Jurisdiction Issues In International Tort Litigation: A Singapore View, Tiong Min Yeo Jan 1995

Jurisdiction Issues In International Tort Litigation: A Singapore View, Tiong Min Yeo

Research Collection Yong Pung How School Of Law

This article looks at the issues that arise at a jurisdictional stage when a claim in tort containing foreign elements is made in a Singapore court. In particular, the amended Order 11 rule 1(f) of the Rules of the Supreme Court is examined. Because of the paucity of local authorities, extensive references are made to relevant Commonwealth cases to aid in the interpretation of the local provision.

Sub‐Bailments And Consent, Andrew B.L. Phang

Research Collection Yong Pung How School Of Law

Of the two major strands existing in the increasingly important topic of sub- bailment on terms, one has become well settled, the other has been shrouded in ambiguity for close to two decades. The recent Hong Kong Privy Council decision of The Pioneer Container’ reaffirms the first strand and, more importantly, delivers a definitive pronouncement on the second.

Towards An Understanding Of Chinese Business Networks In Asia-Pacific: The Singapore Case, Thomas Menkhoff, Chalmers Labig Jan 1995

Towards An Understanding Of Chinese Business Networks In Asia-Pacific: The Singapore Case, Thomas Menkhoff, Chalmers Labig

Research Collection Lee Kong Chian School Of Business

The embeddedness of entrepreneurs in local, regional or global business networks based on kinship, clanship, territorial or ethnic ties and solidarities has often been cited as characteristic of the Chinese business community in Southeast Asia. Qualitative interviews with Singaporean Chinese merchant-exporters were conducted in order to examine this thesis and shed light on the various "guanxi bases" of their international trading networks. The findings suggest that there is a strong tendency among these Singaporean entrepreneurs towards external commercial transactions with "outsiders" and "friends" rather than with "kin" whether by blood, marriage, or ascription. Kinship reciprocity may curb the autonomy and …

Port Multipliers For Singapore: Impact On Income, Output, And Employment, Rex S. Toh, Sock-Yong Phang, Habibullah Khan

Research Collection School Of Economics

This article examines the contribution of the activities of the Port of Singapore Authority (PSA), a government-owned statutory board which operates almost all of the port related activities in Singapore, to the prosperity of the entire country, by way of multiplier analysis. Input-output analysis is used to compute the income, output, and employment multipliers of port activities, broken down into direct, indirect, and induced effects. The policy implications on port investment and maritime policy follow.

R&D/Marketing Communication During The Fuzzy Front-End, Rudy K. Moenaert, Arnoud De Meyer, William E. Souder, Dirk Deschoolmeester Jan 1995

R&D/Marketing Communication During The Fuzzy Front-End, Rudy K. Moenaert, Arnoud De Meyer, William E. Souder, Dirk Deschoolmeester

Research Collection Lee Kong Chian School Of Business

The planning stage of an innovation project has a great effect on the commercial performance of the project. During the "fuzzy front-end", the organization formulates a concept of the product to be developed, and determines whether or not the organization will invest resources in the concrete development of the idea. The integration of R&D and marketing activities is a necessary condition for success in innovation projects. The research question of this study is: from an information processing perspective, what role does information transfer play in integrating R&D and marketing functions during the planning stage, and what effects do project formalization …

Rule Extraction: From Neural Architecture To Symbolic Representation, Gail A. Carpenter, Ah-Hwee Tan Jan 1995

Rule Extraction: From Neural Architecture To Symbolic Representation, Gail A. Carpenter, Ah-Hwee Tan

Research Collection School Of Computing and Information Systems

This paper shows how knowledge, in the form of fuzzy rules, can be derived from a supervised learning neural network called fuzzy ARTMAP. Rule extraction proceeds in two stages: pruning, which simplifies the network structure by removing excessive recognition categories and weights; and quantization of continuous learned weights, which allows the final system state to be translated into a usable set of descriptive rules. Three benchmark studies illustrate the rule extraction methods: (1) Pima Indian diabetes diagnosis, (2) mushroom classification and (3) DNA promoter recognition. Fuzzy ARTMAP and ART-EMAP are compared with the ADAP algorithm, the k nearest neighbor system, …

ucian Humanism" in 1989, the objective of which was "to explore Confucian ethics as a common intellectual discourse in East Asia from a multidisciplinary and cross-cultural perspective" (p. vii), this volume offers a summary of the three-day event. If one were looking for "essays" on Confucian ethics, one would not find them here. With one exception where a participant sent in a written clarification, the report is based on recordings of the wide-ranging discussions that transpired at the workshop. What one will find are serious and often provocative reflections on a complex phenomenon by a group of eminent scholars from …

"The Concept Of Law" Revisited, Andrew B.L. Phang Jan 1995

"The Concept Of Law" Revisited, Andrew B.L. Phang

Research Collection Yong Pung How School Of Law

On any view, Hart is one of (if not the) leading jurists in Anglo-American legal philosophy this century. His central work, The Concept of Law,' is prescribed reading in virtually every jurisprudence course around the world. He has also been involved in the most famous debates in Anglo-American legal philosophy: the Hart-Fuller debate on the separation of law from morality; 2 the Hart-Devlin debate on the enforcement of morals;3 and the Hart-Dworkin debate on judicial discretion 4 -and it ought to be mentioned that it was precisely these debates that forced all three of these jurists to construct their own …

Equal Protection And Sexual Orientation, Jack Tsen-Ta Lee Jan 1995

Equal Protection And Sexual Orientation, Jack Tsen-Ta Lee

Research Collection Yong Pung How School Of Law

Equality is the thread running through the fundamental liberties enshrined in our Constitution. ... Equality, expressed in Art 12 of the [Singapore] Constitution, is also a specific right enforceable by the court. The difficulty comes in applying this deceptively simple concept to real-life situations. ... In considering the validity of legislation, Singapore and Malaysian courts have generally favored rational review, a modest conception of equal protection, unlike their American counterparts which have adopted a more expansive reading in the form of strict and intermediate review. This article examines how these three levels of equal protection review operate, and argues that …

Rediscovering The Constitution, Jack Tsen-Ta Lee

Research Collection Yong Pung How School Of Law

The fundamental liberties in our Constitution involve a study of tensions: between an individual's rights and the community's interests, between the role of the judiciary on the one hand and the executive and legislature on the other. How we should interpret them depends on where we think equilibrium should be established. This depends on two main factors. The first is the proper function of the judiciary as laid down by our Constitution, which is discussed in Part I of this article. The second is the nature of our fundamental liberties, for they are worded with varying degrees of generality. ... …

First Measurement Of The Quark-To-Photon Fragmentation Function, D. Buskulic, Manoj Thulasidas Jan 1995

First Measurement Of The Quark-To-Photon Fragmentation Function, D. Buskulic, Manoj Thulasidas

Research Collection School Of Computing and Information Systems

Earlier measurements at LEP of isolated hard photons in hadronic Z decays, attributed to radiation from primary quark pairs, have been extended in the ALEPH experiment to include hard photon production inside hadron jets. Events are selected where all particles combine democratically to form hadron jets, one of which contains a photon with a fractional energy z 0:7. After statistical subtraction of non-prompt photons, the quark-to-photon fragmentation function, D(z), is extracted directly from the measured 2-jet rate. By taking into account the perturbative contributions to D(z) obtained from an O(S ) QCD calculation, the unknown non-perturbative component of D(z) is …

Object Interactions As First Class Objects: From Design To Implementation, Mahesh Dodani, Benjamin Kok Siew Gan, Lizette Velazquez Jan 1995

Object Interactions As First Class Objects: From Design To Implementation, Mahesh Dodani, Benjamin Kok Siew Gan, Lizette Velazquez

Research Collection School Of Computing and Information Systems

Collaborations between objects make up the dynamic behavior of OO software. These collaborations among objects require careful design and implementation. Treating the interactions as responsibilities that are integrated in the participating objects, results in tight coupling between objects. Tight coupling increases complexity and reduces reusability. Object interactions need to be first class objects from design to implementation. Our research provides a unified approach to model and implement these interactions as first class objects. During analysis and design, they are modeled using DynaSpecs. During implementation, they are coded with a new language construct called Compositions. DynaSpecs and Compositions provide a consistent …

International Rights And Australian Adaptations: Recent Developments In Criminal Investigation, Mark Findlay

Research Collection Yong Pung How School Of Law

To empower the "right to be presumed innocent until proven guilty according to law", Article 14 of the International Covenant on Civil and Political Rights identifies a range of "minimum guarantees" for suspects under investigation and for the accused at trial. Significant among these is that the suspect/accused is "not to be compelled to testify against himself or to confess guilt".

Frustration Of Contracts For The Sale Of Land In Singapore, Andrew B.L. Phang

Research Collection Yong Pung How School Of Law

The recent Singapore Court of Appeal decision of Lim Kim Som v. Sheriffa bah bte Abdul Rahman' is significant for at least two specific (and related) rea in the context of the doctrine of frustration: first, because it pertains to the m particular issue as to whether a contract for the sale of land can be frustrated; second, because it also raises certain significant questions with regard to m general aspects of the doctrine itself.

Contracts Involve More Than Promises, Promises, Kee Yang Low, Patricia Ong Jan 1995

Contracts Involve More Than Promises, Promises, Kee Yang Low, Patricia Ong

Research Collection Yong Pung How School Of Law

You may have heard of the legal requirement that to enforce a contract, a person needs to show that he has given value; that he has given something in exchange for the promise. In legal terms, he must have provided consideration. Consideration involves the idea that the law only forces bargains where something is given for something, not bare promises. Yes, consideration is vital, as a recent Singapore Court of Appeal decision shows. In that case, the entitlement to more than S$100,000 in commission depended on the issue of consideration.

Beyond Pepper V. Hart: The Legislative Reform Of Statutory Interpretation In Singapore, Robert C. Beckman, Andrew B.L. Phang

Research Collection Yong Pung How School Of Law

One of the major controversies in the area of statutory interpretation has centred on the use of parliamentary materials as extrinsic aids by courts in interpreting legislation. The English courts long prohibited any reference to parliamentary materials.' Legislation was passed in Australia in the 1980s to allow liberal reference to parliamentary materials in the courts. More recently, a seminal decision of the House of Lords in 1992 in Pepper (Inspector of Taxes) v. Hart' introduced significant flexibility into the hitherto rigid proscription followed in the English courts, although it did not go as far as the legislative reforms in Australia. …

Knowledge-Based Safety Training System (Kbsts): A Prototype Implementation, Venky Shankararaman, B. S. Lee

Research Collection School Of Computing and Information Systems

A computer-based safety training system for process operators must be able to make effective presentation of textual material, test the trainee's understanding through quizzes and facilitate plant simulation. The general framework of such a system is presented in an earlier paper (Computers in Industry, Vol. 17, 1991, pp. 349–358). In this paper, we discuss the development and implementation of a prototype Knowledge-Based Safety Training System based on the framework. The design philosophy, system architecture and the plant modelling methodology are described.

The Ambiguity Of Accountability: Deaths In Custody, And The Regulation Of Police Power, Mark Findlay Nov 1994

The Ambiguity Of Accountability: Deaths In Custody, And The Regulation Of Police Power, Mark Findlay

Research Collection Yong Pung How School Of Law

Policing is power. Police authority relies on transactions or relationships of power and influence. The nature of that authority depends on, and takes its form from specific environments of opportunity. Opportunity is, in turn, designated by the aspirations for such relationships, and structures and processes at work towards their regulation. Police authority can be confirmed either legitimately or illegitimately, depending on its context. Essential to the operation of police authority are the "boundaries of permission" which designate the dominion of police power. A principal regulator of police authority, and therefore an important mechanism whereby boundaries of permission are determined, is …

A Load Distribution Through Competition For Workstation Clusters, Kam Hong Shum, Muslim Bozyigit Nov 1994

A Load Distribution Through Competition For Workstation Clusters, Kam Hong Shum, Muslim Bozyigit

Research Collection School Of Computing and Information Systems

The aim of this work is to develop a competition driven solution approach for load distribution in distributed computing system (DCS) environments. The subject DCS is composed of a set of workstation clusters. The study deals with concurrent applications, but assumes the existence of the independent tasks executing on individual workstations as well. Akin to conventional load balancing algorithms, the approach considers two phases; the partitioning phase and the mapping phase. Each phase is based on the application and the DCS data which is translated into market data, mainly price. The price is governed by the demand and supply of …

An Empirical Study On End Users' Update Performance For Different Abstraction Levels, Hock Chuan Chan, Kwok Kee Wei, Keng Siau

Research Collection School Of Computing and Information Systems

Recent laboratory experiments have shown a strong tendency that database users can perform better at the conceptual level than at the logical level. The experiments measured users’ performance for the tasks of database design and database retrieval. Besides database design and retrieval, the third major database task is update. User performance for updates has not been measured. With the widespread availability of databases, updates will be done frequently by end-users. This task is gaining in importance as a measure of the usability of a database system. An experiment was conducted to measure the effect of different abstraction levels on user …

Performance Of Combined Diversity Reception And Convolutional Coding For Qdpsk Land Mobile Radio, Huafei Zhou, Robert H. Deng, T. T. Tjhung

Research Collection School Of Computing and Information Systems

Diversity reception and error correction coding are powerful techniques to combat multipath fading encountered in mobile radio communications. In order to improve the transmission performance of the ?/4-shift QDPSK signal in mobile radio channels, the authors propose a new scheme of combined coding and diversity reception, i.e., combination of diversity reception employing code combining (CC) and convolutional coding employing error-and erasure correction Viterbi decoding. They also consider another combination scheme, i.e., combination of diversity reception employing postdetection maximal ratio combining (MRC) and convolutional coding employing hard decision Viterbi decoding. They theoretically analyze the performance of the schemes taking into account …

Optimum Symbol-By-Symbol Detection Of Uncoded Digital Data Over The Gaussian Channel With Unknown Carrier Phase, Pooi Yuen Kam, Seng Siew Ng, Tock Soon Ng Aug 1994

Optimum Symbol-By-Symbol Detection Of Uncoded Digital Data Over The Gaussian Channel With Unknown Carrier Phase, Pooi Yuen Kam, Seng Siew Ng, Tock Soon Ng

Research Collection School Of Computing and Information Systems

A theory of optimum receiver design for symbol-by-symbol detection of an uncoded digital data sequence received over the Gaussian channel with unknown carrier phase is presented. Linear suppressed-carrier modulation is assumed. The work here aims at laying a conceptual foundation for optimum symbol-by-symbol detection, and rectifies existing approaches to the problem. The optimum receiver structure is obtained explicitly for an arbitrary carrier phase model, but its computational requirements are too heavy in general for any practical implementation. In one important special case, namely, the case in which the carrier phase can be treated as a constant over some K+1 symbol …

Current therapy can induce a long-term remission in half the patients with diffuse lymphomas with a large-cell component (DLLC), but more intensive treatment has the potential to improve outcome. Rearrangement of a novel candidate proto-oncogene, bcl-6, correlates with a favorable clinical outcome in DLLC and may thus serve as a prognostic marker.
