Turning The Tempest For God’S Forgotten: Psalm 42 As Synecdochic Lead Of The Elohistic Psalter, David P. Pettit
Turning The Tempest For God’S Forgotten: Psalm 42 As Synecdochic Lead Of The Elohistic Psalter, David P. Pettit
Electronic Theses and Dissertations
This dissertation’s thesis states Ps 42 is the synecdochic lead of the Elohistic Psalter, arguing for a particular type of literary relationship between Ps 42 and this collection (Pss 42-83). As synecdoche, Ps 42 introduces and represents, in microcosm, the themes, imagery, language, and actuational potential of the collection. The lead psalm becomes a lens that affects what aspects and commonalities come to light in the following psalms. This is not merely an intertextual study, however. This study is situated within psalms studies and the long reach of Gerald Wilson’s work and the Shape and Shaping approach to the Psalter. …
The Orient In The Empire’S Poetry: Scholarship, Translation, And Imaginative Geography (1770-1857), Zeeshan Riyaz Reshamwala
The Orient In The Empire’S Poetry: Scholarship, Translation, And Imaginative Geography (1770-1857), Zeeshan Riyaz Reshamwala
Electronic Theses and Dissertations
This dissertation uses the idea of imaginative geography to study literary and scholarly representations of what writers in Europe referred to as the Orient during the long nineteenth century. Imaginative geography refers to a subjective collection of associations that accumulate around a place about which positive knowledge is limited, such that the imaginative associations overpower and structure any empirical knowledge about it, even when further knowledge is acquired. The imaginative geography of the Orient emerged from texts, images, and artifacts that traveled from Asia to Europe through sustained colonial contact. This dissertation studies how writers in India and Britain constituted, …
Violence After Victory: Explaining Variation In State Repression Following Contentious Politics, Christopher Wiley Shay
Violence After Victory: Explaining Variation In State Repression Following Contentious Politics, Christopher Wiley Shay
Electronic Theses and Dissertations
If conflict onset leads to increases in human rights abuse, how can these abuses be curbed once conflicts have ended? To answer this question, researchers have traditionally focused on a country’s regime type and leaders’ incentive structures. This is insufficient, I argue, because many regimes with obvious incentives to curb repression (especially democracies) fail to do so. In addition to regime-type, therefore, the answer depends on whether a given regime can count on the cooperation of its military and law enforcement institutions, which I refer to collectively as the security apparatus. This is because security agents’ prior experiences usually create …
Correlating With Local Variation In Collagen Level And Mechanical Properties Of The Heart Tissues, Talayeh Tavangar
Correlating With Local Variation In Collagen Level And Mechanical Properties Of The Heart Tissues, Talayeh Tavangar
Electronic Theses and Dissertations
The determination of the myocardium's tissue properties is essential in constructing finite element (FE) models of the heart. To obtain accurate results, especially for functionally modeling the heart, we must determine the tissue properties in-vivo. The calculation of the heart tissue properties remains a challenging area as it is categorized as a heterogeneous, anisotropic, nonlinear soft tissue that undergoes large deformation. In this work, we tried to introduce and evaluated a finite element method to determine the mechanical properties of the cardiac tissue. The introduced method combined a finite element modeling with the experimentally obtained images from the left and …
Lawyer Speech, Investigative Deception, And The First Amendment, Rebecca Aviel, Alan K. Chen, False
Lawyer Speech, Investigative Deception, And The First Amendment, Rebecca Aviel, Alan K. Chen, False
Sturm College of Law: Faculty Scholarship
It seems unassailable that attorneys must refrain from deception or dishonesty of any kind as a condition of professional licensure. But this principle, one of the foundational norms of the legal profession, may well infringe upon First Amendment rights, at least in certain applications. In this Article, we confront the tension between an attorney’s expressive and associational rights and her professional duty of absolute honesty. We explain that the latter must yield to the former in the unique circumstances presented by undercover investigations, where attorneys work side-by-side with journalists, civil rights testers, political activists, and others who seek to expose …
Math Achievement Of Low-Socioeconomic Status Students: A Comparative Study Of Public-School Settings, Alexander Ohene Ansah
Math Achievement Of Low-Socioeconomic Status Students: A Comparative Study Of Public-School Settings, Alexander Ohene Ansah
Electronic Theses and Dissertations
In recent years, falling standards in the American public-school system have elicited public concern and criticism, leading to several public-school reforms. One such reform is the charter-school movement. Charter schools provide a public option for parents in search of an alternative to traditional public schools. At the same time, the achievement gap continues to widen, with students of low socioeconomic status on the losing end. Since the beginning of the charter school movement, research has focused on comparisons in achievement between students in charters and traditional public schools. Results have been mixed.
Focusing on low-SES student populations in Colorado, this …
War Of Words: A Rhetorical Analysis Of The Military's Sexual Assault Prevention Posters, Nancy Thurman Clemens
War Of Words: A Rhetorical Analysis Of The Military's Sexual Assault Prevention Posters, Nancy Thurman Clemens
Electronic Theses and Dissertations
Joining the expanding discourse surrounding language and its effects, specifically regarding the performance of gender in a hypermasculine environment, this dissertation offers a rhetorical analysis of the United States Department of Defense's sexual assault prevention and response training materials, particularly posters created between 2009 and 2012. This dissertation examines the context of sexual harassment and assault within the military from the late 1970s until the mid-2000s. Presenting scandals that led up to the development of the Department's Sexual Assault Prevention and Response (SAPR) program, I give a brief history of the establishment and scope of responsibility for the program in …
Criminalized Houseless Women, Jesus, And The Praxis Of Kinship: An Outsider’S Liberative Ethic, Sarah A. Neeley
Criminalized Houseless Women, Jesus, And The Praxis Of Kinship: An Outsider’S Liberative Ethic, Sarah A. Neeley
Electronic Theses and Dissertations
Criminalization measures, such as Denver’s Urban Camping Ban, are an attempt to mask systemic causes of houselessness and assign blame to the personal failures of those living on the streets. Unaccompanied houseless women utilize street families to create community, survive houselessness, and fight criminalization measures. Since liberation and solidarity can become forces of oppression, this dissertation considers cultural evidence for the desire and means of liberation. Street families and the praxis of kinship form the basis of a liberative ethic that critiques systemic causes of houselessness and provides a model of relatedness that works toward social justice. The project is …
Luke Was Not A Christian: Interdisciplinary Perspectives On The Jewish Authorship Of Luke And Acts, Joshua Paul Smith
Luke Was Not A Christian: Interdisciplinary Perspectives On The Jewish Authorship Of Luke And Acts, Joshua Paul Smith
Electronic Theses and Dissertations
This dissertation challenges the long-held assumption that the Gospel of Luke and the Acts of the Apostles were written by a gentile Christian, arguing instead that the author of these texts was an educated follower of “the Way” who was raised and enculturated within a Hellenistic Jewish context. Advancing from a consciously interdisciplinary perspective, it probes the question of Lukan authorship variously from reception history and social memory theory, intertextuality studies, thematic analysis informed by historical and literary criticism, and incorporates emerging insights from the field of cognitive linguistics. It concludes with a reflection upon some of the potential ethical …
Deep Learning Methods For Fingerprint-Based Indoor And Outdoor Positioning, Fahad Alhomayani
Deep Learning Methods For Fingerprint-Based Indoor And Outdoor Positioning, Fahad Alhomayani
Electronic Theses and Dissertations
Outdoor positioning systems based on the Global Navigation Satellite System have several shortcomings that have deemed their use for indoor positioning impractical. Location fingerprinting, which utilizes machine learning, has emerged as a viable method and solution for indoor positioning due to its simple concept and accurate performance. In the past, shallow learning algorithms were traditionally used in location fingerprinting. Recently, the research community started utilizing deep learning methods for fingerprinting after witnessing the great success and superiority these methods have over traditional/shallow machine learning algorithms. The contribution of this dissertation is fourfold:
First, a Convolutional Neural Network (CNN)-based method for …
Recycling Of Fiber Polymer Matrix Composites In Cementitious Materials, Edward Patton Clark
Recycling Of Fiber Polymer Matrix Composites In Cementitious Materials, Edward Patton Clark
Electronic Theses and Dissertations
Recycling options for fiber polymer matrix composite waste materials are limited because they typically cannot be reused, reprocessed for down-cycling, and are generally environmentally unfriendly. The utility industry, specifically electrical distribution, has been increasingly using hybrid carbon, glass fiber, and epoxy resin composite rods for high-voltage (HV) conductor transmission lines. The high-voltage conductor core (HVCC) used in the transmission line can have an optimal in-service-life of roughly several decades, in which the material is then retired to a waste landfill. Currently, there is limited research and recycling methodology for these hybrid composite rods. In this research, powder carbon fiber, glass …
Lebanese Colonial Hang-Ups: Anti-Blackness And The Kafala System In Lebanon, Sarah Gonzalez Noveiri
Lebanese Colonial Hang-Ups: Anti-Blackness And The Kafala System In Lebanon, Sarah Gonzalez Noveiri
Electronic Theses and Dissertations
Lebanon’s colonial legacy has not only influenced the legal and political systems which operate in the country today. As I hope to demonstrate in this dissertation, the strength and cementation of these systems can be seen as a consequence of negotiations of identity, citizenship and nation state that took place during the Ottoman Empire and French colonial rule. The Kafala is one of such systems that developed through the Ottoman Empire and against the backdrop of European colonization. Discourses of race, citizenship, gender and sexuality that were being negotiated by colonial citizens and colonial powers, served to cement the racialized …
Community Unclaimed: Plurality And The Problem Of Sovereignty In Bataille, Nancy, And Blanchot, Gregory J. Grobmeier
Community Unclaimed: Plurality And The Problem Of Sovereignty In Bataille, Nancy, And Blanchot, Gregory J. Grobmeier
Electronic Theses and Dissertations
This dissertation takes up the exchange between three prominent French thinkers on the question of “community”: Georges Bataille, Jean-Luc Nancy, and Maurice Blanchot. Taken together, and starting with Bataille’s prewar writings and communitarian activism in the 1930s, the exchange between them now spans nearly a century. Georges Bataille’s importance as a political thinker and writer was brought out of relative obscurity with the publication of Jean-Luc Nancy’s “La Communauté désoeuvrée” in 1983. Less than a year after the appearance of Nancy’s inaugural essay, Maurice Blanchot, a close friend of the late Bataille, published La Communauté inavouable. Blanchot’s text was …
The Martyr’S Desire: Levinas, Girard, And Infinite Responsibility, Joshua Alan Lawrence
The Martyr’S Desire: Levinas, Girard, And Infinite Responsibility, Joshua Alan Lawrence
Electronic Theses and Dissertations
Perhaps the whole of human history could be summed up with one word: economy. The law of the home and the home of all law. Without fail, this situation results in a structured devotion that must decide what to do with desire. And the economic decision often follows a violent trajectory, most commonly described as sacrifice. Today, states will make efforts to conceal this underlying logic, but the insidious configurations of ‘real politik’ usually surface with a frightening intensity.
My project considers these problematic vestiges through Emmanuel Levinas’s reconfiguration of subjectivity. To address these bio-historical realities, my work highlights the …
Plantation Economy Model As Developed By Lloyd Best And Kari Polanyi Levitt: The Case Of Jamaica, Paula-Leone Samuda
Plantation Economy Model As Developed By Lloyd Best And Kari Polanyi Levitt: The Case Of Jamaica, Paula-Leone Samuda
Electronic Theses and Dissertations
Lloyd Best and Kari Polanyi Levitt created the Theory of the Plantation Economy as an analytical tool for understanding the causes of underdevelopment in the Caribbean region. The theory provides a break from the classical understanding of developing economies as simply pre-industrialized societies. Instead, the theory tracks uneven development through analysis of metropole-hinterland relations, which account for the legacy of slavery, colonialism, and mercantilism on the structure of the global economy. In doing so, Plantation Theory is able to draw a clear link between underdevelopment in the hinterland and development in the metropole. Examining the usefulness of the Theory of …
Fxs-Causing Point Mutations In Fmrp Disrupt Neuronal Granule Formation And Function, Emily L. Starke
Fxs-Causing Point Mutations In Fmrp Disrupt Neuronal Granule Formation And Function, Emily L. Starke
Electronic Theses and Dissertations
Fragile X Syndrome (FXS) is a neurodevelopmental disorder caused by the disruption of Fragile X Mental Retardation Protein (FMRP) function in neurons, affecting nearly 1 in 7,500 individuals. Although FXS typically occurs from a complete loss of FMRP expression due to a CGG trinucleotide expansion within the 5’UTR of the FMR1 gene, single nucleotide polymorphisms (SNPs) within the KH domains of FMRP have been shown to severely disrupt FMRP function. FMRP is an RNA-binding translation repressor that interacts with ~4% of the neuronal transcriptome. Many target mRNAs encode for proteins important for regulating synaptic processes and modulate synaptic plasticity. It …
Student Expressions Of Aesthetic Learning Experiences, Jodie L. Wilson
Student Expressions Of Aesthetic Learning Experiences, Jodie L. Wilson
Electronic Theses and Dissertations
Aesthetic learning experiences are grounded in qualities influenced by the arts: perceptive, sensorial, imaginative, and creative. While the concept of aesthetic experience has been applied broadly within education, student expressions of such experiences have been neglected. This poses a problem of equity both ethically in that the suppression of student voice is perpetuated and pragmatically in that the range and form of aesthetic learning expressed by students is insufficiently attended to and acted upon.
Theoretically guided by John Dewey’s explications of an aesthetic experience and conceptually supported by three interpretive frames—Eisner’s dimensions of schooling, Uhrmacher et al.’s instructional arc, and …
Becoming Global Lawyers? A Comparative Study Of Civic Professionalism, John Bliss
Becoming Global Lawyers? A Comparative Study Of Civic Professionalism, John Bliss
Sturm College of Law: Faculty Scholarship
Through their professional education and training, new lawyers are generally encouraged to adopt a civic vision of professional identity. This article explores convergences and diverges in how new lawyers entering an increasingly globalized legal profession conceive of their civic roles in different national contexts. In particular, I examine corporate lawyers-in-training in the U.S. and China, drawing on interviews and a cross-cultural identity mapping method to compare their accounts of the lived experiences of civic professionalism. I find that professional identity formation in the U.S. sample is largely marked by role distancing and a sense of constrained public-interest expression. In contrast, …
Intimate Partner Violence Through The Eyes Of The Military “Dependent” Spouse, Xander Franklin, Tamara Kuennen
Intimate Partner Violence Through The Eyes Of The Military “Dependent” Spouse, Xander Franklin, Tamara Kuennen
Sturm College of Law: Faculty Scholarship
Throughout this Article, we will examine the extraordinary challenges faced by partners of military members when their relationships become abusive. Few legal scholars have written about the phenomenon; of them, most focus on the servicemember’s—not the partner’s—experience. This Article seeks to fill that gap by providing a contextual analysis of abuse as a continuing process, rather than a discrete incident, and by using the military setting to throw into sharp relief the structural facilitators that too often fade into the background. By constructing this analytical framework, we seek to create analytical applications beyond the confines of a military installation to …
Privacy Losses As Wrongful Gains, Bernard Chao
Privacy Losses As Wrongful Gains, Bernard Chao
Sturm College of Law: Faculty Scholarship
Perhaps nowhere has the pace of technology placed more pressure on the law than in the area of data privacy. Huge data breaches fill our headlines. Companies often violate their own privacy policies by selling customer data, or by using the information in ways that fall outside their policy. Yet, even when there is indisputable misconduct, the law generally does not hold these companies accountable. That is because traditional legal claims are poorly suited for handling privacy losses.
Contract claims fail when privacy policies are not considered contractual obligations. Misrepresentation claims cannot succeed when customers never read and rely on …
We All Want To Change The World: How Behavioral Insights Can Help Reduce Carbon Emissions, Thomas C. Gifford
We All Want To Change The World: How Behavioral Insights Can Help Reduce Carbon Emissions, Thomas C. Gifford
Electronic Theses and Dissertations
The world is in the midst of an unprecedented environmental crisis driven primarily by human behavior. As the world has globalized, countries have developed, and standards of living have improved, global pollution has skyrocketed and has resulted in a wide range of environmentally destructive outcomes. All paths to environmentally sustainable development involve a dramatic cut in carbon emissions from current day levels. In this thesis, I explore how the omission of behavioral factors from mainstream neoclassical models has contributed to, and can aid in reducing unsustainably high levels of carbon emissions. Throughout the history of economic thought, classical economists such …
Resentenced And Released: Re-Entry Needs Following Release From Juvenile Life Without Parole, Daphne M. Brydon
Resentenced And Released: Re-Entry Needs Following Release From Juvenile Life Without Parole, Daphne M. Brydon
Electronic Theses and Dissertations
Over 2,100 individuals serving juvenile life without paroles (JLWOP) sentences in the U.S. became eligible for resentencing following the 2016 Montgomery v. Louisiana Supreme Court ruling. Michigan housed an estimated 370 juvenile lifers at that time, the second largest JLWOP community in the country and has since resentenced and released approximately 120 juvenile lifers. Folx released from prison encounter many barriers to successful re-entry. Barriers are often amplified for those incarcerated as adolescents. Further, services are de-prioritized for folx serving JLWOP sentences, which can be especially damaging for this community whose life experiences are marked by high rates of trauma, …
Examining Experience, Role, And Lgbtq Identity In Department Chairs, Ashton B. Clouse
Examining Experience, Role, And Lgbtq Identity In Department Chairs, Ashton B. Clouse
Electronic Theses and Dissertations
LGBTQ rights have progressed tremendously in recent times, not long ago LGBTQ individuals could be arrested simply for being themselves. Though many rights have been won, the fight for equity continues. This is especially true in the field of education, many think of higher education as a pathway to equity, but in reality it can serve to solidify societal inequities. Campus climate studies of LGBTQ faculty members in higher education show that climate is most impactful at the departmental level (Nichols & Scott, 2005), others highlight the importance of department chairs in fostering climate within their departments (Bystydzienski et al., …
Undergraduate Teaching Excellence Through The Aesthetic Lens Of Crispa, Paula Adamo
Undergraduate Teaching Excellence Through The Aesthetic Lens Of Crispa, Paula Adamo
Electronic Theses and Dissertations
In times where only 60% of college students are graduating (NECS, 2018), the need to help undergraduates thrive in college is vital. Because faculty have a crucial role in this profound endeavor, this study examines the intentions (intentional curriculum) of four undergraduate instructors identified by colleagues and students as good teachers. The study also examines what students take away from their instructors and classes (received curriculum) and looks at how elements of the aesthetic approach to teaching and learning known as CRISPA emerge naturally in the curricula in order to demonstrate the proposition that good teachers, at any level, implement …
“I Shan't Ever Play Down These Influences”: Poulenc’S Neoclassicism As Musical Legacy, Juliet E. Levy
“I Shan't Ever Play Down These Influences”: Poulenc’S Neoclassicism As Musical Legacy, Juliet E. Levy
Electronic Theses and Dissertations
Leaving behind an abundance of primary documents, Francis Poulenc (1899-1963) reveals himself to be a colorful, opinionated composer, with an intriguing mindset regarding the role of twentieth-century composers. Poulenc’s writings place importance on the idea of musical legacy, where engaging with the music of past composers can only enrich compositions of the present, as opposed to the idea that such inspiration makes one’s work less “original.” This idea of compositional heritage stems from Poulenc’s musical education, which was informal, and mainly the product of his robust social network of important musical and artistic figures. Poulenc’s ideology adds a new perspective …

Health Insurance And Bankruptcy Risk: Examining The Impact Of The Affordable Care Act, 86 Brooklyn Law Review ____ (Forthcoming 2021) (Co-Authored With Tim Wadsworth), Philip M. Pendergast, Michael D. Sousa, Tim Wadsworth
Sturm College of Law: Faculty Scholarship
As is well-known, the Affordable Care Act (“ACA”) is an incredibly hot political issue across the country. The ACA was originally proposed in large measure due to the destruction that outstanding medical bills can have on family finances. Most of the existing legal scholarship on medical debt and bankruptcy over the past forty years has tried to answer the question of what percentage of bankruptcy filings are “medical bankruptcies.” To date, this effort has proven inconclusive.
In this Essay, we ask a much more timely and substantive question, namely, what is the relationship between possessing health insurance and the risk …
Operationalizing A New Method For Defining And Scaling Social Innovations Using Tiny Home Communities As A Case Study, Jennifer H. Wilson
Operationalizing A New Method For Defining And Scaling Social Innovations Using Tiny Home Communities As A Case Study, Jennifer H. Wilson
Electronic Theses and Dissertations
Social innovations are new approaches to addressing unmet need. In an increasingly globalized and interconnected world, social innovations propagate rapidly in response to the dynamic conditions of our modern world. An example of an emergent social innovation, tiny home communities are gaining traction as a more economically, socially, and environmentally favorable response to homelessness and inadequacies in the current shelter and housing system. The use of tiny homes communities (that is, intentional clusters of small-scale structures) as an innovative response to homelessness is relatively new. As such, there is limited empirical evidence on the topic. Lack of research and defined …

Frivolous Defenses, Thomas D. Russell
Sturm College of Law: Faculty Scholarship
This article is about civil procedure, torts, insurance, litigation, and professional ethics. This is an empirical piece with data drawn from a sample of 356 answers to 298 complaints in car crash lawsuits to identify various ways that, I argue, insurance defense lawyers evade the rules of civil procedure and, frankly, act unprofessionally.
The empirical center of this piece examines 356 answers in car crash personal injury cases in Colorado’s district courts. First, I situate these cases within dispute pyramid elements including the total number of miles-traveled within Colorado and also with respect to the volume of civil litigation.

Kidney, Money, And The Shī‘Ah Implementation Of The Rule Of Necessity, Zahra Takhshid
Sturm College of Law: Faculty Scholarship
In the U.S., over 43,000 people die every year waiting for a kidney. In Iran, however, monetary incentives have eliminated such a waitlist. Iran is the only country in the world with an unrelated living kidney donor program that has allowed for monetary incentives in the form of an altruistic gift, which has become known as “the Iranian Model.” Nevertheless, the legal details of the system remain vague and scholars both in and outside of Iran continue to debate the nature of the system. Does the Iranian system consider kidneys a commodity? Can you legally buy a kidney in Iran? …

Cheap Speech Creation, 54 U.C. Davis L. Rev. 2405 (2021), Alan K. Chen
Sturm College of Law: Faculty Scholarship
As we look back on Professor Eugene Volokh’s predictive article about cheap speech, it is worth examining what other elements of the speech and media landscape, as well as the supporting legal infrastructure, have changed over that same period. This Essay focuses on the substantial reduction in the cost of speech creation, as opposed to distribution. After briefly discussing the accuracy of many of Volokh’s most important predictions, it examines innovative technological changes that have enabled a larger number and more diverse range of people to engage in speech creation because of the rapidly shrinking costs of doing so by …
