In 1978 the Cornell Law Review published a Special Project devoted to Article Two commercial warranties. Nine years have since elapsed, and we have decided to update and reassess this important area of the law. We have discovered that although judicial treatment of many aspects of Article Two warranty law has remained stable, in some instances the courts' treatment has progressed and in other instances it has become unclear. This Special Project is our attempt to assemble these changes, interpret the progress, and suggest new lines of analysis to clarify areas of conflict.

Development Of Dynamic Non-Hortonian Watershed Models For Steeply Sloping Forested Watersheds: Application To Eastern Kentucky, Lindell E. Ormsbee, Abdul Q. Khan

KWRRI Research Reports

A comprehensive conceptual watershed model is developed to simulate the hydrologic response of steeply sloping forested watersheds. Two non-Hortonian and two Hortonian models were first tested with data from selected watersheds in West Virginia and eastern Kentucky in order to understand the different mechanisms of flow responsible for storm hydrograph generation in this type of watersheds. The two non-Hortonian models tested were the kinematic storage model (Sloan et al. 1983) and the saturation deficit model (Beven and Wood, 1983). Both models were unable to adequately reproduce the observed hydrographs in the four forested watersheds considered in this research. The two …

Tall fescue (Festuca arundinacea, Schreb.) is a well adapted, widely used pasture species occupying approximately 5.5 million acres in Kentucky and 35 million acres in the south central United States.

Commercial tall fescue varieties have been developed from plant materials of either northern European or Mediterranean origin. Varieties developed at the University of Kentucky -- Kentucky 31, Kenmont, Kenwell, Kenhy, and Johnstone -- trace to plant materials of northern European origin. The Kentucky varieties have later maturity dates and have greater resistance to certain foliar diseases during summer than varieties that are of Mediterranean origin (i.e., Alta, Fawn, Goar, and …

Increasing demands of municipal, industrial, and agricultural water users have taxed existing water supplies in many parts of the Eastern United States. Larger rivers and lakes have not been severely threatened, but recurrent drought conditions in some areas have impaired stream flows and lake levels in smaller watercourses. Groundwater problems have also arisen as more users have turned to groundwater sources to meet water needs. These problems include interference between wells, overdraft of ground- water aquifers, salt water intrusion, and subsidence. Water quality is also a problem in many states. Alfalfa hay is a potentially marketable-profitable product if--if quality is satisfactory to meet buyer's needs, if it is packaged such that it meets buyer's feeding program and can be transported efficiently, if in sufficient quantity, if storage site is accessible by truck or trailer, and if it is competitively priced. Meeting these minimum criteria only means the hay is potentially marketable; only after it has been sold does it become potentially profitable.

Returns on many Kentucky farms are declining due to reduced tobacco and feedgrain income. This fact, coupled with traditionally low (or negative) returns from typical cow/calf beef enterprises, has been associated with interest in alternative crop and livestock production systems. Alfalfa produced as a cash crop is increasing and many farmers are realizing substantial returns. In the Central Kentucky Area, many farmers have been stimulated to produce alfalfa since demand for high quality hay by horse farms has been strong.   1. The pure alfalfa stand would not be damaged during the grazing period.
  2. For steers - animal performance while on the alfalfa was more important than pounds of beef produced per acre.
  3. For cow/calf - animal density high enough to remove green leaf area in maximum of 5 days.
  4. Initiate the demonstration with a minimal out-of-pocket cost for fence, water system, etc.
  5. Minimize the occurrence of bloat where possible.

The most significant advances in weed control in alfalfa have originated from developments in herbicide technology, This method of weed control began over 20 years ago when such herbicides as EPTC and 2,4-DB were being used by alfalfa farmers. Alfalfa can be grown anywhere in Kentucky and on a wide range of soil types. This statement seems to contrast with what we are accustomed to hearing in regard to alfalfa. The usual statement is: "Alfalfa requires a deep, well drained and highly fertile soil . . .". Actually, the two statements are not conflicting. They just represent the plant-soil interactions. The first looks at what is possible while the other is concerned with the ideal situation. In order to understand these different perspectives, we need to consider how soil characteristics affect the alfalfa plant.

The act of giving a gift is accomplished so easily that the legal consequences often escape the donor. Even when a donor stops to contemplate the legal significance of her or his act, a parental donor probably is unaware that a gift to a child may affect the child's inheritance rights in the parent's estate. Kentucky is among the minority of states which continue to presume that a parental gift is intended as an advancement to the child donee. The potential for predicting flood magnitude and frequency using sediments deposited in backwater areas during flash floods was investigated on the Cumberland Plateau of eastern Kentucky, a region n9torious for flash flooding. Slack-water deposits are abundant in the area at tributary mouths and bedrock channel expansions. They are identifiable on geologic quandrangle maps, and are locally good potential indicators of maximum flood-crest elevations. However, in this humid region, flash floods could not be distinguished from non-flash floods using slack-water sedimentology.

The effects of sulfuric acid on embryos, larvae, and juvenile fish were examined using standard bioassay techniques, as well as in a preference/ avoidance behavioral test. The objectives were to compare the sensitivities of the various ages of fish to acid and to assess the use of the behavioral test in a hazard assessment program. In an 8-day static renewal bioassay, embryos and larvae of the fathead minnow were not affected at a pH of 4.92 and above, but pH 3.57 produced complete mortality prior to hatching. In 96- hr acute bioassays, 8-wk juvenile fathead minnows survived 100% at pH's …

A composition is provided for the treatment of contagious equine metritis, a contagious venereal disease of horses. The composition appears to function as a biological inhibitor and has antibacterial and antifungal activity when applied to the normal flora and secretions of the epidermis and mucous membranes. Also, the composition has antipruritic and anti-inflammatory activity. The composition is efficacious in the treatment of lesions produced by bacteria, fungi, allergies, viruses, trauma, and burns to the epidermis, dermis, muscles and mucous membranes of the surface or in body cavities of animals and man.

Aflatoxin B1 production by Aspergillus flavus (NRRL 6432) was determined on physically damaged corn stored at 35,25 and 20°C and at relative humidities of 97 and 92%. Production at lower relative humidities of 80 and 85% were also tested at 25°C. Production lag times were significantly different for all test conditions. Lag times ranged from 46 h at 97% relative humidity and 35°C to 173. 8 h at 20°C and 92% relative humidity. Aflatoxin B, concentration doubled every 6 to 10 hours after a level of 10 ppb had been reached. Production rate constants were not significantly different between …
