The Taxation Of Family Religious Orders, Albert Feuer
The Taxation Of Family Religious Orders, Albert Feuer
University of Dayton Law Review
Some promoters have reportedly claimed that individuals may avoid income taxes without changing their life styles in any manner by using a kit available at a substantial price to form and utilize a “family religious order,” i.e., a religious order consisting of an individual and his immediate family; the individual directs the order as its minister. In accord with a “vow of poverty” the family members assign all their assets, income, and the use of their personal services to the family religious order. In return, the family religious order provides the family members with all their former living expenses, including …

H.B. 835: Ohio's Response To The Domestic Violence Dilemma, Mark R. Chilson
H.B. 835: Ohio's Response To The Domestic Violence Dilemma, Mark R. Chilson
University of Dayton Law Review
Domestic violence is most often manifested by repeated, deliberate and severe beatings of family or household members. Victims frequently suffer broken bones, concussions, miscarriages or other physical injuries. The abused family or household members are also subjected to serious psychological and emotional injuries. Even though domestic violence impacts most clearly upon the victims, the assailants, too, are not without injury, often suffering from some type of mental illness, alcohol or drug abuse problem. The traditional view is that domestic violence does not exist, or if it exists, it must be dealt with privately. Today this view inappropriately deals with the …

Income Tax Aspects Of The Vow Of Poverty, Nancy H. Wilberding
Income Tax Aspects Of The Vow Of Poverty, Nancy H. Wilberding
University of Dayton Law Review
Religious orders, which by their nature are typically under the jurisdiction and control of a church, were present in the United States long before the enactment of the sixteenth amendment which authorized the present federal income tax. The Internal Revenue Code generally defines gross income for individuals and organizations alike as income from whatever source derived. Nevertheless, certain organizations which are tax-exempt are not required to pay tax on their income, unless the income is from a business unrelated to the exempt purposes of that organization. It is typical for many religious orders to require a member to take a …
