There is probably no subject more sensitive to an employer today than "discrimination." The mood of the country and the "persuasive encouragement" of legislation and governmental enforcement, are making employers acutely aware of their obligation to eradicate any type of discrimination in the hiring, paying, promotion and termination of any of their employees. The Equal Employment Opportunity Commission, in its enforcement of Title VII of the Civil Rights Act and the Equal Employment Opportunity Act, acts as the vanguard on many of the attacks on discrimination due to race, creed, religion, or national origin.' Much litigation in the past has dealt with the rights of college students. It was the landmark decision of Dixon v. Alabama State Board of Education which first held that procedural due process was to be applied to the disciplinary actions of colleges and universities. Following that decision, the courts generally have adopted a standard of fairness and reasonableness when considering whether or not a student's rights to due process were violated. In Williams v. City of New York the Second Circuit Court of Appeals denied an award of exemplary damages in a suit for malicious prosecution citing as authority numerous New York state cases. New York's common law has refused to award punitive damages against a municipal corporation. Samuel Tito Williams was arrested in 1947 and accused in the murder of a young black girl. Maria McGowan was the wife of E.J. McGowan, a United States national who owned 37 acres of land in Mississippi. McGowan died intestate in Panama on October 31, 1957.

His brother, H.E. McGowan, a Mississippi resident, was notified of the death by a United States consular report which indicated that Maria was the decedent's widow and listed her address.
