Consideration of the religious and moral significance of legal practice is a subject to which too little attention has been paid in American legal education. Louis M. Brown has been one of those few engaged in the teaching of law who has explored the ethical components of lawyering; his example has been a great influence on many of us. It seems appropriate, therefore, in this tribute to Louis M. Brown, to consider the role which Christian values may play in producing lawyers who are well-developed in interpersonal as in professional skills.
This essay will seek to relate Christian values to …

My assessments of the Law School have tended more to describe developments than to state aspirations. I continue to assess things in that vein; my preference for leadership in the Dean's Office is to build on the goals which are implicit in the work of the tireless, dedicated people who teach and learn law at Notre Dame. My hope in approaching our enterprise in this way is to discover myself, and to help my colleagues discover, the power with which they serve God, the University, the community, our embattled profession, and one another. "This power in us," St. Paul said, …

Abortion: The Court Decides A Non-Case, Joseph O'Meara
Journal Articles
It took the Supreme Court 105 years to discover that the Fourteenth Amendment guarantees a personal right of privacy that invalidates state statutes forbidding abortion except to save the mother's life. As Mr. Justice Rehnquist pointed out, in a dissent that no member of the Court attempted to answer, at least thirty-six states had such anti-abortion statutes when the Fourteenth Amendment was adopted. None was attacked on the ground that they offended the newly adopted amendment. The only conclusion possible from this history is that the drafters did not intend to have the Fourteenth Amendment withdraw from the States the …

These are curious times for American legal education, especially curious perhaps at this university law school, because we claim adherence to the traditions of Thomas More. Our profession has for more than two centuries provided rulers for America, as it provided leaders, including More himself, for More's England—presidents and speakers, senators and administrators, benign manipulators in American corridors of power. More than a few of America's lawyer leaders have been educated at Christian, university law schools, and, as I think about Notre Dame law students this summer, I hope we are educating more than a few replacements for the lawyer-leaders …

This is my first report to you as dean of the Notre Dame Law School. It seems to me important to begin it with an assessment of the decade that intervened between 1961, when I graduated from the Law School, and 1971, when Father Hesburgh appointed me to be dean. I assess, of course, a decade of law at Notre Dame during most of which (1963-71) I participated as a member of the faculty. I made this assessment, in approximately these terms, to Father Burtchaell and to our students in March, 1971; to our Advisory Council in April, 1971; and …

Will Interviews, Young Family Clients And The Psychology Of Testation, Thomas L. Shaffer
Will Interviews, Young Family Clients And The Psychology Of Testation, Thomas L. Shaffer
Journal Articles
The psychology of testation—the human content in will interviewing and consequent "estate planning"—is a mixture of attitudes toward death, attitudes toward property, and attitudes toward giving. This article is an attempt to examine this human content in five specific lawyer-client settings. The clients are young married couples with small children; they are people to whom death would seem remote, whose property is skimpy and largely devoted to dependent support, and whose attitudes toward giving are likely to be narrowly focused on members of their immediate families.
