluate the general usefulness of this regulatory technique across industries and applications. These insights would be relevant not only to …

"Show And Tell": An Analysis Of The Scope Of The Attorney-Client Waiver Standards, Roberta M. Harding Apr 1995

"Show And Tell": An Analysis Of The Scope Of The Attorney-Client Waiver Standards, Roberta M. Harding

Law Faculty Scholarly Articles

As today's society becomes increasingly litigious, document productions, a major discovery tool, are growing larger. One inevitable consequence of this phenomenon is the increased risk that communications protected by the attorney-client privilege may be inadvertently disclosed. Privileged communications may also be disclosed to an adversary under more questionable circumstances: specifically, the intentional, strategic disclosure of privileged information favorable to the disclosing party's position.

In any case involving the disclosure of privileged information, the court must initially decide whether the privilege is waived. To resolve this threshold issue courts apply one of the three waiver tests. If a court decides that …

Opportunities For No-Till Alfalfa In Kentucky, Jimmy C. Henning, Garry D. Lacefield, Andy Anderson Feb 1995

Opportunities For No-Till Alfalfa In Kentucky, Jimmy C. Henning, Garry D. Lacefield, Andy Anderson

Kentucky Alfalfa and Stored Forage Conference

There is a rising interest in the use of alfalfa in pastures, especially for dairy cattle, beef stockers and as supplemental summer grazing for cows with calves. Kentucky has the land resource to support 2 million acres of alfalfa without reducing acres in cultivated crops. Acres of alfalfa seeded for pasture use would be in addition to the 350,000 acres presently used primarily for hay. However, these additional acres are rolling and erodible and therefore alfalfa should be established by no-till methods.

Chemical And Biological Monitoring Of A Constructed Wetland On Jones Branch Treating Acid Mine Drainage, Barbara A. Ramey, George Chalfant, Jon A. Walker Jan 1995

Chemical And Biological Monitoring Of A Constructed Wetland On Jones Branch Treating Acid Mine Drainage, Barbara A. Ramey, George Chalfant, Jon A. Walker

KWRRI Research Reports

Acid mine drainage (AMD) from an abandoned underground coal mine in the Jones Branch watershed in McCreary County, KY, substantially reduced water quality in Jones Branch. Downstream from the mine seeps, the pH was routinely below 4.5 and concentrations of most heavy metals, especially iron, were elevated. A cattail wetland (1,022 m2) was constructed on Jones Branch in 1988-1989 to obviate the effects of the AMD. Monthly chemical monitoring was performed on the water from above, from below, from the inlet and outlet of the wetland, and from the 25 cells within the wetland. Based on chemical monitoring, …

Document Availability And Delivery: Problems And Prospects For Developing Countries, Antoinette Paris Powell

Library Faculty and Staff Publications

The central theme of this paper was originally developed for the Third Conference on Librarians in International Development held at Oregon State University in Corvallis, Oregon, U.S.A. in May of 1991 . The idea for the paper had its roots in the Vllth World Congress of the International Association of Agricultural Librarians and Documentalists (IAALD) where Syed Salim Agha presented a paper entitled "Effecting Information Transfer Through the Document Delivery Process in South East Asia." In that paper Syed Salim Agha outlined the barriers to document delivery along with potential solutions. His presentation left a lasting impression and six years …

High-Carbonate, Low-Silica, High-Calcium Stone In The High Bridge Group (Upper Ordovician), Mason County, North-Central Kentucky, Warren H. Anderson, Lance S. Barron

Information Circular--KGS

The High Bridge Group (Middle Ordovician) of northeastern Kentucky is a major source of limestone and dolomite for construction, agricultural, and industrial stone. These industries require carbonate rocks of high chemical purity. Chemical analyses of foot-by-foot samples from a Mason County core show that three zones of high-calcium and several thick zones of high-carbonate and low-silica stone are present in the High Bridge at a mineable depth. Mason County is located in northeastern Kentucky, on the Ohio River, and offers river access to transportation to the metropolitan Covington-Cincinnati market and the northern portion of the Eastern Kentucky Coal Field for …
