Aaron’S Law: Bringing Sensibility To The Computer Fraud And Abuse Act, Mark Murfin

Southern Illinois University Law Journal

The Computer Fraud and Abuse Act is a federal law that governs the crime of computer hacking.  However, it was written in a time before the internet as we know it existed.  Aaron’s Law is the latest proposal aimed at fixing it.  Aaron Schwartz, the law’s namesake, tragically committed suicide while being prosecuted for a violation of this law.  This Comment argues that Aaron’s Law is a good step forward, but not the overhaul this nation deserves.

Freshwater resources are critical features of the landscape and are threatened by many phenomena (e.g., eutrophication, invasive species, climate change, acid rain). The importance of fresh waters requires that scientists continually improve their tactics and technologies for broader understanding. Increasing use of automated sensors to collect environmental data creates a need for training of environmental scientists. In this paper, we present case studies based on a doctoral training program. For each case study presented, the goals and overall recommendations for adaptation to other programs are discussed. This work rethinks current interpretations of American exceptionalism, emphasizing dynamic relations, especially those we could call "ironic." I am reading Reinhold Niebuhr's The Irony of American History alongside Eric Voegelin's and Woodrow Wilson's philosophical and political treatment of freedom, expressed through the ideal of American personhood. American entertainment continues to spread globally, and the spreading creates a wider nexus of efficacious relations, allowing for the interplay of hidden relations and symbolic complexes. "Ironic American exceptionalism," as I call it, highlights the positive aspects, usually overlooked, provided by "virtual integration" and the spawning of novel cultural hybrids. This paper is about a very complicated and multifaceted issue of corruption. The main purpose of this paper is to find the impact of development indicators which are political stability and violence, government effectiveness, regulatory quality, rule of law, voice and accountability on the control of corruption in Afghanistan. Furthermore we are interested to know the direction of causality among these variables. The data is analyzed through ordinary least square regression method. Assessment of agricultural extension education efforts in Afghanistan was conducted through a qualitative case study of eight U.S. support personnel serving in the country. Security & access and provincial diversity were two overriding factors which determined how the three key attributes of assessment, content and process (Barrick et al., 2009) were able to function in an Afghan agricultural extension education program. Respondents indicated training should focus on young farmers and local farm demonstration sites should be essential program components. Respondents stressed recruitment of agents from local districts when this would not imperil the agents or their families. Respondents also insisted …

Detainees in the War on Terror have been at Guantanamo Bay for over a decade.  The justification for these detentions has been, at least in part, the on-going hostilities in Afghanistan.  However, President Obama’s announcement in his 2013 State of the Union address that “by the end of [2014], our war in Afghanistan will be over” may undercut the continuing detention authority for at least some of these Guantanamo detainees.  This Article analyzes the legal doctrine of release and repatriation in light of President Obama’s announcement and concludes that the President’s determination that hostilities have concluded between specific Parties to …

Many of the detainees at the U.S. Naval Base at Guantanamo Bay, Cuba, have been held there for more than ten years by the U.S. government without formal charges or a trial.  This Article uses the story of Djamel Ameziane, an Algerian national captured in Pakistan in 2002 and handed over to U.S. authorities, to illustrate the problems that face many of the remaining detainees.  Mr. Ameziane’s case has languished in U.S. courts for eight years.  Failing to obtain timely relief from U.S. authorities, Mr. Ameziane has petitioned for relief from the Inter-American Commission on Human Rights.  His petition raises …

This essay examines the role of the (counterfeit) fashion industry in shaping democracy, citizenship, and human rights ideals in the United States. Using the Harper's Bazaar “Fakes are Never in Fashion” anti-counterfeiting advertisement campaign as a case study, I explore how race, class, gender, law, and human rights discourse, coalesce to systematically maintain exploited garment workers voiceless/rights-less while simultaneously preserving the material interest(s) of a White, capitalist, patriarchal, hegemonic global order. This study presents important implications for larger discussions of rights and justice. In this dissertation, I outline a theoretical justification for a new world systems analysis in order to understand economic development and underdevelopment, and stratification systems that emerge within nation states because of their global social location. I present my detailed case for amending Wallerstein's World-Systems Analysis by empirically incorporating the interplay of the military, economy and state as opposed to his primarily economic division of labor that defines the core, periphery and semi periphery. I do this by uncovering the latent structure of militarization and its articulation within the world system controlling for state strength. I also outline the basic …

Hal W. Trovillion's Role In Preserving The History Of "Bloody Williamson", Melissa A. Hubbard

Articles

This article examines the efforts of Hal W. Trovillion, newspaper editor and private printer, to document the controversial history of his southern Illinois coal mining town in the early twentieth century. As a historical case study, it explores some of the challenges inherent in preserving original documents and cultural knowledge without institutional support, and with active interference from community members who worked to suppress information. Trovillion used his printing presses and contacts in the historical community to ensure that the turbulent events occurring in his town in the 1920s would be preserved in the archival record.

This dissertation examines male bereavement in medieval literature, expanding the current understanding of masculinity in the Middle Ages by investigating both the authenticity and affective nature of grief among aristocratic males. My focus is on the pattern of bereavement that surfaces across genres and that has most often been absorbed into studies of lovesickness, madness, the wilderness, or more formalist concerns with genre, form, and literary convention, but has seldom been discussed in its own right. The main operating concern of all species in any ecosystem or natural environment is rooted in the battle for survival.  This constant battle for survival is most highlighted in the two main modes of species interaction; categorized as predation or competition.  This research focused on applying biological mathematics to analyzing predation relationships, especially the relationship between the Canadian Lynx and the Snowshoe Hare.  This predation relationship is quite special, because these species interact in a relatively isolated manner compared to others, meaning their populations fluctuated in a regular cycle.  These population fluctuations can be defined and analyzed mathematically using systems …
