When Sparks Fly Because Of Your Neighbour’S Independent Contractor: The Stricter-Liability Test Of Private Nuisance In Singapore – Pex International Pte Ltd V Lim Seng Chye And Another And Another Appeal [2020] 1 Slr 373, Samuel Hzi Xun Tay
Singapore Law Journal (Lexicon)
When your land has been damaged by your neighbour’s independent contractor, who should be held responsible—the contractor or your neighbour? Previously, it was considered by some to be difficult to pin liability on one’s neighbour. 1 This position was criticised for being unfair and unjust, especially in situations where one was unable to obtain recourse from the contractor.

On 2 January 2021, certain statutory amendments came into effect: specifically, the Supreme Court of Judicature (Amendment) Act 2019 (Act 40 of 2019) (“SCJ(A)A”) which amended the Supreme Court of Judicature Act (Cap 322, 2007 Rev Ed) (“SCJA”), and the Rules of Court (Amendment No. 5) Rules 2020 (“ROC(A)”) which amended the Rules of Court (Cap 322, R 5, 2014 Rev Ed) (“ROC”). These amendments had a significant impact on the court appellate system. For clarity, the pre-2 January versions of the legislation will be referred to as the “former SCJA” and “former ROC”, while the post-2 January versions will …

It is well-understood that for most crimes to be established, the requirements of actus reus (the physical element) and mens rea (the mental element) need to be proven beyond a reasonable doubt. However, in situations involving joint offenders, if one of the offenders dealt the fatal blow, while the other offender acted as a lookout, can the other offender really be said to have the actus reus of the particular offence?

Stephen’S Prudent Person And The Standard Of Proof In Indian Evidence Act Jurisdictions, Siyuan Chen
Singapore Law Journal (Lexicon)
Sir James Fitzjames Stephen’s Indian Evidence Act of 1872 remains on the statute books of many Commonwealth jurisdictions. The contents of the statute have also remained largely intact. Unsurprisingly, then, there has been a growing chasm between what the statute provides for and how the common law rules on evidence have developed. However, the statute’s treatment of the concept of standard of proof has arguably been more sophisticated than what the courts have given credit for. In this article, it is argued that a return to the statute’s original conception of standard of proof will go some way in alleviating …

Taming Reflective Loss – Miao Weiguo V Tendcare Medical Group Holdings Pte Ltd [2022] 1 Slr 884, Pey Woan Lee
Singapore Law Journal (Lexicon)
At common law, the “no reflective loss” (“NRL”) principle bars a shareholder from bringing a personal action to recover any diminution in share value resulting from a wrong inflicted by a thirdparty wrongdoer on the company. Such reduction in value is not treated as the shareholder’s personal loss as it is a “mere reflection” of the company’s loss. And this is so even if the company does not seek to recover from the wrongdoer or settles with the wrongdoer for a sum well below its actual loss. Though endorsed by the highest courts, the NRL principle remains controversial by reason …

Despite being widely used in health economics, dynamic models of health and healthcare typ ically assume that the persistence in these outcomes is the same for every individual. This paper explores individual-level heterogeneity in the persistence of health outcomes. Using simple re gression methods that do not place any restriction on the distribution of the heterogeneity in persistence, the paper documents substantial heterogeneity in health, medical expenditures, and healthcare use. We show that neglecting this heterogeneity leads to estimates that overstate the average persistence and can bias the coefficients of covariates. We find that between 75% and 87% of individuals …

Image generation relies on massive training data that can hardly produce diverse images of an unseen category according to a few examples. In this paper, we address this dilemma by projecting sparse few-shot samples into a continuous latent space that can potentially generate infinite unseen samples. The rationale behind is that we aim to locate a centroid latent position in a conditional StyleGAN, where the corresponding output image on that centroid can maximize the similarity with the given samples. Although the given samples are unseen for the conditional StyleGAN, we assume the neighboring latent subspace around the centroid belongs to …

Chinese Global Orders: Socialism, Tradition, And Nation In China-Russia Relations, William A. Callahan
Research Collection School of Social Sciences
While many use rational IR theory to explain Chinese foreign policy behavior, this paper follows global IR to employ interpretivist theory to examine how Chinese elites understand their country’s role in the world. In particular, it explores the Chinese global order ideas of socialism, tradition, and nation through a comparative analysis of how they work in China–Russia relations, especially after China’s 20th Communist Party Congress in 2022. The first section presents a critical analysis of the realist understanding of the China–Russia–U.S. strategic triangle. It argues that the socialist concept of “united front work” better explains Chinese (and Russian) policy in …

Automated program repair (APR) has been gaining ground recently. However, a significant challenge that still remains is test overfitting, in which APR-generated patches plausibly pass the validation test suite but fail to generalize. A common practice to assess the correctness of APR-generated patches is to judge whether they are equivalent to ground truth, i.e., developer-written patches, by either generating additional test cases or employing human manual inspections. The former often requires the generation of at least one test that shows behavioral differences between the APR-patched and developer-patched programs. Searching for this test, however, can be difficult as the search space …

Privacy-Preserving Ranked Spatial Keyword Query In Mobile Cloud-Assisted Fog Computing, Qiuyun Tong, Yinbin Li Miao, Ximeng Liu, Robert H. Deng, Robert H. Deng
Research Collection School Of Computing and Information Systems
With the increasing popularity of GPS-equipped mobile devices in cloud-assisted fog computing scenarios, massive spatio-textual data is generated and outsourced to cloud servers for storage and analysis. Existing privacy-preserving range query or ranked keyword search schemes does not support a unified index, and are just applicable for the symmetric environment where all users sharing the same secret key. To solve this issue, we propose a Privacy-preserving Ranked Spatial keyword Query in mobile cloud-assisted Fog computing (PRSQ-F). Specifically, we design a novel comparable product encoding strategy that combines both spatial and textual conditions tightly to retrieve the objects in query range …

The Influence Of Subjective Socioeconomic Status On Executive Functions In Middle-Aged And Older Adults, Yu Ping Wong, Hwajin Yang
Research Collection School of Social Sciences
Subjective socioeconomic status (SES) has been shown to influence both psychological and biological outcomes. However, less is known about whether its influence extends to cognitive outcomes. We examined the relation between subjective SES and executive functions (EF)—a set of cognitive control processes—and its underlying mechanisms. By analyzing a nationally representative cohort of middle-aged and older adults (age 40–80) from the MIDUS 2 National Survey and Cognitive Project, we tested a serial mediation model with sense of control and health as sequential mediators. Using structural equation modeling, we found that subjective SES is indirectly related to EF via sense of control …

Bills of lading have been described as the cornerstone of modern sea carriage (i.e., the transport of goods by sea). Traditionally, a bill of lading serves three functions: (1) it is a receipt by the carrier acknowledging the shipment of goods, (2) it is a memorandum of the terms of the contract of carriage, and (3) it is also a document of title to the goods shipped.

Essays On Culture, Institutions, And Development, Meng Liu
Dissertations and Theses Collection (Open Access)
This dissertation consists of three chapters that study culture, institutions, and economic development. In the first chapter, we study the impact of Confucianism on long-run development in northern Vietnam. Using the variation in Confucian literati across 217 historical districts between the Primitive Le and Nguyen dynasties (1426 CE - 1919 CE), we find that districts with greater exposure to Confucianism have experienced better economic outcomes over the past century. The result is robust to using the distance to exogenously located hermit Confucian as an instrument and accounting for a battery of confounders. We show that the positive effects of Confucianism …
It’S A Privilege, Not An Entitlement: Attributions Of Advantage And Perceived Deservingness Distinguish Feelings Of Privilege And Entitlement, Amos Tai
Dissertations and Theses Collection (Open Access)
Having an advantage over others can be seen as a privilege or an entitlement. Drawing on attribution theory, we hypothesized that recipients of relative advantage may perceive it as a privilege or an entitlement based on external or internal attributions of their advantage, respectively. Furthermore, we hypothesized that relative to the external attribution of privilege, the internal attribution of entitlement should subsequently predict stronger beliefs of deservingness, as well as stronger feelings of pride in response to received advantage, but stronger feelings of anger when advantage is denied. Study 1 tested the basic attributional processes tied to privilege and entitlement …

How To Resuscitate A Sick Vm In The Cloud, Xuhua Ding
Research Collection School Of Computing and Information Systems
A guest virtual machine in a cloud platform may fall “sick” when its kernel encounters a fatal low-level bug or is subverted by an adversary. The VM owner is hence likely to lose her control over it due to a kernel hang or being denied of remote accesses. While the VM can be rebooted with the assistance from the cloud server, the owner not only faces service disruption but also is left with no opportunity to make an in-depth diagnosis and forensics on the spot, not to mention a live rectification. Currently, the cloud service provider has neither incentive nor …

Semantic Scene Completion With Cleaner Self, Fengyun Wang, Dong Zhang, Hanwang Zhang, Jinhui Tang, Qianru Sun
Research Collection School Of Computing and Information Systems
Semantic Scene Completion (SSC) transforms an image of single-view depth and/or RGB 2D pixels into 3D voxels, each of whose semantic labels are predicted. SSC is a well-known ill-posed problem as the prediction model has to “imagine” what is behind the visible surface, which is usually represented by Truncated Signed Distance Function (TSDF). Due to the sensory imperfection of the depth camera, most existing methods based on the noisy TSDF estimated from depth values suffer from 1) incomplete volumetric predictions and 2) confused semantic labels. To this end, we use the ground-truth 3D voxels to generate a perfect visible surface, …

The Bemi Stardust: A Structured Ensemble Of Binarized Neural Networks, Ambrogio Maria Bernardelli, Stefano Gualandi, Hoong Chuin Lau, Simone Milanesi
Research Collection School Of Computing and Information Systems
Binarized Neural Networks (BNNs) are receiving increasing attention due to their lightweight architecture and ability to run on low-power devices, given the fact that they can be implemented using Boolean operations. The state-of-the-art for training classification BNNs restricted to few-shot learning is based on a Mixed Integer Programming (MIP) approach. This paper proposes the BeMi ensemble, a structured architecture of classification-designed BNNs based on training a single BNN for each possible pair of classes and applying a majority voting scheme to predict the final output. The training of a single BNN discriminating between two classes is achieved by a MIP …

Growing Up Under Mao And Deng: On The Ideological Determinants Of Corporate Policies, Hao Liang, Rong Wang, Haikun Zhu
Research Collection Lee Kong Chian School Of Business
Historically, economic activities have been organized around certain ideologies. We investigate the impact of politicians’ ideology on corporate policies by exploring a unique setting of ideological change—China from Mao to Deng around the 1978 economic reform—in a regression discontinuity framework. We find that the age discontinuity of politicians around 18 years old in 1978, who had already joined the Chinese Communist Party (CCP) or joined soon thereafter and later became municipal paramount leaders, has had a lasting effect on contemporary firm- and city-level policies. In particular, firms in cities with mayors that joined the CCP under the ideological regime of …

Measuring The Learning Effectiveness Of Two Courses In A Program In Accounting Data And Analytics, Clarence Goh, Duan Ning, Magdeleine Lew, Gary Pan, Poh Sun Seow
Research Collection School Of Accountancy
Driven by rapid technological innovation, information technology (IT) is expected to significantly alter the way that accountants work. However, both accounting researchers and practitioners have observed a shortage of accounting professionals who currently possess the relevant technology skillsets to exploit technological advances. In response, the School of Accountancy of a Singapore-based university launched a second major program in Accounting Data and Analytics in 2018. In this study, we examine the learning effectiveness of two courses – Business Data Management and Data Modelling & Visualization – offered as part of the program. Overall, our results suggest that the courses are effective …

Glocal Energy-Based Learning For Few-Shot Open-Set Recognition, Haoyu Wang, Guansong Pang, Peng Wang, Lei Zhang, Wei Wei, Yanning Zhang
Research Collection School Of Computing and Information Systems
Few-shot open-set recognition (FSOR) is a challenging task of great practical value. It aims to categorize a sample to one of the pre-defined, closed-set classes illustrated by few examples while being able to reject the sample from unknown classes. In this work, we approach the FSOR task by proposing a novel energy-based hybrid model. The model is composed of two branches, where a classification branch learns a metric to classify a sample to one of closedset classes and the energy branch explicitly estimates the open-set probability. To achieve holistic detection of openset samples, our model leverages both class-wise and pixelwise …

Purpose – This study seeks to apply a dual-processing model to understand how ethical leadership prohibits employee unethical behavior through both employee deontic justice and distributive justice. Design/methodology/approach – A survey research was conducted with 62 supervisors and 244 subordinates of 17 firms collected at 2 time points separated by approximately 3 weeks in People’s Republic of China. Findings – A multilevel modeling analysis was used to test the dual-processing model. The results showed that both employee deontic justice (moral intuition process) and distributive justice (deliberate reasoning process) significantly mediate the negative relationship between ethical leadership and employee unethical behavior. …

Under high pathogen threat, it is adaptive for humans to find mates with high immunocompetence. Supporting this, research shows that pathogen cues increase humans’ preference for physical attractiveness—an indicator of a well-functioning immune system—among their potential mates. Building on this literature, we examined whether exposure to videos depicting pathogens (vs. a control video of nature scenery) triggers the desire to signal one’s physical attractiveness. We tested this prediction in four experiments, including two well-powered preregistered ones. In Experiment 1, we examined how pathogen cues influenced the desire for cosmetic surgery and the amount of time and money participants are willing …

Gnnlens: A Visual Analytics Approach For Prediction Error Diagnosis Of Graph Neural Networks., Zhihua Jin, Yong Wang, Qianwen Wang, Yao Ming, Tengfei Ma, Huamin Qu
Research Collection School Of Computing and Information Systems
Graph Neural Networks (GNNs) aim to extend deep learning techniques to graph data and have achieved significant progress in graph analysis tasks (e.g., node classification) in recent years. However, similar to other deep neural networks like Convolutional Neural Networks (CNNs) and Recurrent Neural Networks (RNNs), GNNs behave like a black box with their details hidden from model developers and users. It is therefore difficult to diagnose possible errors of GNNs. Despite many visual analytics studies being done on CNNs and RNNs, little research has addressed the challenges for GNNs. This paper fills the research gap with an interactive visual analysis …

Regression-Adjusted Estimation Of Quantile Treatment Effects Under Covariate-Adaptive Randomizations, Liang Jiang, Peter C. B. Phillips, Yubo Tao, Yichong Zhang
Research Collection School Of Economics
Datasets from field experiments with covariate-adaptive randomizations (CARs) usually contain extra covariates in addition to the strata indicators. We propose to incorporate these additional covariates via auxiliary regressions in the estimation and inference of unconditional quantile treatment effects (QTEs) under CARs. We establish the consistency and limit distribution of the regression-adjusted QTE estimator and prove that the use of multiplier bootstrap inference is non-conservative under CARs. The auxiliary regression may be estimated parametrically, nonparametrically, or via regularization when the data are high-dimensional. Even when the auxiliary regression is misspecified, the proposed bootstrap inferential procedure still achieves the nominal rejection probability …
Is Democracy Good For Growth? Development At Political Transition Time Matters, Di Sima, Fali Huang
Is Democracy Good For Growth? Development At Political Transition Time Matters, Di Sima, Fali Huang
Research Collection School Of Economics
Is democracy a better political regime for economic prosperity than autocracy? This paper shows that the answer depends on the initial economic development level during the democratic transition when the foundation of institutions was laid. Democracy facilitates growth only in countries that already have adequate development at transition time. These countries are more likely to create and sustain growth-enhancing institutions than others. Without appropriate development, democracy does not improve growth; this applies to about 40% of the third-wave democratized countries. These results are based on a sample of 153 countries in 1960–2010 and robust to various specifications and endogeneity issues.

Freestyle Layout-To-Image Synthesis, Han Xue, Zhiwu Huang, Qianru Sun, Li Song, Wenjun Zhang
Research Collection School Of Computing and Information Systems
Typical layout-to-image synthesis (LIS) models generate images for a close set of semantic classes, e.g., 182 common objects in COCO-Stuff. In this work, we explore the freestyle capability of the model, i.e., how far can it generate unseen semantics (e.g., classes, attributes, and styles) onto a given layout, and call the task Freestyle LIS (FLIS). Thanks to the development of large-scale pre-trained language-image models, a number of discriminative models (e.g., image classification and object detection) trained on limited base classes are empowered with the ability of unseen class prediction. Inspired by this, we opt to leverage large-scale pre-trained text-to-image diffusion …

Strategic Planning For Flexible Agent Availability In Large Taxi Fleets, Rajiv Ranjan Kumar, Pradeep Varakantham, Shih-Fen Cheng
Research Collection School Of Computing and Information Systems
In large scale multi-agent systems like taxi fleets, individual agents (taxi drivers) are self interested (maximizing their own profits) and this can introduce inefficiencies in the system. One such inefficiency is with regards to the "required" availability of taxis at different time periods during the day. Since a taxi driver can work for limited number of hours in a day (e.g., 8-10 hours in a city like Singapore), there is a need to optimize the specific hours, so as to maximize individual as well as social welfare. Technically, this corresponds to solving a large scale multi-stage selfish routing game with …
