A Second Bite At The Apple: An Analysis Of In Re Jackson And Attempting To Use The Right Of Publicity As A Quasi Remedy To Copyright Preemption, Reyna Herrera

Southern Illinois University Law Journal

The Second Circuit recently decided the case of In Re Jackson, where famous rapper Curtis Jackson ("50 Cent") brought suit against William Roberts ("Rick Ross") asserting a state law right of publicity claim, involving Jackson's song "In Da Club." Currently, many circuits are divided as to whether the federal Copyright Act preempts such a claim. This note discusses the history of both the federal Copyright Act and the right of publicity, and explores past circuit court decisions regarding both laws, noting an exception many circuits chose to adopt: the commercial use exception. This note analyzes the commercial use exception …

A Daycare Artist Residency In Minusio: Aesthetic Eunuciations In Borderspaces, R. Michael Michael Fisher Feb 2023

A Daycare Artist Residency In Minusio: Aesthetic Eunuciations In Borderspaces, R. Michael Michael Fisher

Artizein: Arts and Teaching Journal

This is a compilation of happenings from an artist residency at an urban core daycare and kindergarten site from July-December, 2021. The artist provides some notes on how to approach a residency, create site-specific art and work with the children, their teachers, care staff and the community surrounding the site. A newly coined concept of minusio, emerged over time and served as an invisible basis for art-care, in a sense the mirror(ing) of the gift of nurturing but also the lack of care—and offering a route to what human’s really desire, when they are not so busy and distracted …

Chicago Automated Red Light Enforcement Policy, Hailey Blanchard Jan 2023

Chicago Automated Red Light Enforcement Policy, Hailey Blanchard

Research Papers

As the use of automated speed enforcement expands, public debate remains over questions of equity around camera placement. When technological advances are made often the social impact lags behind the economic or legislative impact. In this paper, I examine the social equity of Chicago, Illinois speed camera enforcement. In this paper, I review the policy of red-light speed cameras in Chicago and the enforcement. Using publicly available data on the location of speed cameras and data on traffic accidents, I examine the placement of speed cameras in Chicago. I find that serious accidents are more likely in areas with higher …

Economic Analysis Of Alexander County, Jeffrey Myers

Research Papers

Since 2020, economies across the country and world have been recovering from one of the most unique and impactful events in modern history, COVID-19. The pandemic had an impact on both regional economies and national economies alike. Unlike most counties, Alexander County, Illinois was struggling before the pandemic. There were plans in place by the state government to hopefully improve the economic well-being of the area, but most of those projects were paused in the wake of COVID-19. This paper will examine the history of the county, various economic sectors, and the challenges faced ahead. The paper will conclude with …

Are You Her Nanny?, Ann Thomson Dec 2022

Are You Her Nanny?, Ann Thomson

Research Papers

This project aims to share the experience of a South Korean immigrant woman in the United States in her journey of adopting a White embryo through the medium of a photographic essay. In doing so, the objective is to explore how the changing ethnoscape of the world and Assisted Reproductive Technology (ART) is bringing the world together, the ways in which it has created a provision for an inversion of adoption norms simultaneously enabling mother-child bonding experiences from conception to childbirth, which is largely lacking in traditional methods of adoption. Although there are benefits and possibilities created via ART, any …

Tracing The Roots Of Resistance, Collective Action And Solidarity Among Igbo Women, Sebastian Ukoh Dec 2022

Tracing The Roots Of Resistance, Collective Action And Solidarity Among Igbo Women, Sebastian Ukoh

Theses

Most societies have always achieved balance through some internal mechanisms. Achieving gender balance and drawing lines without letting what we may term the "stronger sex" domineer the "weaker sex" is not always easy. Among the Igbos of South Eastern Nigeria, the women have always pressed home their demands without fear. We will be looking at how they have done this for more than a century, especially at the onset of the British colonial enterprise.

From Immigrant To Refugee: An Evaluation And Case Study Of The Historiography Surrounding Chinese Immigration To The Americas And Caribbean, 1840s-2000s, Joshua Cannon

Research Papers

From the middle of the nineteenth century to the early and mid-twentieth century, Chinese immigrants came to the Americas and the Caribbean in droves. Often these immigrants came to places like the American Mid-West, Peru, or Jamaica as indentured laborers. Ushered into nations hoping to obtain great riches to bring back to China, most of these immigrants fell into unfair and arduous labor contracts. This paper asks: what are the trends in this research, and where is it lacking? The work presented in this paper is in two parts. The first part explores the methodologies within prominent positions on Chinese …

South Texas Water Resource Mental Models: A Systems Thinking, Multi-Stakeholder Case Study, Chris Flores-Lopez, Benjamin L. Turner, Roger Hanagriff, Ammar Bhandari, Tushar Sinha

Journal of Contemporary Water Research and Education

The Coastal Bend (CB), Lower Rio Grande Valley (LRGV), and Wintergarden (WG) subregions of south Texas co-exist in similar socio-economic contexts but rely on markedly different water sources (CB: precipitation; LRGV: surface water; WG: groundwater). This has led to unique agricultural practices and municipal policies and reinforced mental models adapted specifically to each subregion, both of which are critical to understanding structural causes behind current water use and future water sustainability. To better stakeholder mental models in each subregion, semi-structured interviews were conducted with individuals with a significant stake in water resource use and management. Results indicated near unanimous consensus …

#Listentosurvivors: A Case Study Of Three Human Trafficking Awareness Campaigns On Twitter, Alex Rister Jul 2022

#Listentosurvivors: A Case Study Of Three Human Trafficking Awareness Campaigns On Twitter, Alex Rister

Kaleidoscope: A Graduate Journal of Qualitative Communication Research

Although human trafficking is a widespread issue impacting millions of people, anti-trafficking campaigns often misrepresent the problem. Media can distort the reality of trafficking and avoid addressing underlying issues such as violence against women. Digital activism is a critical strategy to accurately communicate human trafficking and in particular, Twitter is cited as important for such efforts. This case study examines 100 tweets from Polaris Project, Girls Educational and Mentoring Services, and End Slavery Now. A thematic analysis of 100 tweets was conducted to reveal three primary themes: realistic information of practical value, feminist voices and stories, and engagement with other …

Globalizing Sexual Violence: Charting A Path For Future Research, Adam J. Whiteside Jul 2022

Globalizing Sexual Violence: Charting A Path For Future Research, Adam J. Whiteside

Kaleidoscope: A Graduate Journal of Qualitative Communication Research

Sexual violence is a global issue with devastating consequences. Existing research primarily focuses on its prevalence globally or how countries understand sexual violence. Additionally, media reports often misrepresent sexual violence, fail to capture its complexities, and ignore larger gender issues at play. This article synthesizes extant research using a feminist intersectional approach to provide a basis for comparing how sexual violence is discursively constructed globally. More specifically, how historical, cultural, and socioeconomic discourses underscore the perpetration and media framing of sexual violence. To this end, I reviewed 49 articles on sexual violence in India and South Africa with an eye …

Coats Of Fire: Rhetorical Identity Negotiations Of Feminist Evangelical Christians, Karly L. Poyner Jul 2022

Coats Of Fire: Rhetorical Identity Negotiations Of Feminist Evangelical Christians, Karly L. Poyner

Kaleidoscope: A Graduate Journal of Qualitative Communication Research

This paper examines the identity negotiations of undergraduate students who identify as both feminist and evangelical Christian. Studies of the negotiation of religious identities and social identities have primarily focused on contexts such as sexuality/religion, context/location, and culture/religion. This study, however, focuses on young adults attending private, religious universities while openly identifying as religious and feminist. By pinpointing Christian universities, this study uncovers an additional layer of tension, since these schools “arguably exert a stronger influence over their students than churches, religious denominations, or parachurch ministries” (Gardner, 2017, p. 33). From 14 interviews with feminist Christian students using Ting-Toomey’s INT …

The Church And Michael Brown: The Influence Of Christianity On Racialized Political Attitudes In Ferguson, Missouri, Tyler Chance

The Simon Review (Occasional Papers of the Paul Simon Public Policy Institute)

This study examines whether the Christian faith played a pacifying or inspiring role in racialized politics following the death of Michael Brown and subsequent uprisings in Ferguson, Missouri. To evaluate the role of religion in responding to racialized crisis, the author examines both the attitudes of individual citizens and the actions of faith leaders. Using data gathered from two exit polls conducted by the author in Ferguson and the surrounding area during the period between the death of Michael Brown and the decision not to indict the officer who killed him and then again after the grand jury decision, the …

Outside And In: Social Support's Relationship With Support While Incarcerated, Phillip Michael Galli May 2022

Outside And In: Social Support's Relationship With Support While Incarcerated, Phillip Michael Galli

Dissertations

Positive social support acts as a barrier against life events. Related to crime, positive social support may improve prison institutional behavior, reentry outcomes, and reduce recidivism. Conversely, negative support may create deleterious effects for individuals as they navigate life’s challenges. This dissertation explores the relationships between indicators of positive pre-prison social support (living as a family unit, marriage, financial help) and pre-cursors to negative social support pre-prison (caregiver substance use, family criminal history, growing up in foster care, receiving welfare, living in public housing and physical/sexual abuse) and three forms of carceral social support (visitation, making/receiving phone calls, and religious …

The Roles Of Global Identity, Self-Construals, And Construal Level Theory On Consumers' Prosocial Consumption., Wan Nur Fareeha Wan Ahmad Fauzi

Research Papers

Companies are focusing on creating a successful corporate social responsibility (CSR) campaign to appeal to and appease consumers and shareholders alike. As the business model gains its notoriety, scholars, and practitioners have studied consumers’ preferences of CSR messaging by different cultural backgrounds. However, with globalization in mind, consumers’ are now bicultural and more globally conscious thanks to the advancement of technology. Very little research investigates the impact of consumers’ CSR preferences while considering consumers’ global consciousness and their identity in relation to others. This leads me to propose a research investigating the interactions between consumers’ self-construals, the globality of CSR …

The All-American Christ, Mark St George Mar 2022

The All-American Christ, Mark St George

Research Papers

My research identifies the mythogenesis of the myth-hero, the All-American Christ. This figure is realized through motion pictures by fusing together the ideological strains of Judeo-Christian vicarious redemption, Biblical American Exceptionalism, and conservative, Muscular Christianity. Using the methodologies of historical criticism and American studies, I argue that the construction of this conservative myth represents a militant manifestation of theocratic media, and is evangelized in the 1971 Christ film, The Omega Man, starring Charlton Heston.

Engagement Under Pressure: The Impact Of Identity On Engagement During Times Of Crisis, E. Kobena Osam, Nicole Dillard, Dennia Palmer

Online Journal for Workforce Education and Development

Background: Whether it is by creating the conditions that lead to maximizing human capital or the outcomes of productivity, increased performance and work ethic (Karatepe & Olugbade, 2016; Zhong et al., 2015), employee engagement has consistently been linked to workforce development. However, this past year we saw this relationship challenged due to the global pandemic of COVID-19. Additionally, amid COVID-19 a second pandemic of racial injustice created twin crises that further complicated the experiences of employee engagement in the workforce. Purpose: As such, the purpose of this study was to explore how identity-based, qualitative research can provide insight to engagement …

Exit Essay: A Reflection On More Than 50 Years Of Media Coverage In The Illinois Statehouse, Steven E. Brown

The Simon Review (Occasional Papers of the Paul Simon Public Policy Institute)

For nearly 40 years, Steve Brown has directed a public relations practice that served clients ranging from Illinois House Speaker Mike Madigan to small, struggling not-for-profits like the Transitional Living Program. He has seen journalism and the media evolve from the days of Royal manual typewriters to 24-hour news channels and smartphones capable of delivering broadcast-quality video in an instant.

Before going into PR, Brown was an award-winning political writer, investigative reporter, and the first full-time Statehouse Bureau chief for the Daily Herald newspapers. He also served as director of intergovernmental affairs for the City of Chicago during Mayor Jane …

Teaching Courtroom Advocacy Principles And Skills Across Systems And Cultures, Christopher W. Behan Oct 2021

Southern Illinois University Law Journal

Increasing global interconnectedness in legal education makes it possible for instructors from different countries and legal systems to collaborate in teaching courtroom advocacy skills courses. This article points out some of the potential pitfalls of teaching across systems and cultures. These include legal ethnocentrism and ignorance of practices and procedures that are culturally appropriate in foreign jurisdictions. The article identifies a set of universal baseline skills and practices that can be adapted for local conditions when developing collaborative advocacy skills training courses.

Is Violent Crime A Function Of Drug Enforcement?, Emmanuel Ibifafa Ubani Jun 2021

Is Violent Crime A Function Of Drug Enforcement?, Emmanuel Ibifafa Ubani

Theses

This paper examines the relationship between the incidences of violent crime and the level of drug enforcement. To do this, the paper compiles a panel dataset from 30 large cities across the US and using fixed effect regression analyzes the dataset. The paper finds that increase in drug enforcement does not lead to significant or noticeable decrease in violent crime offenses. Specifically, the paper finds that the relationship between drug enforcement and violent crime offenses has a positive and significant contemporaneous relation although it is no longer significant with lagged enforcement.

How Are Women Farmers "Doing" And "Undoing" Gender?: An Exploration Of Women's Gender Practices In Farming, Rebecca J. Tuxhorn Jun 2021

How Are Women Farmers "Doing" And "Undoing" Gender?: An Exploration Of Women's Gender Practices In Farming, Rebecca J. Tuxhorn

Dissertations

The number of women farmers in the US continues to grow even at a time when the number of men farmers is decreasing. But even as women are experiencing growing representation in this historically men-dominated occupation, they are more likely to operate smaller farm operations, own less land, and earn less than men farmers. Additionally, there are barriers to accessing the full farmer identity due to their invisibility in the largely patriarchal structure of agriculture. In this dissertation, I endeavor to learn more about how women farmers navigate the gendered structure of farming, including barriers to accessing occupation-related resources and …

The Framing Of The Common Core State Standards In The New York Times And Chicago Tribune From 2014-2015, Conor Joseph Byrne Apr 2021

The Framing Of The Common Core State Standards In The New York Times And Chicago Tribune From 2014-2015, Conor Joseph Byrne

Research Papers

A narrative of optimism abounds in dominant U.S. culture regarding education as the “great equalizer” of society. As a result, the experience of the disenfranchised such as those with learning differences, English language learners, and racial minorities often go unnoticed or misrepresented. Other factors such as the role of big business and standardized testing in funding school districts avoid critical analysis, including in the mainstream media. In a content analysis of 120 articles from the New York Times and the Chicago Tribune covering Common Core State Standards from 2014-2015, this study discovers both newspapers fail to make significant mention of …
