Modernity And The Law: A Late Twentieth Century View, Robert P. Burns
Notre Dame Journal of International & Comparative Law
This Article explores Roberto Unger’s understanding of the specific significance that modernity has for law. It provides an account of the distinctions among customary law, bureaucratic law, the modern liberal rule of law ideal, and the unraveling of the rule of law in postliberal societies. It compares his views with those of other major theorists of modernity and with legal theorists. Finally, it discusses his speculations about then future developments and the relationship between central institutional and philosophical issues.

Legal System Network Effects And Global Legal Development, David C. Donald

Law originates in local environments, yet can be transmitted globally or over time to new contexts and foreign or future users. At its origin, law arises in response to social needs, but once formalized it takes on a semantic life of its own in a network of users. A rule created in response to a random New York plaintiff could—with sufficient popularity—end up as the standard norm applied globally, regardless of its underlying suitability for specific local needs.

This note explores various pro bono technologies available on the legal market as well as looks to how firms will conduct pro bono work in the future and what the drivers of change are within the industry. Addressing barriers to adopting certain technological offerings, as well as how those offerings can and should be evaluated, is important to finding aspects of legal technologies that can aid in solving legal problems. Progressive Genetic Ownership, Jessica L. Roberts
Notre Dame Law Review
Recently, property law scholars have challenged neoclassical economic theory as the primary lens for understanding ownership. As an alternative to the all-too-familiar concepts of welfarism, rational choice theory, and cost-benefit analysis, they offer “progressive property,” a school of thought grounded in value pluralism, communitarianism, and redistribution. To date, much of the progressive property literature has focused exclusively on land use. This Article tests the versatility of this new property school by applying it to a novel context: genetic ownership. As with real property, discussions surrounding genetic ownership have been entrenched in the language of neoclassical economics. Given the proliferation of …
