President's Foreword, Raymond A. Roesch S.M.
University of Dayton Law Review
Message from University of Dayton President Father Raymond A. Roesch, S.M.: So many pleasant emotions are connected with publication of this first issue of the Law Review. Perhaps foremost is pride in the rapid progress of the Law School since its rebirth in August of 1974. There were some who predicted at that time that history would repeat itself: as the original Law School was forced to close during the Great Depression, so might this venture fail in the face of unprecedented inflationary economic conditions. Happily, the pessimists have so far proven incorrect. And while the challenges inherent in every …

A Comment on Cox Broadcasting Corp. v. Cohn, 95 S.Ct. 1029 (1975).
Rape is a crime in which a greater social stigma is often attached to the victim than to the perpetrator. A robbery victim is rarely made to feel that he "asked for it," but a rape victim frequently is. In implicit recognition of the "chilling effect" this situation has on reports and prosecutions of rape offenses, the legislatures of Georgia' and of several other states' have enacted statutes prohibiting media disclosure of a rape victim's name or identity. That the identity of a rape victim is in our …

Jersey Central Power and Light Co. v. Local 327, IBEW, 508 F. 2d 687 (3d Cir. 1975).
Title VII of the Civil Rights Act of 1964, as amended by the Equal Opportunity Act of 1972,' has produced a variety of complex legal problems. Included, due to the recent recession, has been the conflict between the Act's interpretation and contractual seniority rights during layoffs.' Resolution of the issue of whether layoffs in reverse order of seniority violate Title VII influences not only contractual relations between unions and corporations, but also the strength of the Equal Employment Opportunity Commission,' and the effectiveness …

University of Dayton Law Review
Abortion: Right of Minors to Abortion Without Parental Consent, State v. Koome, 84 Wash.2d 901, 530 P.2d 260 (1975).
The Supreme Court of Washington recently has shed some light upon the murky legal area of the constitutional rights of minors. In State v. Koome, the Court held that the state could not require an unmarried pregnant woman under the age of eighteen to obtain her parents’ permission in order to have an abortion. This decision extended the now constitutionally protected right of privacy with regard to abortion as set out for adults by the United States Supreme Court to all …

Tarlton v. Saxbe, 507 F.2d 1116 (D.C. Cir. 1974).
The use and dissemination of criminal records for routine suspect checks, sentencing and parole hearing has been the subject of much recent discussion. Much of the controversy revolves around the increased access to criminal history files through the FBI's National Crime Information Center (NCIC) which serves as a clearing house for law enforcement agencies throughout the nation. Due to conflicting court decisions and varying state statutes, the rights, requirements and limitations for expunging these records are presently in a state of confusion.
Sex Discrimination: Female Participation In Little League Baseball, Terry Miller
Sex Discrimination: Female Participation In Little League Baseball, Terry Miller
University of Dayton Law Review
King v. Little League Baseball, Inc., 505 F.2d 264 (6th Cir. 1974).
Do girls have the constitutional right to participate on an equal basis with boys in Little League baseball? According to King v. Little League Baseball, Inc., girls do not even possess the right to have this question answered by a federal court. This suggests that the paramount consideration in cases challenging sexual discrimination by private athletic organizations is not the presence of a right, but the existence of a remedy.
