Free Speech, Rational Deliberation, And Some Truths About Lies, Alan K. Chen Nov 2020

Free Speech, Rational Deliberation, And Some Truths About Lies, Alan K. Chen

Sturm College of Law: Faculty Scholarship

Could “fake news” have First Amendment value? This claim would seem to be almost frivolous given the potential for fake news to undermine two core functions of the freedom of speech – promoting democracy and facilitating the search for “truth,” as well as the corollary that to be valuable, speech must promote rational deliberation. Some would therefore claim that fake news should count as “no value” speech falling outside of the First Amendment’s reach. This Article argues somewhat counterintuitively that fake news has value because speech doctrine should not be focused exclusively on the promotion of rational deliberation, but should …

Incorporating Human Harm Into The No-Injury Rule, Joseph Chase Sep 2020

Incorporating Human Harm Into The No-Injury Rule, Joseph Chase

Water Law Review

This essay argues that the no-injury rule should prevent challenges to water rights that would result in human harm, not only, material injury to other water rights. Colorado water courts are at averse to making decisions based on public policy, but there is enough statutory judicial, and historical precedent to vitiate this new injury standard. A more compassionate no-injury rule supports the fundamental concepts of maximum utilization and optimum use: the first by creating a presumption against concentration of use; and the second by examining a water transfer's effect on human flourishing alongside its economic and environmental impact.

A New Day: Empowering Groundwater Conservation Districts To Manage Groundwater In Texas, Emily A. Fouts

Water Law Review

Addition ally, as populations increase, municipalities rely on groundwater resources to fill their growing needs. Citizens' of Texas have always recognized the importance of groundwater management and conservation and created a regulatory structure designed to manage groundwater resources at the local level through Groundwater Conservation Districts ("GCD"s). Where Is The Community? A Qualitative Case Study Of A School Closure In An Urban School District, Anthony Mcwright

Educational Leadership and Policy Studies: Doctoral Research Projects

Family and community engagement are a proven strategy for strengthening schools. Across the United States, parents and community members have pressed school boards and district leadership for more transparency and broader participation in decisions about school turnaround. The purpose of this qualitative case study is to understand the decision-making process for the school closure of Rocky Mountain High School, a neighborhood school in an Urban School District in the Rocky Mountain West and the impact it had on the community. To better understand this dilemma, a case study method was used to identify real-life perspectives of community members associated with …

Primary Sources In The College Classroom: The Beck Archives At The University Of Denver Libraries, Jeanne E. Abrams

Center for Judaic Studies: Faculty Scholarship

The University of Denver’s Libraries’ Special Collections, which include the Beck Archives of Rocky Mountain Jewish History, have made a concerted effort to encourage faculty to incorporate the use of primary sources into their undergraduate curricula. Teaching teams, consisting of special collections curators, reference and instruction librarians, and faculty members, used both digital and physical primary resources to engage students. These efforts led to the DU project’s being named the recipient of the 2018 Primary Source Award for Teaching from the Center of Research Libraries. This article details the project and highlights the Beck Archives items, which were especially effective …
