The aim of this article is to discuss the restitutionary principles applicable to quantum meruit claims in building contracts. In the first part we consider the concept itself and identify the contexts in which such a claim is pursued. In the second part of the article, to be published in the next issue of the JCL, attention is directed, principally, to one issue, namely whether the contract price constitutes a ceiling on the amount recoverable under a quantum meruit claim following breach by the defendant.

This very brief essay seeks to sketch out as well as consider an approach toward legal analysis and reasoning that would aid in the development of an autochthonous Singapore legal system, ' and that, in any event, would probably also be relevant even in more generalized ad hoc situations. It is assumed that many, if not most, of those involved in the discipline of Singapore law desire the construction of an autochthonous legal system, although the skeptic might find - as just mentioned - the approach suggested here of some utility as well.

The Rate Of Return Under Re-Capitalization: A Note, Mohamed Ariff, Kian Guan Lim

The article discusses issues related to variations in rate of return of stocks under re-capitalization. Share returns are commonly adjusted for re-capitalization by distributing the difference between market and exercise prices over the number of shares. Re-capitalization is said to occur when the total amount of equity capital or number of shares in a firm changes. New issues usually take the form of bonus issues or new paid-up issues called rights issues, which do not change the amount of equity.

An upper bound on the bit-error probability (BEP) of a linear cyclic code over GF(2l) with hard-decision (HD) maximum-likelihood (ML) decoding on memoryless symmetric channels is derived. Performance results are presented for Reed-Solomon codes on GF(32), GF(64), and GF(128). Also, a union upper bound on the BEP of a linear cyclic code with either hard- or soft-decision ML decoding is developed, as well as the corresponding bounds for the extended code of a linear cyclic code. Using these bounds, which are tight at low bit error rate, the performance advantage of soft-decision (SD) ML and HD ML over bounded-distance (BD) …

For four years now a survey has been carried out by a research team at Insead to build a database on the manufacturing strategies as they are defined and implemented by large European companies. In this paper some of the 1987 data are presented, and a comparison of manufacturing strategies of large companies in the three most important European countries is made. Through analysis of specific decisions in the management of manufacturing in 163 companies, we have identified the key dimensions along which mort of the differences among manufacturing strategies can be explained. Previous research—mostly based on clinical observations—has focused on describing the typical decision categories in manufacturing strategy. Our large sample has allowed us to move beyond that and focus on the differences among manufacturing strategies. Data were collected by mailed questionnaires as a part of a large research project ‘Manufacturing Futures’. A problem in designing semiconductor memories is to provide some measure of error control without requiring excessive coding overhead or decoding time. In LSI and VLSI technology, memories are often organized on a multiple bit (or byte) per chip basis. For example, some 256K bit DRAM's are organized in 32K ?? 8 bit-bytes. Byte-oriented codes such as Reed-Solomon (RS) codes can provide efficient low overhead error control for such memories. However, the standard iterative algorithm for decoding RS codes is too slow for these applications. The preface paradox strikes us as puzzling because we feel that if a person holds a set of inconsistent beliefs, i.e. beliefs such that at least one of them must be correct, then he should give at least one of them up. The performance of a concatenated coding scheme for error control in ARQ systems is analyzed for both random error and burst-error channels. In particular, the probability of undetected error and the system throughput are calculated. In this scheme, the inner code is used for both error correction and error detection, and the outer code is used for error detection only. Interleaving/deinterleaving of the outer code is assumed. A retransmission is requested if either the inner code or the outer code detects the Presence of errors. Various coding examples are considered. This note reexamines the general class of Sargan densities analyzed by Goldfeld and Quandt (1981), Kafei and Schmidt (1985), and others in the context of approximating normal densities in certain econometric models. It suggests a third-order Sargan density which complies with the Goldfeld and Quandt criteria, is unimodal, and is the best approximation to the normal for orders less than or equal to 3. Some errors in Goldfeld and Quandt paper are corrected.

The large majority of modern production companies have at their disposal a multitude of computer systems. The immediate challenge for these companies consists of integrating these computer systems and databases. How will one arrive at this integration? On the basis of a questionnaire administered among a group of 174 large European manufacturers, one comes to the conclusion that this integration is one of the immediate priorities for this group of companies. This paper provides an analytical study of linear regressions involving the levels of economic time series. An asymptotic theory is developed for regressions that relate quite general integrated random processes. This includes the spurious regressions of Granger and Newbold (1974) and the recent cointegrating regressions of Granger and Engle (1985). An asymptotic theory is developed for the regression coefficients and for conventional significance tests. It is shown that the usual t- and F-ratio test statistics do not possess limiting distributions in this context but actually diverge as the sample size T ↑ ∞. Examined the possibility that distinct languages are capable of exerting language-specific effects on people's impressions of and memory for other individuals. Parallel English- and Chinese-language descriptions were created of 2 characters exemplifying personality schemas with economical labels in English but not in Chinese, and 2 characters exemplifying personality schemas with economical labels in Chinese but not in English. Three groups of 12 undergraduates participated as Ss-English monolinguals, Chinese-English bilinguals who read and responded in English, and Chinese-English bilinguals who read and responded in Chinese. This article deals with some problematic aspects of the general reception of English law in Singapore. It examines, first, the concept of the 'cut-off' date for statutes and the common law. The second substantive part deals with the concepts of suitability and modification, analysing their theoretical cogency as well as their application in the local context. The discipline of criminology has been dominated since the turn of the century by an explanatory paradigm' known as 'positivism'. The distinctive features of that paradigm have been both substantive and methodological. On the substantive side 'positivist criminology' has been marked by a commitment to the explanation of criminal behaviour (and deviance generally) in terms of characteristics of the individual. Thus positivist criminology has been notable for its explanations of criminal behaviour in terms of gross bodily features, patterns of child-rearing, genetic defect, and idiosyncratic personality traits. The contemporary crisis in the maintenance of civil order on both sides of the Irish border has initiated unique developments in the "system" of criminal justice within Ireland. Integrating Zero-Base Budgeting With Management-By-Objectives: An Empirical Inquiry, John Joseph Williams, James D. Newton, Eric A. Morgan

Popular arguments in the management literature advocate the implementation congruity and complementarity of zero-base budgeting (ZBB) with an established management-by-objectives (MBO) system. The present study examined management perceptions on 28 ZBB implementation variables for MBO users and non-MBO users which were gathered from 153 managers at two hierarchical levels within a single private sector organization. Results from both univariate and multivariate tests indicate that ZBB implementation was not facilitated by the existence of an MBO system for either lower level management or for upper level management. The evidence obtained here strongly suggests that the purported conventional rationale underlying ZBB coupling …
