Municipal Sign Ordinances In The Post-Reed World: How Can Municipalities Continue To Regulate Signs Without Violating The First Amendment?, James V. Ferolo, J. Allen Wall, Jonathan M. Priest

Southern Illinois University Law Journal

In the aftermath of Reed, municipal officials face the question of how to regulate signs to promote legitimate governmental purposes without violating the First Amendment.

This article first seeks to provide answers to this important question by providing a historical context for the Reed v. Town of Gilbert decision by examining several earlier Supreme Court decisions that considered the constitutionality of sign regulations and the principles it used to determine when these laws violated the Free Speech Clause.

Secondly, the article examines several Federal Circuit Court of Appeals and Federal District Court, post-Reed, decisions that have interpreted and applied the …

Effects Of Prompting Via Automated Phone Calls On Documentation Completion, Erin Malinowski May 2022

Effects Of Prompting Via Automated Phone Calls On Documentation Completion, Erin Malinowski

Theses

This study attempted to determine if a low-cost, minimally time consuming intervention could increase document completion – specifically end of shift reports. Using a concurrent multiple baseline design, automated phone calls reminded staff to complete their end of shift reports. Participants were the staff members at 16 group homes. All participants were trained Direct Support Professionals. The dependent variable was completion of end of shift reports as a percent of opportunities. There was a measurable response to the intervention. Overall, the percent of completion increased from 4% in baseline to 22% during intervention. The agency desired a much higher response …

Outside And In: Social Support's Relationship With Support While Incarcerated, Phillip Michael Galli May 2022

Outside And In: Social Support's Relationship With Support While Incarcerated, Phillip Michael Galli

Dissertations

Positive social support acts as a barrier against life events. Related to crime, positive social support may improve prison institutional behavior, reentry outcomes, and reduce recidivism. Conversely, negative support may create deleterious effects for individuals as they navigate life’s challenges. This dissertation explores the relationships between indicators of positive pre-prison social support (living as a family unit, marriage, financial help) and pre-cursors to negative social support pre-prison (caregiver substance use, family criminal history, growing up in foster care, receiving welfare, living in public housing and physical/sexual abuse) and three forms of carceral social support (visitation, making/receiving phone calls, and religious …

Using Email Reminders To Increase Virtual Attendance For Middle School Students, Lauren Cline May 2022

Using Email Reminders To Increase Virtual Attendance For Middle School Students, Lauren Cline

Theses

As the COVID-19 pandemic progressed, professionals in the field of behavior analysis and education have continually asked how to help students access quality education while still keeping them safe and healthy. There have been multiple options presented that allow students to access their education, such as being fully in-person, fully virtual, and a hybrid option that includes both in-person and virtual learning. Due to different factors, families may choose a full virtual option for their children. But then the question becomes, “how do we make sure they log into their classes on time?” School attendance continues to be an issue …

The Roles Of Global Identity, Self-Construals, And Construal Level Theory On Consumers' Prosocial Consumption., Wan Nur Fareeha Wan Ahmad Fauzi

Research Papers

Companies are focusing on creating a successful corporate social responsibility (CSR) campaign to appeal to and appease consumers and shareholders alike. As the business model gains its notoriety, scholars, and practitioners have studied consumers’ preferences of CSR messaging by different cultural backgrounds. However, with globalization in mind, consumers’ are now bicultural and more globally conscious thanks to the advancement of technology. Very little research investigates the impact of consumers’ CSR preferences while considering consumers’ global consciousness and their identity in relation to others. This leads me to propose a research investigating the interactions between consumers’ self-construals, the globality of CSR …

A Comparative Analysis Of Florida Universities’ Connections Between Nil And Life Skills For Student-Athletes, Kevin Kendrick Apr 2022

A Comparative Analysis Of Florida Universities’ Connections Between Nil And Life Skills For Student-Athletes, Kevin Kendrick

Ed.D. Capstone Reports

Amateurism, as it applies to student-athletes, is the contention that student-athletes should take part in sports as a hobby as opposed to compensation. The NCAA mandates students shall and ought to compete without salary to preserve their amateur status (Lemons, 2014). The NCAA also supposes any compromise to this status will result in the disqualification of student-athletes in any future college-level competitions. According to the NCAA, “No student shall represent a college in any intercollegiate game or context … who has at any time received money or any other consideration, directly or indirectly” (NCAA, 2013).

According to the NCAA constitution, …

Gamification Via App-Based Rewards Systems: Behavioral Changes And Effects On User Interactions, Eric Michael Halfacre Apr 2022

Gamification Via App-Based Rewards Systems: Behavioral Changes And Effects On User Interactions, Eric Michael Halfacre

Research Papers

User retention and consistent engagement can be difficult with many applications vying for our limited time and attention. Finding innovative ways to draw in new users while appealing to current users also causes many developmental and marketing hurdles. Incorporating games, especially for those who have grown up with a controller in their hands, can be an incentive to gamify activities that award users just for participating. These processes can incentivize and reinforce participatory habits to better the users' lives or can also be a detriment with unforeseen effects.

This research aims to analyze and assess game-based systems used to change …

Verbal Bullying In School: The Constitutional And Psychological Argument That Government Intervention Makes Things Worse, Artem M. Joukov, Samantha M. Caspar Mar 2022

Verbal Bullying In School: The Constitutional And Psychological Argument That Government Intervention Makes Things Worse, Artem M. Joukov, Samantha M. Caspar

Southern Illinois University Law Journal

American public schools and colleges work with law enforcement to curb bullying of almost any kind. These well-intended measures aim to protect students, yet they restrict broad categories of expression likely protected by the U.S. Constitution. With social media at their fingertips, pupils have endless ways to violate anti-bullying laws and regulations, and imposing these controls may legally harm the speaker more than it protects the psyche of the listener. We document how enforcing anti-bullying regulations in schools has done little to curb psychological problems among attendees and how it may rob them of certain opportunities to develop psychological coping …

Psychological Resilience And Cognitive Function Among Older Military Veterans., Justin T Mcdaniel, Erin R Hascup, Kevin N Hascup, Mehul Trivedi, Harvey Henson, Robert Rados, Mary York, David L Albright, Taryn Weatherly, Kaitlyn Frick

Articles

The purpose of this study was to explore the association between psychological resilience and cognitive function in military veterans. We obtained public-use data from the Health and Retirement Study (HRS) for this cross-sectional study of military veterans aged 52 to 101 years (n = 150). We estimated a multivariable linear regression model in which cognitive function served as the dependent variable and psychological resilience served as the independent variable. After controlling for demographics, health conditions, and health behaviors, veterans who had higher psychological resilience scores had better cognitive function (b = 0.22, p = 0.03). Our findings suggest that psychological …

Crazy Story: Admission Of Guilt Or Braggadocio? Defendant-Authored Drill Lyrics As Evidence In Trials, Hugh Toner Iv Jan 2022

Crazy Story: Admission Of Guilt Or Braggadocio? Defendant-Authored Drill Lyrics As Evidence In Trials, Hugh Toner Iv

Southern Illinois University Law Journal

Rap music is a legitimate, commercially successful industry, which provides opportunities to amass or achieve wealth. Drill rap, is an internationally popular sub-genre originating from the streets of Chicago in the early 2010s. It addresses some common themes or issues seen before in previous rap songs. However, it focuses nearly exclusively on violence, crime, guns, and drugs. Furthermore, it does so in a nihilistic manner. In fact, international drill artists often wear masks to avoid being targeted. For this reason, it is easily susceptible to being misinterpreted as reality—especially on serious matters such as life, liberty, and the criminal justice …

Death With Dignity: Terminally Ill(Inois), Nathan T. Levy Jan 2022

Death With Dignity: Terminally Ill(Inois), Nathan T. Levy

Southern Illinois University Law Journal

Since the turn of the century, ten jurisdictions have followed Oregon’s lead by legalizing medical aid in dying. Illinois is not one of those jurisdictions. This Note argues that Illinois would benefit from permitting its terminally ill patients access medical aid in dying. This Note suggests the end-of-life decision making ability currently available to Illinois’ terminally ill patients is not sufficient to relieve the patients of the potential for conscious end-of-life suffering, loss of autonomy, and loss of dignity. Furthermore, the aging “Baby Boomer” generation, the insufficiency of end-of-life care, and physician compliance exacerbate the need for legalized medical aid …

The Impact Of Exercise Therapy On Upper Extremity Strength In A Breast Cancer Survivor Diagnosed With Breast Cancer-Related Lymphedema: A Single-Case Study, Nia E. Ward

Research Papers

Breast cancer-related lymphedema (BCRL) is one of the complications resulting from treatment, particularly surgical removal of lymph nodes. It is defined as arm edema in breast cancer patients caused by interruption of flow in the axillary lymphatic system from surgery or radiation therapy, which results in the accumulation of fluid in the subcutaneous tissue of the arm, with a decrease in tissue distensibility around the joints and an increased weight of the extremity.

There are a number of therapies for the management of BCRL. Most common among them is decongestive lymphatic therapy, which includes exercise therapy. Exercise and movement plans …

Growth Mindset Pedagogy And Introductory Communication Courses, Isaiah Carrington Jan 2022

Growth Mindset Pedagogy And Introductory Communication Courses, Isaiah Carrington

Research Papers

How students view their own ability to learn plays a significant role in how they perform over the course of the semester. Students who do not believe in their ability to learn will struggle to find success in the classroom. However, if an instructor can encourage students to have a growth mindset (a mindset in which a person believes that they can develop skills with time and effort), students are more likely to achieve at a high level. In this research, three themes for successful growth mindset intervention in a post-secondary classroom are presented. The themes are: an early introduction …

Structural Language Abilities In Children With Attention-Deficit/Hyperactivity Disorder And The Potential Role Of Working Memory, Sarah Pieciak Jan 2022

Structural Language Abilities In Children With Attention-Deficit/Hyperactivity Disorder And The Potential Role Of Working Memory, Sarah Pieciak

Research Papers

The contributions of working memory to structural language have been well studied in the general population. Additionally, many studies have examined working memory in children with Attention-Deficit/Hyperactivity Disorder (ADHD). Although children with ADHD often present with difficulties in structural language, few studies have examined the relationship between the three areas: ADHD, structural language and working memory. Hence, the present review will examine the literature on the relationship between working memory and structural language within the context of ADHD and the accompanying symptom dimensions, thereby attempting to address this dearth in the literature. A greater understanding of this relationship may contribute …

Ai And Gender In Persuasion: Using Chatbots To Prevent Driving Under The Influence Of Marijuana, Victoria Halfacre

Research Papers

Will new media techniques, such as artificial intelligence (AI), help refresh public safety advertising campaigns and help better target specific populations, and aid in persuasive, preventative marketing? This paper used hypocrisy induction as a persuasive tool for standalone artificial intelligence chatbots to test potential behavioral change in the context of marijuana. This research further tested whether the chatbots' gender and language styles impact how persuasive and effective the chat agents are perceived to be using hypocrisy induction. An online experiment conducted with 705 participants (Mage = 42.9, 392 women). where participants interact with a chatbot that is manipulated …

“The Sky Is Falling, The Sky Is Falling”: Why Inciting Mass Psychological Panics Should Trigger Legal Liability, Jason P. Kight, David Scott Jan 2022

“The Sky Is Falling, The Sky Is Falling”: Why Inciting Mass Psychological Panics Should Trigger Legal Liability, Jason P. Kight, David Scott

Southern Illinois University Law Journal

With a twenty four hour, seven days a week news cycle and social media leaders, activists and other groups have more access to the public than ever before. This access can lead to events known as mass psychological panics that can have devastating outcomes. In this paper two main cases were examined: Harold Camping and his religious zeal that led to a mass psychological panic, and QAnon which led to the storming of the US Capitol in January of 2021. This paper posits that there should be a federal statute criminalizing incitement via social media.

Abstract “The Bridge”

Stories That Mattered: Inspirited Stories and the Unfolding Arts Curriculum as a call for papers for Fall 2021 issue inspired this Art Therapy educator to consider and re-examine past teaching beliefs and practices, to underscore and understand with more clarity, how the dissonance between two styles of a classical Fine Arts and an Art Therapy Education became apparent in an Art Therapy graduate studio course. With a sharing of past experiences and ideology, Berkowitz writes about how the examination of quality and fears, about a fine arts critique and the nonjudgmental art discussion, highlight the need to …

Keep On Going..., Jane K. Bates

Artizein: Arts and Teaching Journal

In this article I make a case for holistic art education and demonstrate the transformative power of art and art teachers through two interconnected stories. The first is about my introduction to art in my sixth-grade class, and how this experience changed my life. The second, set more than fifty years later, is about my retirement from and return to teaching. These stories address why a holistic approach to teaching is so important and relevant today; relate how I came to develop my own approach; and describe how I implemented it in a teacher-training course. The message they send is …
