Time Over Matter: Measuring The Reasonableness Of Officer Conduct In § 1983 Claims, Evelyn Michalos

In the United States, far more police encounters result in civilian and officer deaths than in other democratic countries. When a government actor uses excessive force against an individual during an arrest or investigatory stop in violation of the Fourth Amendment right against unreasonable seizure, 42 U.S.C. § 1983 provides a federal civil remedy for that individual. In Graham v. Connor and Tennessee v. Garner, the U.S. Supreme Court held that courts should assess the reasonableness of an officer’s use of force to seize an individual in light of the “totality of the circumstances,” which includes the severity of …

Novel Perspectives On Due Process Symposium: Uncoupling Habeas Corpus And Due Process, Jonathan G. D’Errico

This exploration concludes by finding that select elements of the Due Process Clause persist even during suspension and thus restrict otherwise forbidden Executive action. Part I overviews the scope of the Great Writ and the effect of its suspension. Part II details two conflicting views of the writ’s relationship with the constitutional demands of due process. Finally, Part III asserts that suspension quiets some facets of the Due Process Clause but does not entirely extinguish the right to procedural due process.

The United States has just witnessed an impeachment debate which may have far-reaching ramifications for our democratic institutions. These hostilities began with an anonymous whistleblower complaint from a government employee, disclosing what he or she believed were illegal activities directed by President Donald J. Trump. Ever since, discussion of whistleblowers has taken on greater salience in the news cycle. Today, there are a number of whistleblower statutes that protect employees who disclose knowledge of their employer’s illicit activities from workplace retaliation. Is There A Right To Tweet At Your President?, Nick Reade

The U.S. Supreme Court has developed the public forum doctrine to protect the First Amendment rights of speakers in places of assembly and expression. The doctrine facilitates free expression by restricting the government’s ability to discriminate against or regulate speech in state- controlled public forums. In 2019, two federal courts of appeals extended the doctrine to protect speakers who express themselves in the interactive spaces that elected politicians control on their personal social media accounts. The City of New York brought a motion seeking a preliminary injunction under Multiple Dwelling Law §306 to prohibit certain individuals and companies from permitting the use or occupancy of specified buildings for less than thirty consecutive days. The defendants, including both individuals and corporations, were accused of advertising and renting accommodations for illegal short-term periods, violating housing laws and creating numerous safety hazards. Despite enforcement efforts, the defendants continued their illegal activities, prompting the city to seek injunctive relief.
