One of the most crucial issues facing courts in recent years is the admissibility of novel scientific evidence. There is obviously a strong temptation to use a scientific process or machine that purports to provide unbiased information free from the many competency and credibility problems associated with testimonial evidence. One such process, called spectrographic analysis, is now being favorably received by the courts despite its substantial shortcomings. Spectrographic analysis-popularly known as "voiceprints"- is a technique for the identification of voices with the aid of a machine known as the sound spectrograph. Sensational crimes are often the focal point of extensive news coverage. If the media's reporting is objective, it may not significantly infringe upon the defendant's right to a fair trial as guaranteed by the fifth and sixth amendments. Extensive pretrial publicity, however, necessarily raises the possibility of prejudice, even though the information reported may be true. Despite the fact that the coverage may have resulted from the defendant's misdeeds, he is nevertheless entitled to be tried by persons who have not prejudged his case. …

Few would deny the extensive authority possessed by the states to establish, regulate, and supervise the educational systems within their respective domains. However well-established that authority may be, states and school officials unmistakably remain subject to the provisions of the Federal Constitution via the supremacy clause. Roe v. Ingraham, 403 F. Supp. 931 (S.D.N.Y. 1975) prob. juris. noted sub nom., Whalen v. Roe, 44 U.S.L.W. 3471 (U.S. Feb. 24, 1976).

In Roe v. Ingraham, the United States District Court for the Southern District of New York held that sections of the New York Public Health Law requiring reporting of names and addresses of persons receiving prescriptions for specific drugs to a central data bank were unconstitutional in that they intruded upon and interfered with the constitutional right of privacy inherent in the doctor-patient relationship. United States v. Stewart, 531 F.2d 326 (6th Cir.), cert. denied, 96 S.Ct. 2629 (1976). In 1970, under heavy nationwide pressure to take action against the escalating crime problem, Congress passed the Organized Crime Control Act. Undoubtedly the most controversial new provision of this Act is Title X of the Dangerous Special Offender Act, which provides increased penalties for habitual or professional criminals convicted of a triggering felony. Few problems have plagued the courts in the last decade with greater persistence than those associated with obscenity. The concept of obscenity varies from place to place and from time to time, and since it is essentially a subjective concept, it also tends to vary from person to person. The development of a concept of "community standard" recognizes that diverse viewpoints exist and has resulted in the consideration by courts of the concept of obscenity in light of a local standard rather than a national one. In the past fifteen years the plight of the physically abused child has received extensive attention in medical, legal, and sociological journals. The result has been the emergence of a new medical diagnosis known as the battered child syndrome. The syndrome takes its name from the "battering" the child receives from his abusive parent(s) or ostensible caretaker.
