Assembly Constitutional Amendment 20. Adds section 31c to Article IV of Constitution. Declares Legislature may enact general laws for refunding, repayment or adjustment, from public funds raised or appropriated by United States, the State or its political subdivisions for street and highway improvement purposes, of assessments or bonds or any portion thereof, which have become a lien on real property and were levied or issued to pay costs of such improvements which may be, or may have become, of more than local benefit. Ratifies any such acts of Legislature heretofore adopted.

Assembly Constitutional Amendment 39. Amends section 31 of Article IV of Constitution. Authorizes water districts and water conservation district, for the purpose of acquiring water, water rights and other necessary property to acquire and hold stock of Corporations owning water, water rights, canals, water works and franchises. Authorizes treasurer of political subdivision under resolution of governing body thereof to make temporary transfer of funds in his custody to pay interest and principal of bonds issued by such subdivision.

Referendum against Chapter 51, Statutes 1935 entitled "An act relating to revenue and taxation, providing for an excise tax on the sale of all oleomargarine containing any fat or oil ingredient other than anyone or more of the following: oleo oil, oleo stock, oleo stearine from cattle, neutral lard from hogs, sheep fat, cottonseed oil, peanut oil, corn oil, or milk fat; providing a penalty for a violation of the provisions thereof," which act imposes a tax of ten cents per pound on oleomargarine (therein defined) sold or offered for sale in California.

Authorizes in eminent domain proceedings the taking of immediate possession of right of way, property, or lands acquired for public use upon deposit in court of money to pay subsequent award of compensation.

Permits reenacting or continuing 1935 statute imposing vehicle license fee based on value, provided revenue, excluding collection costs and subventions to counties and municipalities, is first applied to obligations under State highway bonds outstanding when measure becomes effective.

Provides a method by which any county, regardless of population, having one or more incorporated cities within its boundaries, may frame and adopt a charter for a consolidated city and county government having same boundaries as the former county. (Present constitutional provision excludes counties having less than 200,000 population from the right to adopt such a consolidated government, and permits establishment of a city and county government for area comprising only a portion of the former county.)

Assembly Constitutional Amendment 42. Amends Constitution section 9a, Article XIII. Declares taxes levied for any current tax year upon personal property and assessments upon possession of or upon claim or right to possession of land and taxable improvements on land exempt from taxation, if not a lien upon land of sufficient value to secure their payment, shall be based upon tax rates tor preceding tax year upon similar property where taxes were a lien upon land of sufficient value to secure payment thereof. Permits equalization of assessment on such property.

Vests State Tenure Board and local school boards with jurisdiction to hear and decide charges against instructor, prescribing procedure therefor, permitting instructors to appear and defend, and empowering State Tenure Board to sustain or overrule such decisions of local school board.

Authorizes Los Angeles County, upon assent of two-thirds qualified electors voting thereon, to incur an indebtedness, not exceeding five million dollars, and issue tax exempt bonds therefor; funds to be used by Pacific Exposition, a corporation to finance, under conditions prescribed by county board of supervisors, an exposition in said county commemorating completion of Boulder Dam. Bonds to mature within forty years; interest not exceeding six per cent annually. County directed to levy special annual property tax for interest and sinking fund requirements.

Creates Court of Criminal Appeals consisting of a Chief and four Associate Justices (twelve-year terms, salaries same as Supreme Court Justices) to succeed to jurisdiction of Supreme Court in death penalty cases and criminal jurisdiction of District Courts of Appeal. Governor appoints first Justices of Court of Criminal Appeals for specified terms, thereafter offices are elective. Grants Supreme Court limited appellate power to pass on validity of a law after decision thereon by Court of Criminal Appeals.
