Southern Illinois University Law Journal
This Comment explains why the proposed animal abuse registry in Illinois should not be passed because it pushes constitutional limitations, is impractical, and would be ineffective in meeting its goals. It first discusses background information on animal abuse registries, including Illinois’ proposed registry, and other relevant Illinois registries. The Comment then discusses the constitutional limits any registry in Illinois faces and focuses on how the proposed animal abuse registry pushes the constitutional bounds of due process. Lastly, the Comment analyzes the problems associated with an animal abuse registry in Illinois, most notably the lack of financial resources in Illinois and …
Empower The Student, Liberate The Professor: Self-Assessment By Comparative Analysis, Joi Montiel
Empower The Student, Liberate The Professor: Self-Assessment By Comparative Analysis, Joi Montiel
Southern Illinois University Law Journal
Experts in legal education have argued that law professors should teach students to be self-regulated learners—to be conscious of their learning process so they can transfer learned skills. They have also argued that law professors should assess student learning as learning occurs, rather than giving a single end-of-semester exam. However, use of formative assessment—assessing student learning throughout the semester—can be perceived as a burden on professors.
This Article introduces Self-Assessment by Comparative Analysis, a teaching method that empowers law students by providing a formative assessment that teaches students to self-regulate their learning, preparing them for the realities of law practice. …
All Prisoners Are Equal, But Some Prisoners Are More Equal Than Others: An Inmate’S Right To Sex Reassignment Surgery After Kosilek V. Spencer, 889 F. Supp. 2d 190 (D. Mass. 2012), Julia Kaye Wykoff
Southern Illinois University Law Journal
In a system where all prisoners are equal, some prisoners are more equal than others. Despite the progression of the LGBT community, one very overlooked group is transgender prisoners. This Note explores a transgender prisoner’s rights to sex reassignment surgery. In 2012, a federal district judge held for the first time that a DOC prisoner must receive sex reassignment surgery. In a ten-year battle, Michelle Kosilek presented evidence that his Gender Identity Disorder was so severe that the only way to medically treat the condition was to have a sex reassignment surgery. This case presented new, unprecedented law regarding the …

Protecting A Dream: Analyzing The Level Of Review Applicable To Daca Recipients In Equal Protection Cases, Tania P. Linares Garcia
Southern Illinois University Law Journal
Faced with congressional inaction regarding comprehensive immigration reform, the Obama administration, through the Department of Homeland Security (DHS), implemented the Deferred Action for Childhood Arrivals (DACA) program in an effort to give young undocumented noncitizens the opportunity to contribute their skills and education to the American community by granting them deferred prosecutorial action and work authorization for a renewable term of two years. To date, DHS has granted DACA relief to over 521,825 young immigrants who would not otherwise be able to legally work in the United States.
Although DACA recipients enjoy federal work authorization, states have adopted policies that …

Whither Notice Pleading?: Pleading Practice In The Days Before Twombly, Jason A. Cantone, Joe S. Cecil, Dhairya Jani
Southern Illinois University Law Journal
Most scholars mark the end of notice pleading in federal civil cases at the time of the Supreme Court’s 2007 decision in Bell Atlantic Corp. v. Twombly or, at the latest, at the Court’s 2009 decision in Ashcroft v. Iqbal. Scholars have noted occasional departures from the notice pleading standard in more complex civil cases, but notice pleading has been thought to remain the prevalent practice in simple negligence cases. This Article examines two sets of complaints filed in federal district courts in 2006 in cases alleging injuries from simple automobile accidents. We find that notice pleading practice, as …
Domestic Tranquility: The Goals Of Home Protection, Burke Bindbeutel
Domestic Tranquility: The Goals Of Home Protection, Burke Bindbeutel
Southern Illinois University Law Journal
This Article proposes an explanation for the special place of the home by surveying the development of privacy jurisprudence and grounding that development in our political tradition. Our earliest conception of rights began with a kind of home protection. But then there was a crucial shift into the abstract realm of privacy. Legal home protection has evolved beyond a ceasefire between state and citizen. Where before it was enough to stay the government’s intrusion into the home, there is today a recognition of the value of the intimate association of free individuals and the trust in government which arises from …

A Noble Dream: The Inter-American Studies Program At Southern Illinois University, Carbondale (1958-1985), Colin T. White
Honors Theses
This essay explores the rise and fall of the Inter-American studies program at Southern Illinois University Carbondale. The Inter-American Studies Program attempted to bridge two distinctive bodies of academic literature when Dr. Albert Bork first envisioned it. Unlike other programs founded in the 1950s, SIU’s Inter-American Studies program was an academic experiment challenging that emerging trend. Regardless of its failure, the program’s original idea was innovative.

Asian Gangs In The United States: A Meta-Synthesis, Sou Lee
Asian Gangs In The United States: A Meta-Synthesis, Sou Lee
Theses
The purpose of this study is to gain a holistic understanding of the Asian gang phenomenon through the application of a meta-synthesis, which is seldom utilized within the criminal justice and criminology discipline. Noblit and Hare’s (1988) seven step guidelines for synthesizing qualitative research informed this methodology. Through this process, 15 studies were selected for synthesis. The synthesis of these studies not only identified prevalent themes across the sample, but also provided the basis for creating overarching metaphors that captured the collective experience of Asian gang members. Through the interpretive ordering of these metaphors, a line of synthesis argument was …

The Big Five And Adhd: An Investigation Of Subtypes And Emotional Regulation, Gabriel Casher
Theses
Attention-Deficit/Hyperactivity Disorder (ADHD) is a commonly occurring neurodevelopmental disorder in children, affecting 3-7% of children (APA, 2000). Despite the high prevalence of ADHD, conceptualization of its subtypes, ADHD-PI and ADHD-C, remains under debate. One method of describing psychopathology is through the use of personality traits. The current study evaluated relationships between ADHD subtypes, ADHD symptoms, and the Big Five in 83 children between 8 and 12 years of age. Children with ADHD were consistently rated as having lower Agreeableness, Conscientiousness, and Openness than children without ADHD. Additionally, children with ADHD-PI had the lowest Openness, and children with ADHD-C had the …

Is There Justice For Sexual Trauma? A Structural Model To Examine Factors Influencing Posttraumatic Growth And Distress, Danielle Grace Fetty
Is There Justice For Sexual Trauma? A Structural Model To Examine Factors Influencing Posttraumatic Growth And Distress, Danielle Grace Fetty
Dissertations
The current study employed an exploratory approach to examine how specific sets of variables map onto a theoretical framework of posttraumatic growth (Schaefer & Moos, 1998). Specifically, the predictive capacity of belief in ultimate justice, optimism, and supportive relationships on outcomes of posttraumatic growth (PTG) and distress were examined, as mediated by supportive spirituality, meaning making, and problem solving. Secondarily, the factor structure and internal consistency of the English translation of the Belief in Immanent and Ultimate Justice Scale (BIUJS; Maes, 1998a, 1998b) was tested, which had yet to be used in the United States or with sexual assault survivors …

Considering theoretical and clinical aspects, it was recommendable to use PCL-R total score as …
The Brontë Attachment Novels: An Examination Of The Development Of Proto-Attachment Narratives In The Nineteenth Century, James Mcnierney
The Brontë Attachment Novels: An Examination Of The Development Of Proto-Attachment Narratives In The Nineteenth Century, James Mcnierney
Theses
John Bowlby’s work on attachment theory in the 1960s altered the cultural understanding of parent-child relationships. Bowlby argued that the ability for an individual to form attachments later in life, be that familial, romantic, or friendship is affected by whether or not that individual formed a strong attachment to a primary caregiver in early childhood. My thesis uses Bowlby’s theory as a critical lens to examine three novels by the Brontës: Wuthering Heights by Emily Brontë, Jane Eyre by Charlotte Brontë, and The Tenant of Wildfell Hall by Anne Brontë. I use this theory in order to demonstrate that these …

Cracking The World System: Mediating Public Pedagogies From The “World Revolution” Of 1848, James Kepley Anderson
Dissertations
This project adopts the framework of World Systems Analysis [WSA], formulated by global sociologist Immanuel Wallerstein, to take the entire world system as the unit of analysis. Drawing on the work of Paulo Freire, the seminal theorist of critical pedagogy, this project couples WSA with the analytic lens of public pedagogy to overcome the conceptual limitations of ideology and of various postmodern critiques. Primary media sources are used for purposes of critical political economy, to outline the contours of economic changes and class formations from the first world revolution. A detailed descriptive history of the revolutions that swept across Europe …

The Use Of Specialized Cybercrime Policing Units: An Organizational Analysis, Dale Willits, Jeffrey Nowacki
Articles
Given the increased focus and importance of cybercrime, some police agencies have turned to the use of specialized cybercrime policing units. Research has yet to examine the how frequently these units are used in policing, nor has research examined the types of agencies most likely to use these units. The current research, drawing on contingency theory, institutional theory, and Maguire’s theory of police organizational structure, uses four waves of Law Enforcement Management and Administrative Survey data to provide a descriptive analysis of specialized cybercrime units with a focus on identifying organizational correlates, environmental pressures, and the role of time. Trend …
