Preparing For Baby Boomers As An Agri-Tourism Market, Anthony Agbeh, Elaine T. Jurkowski

Peer-reviewed Articles

The tsunami of baby boomers has led to an increase in people over the age of 60 traveling, and venturing to rural and agri-tourism environments or settings. Coupled with this new trend, is an increase in the number of travelers with disabilities or mobility impairments, who have comfortably traveled domestically through accommodations, afforded through the Americans’ with Disabilities Act. The Climate Of Opinion In Illinois 2008- 2016: Roots Of Gridlock, John Jackson, Charles W. Leonard, Shiloh L. Deitz

The Simon Review (Occasional Papers of the Paul Simon Public Policy Institute)

Since January 1, 2015, Illinois has been frozen in a governmental and political gridlock that has dominated the state’s political discourse, consumed the energies of all involved, and created chaos in governmental and non-profit agencies that normally deliver state services. It has also created untold hardship and suffering among those who are most dependent on state services. The conflict has especially threatened to drastically reduce the quality and missions of the institutions of public higher education in Illinois, a state system that was widely recognized as one of the best in the nation and the world.

All Prisoners Are Equal, But Some Prisoners Are More Equal Than Others: An Inmate’S Right To Sex Reassignment Surgery After Kosilek V. Spencer, 889 F. Supp. 2d 190 (D. Mass. 2012), Julia Kaye Wykoff

Southern Illinois University Law Journal

In a system where all prisoners are equal, some prisoners are more equal than others. Despite the progression of the LGBT community, one very overlooked group is transgender prisoners. This Note explores a transgender prisoner’s rights to sex reassignment surgery. In 2012, a federal district judge held for the first time that a DOC prisoner must receive sex reassignment surgery. In a ten-year battle, Michelle Kosilek presented evidence that his Gender Identity Disorder was so severe that the only way to medically treat the condition was to have a sex reassignment surgery. This case presented new, unprecedented law regarding the …

State Ex Rel. Proctor V. Messina And Ex Parte Communications Under The Hipaa Privacy Rule: The “Judicial Proceedings” Split, Daniel J. Sheffner May 2016

State Ex Rel. Proctor V. Messina And Ex Parte Communications Under The Hipaa Privacy Rule: The “Judicial Proceedings” Split, Daniel J. Sheffner

Southern Illinois University Law Journal

In State ex rel. Proctor v. Messina, the Supreme Court of Missouri held that the HIPAA Privacy Rule does not authorize court orders permitting defense counsel to enter into informal ex parte communications with a plaintiff’s treating, non-party health care provider, absent the plaintiff’s authorization. In overruling the trial court’s order allowing such ex parte communications, the 2010 decision comports with the majority of state courts that prohibit such informal discovery techniques. Notably, however, the Missouri court did not rest its holding on any state substantive rule expressly prohibiting ex parte communications, but on the court’s interpretation of the …

Domestic Tranquility: The Goals Of Home Protection, Burke Bindbeutel May 2016

Domestic Tranquility: The Goals Of Home Protection, Burke Bindbeutel

Southern Illinois University Law Journal

This Article proposes an explanation for the special place of the home by surveying the development of privacy jurisprudence and grounding that development in our political tradition. Our earliest conception of rights began with a kind of home protection. But then there was a crucial shift into the abstract realm of privacy. Legal home protection has evolved beyond a ceasefire between state and citizen. Where before it was enough to stay the government’s intrusion into the home, there is today a recognition of the value of the intimate association of free individuals and the trust in government which arises from …

Disaster Relief Housing: A Passive Design Approach, Lauren K. Ovca

Honors Theses

Hurricanes, forest fires, floods, and avalanches are only a few of the natural disasters that can devastate cities, communities, and families. Too often the individuals that have endured these catastrophes have nowhere to go. As traveling out of the area may not be possible, they are often crowded into shelters or given inferior, substandard housing. These living conditions are far from ideal, and what was initially presented as a housing solution for a week or two can quickly turn into a harsh reality for several months or more.

Why not provide better housing solutions during these trying times? The answer …

When Affirmative Action Is White: Italian Americans In The City University Of New York, 1976 – Present, Liana Kirillova

2016

In 1976, the City University of New York (CUNY) unprecedentedly included Italian Americans in its affirmative action policy, providing them with the status of a designated minority. At the moment, CUNY is the only place where Italian Americans have gained such privileges alongside federally recognized racial and ethnic groups. This historically unique decision has significantly influenced the Italian American community in New York. Yet the question remains: have they made satisfactory progress as a group? Tracing the dynamics in their relations with CUNY authorities, today one can detect a high level of dissatisfaction among Italian American faculty. Additionally, it is …

Women's Textile Graffiti: An Aesthetic Staging Of Public/Private Dichotomies, Diana Christine Woodhouse May 2016

Women's Textile Graffiti: An Aesthetic Staging Of Public/Private Dichotomies, Diana Christine Woodhouse

Dissertations

The cultural performance of textile graffiti, or yarnbombing, dramatizes women’s contested relationship to the public/privates dichotomies that constitute neoliberal capitalism as well as liberal democracies. Across both of these institutions, privatized matters are problematically excluded from political consideration, and private sphere values—such are nurturance, interdependence, and communalism—are denied their necessity and legitimacy as public goods. Textile graffiti artists furnish an association between public and private life by placing signifiers of domesticity and caregiving onto the public streets, and adorning those nurturant signifiers with political and/or feminist messages. In so doing, textile graffiti functions to politicize caregiving, to highlight its gendered …

Asian Gangs In The United States: A Meta-Synthesis, Sou Lee May 2016

Asian Gangs In The United States: A Meta-Synthesis, Sou Lee

Theses

The purpose of this study is to gain a holistic understanding of the Asian gang phenomenon through the application of a meta-synthesis, which is seldom utilized within the criminal justice and criminology discipline. Noblit and Hare’s (1988) seven step guidelines for synthesizing qualitative research informed this methodology. Through this process, 15 studies were selected for synthesis. The synthesis of these studies not only identified prevalent themes across the sample, but also provided the basis for creating overarching metaphors that captured the collective experience of Asian gang members. Through the interpretive ordering of these metaphors, a line of synthesis argument was …

Voice And Silence Among International Students In The U.S.- American Classroom: Towards A Dialogic And Inclusive Approach To Voice, Silence, And Active Listening, Jana Simonis

Dissertations

Each year, thousands of international students move to the United States to pursue higher education. Over the past few years in particular, the numbers of international students enrolled at U.S.-American universities has been on a constant incline. Two of the biggest changes that international students may experience are the different expectations of classroom etiquette and participation in the U.S.-American classroom setting. Impacted by many years of exposure to West-centric approaches to pedagogical praxis, the U.S.-American classroom has been created as a privileged space in which, more often than not, West-centric epistemologies, approaches to pedagogy, and ways of knowledge production are …

Cracking The World System: Mediating Public Pedagogies From The “World Revolution” Of 1848, James Kepley Anderson

Dissertations

This project adopts the framework of World Systems Analysis [WSA], formulated by global sociologist Immanuel Wallerstein, to take the entire world system as the unit of analysis. Drawing on the work of Paulo Freire, the seminal theorist of critical pedagogy, this project couples WSA with the analytic lens of public pedagogy to overcome the conceptual limitations of ideology and of various postmodern critiques. Primary media sources are used for purposes of critical political economy, to outline the contours of economic changes and class formations from the first world revolution. A detailed descriptive history of the revolutions that swept across Europe …

The Use Of Specialized Cybercrime Policing Units: An Organizational Analysis, Dale Willits, Jeffrey Nowacki Apr 2016

The Use Of Specialized Cybercrime Policing Units: An Organizational Analysis, Dale Willits, Jeffrey Nowacki

Articles

Given the increased focus and importance of cybercrime, some police agencies have turned to the use of specialized cybercrime policing units. Research has yet to examine the how frequently these units are used in policing, nor has research examined the types of agencies most likely to use these units. The current research, drawing on contingency theory, institutional theory, and Maguire’s theory of police organizational structure, uses four waves of Law Enforcement Management and Administrative Survey data to provide a descriptive analysis of specialized cybercrime units with a focus on identifying organizational correlates, environmental pressures, and the role of time. Trend …

The Author Is Absent: Toward Emergent Narrative Event Environments, Dimitar O. Velkov 3030359

Research Papers

Creating an emergent narrative or one which is not predetermined by the controlling figure of the game designer, but instead frees the audience to guide and control the story has been a major interest in the field game design studies of virtual world storytelling. “The Author Is Absent” is an art project that interprets an emergent narrative problem through the prism of performance arts, and mainly the happenings of Alan Kaprow. The following paper provides a theoretical groundwork and some historical examples of previous attempts in the same tradition. It then goes on to elucidate the formal aspects of the …

Common Thread Of Success: Connecting, Relationships, Networks, Katherine L. West Apr 2016

Common Thread Of Success: Connecting, Relationships, Networks, Katherine L. West

Research Papers

This paper shows that success centers around connection to community, and relationships within a network. Three case studies presented, include the 1950’s conflict between Robert Moses and Jane Jacobs, the non-profit organization charity: water, and the e-commerce business Amazon.com, highlighting the common thread of success. Storytelling, communication biases, and motivation were identified as three main factors that aided in the community connections supporting their success. These factors were then applied to WSIU Public Broadcasting as an example, with the theory that they could effectively be applied to any organization. The key for success is connection, so each time these supporting …
