S.B. 297: Procedural Changes In Civil Commitment For Those Found To Be Not Guilty By Reason Of Insanity In Ohio, Frank Nagatani, Ned J. Nakles

In April 1980, the Ohio General Assembly enacted Senate Bill 297. The bill was promulgated to provide specific changes in the procedures for the civil commitment and release hearings of persons found not guilty by reason of insanity (NGRI). This legislation was enacted as an emergency measure in response to increasing public unrest over the release of NGRI patients. Much of the concern was seemingly precipitated by recent, well publicized trials in which the defendants pled not guilty by reason of insanity following charges of murder. Religious orders, which by their nature are typically under the jurisdiction and control of a church, were present in the United States long before the enactment of the sixteenth amendment which authorized the present federal income tax. The Internal Revenue Code generally defines gross income for individuals and organizations alike as income from whatever source derived. Nevertheless, certain organizations which are tax-exempt are not required to pay tax on their income, unless the income is from a business unrelated to the exempt purposes of that organization. The spread of contagious diseases has been a major problem that has plagued society throughout history. In the recent past, smallpox and polio have struck down thousands of individuals, and today German Measles and other serious viruses continue to threaten the health of our population. Fortunately vaccines have been developed that help prevent these diseases from spreading through our population, and presently a large number of the communicable diseases can be combatted.

Perhaps one of the greatest aids to beleaguered municipal and county police forces in the fight against crime is the use of special policemen by department stores and factories. As is often the case with any good preventative, however, there is great potential for abuse. While special police beneficially free more regularly employed municipal and county police officers for other duties, their increasing use is beginning to raise a number of legal issues which are not easily resolved.

Our society has witnessed, in recent years, the growing menace of drug abuse in the United States. In an effort to curb the distribution and sale of controlled substances such as marijuana, police have resorted to novel means of ferreting out concealed drug caches. The use of specially-trained animals to detect odoriferous drugs among the personal effects of suspicious persons is currently favored by both courts and law enforcement agencies. Computerized Criminal Records: The Duty Of The Fbi To Maintain And Disseminate Accurate Files, Barbara Pugliese Gorman

Tarlton v. Saxbe, 507 F.2d 1116 (D.C. Cir. 1974).

The use and dissemination of criminal records for routine suspect checks, sentencing and parole hearing has been the subject of much recent discussion. Much of the controversy revolves around the increased access to criminal history files through the FBI's National Crime Information Center (NCIC) which serves as a clearing house for law enforcement agencies throughout the nation. Due to conflicting court decisions and varying state statutes, the rights, requirements and limitations for expunging these records are presently in a state of confusion.
